BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz ALSO PRESENT: Christina Battalia,Town Clerk William Maker,Jr.,Town Attorney ABSENT: Stephen V.Altieri,Town Administrator CALL TO ORDER-WORK SESSION On motion of Councilwoman Wittner,seconded by Councilman Odierna,the Work Session was unanimously opened at 5:10PM. On motion of Supervisor Seligson,seconded by Councilwoman Wittner,the Board unanimously agreed to enter into an Executive Session to discuss the appointment to the Town Board and appointments to Boards and Commissions. EXECUTIVE SESSION Appointment to the Town Board Appointments to Boards and Commissions On motion of Councilwoman Wittner,seconded by Supervisor Seligson,the Board unanimously agreed to reenter Work Session. Byron Place Associates The Town Board reviewed an updated memo from Mr.Altieri regarding the Byron Place Associates Madison Avenue Project. Mr.Altieri stated that the construction plans were originally submitted to the Building Department on August 1,2011,and are currently being reviewed by two outside engineering consultants, paid for by the developer. It is anticipated that the developer will receive a building permit in February. With respect to previous discussions regarding the green roof,it now appears that the developer has decided to leave the green roof in place. The developer will construct a green roof that will cover 25%of the flat roof area. The development will include ten affordable rentals as part of the plan and Mr.Altieri will again contact Westchester County to ask that they consider counting the units toward the housing settlement. Murray Avenue and Colonial Avenue Crossing The Board revisited the issue of children crossing Murray Avenue near Colonial Avenue with the assistance of the School Crossing Guard. The Board would like to have a police presence at this crossing to emphasize that this crossing is not sanctioned by the Town.Councilwoman Katz emphasized that if you want effective enforcement you must speak with the PTA. Supervisor Seligson asked Councilwoman Katz to follow up with the School and with the PTA. Mr. Maker 1 January 4,2012 suggested the Town consider moving the current crosswalk to be more in line with the current 'unauthorized'crossing. Mr.Altieri noted that this would need State approval,as Murray Avenue is a State road. Update—Hommocks Ice Rink Proiect Supervisor Seligson noted that she and Mr.Altieri recently met with Jill Fisher,Superintendant of Recreation to review the plans for the first phase of work at the Ice Rink. Supervisor Seligson noted that at$400,000.00,this is a significant project,adding an important component of this phase is the change in the lighting. Amendment to Open Meetings Law Town Clerk,Christina Battalia updated the Board on legislation signed yesterday by Governor Cuomo. The Law stipulates that documents being discussed at a Town Board Meeting be available to the public prior to the meeting. The Law also states that municipalities that have a web site need to make those documents available on the web site. Budget Focus Groups Supervisor Seligson noted that she would like the Town to consider utilizing focus groups as a way to generate resident input with respect to the budget. It was noted that this is currently being utilized by the Mamaroneck School District. Town Yard Accident Sergeant Melrose and Detective Edmonds were present and gave an update on the investigation of the death at the Town Yard of Robert DeVecchio. The Detectives reported that their investigation is complete and that the reports are finalized. The reports show that this was nothing more than a terrible accident.There was no wrongdoing on the part of the driver of the truck. The truck inspection reports no malfunction. The Town still awaits the reports from the County and the Department of Transportation. Update-Westchester County Housing Settlement Supervisor Seligson would like the Town to be more proactive with respect to the Westchester County Housing Settlement. Supervisor Seligson attended a conference at which she had the opportunity to speak with John Nolon. Mr. Nolon is a Professor of Law at Pace University School of Law,and a housing specialist.. Supervisor Seligson noted that Mr. Nolon has offered to come speak with the Board on the subject of the settlement. Boards and Commissions The Board reviewed the expiring terms and vacancies on the various Town Boards and Commissions. The Board will make appointments at the January 18`"meeting. There are a number of vacancies that the Board members are actively seeking candidates for. Mr. Maker will look into the laws regarding changing the number of planning board members. Mr. Maker will also draft legislation to abolish the Historic Records Committee, as requested by the Town Board. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. 2 January 4,2012 Supervisor Seligson welcomed everyone, noting the many officials in attendance. Fire Chief Brendan Collins was asked to lead the Pledge of Allegiance. SWEARING IN CEREMONY Town Justice, Dolores Battalia,swore in the following Elected Officials Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilwoman Abby Katz Town Justice Jean Marie Brescia Town Clerk Christina Battalia Town Clerk,Christina Battalia,swore in the Deputy Town Clerks' Deputy Town Clerk,Cindy Atiencia Deputy Town Clerk, Linda Silvestre Supervisor Seligson addressed the residents of the Town of Mamaroneck: SUPERVISOR'S ADDRESS Welcome to the first meeting of the Mamaroneck Town Council of 2012. I'm Nancy Seligson and I'm the new Supervisor of the Town.After being on the Town Council for 12 years, I'm delighted and excited to be the Supervisor. We run a very good government in the Town and 1 plan to continue that. We have great staff under the excellent leadership of Town Administrator,Steve Altieri. I look forward to continuing to work with our emergency services and want to thank the police,fire and ambulance departments for their dedication and commitment. We have wonderful chiefs in the fire and police departments, and wonderful department heads of the ambulance district, highway,sanitation, assessor, building,finance, court, recreation, tax and town clerk's office. The Town provides all of these essential services to the residents of the Unincorporated Town, and many of these services to the Village of Larchmont and half of the Village of Mamaroneck. Our communities share many things and we will continue to look at ways we can streamline, and consolidate services to improve government. l look forward to working with the Villages of Larchmont and Mamaroneck. As 1 said, I've been on the Town Council for 12 years serving as a Councilwoman. We have the dedicated Phyllis Wittner and Ernie Odierna returning as Council people, and one new member,Abby Katz, who was elected in November. We have an empty seat on the Town Council for the remaining two years of my term. Tonight we will appoint a new Councilperson to that seat. 1 would like to improve our government communications to better inform you, our residents, of what is happening in your local government. We have a great website that gives lots of information about the Town services and upcoming events. Please sign up to be on our email blast list. You can sign up for specific notifications and agendas. 1 plan to start every board meeting with a short update on what has been happening in the Town to give you a flavor of what we're working on. 1 would like to produce the Town newsletter more frequently, maybe monthly, to keep everyone informed and up to date. l hope to do this through the website. There area few big items on this year's agenda that 1 would like to mention. The first is Re- Val, or reassessment. The Town embarked on re-val last year to ensure property owners are 3 January 4,2012 ONLY paying their fair share of the tax burden, no more or no less. Reassessment does not raise more tax dollars;a reassessment re-distributes how the budgets/levies are collected. We want residents to understand our intention is to work closely with the community throughout this project. We recognize reassessment is a complicated and emotional issue, and while not the most popular, reassessment does create a more equitable assessment roll. Our contractor for the reassessment project is GAR Associates. Over the past month, GAR Associates, held six educational workshops for residents. The attendance was good and we want to thank the property owners that participated in this first series. The workshops will air on Channel 76, everyday to this Friday January 6 at 3 AM, 9 AM, 3 PM, and 9 PM. It is very important to have the cooperation from the property owners in providing inventory information. This includes access to both the property's interior and exterior. Gathering as much information as reasonably possible assists in creating the most accurate valuation. In the event the Contractor does not have the property owners'cooperation, this does not mean a reasonable full market value estimate cannot be produced. We understand and respect property owner's rights to refuse access to their property. However, a full market estimate will be made of every parcel in the Town regardless of access. You might be concerned about renovations in your home. The Town has adopted an Amnesty Program for property owners in the unincorporated area who performed renovation without obtaining proper permits. The Town asks property owners to file for a permit, but the Town will not charge a permit fee or violation charges through February 1, 2013. Keep in mind the data collectors/appraisers are not building inspectors or code enforcement officers. They will simply record what they see. It is never our intention to "penalize"a property owner for maintaining their home. Please remember that property information maintained in the assessor's office has always bee public information. Many communities across New York State and the United States have on- line access to public information. Typically the condition of a house or special circumstances such as a basement that floods is not available on-line. In the event GAR appraisers do not have access to the interior of a property they will make some assumptions along with the use of existing information from the assessor's records, the building department and other sources such as aerial imagery. If anyone has any questions regarding the Reassessment Project in the Town of Mamaroneck, please do not hesitate to contact us. We are here to help and see to it that the process produces the fair and equitable assessments residents of the Town expect. You will receive a letter from the Town Board explaining much of what I've said and more. Please feel free to contact us if you have concerns. The second item is taxes. We know everyone would like their taxes to decrease. 1 would like my taxes to decrease. Please remember, that although The Town collects all of your taxes, we keep only 20% to run the Town. The rest goes to the schools and county. In our enormous effort to decrease taxes, and live within the state-imposed 2% tax levy cap, we would like to hear from you as to which services you would consider changing to reduce some of the 20% that we keep. We hope to run focus groups with residents this winter to discuss this. Another big item on the horizon is the Westchester County Fair Housing Settlement. The Town of Mamaroneck is one of the 31 Federally targeted municipalities required to build fair and affordable housing. 1 feel strongly that we should have diverse housing to strengthen our ability to keep seniors, and young people here and to create a vibrant diverse community. But it's not that easy to build new housing in an already developed community. We don't have large tracts of buildable land. We do have the opportunity to rebuild or renovate existing housing to accommodate changes, and because we are a very developed community, adding additional housing in certain places won't change the character of what is already there. 1 hope to work with the County and all of you to determine possible locations for fair and affordable housing. 4 January 4,2012 One of my primary goals is to reduce our energy use and carbon footprint in the Town, not just to benefit the environment, but also to save money. 1 believe that if we invest now to reduce our current and future energy use, we will help position the Town for continued financial stability and flexibility. We will embark on renovating the Hammocks Ice Rink this year. The ice rink is the largest energy user in the Town. By upgrading the lighting, dehumidification system and mechanics we can save energy. We continue to change our streetlights over to LED lights. They're expensive but last much longer and use much less energy. I'm very proud that we have 2 garbage trucks running on used vegetable oil. They run much cleaner than a full-diesel truck with less particulate matter, and the vegetable oil is free. We get it from local merchants. That saves lots of money buying diesel fuel. Supervisor Seligson stated that as previously noted there is a vacancy on the Town Board.Supervisor Seligson introduced the motion to appoint Jaine Elkind Eney to fill the vacancy on the Town Board. Supervisor Seligson reported that Jaine has been a wonderful Trustee in the Village of Larchmont, and has served the Town as Chair of the Board of Assessment Review for 17 years. Jaine has been a resident of our collective community for a very long time. Jaine raised her two children here, is a Wellesley graduate and a local attorney. Jaine has proven to be a wonderful civic minded contributor to our community.Supervisor Seligson said Jaine will be an excellent addition to the Town Board. On motion of Supervisor Seligson,seconded by Councilman Odierna,the following was approved, WHEREAS,with the election of Nancy Seligson as Supervisor to the Town of Mamaroneck effective January 1,2012,there exists a vacancy on the Mamaroneck Town Board. NOW THERFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby appoint Jaine Elkind Eney to fill the unexpired term of Nancy Seligson as Councilmember for the Town of Mamaroneck, and BE IT, FURTHER RESOLVED,that the foregoing appointment shall be effective immediately and shall expire on December 31,2012. ORGANIZATIONAL AGENDA SUPERVISOR'S APPOINTMENTS BE IT RESOLVED,that the Supervisor does hereby appoint Phyllis Wittner,as Deputy Town Supervisor,effective January 1,2012 and terminating December 31,2013, 5 January 4,2012 and BE IT RESOLVED,that the Supervisor does hereby appoint Stephen V.Altieri,the Town Administrator,as Budget Officer,effective January 1,2012 and terminating December 31,2013. TOWN BOARD APPOINTMENTS&RESOLUTIONS TOWN COMPTROLLER On motion of Councilwoman Wittner,seconded by Councilwoman Abby Katz it was unanimously RESOLVED,that Anthony Siligato is hereby reappointed Comptroller of the Town of Mamaroneck,for a term of two years commencing January 1,2012,terminating on December 31,2013. RECEIVER OF TAXES On motion of Councilman Odierna,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that Anthony Siligato is hereby reappointed Receiver of Taxes of the Town of Mamaroneck,for a term of two years commencing January 1,2012,terminating on December 31, 2013. MARRIAGE OFFICERS On motion of Councilwoman Wittner,seconded by Councilwoman Abby Katz,it was unanimously RESOLVED,that the Town Board of the Town of Mamaroneck does hereby appoint Christina Battalia,and Nancy Seligson as Marriage Officers,effective January 1,2012 and expiring with their terms of office. REGISTRAR OF VITAL STATISTICS On motion of Councilwoman Abby Katz,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that the Town Board of the Town of Mamaroneck does hereby appoint Town Clerk Christina Battalia,as Registrar of Vital Statistics,effective January 1,2012 and expiring with her term of office. DEPUTY TOWN CLERK'S On motion of Councilwoman Wittner,seconded by Councilman Odierna,it was RESOLVED,that pursuant to the Town Clerk's recommendation,the Town Board does hereby 6 January 4,2012 reappoint Cindy Atiencia as Deputy Town Clerk, effective January 1,2012 through December 31, 2015; and BE IT FURTHER RESOLVED, pursuant to the Town Clerk's recommendation,the Town Board does hereby reappoint Linda Silvestre as Deputy Town Clerk, effective January 1,2012 thru December 31, 2015. On February 4`"the Department will hold their Installation Dinner and on March 4`"they will hold their annual Fire on Ice Fundraiser. Career Firefighter William Primiroso is retiring after 37 years with the Town. Unfortunately,with another firefighter out sick the Department is down two firefighters. Commissioner Wittner noted the serious fire on Weaver Street,adding there were no injuries or deaths and the caretakers at the home have been relocated to alternative housing. 10 January 4,2012 Commissioner Odierna was also sorry to hear of the passing of Bernie Bellush,adding he was a wonderful guy. Supervisor Seligson thanked the Fire Department for handling the Weaver Street fire so professionally. There being no further business to come before the Commission,on motion of Commissioner Odierna,seconded by Commissioner Wittner,the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Report of Bids—TA-11-08 Retaining Wall Repairs at Valley Stream Road East The Report of Bid is entered into the record as: Attachment A On motion of Councilman Odierna,seconded by Councilwoman Wittner,the following was approved, WHEREAS,on November 10,2011 the Town publicly opened and read four bids for Contract TA-11-08 Retaining Wall Repairs at Valley Stream Road East,and WHEREAS,a defect was discovered with the lowest bid submitted and the Town was unable to find any financial rating of the surety company named in the bid. NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby award Contract TA-11-08 to the second lowest responsible bidder, Landi Contracting of Hawthorne, NY,at a total price of$25,255.00,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said Contract on behalf of the Town. Authorization—KVS Payroll Software On motion of Councilwoman Wittner,seconded by Councilman Odierna,the following was approved, WHEREAS,as part of the 2012 Budget and the 2012 Capital Plan,the Town approved moving the payroll preparation to an in-house system rather than using an outside service. 11 January 4,2012 NOW THERFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby accept the proposal from KVS Information Systems to install payroll software into the Town's existing KVS Financial Management System at a cost for the software of$36,844.00 and an annual support service fee of$2,949.00,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Announcement—Martin Luther King,Jr.Tribute The annual Dr. Martin Luther King,Jr.event will be held on January 111h at the Hommocks Auditorium beginning at 7:30pm. John Gitlitz,the former Chair of the Hispanic Resource Center,will be the honoree and Pastor James Forbes of Riverside Church will be the Keynote Speaker. A special tribute will also take place for the founders of the Larchmont Gazette for their service to the community. 4. Salary Authorization—Recreation On motion of Councilwoman Wittner,seconded by Councilman Odierna,it was RESOLVED,that as provided for in the 2011 and 2012 Town Budget the Mamaroneck Town Board does hereby authorize the payment of salary to the following: HOMMOCKS PARK ICE RINK-Retroactive 12/18/11 through 6/30/12 Taylor Creazzo Skate Guard $10/hr John Cotter Heffernan Skate Guard $11/hr HOMMOCKS POOL—Recroactive 12/27/11—continuous Rachael Chess Lifeguard $11.25/hr Caroline Spader Lifeguard $11.75/hr Swim Instructor $19/hr Elizabeth Eney Lifeguard $10.50/hr Swim Instructor $14/hr The above resolution was put to a roll call vote: Katz Aye Odierna Aye Wittner Aye Seligson Aye 12 January 4,2012 ORAL COMMUNICATIONS George Roniger of the Larchmont Gardens'Civic Association congratulated all the newly elected officials,adding the Town is in good hands. Mr. Roniger shared a special congratulation to Abby Katz and thanked her for her many years with the Larchmont Gardens'Civic Association. REPORT OF COUNCIL Councilman Odierna noted that due to the holiday season at which time many of the Town's Boards and Commissions do not meet, he attended very few meetings. Councilman Odierna is looking forward to future conversations with the Board and with residents'about making our government more open and responsive. Councilwoman Wittner attended Fire Council recently, noting that over the last few weeks it has been very quiet. Councilwoman Wittner welcomed Abby Katz to the Town Board. SUPERVISOR'S REPORT Supervisor Seligson noted that as Town Supervisor she is also a Trustee for the Westchester Joint Water Works and a Trustee for the Joint Sanitation Commission,adding she has already attended those meetings and will report further on those at a later date. Supervisor Seligson noted the recent construction of the buildings for the Sanitation operation,adding it was well deserved and a long time coming. The Town recently celebrated a soft opening of the buildings which Supervisor Seligson said look fantastic. Supervisor Seligson thanked Bill Maker for his continued guidance,adding how much she and the Board appreciate his counsel. ADJOURNMENT The meeting was closed in memory Diane Altieri Levitz,Steve Altieri's sister; sympathy goes out to her husband,children and family.
