HomeMy WebLinkAbout2011_09_21 Town Board Minutes September 21,2001 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON SEPTEMBER 21,2011, BEGINNING AT 5:30PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN,740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M.O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Supervisor O'Keeffe,seconded by Councilwoman Wittner,the Work Session was unanimously opened at 5:30PM. Paige Rentz,of the Sound and Town was present. 2012 Budget The Board reviewed a memo prepared by Mr.Altieri titled 'Property Tax Cap Formula for Determining Tax Levy'. Mr.Altieri's memo demonstrates the tax cap calculated using actual Town figures. Keeping within the Tax Cap the Town would be able to increase the tax levy by a total of$670,599 or 3.23 percent. Mr. Altieri explained that it is too early to determine whether a budget can be presented that is within the cap while maintaining current levels of services. Therefore, Mr.Altieri would like to present a Tentative Budget that"will be tight but realistic that continues all services". Mr.Altieri also stated that the tax cap override cannot be on a fund to fund basis as previously discussed. ADDED ITEMS Budget Calendar Dates Councilman Odierna asked the Board to consider changing the October 26`" Budget Session. School Taxes Mr.Altieri explained that he was notified this morning by the Mamaroneck School District that a School Board vote took place last evening authorizing a 30 day extension for payment of the School Taxes which are currently due by the 301"of September. The School Board is extending this gesture to help homeowners who have been impacted by Hurricane Irene. Mr.Altieri informed the School Board that pursuant to Real Property Tax Law 925A,an extension can only be authorized for all residents and cannot be targeted to a certain population. The School Board stated it would hold an emergency meeting this evening to rescind the vote. TAKEN OUT OF ORDER Update to Sanitation Buildings Mr.Altieri passed photos of the building construction to date. 1 September 21,2001 Town Cemeteries Town Historian, Donald March performed a walk-thru of all the Town cemeteries in the wake of Hurricane Irene to access any damage.The Town Board reviewed the report from Mr. March. Mr.Altieri will request the Highway Department go into the cemeteries and confirm the findings and recommendations of Mr. March. Update—Martin Luther King,Jr. Event Supervisor O'Keeffe informed the Town Board of the status of this event. The Committee,with substantial help from the Local Summit,is planning the event for January. Dr Shaps,Superintendant for Mamaroneck Schools, has authorized the use of the Hommocks Auditorium,adding this should be a great venue. Update—Gardens' Lake The Town Board reviewed a memo prepared by Mr.Altieri outlining the status of the project. Specifically, the greatest issues involve the establishment of the new stand of grass and plantings during the summer months. There were also a number of planting plugs and trees along the planting benches that needed replacement. Due to these problems,the fencing remains in place to keep wildlife out. It is anticipated that a re-opening could take place in mid October. Proposed Walgreens Pharmacy Mr.Altieri stated that there have been meetings with representatives from Walgreens regarding their proposed store opening at the old Blockbuster Video Store on Boston Post Road. Based upon their conceptual plan it would appear that it fits within the existing land use code and would not require formal review by the Planning or Zoning Boards.The Board of Architectural Review would be required for signage. The greatest concern for the Town would appear to be traffic.The Town is awaiting a traffic study that Walgreens has agreed to prepare. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20 PM, she then pointed out the location of exits. Supervisor O'Keeffe noted the agenda items discussed during Work Session, reiterating to the audience that the Work Session is open to the public. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe,then on motion of Commissioner Wittner, seconded by Commissioner Seligson,the Board of Fire Commissioners was unanimously declared open. AFFAIRS OF THE TOWN 1. Authorization—Amend Capital Project#2011-15 Property Revaluation On motion of Councilman Odierna,seconded by Councilwoman Wittner,the following was approved WHEREAS,on September 7,2011 the Town Board awarded the contract for the Property Revaluation Project to Garr Associates and authorized the borrowing of not 3 September 21,2001 more than $1.3 million dollars,and WHEREAS,with the borrowing now authorized,the Town Board must amend the Capital Project to reflect the$1.3 million dollars of borrowed funds. NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby amend the Capital Project Fund (Fund H), Expense Account H.1355.0400.2011.15-Town Wide Property Revaluation to$1,300,000.00 and Revenue Account H.0000.5730.2100.15-Bond Anticipation Notes to$1,300,000.00. Authorization—Westchester County Stipulation Electronic Filing On motion of Councilman Odierna,seconded by Councilwoman Seligson,the following was approved, WHEREAS,the New York State Court System has established a program to permit the electronic filing of various documents,and WHEREAS,the Westchester County Clerk's Office is asking several municipalities to enter into a Pilot Program. NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby approve of entering into a Pilot Program with the County of Westchester for the electronic filing of the Small Claims Assessment Review(SCAR) proceedings,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town,subject to review of the form of the stipulation by the Town Attorney. Authorization—Revised School Tax Warrant TOWN OF MAMARONECK SCHOOL TAX WARRANT FOR THE YEAR 2011 STATE OF NEW YORK ) COUNTY OF WESTCHESTER ) TO: Receiver of Taxes of the Town of Mamaroneck in said County YOU ARE HEREBY COMMANDED, to receive and collect from several persons named in the assessment roll of the Union Free School District in the Town of Mamaroneck, hereunto annexed and herewith delivered to you, the sum of the School Taxes of said School District set opposite their respective names in accordance with provision of Chapter 852 of the Laws of 1948 (Title 16) and the acts amendatory thereof and supplemental thereto including the amendment made by Chapter 386 of the Laws of 1962 and the resolution adopted by the Town Board of the Town of Mamaroneck on September 21,2011. Authorization—Disposition of Computer Equipment On motion of Councilman Odierna,seconded by Councilwoman Wittner,the following was approved, WHEREAS, Hurricane Irene had a devastating effect upon the Catskill and upstate regions of New York and extending to Municipal Offices throughout the State,and WHEREAS,the Town Clerk's Association of Westchester has led an effort to assist local governments impacted by the storm,and WHEREAS,the Town of Mamaroneck has computers no longer needed that would normally be declared surplus and recycled through the Westchester County E-Waste Program. NOW THERFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby approve the disposition of surplus computer equipment to be donated to Municipalities in New York State. Mr. Roniger announced this year's Rag-a-Muffin Parade would take place on October 22 at 4:OOPM, adding pets are invited! Mr. Roniger was happy to report that Brookside Drive escaped flooding during the Hurricane and this last storm; most probably due to the lowering of the Reservoir. Mr. Roniger noted that the Larchmont Gardens'Civic Association would be happy to host an information session for the revaluation project. 8 September 21,2001 Councilman Odierna asked Mr.Altieri to give Mr. Roniger a status report on the Gardens' Lake. Mr.Altieri stated that previously this evening a report was given to the Town Board on the status of the Gardens' Lake Project. Mr.Altieri stated that the issues at the lake are partly due to contractor errors and partly due to this summer's very hot weather.Over the last few weeks,the contractor has been at the Lake reseeding and taking care of the marsh plantings and trees. Mr.Altieri emphasized that this is all at the contractor's expense. The Town anticipates re-opening in mid October. Mr. Roniger offered the Larchmont Gardens'Civic Association as host to a re-opening party. REPORT OF COUNCIL Councilman Fishman attended the Zoning Board of Appeals Meeting. Councilman Fishman noted that many of the Boards are seeing a lot more activity,adding this is a very encouraging sign. Councilwoman Seligson attended meetings for the Traffic Committee,the Library Board and multiple meetings for the 3501"Anniversary. Councilwoman Seligson noted the September 111"Ceremony,adding it was a very meaningful event for our community.The re-opening of the Senior Center BBQ was fabulous, adding the VFW looks great! Councilwoman Wittner added to Councilwoman Seligson's list of events to include the opening of the Mamaroneck Library.This was a terrific event,adding she can't wait to visit and view the archives.The Sheldrake Environmental Center held its Annual Meeting which Councilwoman Wittner noted was excellent. Their Annual Report was distributed and is quite impressive. The speaker at the Annual Meeting was Judy Martin. She spoke about'greening'your home in a practical and cost effective way.The Center is currently showing a series of bird photos which she encourages residents to go see,adding they are magnificent. Councilman Odierna was in Cape Cod last week, noting how great the weather was.Councilman Odierna attended the Board of Architectural Review(BAR)at which they discussed signage for the new Diner, BLD. The gentleman presenting to the BAR on behalf of the Diner was not familiar with the Town Code and therefore no resolution was made. WRITTEN COMMUNICATIONS The Town Clerk received the following from Councilwoman Wittner and it was requested they be put in the Minutes: My special thanks to Matt Sullivan for producing our historical video. While Matt works for LMC-TV, he volunteered his expertise and a great deal of time and effort to the filming of the historical video. He met with me on numerous occasions and with Lynn Crowley, Larchmont Historical Society historian who provided historic photos, attended numerous planning meetings, and filmed around Town. A special thank you to Elizabeth Paul for making the more recent times slides possible by providing the photos and then putting them on a DVD. Thanks to Alaiyo Bradshaw for making the titles. A few words about Alaiyo-1 met her at the wake forJimmy Johnson and learned that she is the wife of Jay Johnson, otherwise known as James G.Johnson, 111. There was a beautiful showing of some Johnson photos with explanatory titles on a movie screen so that everyone could enjoy them. When Ruth Lowy introduced me to Alaiyo, l admired the photos and said that 1 was looking for someone who could execute titles for slides for our 350`h Anniversary. Alaiyo immediately offered to do the job and that was the beginning of our friendship. She also told me that she is an artist and would love to do a painting for the 350`h1 1 hope you've all seen the Then and Now watercolor. Alaiyo spent hours looking around the 9 September 21,2001 Town of Mamaroneck before deciding on presenting the Town Center, the first Mamaroneck High School and today's seat of Town government. She has been absolutely fantastic in her efforts for the Town even bringing the framed watercolor by train from her studio in Brooklyn. By next week we will have a framed watercolor at the Town Center for all to see. My thanks to our resident Steve Mitsch for always being a most dependable friend. Steve was given the job of illustrating the purchase price of Mamaroneck and that of zoning code items. His sketches are wonderful and an important part of the historical video. Credit for the text must also be given to Paula Lippsett Halperin and Judith Spikes for their written histories of the Town and Village of Larchmont. To all, many, many thanks ADJOURNMENT Supervisor O'Keeffe noted the passing of Larry Santangelo. Mr.Santangelo was the husband of Josie Santangelo who formerly was an employee of the Town's Senior Center. Supervisor O'Keeffe also noted the passing of Dominick Suppa, husband of Rose Suppa our former Murray Avenue Crossing Guard.Our sympathy goes out to the families of these two individuals.
