BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M.O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Supervisor O'Keeffe,seconded by Councilwoman Seligson,the Work Session was unanimously opened at S:OOPM. Westchester Joint Water Works The Town Board reviewed the Westchester Joint Water Works: Financial Meeting Agenda—May 17,2011 2011 Proposed Distribution of 2010 WJWW Net Income Mr.Altieri stated that he and other officials attended a recent meeting with the Westchester Joint Water Works. Westchester Joint Water Works' proposed water rate increase was estimated in July of 2011 at 14.1%, but has since been reduced to 7.7%. It was noted that the rate increase for New York City is still unknown and could affect the final rate. Mr.Altieri noted that he informed the Westchester Joint Water Works of the Towns' reluctance for a retroactive rate increase. Councilwoman Seligson noted that apparently in this report,there is so much that is subject to change, and therefore this report should be considered as an 'for your information'. It was also noted that the Town of Harrison has asked for a waiver on their current payments.The Member Municipalities have approved that waiver. The Board discussed and noted that the Springdale Pump Station needs to be moved along,adding an easement needs to be given by the Town to the Westchester Joint Water Works. Supervisor O'Keeffe asked Mr.Altieri to work closely on this with Mr. Conneta. Town Fee Schedule The Board reviewed an updated fee schedule prepared by the Town Clerk. It contains all fees previously approved by the Board. Ms. Battalia and Mr.Altieri with the help of Mr. Maker are reviewing the format and making appropriate changes. This will be on the agenda for the June 15th Town Board Meeting. Urban County Consortium Mr. Maker noted his review of the Urban County Consortium Agreement. The Board reviewed the letter from Norma Drummond which stated that the Town would automatically be renewed into the Consortium unless the Town was to formally opt out. 1 JUNE 1, 2011 Pryer Manor Right-of-Way Mr. Maker reported to the Town Board on his review of the maps and easements which relates to the Pryer Manor Right-of-Way.As follows: 1. In 1966 there is an Agreement between the Town and the County of Westchester for the area known as the access road to the County Pump Station. 2.This Agreement stipulates that the Town cannot'turn over' maintenance to residents. 3.An easement exists for access to Mr.Timothy Doherty's home from Dillon Road thru an area that is currently grassed over. 4.A second easement exists from Mr.Sidney Doherty,Sr.,to his son, Brian. 5.The 'right of way' referred to in the easement with Mr. Kish and the Gilliam and DiBicari properties refers to the Premium River Road extension as a private road owned by Mr. Kish. Additionally,the properties shown on the map designating the street, have right of ways that have been designated on said map. The Board stated that due to this information,the discussion is now closed. 2010 Financial Statements/Independent Auditor's Report Dominick Consolo and Alan Kassay of O'Connor Davies Munns&Dobbins, LLP Accountants and Consultants presented the Financial Statements to the Town Board. The Town Board reviewed the Financial Statements and Supplemental Information for year end December 31,2010,and the Independent Auditor's Report and the Independent Auditor's Report on Communication of Internal Control Matters Identified in the Audit. Board of Assessment Review Mr. Maker and Ms. Battalia discussed with the Town Board the issue that is arising from the Town's new Law adding additional members to the Board of Assessment Review.The State does not recognize terms longer than five years. Although the Town has superseded State Law with regard to the appointment of Alternates,in this instance it appears easier to change the appointed terms so as they would expire within five years.Therefore,the Public Hearing for this evening will be adjourned until June 15. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:25 PM,she then pointed out the location of exits. Supervisor O'Keeffe noted the agenda items discussed during Work Session, reiterating to the audience that the Work Session is open to the public. TAKEN OUT OF ORDER PUBLIC HEARING — Installation of Stop Signs on Forest Ave 2 JUNE 1, 2011 The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE,that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday,June 1,2011 at 8:00 PM or as soon thereafter as is possible in Conference Room C of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider installing two stop signs on Forest Avenue. Purpose: It is the recommendation of the Traffic Committee that two stop signs be installed on Forest Avenue. One is in the northbound direction at Forest Place, and one is in the southbound direction at the bend in the road nearest Rockland Avenue. The Traffic Committee has heard from residents that Forest Avenue has become a popular short cut and high speeds have been observed frequently by the Police. The full text of this Amendment may be examined and copies obtained at the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. Boston Post Road Mamaroneck, New York PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: May 25,2011 On motion of Councilman Fishman,seconded by Councilwoman Seligson,the Public Hearing was unanimously opened. Supervisor O'Keeffe asked if anyone wished to comment on the proposed Local Law. Mr.Tricarico,771 Forest Ave addressed the Board. His home is at the 90 degree bend in Forest Ave. He stated his wife and dog were each hit by cars. Mr.Tricarico gave photos demonstrating vehicles crossing the double yellow line while making the turn. Mr.Tricarico believes more than just two stop signs should be installed. Councilman Fishman stated that stop signs are not intended to be used for slowing traffic. Councilman Fishman added that the installation of stop signs causes additional issues like noise pollution,environmental issues,as well as sign pollution. Pier Witek, 716 Forest Ave,addressed the Board.She stated that she was the resident who initiated the speed restriction on Forest Avenue. The reason she kept coming back to the Traffic Committee with regards to Forest Ave,adding it is a major thoroughfare with no sidewalks. Additionally,it displays as a route to 195 when programmed into a GIS system. Councilman Fishman asked the Traffic Committee why they are using a stop sign in this instance when they have advocated against it being used as a speed reducing device. Doris Block,Chair of the Traffic Committee, responded. Ms. Block stated that previously the Traffic Committee has recommended not using stop signs this way,with a few exceptions,one being Rockland Avenue,West Garden. Ms. Block stated that this is an unusual street,one being the 90 degree bend and the fact that there are no sidewalks where many children walk to school and its proximity to the school. 3 JUNE 1, 2011 Supervisor O'Keeffe stated that during her tenure of 16 years with the Town there have been repeated complaints on this street. Harry Silton,731 Forest Ave addressed the Board. Mr.Silton said although he is not opposed to a solution he highly objects to the stop sign being placed in front of his home. A significant appeal to purchasing his home last December was the quaint and quite street that it is,adding he agrees with Mr. Fishman's statement with regard to the negative effects it will cause. Mr. Silton did note that there is currently a sign alerting drivers of limited sight visibility. Finally, Mr.Silton stated that with the installation of the stop sign he will have limited parking in front of his home,which would,in his opinion lower his property value. Councilman Odierna asked Ms. Block to comment on whether the Police had found excessive speeding on the road. Ms. Block replied that the Police did not find excessive speeding. Rachael Goldman,43 Edgewood Avenue,addressed the Board. Ms.Goldman stated that stop signs are used to force drivers to stop and look,this would apply to the stop sign at the bend,adding she does not see the need for the second stop sign. Councilman Odierna stated he does not see a reason for two stop signs on this street,adding he could be convinced of one. Pier Witiek stated she disagreed. Ms.Witek thinks that the fact that this is a blind hill upward with little visual,a stop sign is warranted to alert drivers. Councilwoman Seligson stated that as a liaison to the Traffic Committee,she has sat in on many of these discussions. Councilwoman Seligson is empathetic to residents who could have this sign in front of their homes. Supervisor O'Keeffe asked Mr. Maker if it would be acceptable given the previous notice of two stop signs to pass this Law approving only one. Mr. Maker stated yes,this Law can be adopted with amendments. On motion of Councilwoman Wittner,seconded by Councilman Fishman,the Public Hearing was unanimously closed. On motion of Councilwoman Wittner,seconded by Councilman Odierna,it was unanimously RESOLVED,that the Mamaroneck Town Board finds that the adoption of the proposed Local Law"Stop Sign on Forest Avenue"is hereby declared to be a Type II Action,with no impact under the New York State Environmental Quality Review Act(SEQRA)and requiring no further action. On motion of Councilwoman Wittner,seconded by Councilman Odierna,the following Local Law was approved: Local Law Local Law No. 6-2011 This local law shall be known as the"Stop Sign on Forest Avenue" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1—Purpose: Forest Avenue has become a popular shortcut between Weaver Street and Rockland Avenue. The Police Department has observed the number of vehicles and the speed of traffic traveling on Forest Avenue on several occasions. The increased traffic, coupled with an almost 90 degree bend on Forest Avenue, calls out for greater 4 JUNE 1, 2011 control over traffic. To assure safety, the Town Board finds it appropriate to install a stop sign in one location on Forest Avenue. This local law does just that. Section 2—Regulation of Traffic on Forest Avenue: Vehicles traveling south on Forest Avenue shall be required to come to a full stop on Forest Avenue at the point south of Rockland Avenue where Forest Avenue changes direction by approximately 90 degrees. Section 3—Sign(s)to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of Forest Avenue indicating where a full stop is required by this law. Section 4—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5—Effective Date: This Local Law shall become effective upon filing with the Secretary of State. The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye PUBLIC HEARING — Parking Restriction—Edgewood Avenue The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE,that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday,June 1,2011 at 8:00 PM or as soon thereafter as is possible in Conference Room C of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider a No Parking Zone on the west side of Edgewood Avenue from the Fire House Driveway to Judson Street from 9:OOam to 10:OOam Monday—Friday. Purpose: It is the recommendation of the Traffic Committee that due to excessive commuter parking on Edgewood Avenue parking should be restricted on the west side of Edgewood Avenue from the Fire House Driveway near Weaver Street to Judson Street from 9:OOam to 10:OOam Monday—Friday. The full text of this Amendment may be examined and copies obtained at the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. Mr. Maker explained the Local Law. Councilman Fishman stated this is a similar restriction as the one on Edgewood Avenue from Murray Avenue to Judson Street. Supervisor O'Keeffe asked if anyone wished to comment on the proposed Local Law. Curbie Cohen,34 Edgewood Avenue,addressed the Board. Ms.Cohen initiated the discussion with the Traffic Committee regarding the restricted parking. Ms.Cohen stated there is a problem with commuter parkers along Edgewood Avenue,adding the current laws passed on other streets has forced commuter parkers onto this section of Edgewood Avenue. Rachael Goldman,43 Edgewood Avenue,addressed the Board and stated she was in favor of the restriction. Joseph McElhinney,7 Judson Street,addressed the Board and stated he was in favor of the restriction. Amy Nathan,5 Edgewood Avenue,addressed the Board. Ms. Nathan is opposed to the restriction because she feels it will just push parkers to her end of the street where the restriction will not apply. Ms. Nathan is concerned that the volunteers will have no where to park except directly in front of her home which, effectively guaranteeing there will always be a vehicle parked in front of her home. Ms. Nathan is also concerned that service vehicles will be unable to park anywhere near her home. Supervisor O'Keeffe read letters received by the Town Clerk as follows: Barbara Gessler,27 Edgewood Avenue opposes the restriction of parking. Amy and Carl Nathan,5 Edgewood Avenue,opposes the parking restriction. Paul Schwendener,27 Edgewood Ave,opposes the parking restriction. Mr. Heslin,39 Edgewood Avenue,addressed the Board. Mr. Heslin objects to the parking restriction. Mr. Heslin stated he has lived on the street for many years and although he sympathizes with his neighbors' frustration he does not want to see this picturesque little street littered with signs. Darren Cohen,34 Edgewood Avenue,addressed the Board. He agrees with Ms. Nathan that this would just push the problem down the street. Mr. Cohen thinks the issue could be corrected by extending the no parking restriction to the full length of Edgewood Avenue. Mr.Altieri stated that this exemption was due to the Fire Department's personnel needing a place to park. Supervisor O'Keeffe asked if this situation seems to be a hardship worth the detriment the solution may cause? Councilman Fishman asked Ms. Block,Chair of the Traffic Committee,if what she's heard this evening effects the Committee's recommendation? Ms. Block stated that by nature of the process the Committee usually only hears from those in favor of restrictions. Ms. Block also noted that this street is difficult to add restrictions because there is already no parking on one side of the street. 6 JUNE 1, 2011 The Board thanked everyone involved for their time and energy but at this juncture the Town Board will not make a motion to adopt this Local Law. TAKEN OUT OF ORDER PRESENTATION Alan Kassay,of O'Connor Davies Munns&Dobbins, LLP Accountants and Consultants gave a presentation of the Financial Statements and Auditor's Report for the year ending December 31,2010. Supervisor O'Keeffe noted to the audience that the Town Board had reviewed this extensively in their work session. Supervisor O'Keeffe thanked Mr. Kassay for his presentation. PUBLIC HEARING(S) — Alternate Members—Board of Assessment Review The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE,that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday,June 1,2011 at 8:00 PM or as soon thereafter as is possible in Conference Room C of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider an Additional Alternate to the Board of Assessment Review. Purpose: The Town Board finds that having two Alternate Members on the Board of Assessment Review will eliminate the possibility of not having a quorum. Therefore it is the recommendation of the Town Board to increase the number of Alternate Members from one to two. The full text of this Amendment may be examined and copies obtained at the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. There being no further business to come before the Commission,on motion of Commissioner Wittner,seconded by Commissioner Seligson,the Commission unanimously adjourned and the Town Board reconvened. 8 JUNE 1, 2011 AFFAIRS OF THE TOWN 1. Report of Bids—TA-11-13A Police Uniform Cleaning On motion of Councilwoman Wittner,seconded by Councilman Fishman,the following was approved; WHEREAS, on May 12, 2001 the Town publicly opened and read one (1) bid for TA-11- 13A-Cleaning of Police uniforms. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby award Contract TA-11-13A - Cleaning of Police Uniforms to the only bidder, Excelsior Cleaners of Larchmont, NY at a price of $6.00 for a laundered shirt and $3.00 for laundered trousers. Authorization—Transfer of Funds—Tree Fund On motion of Councilman Odierna,seconded by Councilwoman Wittner,it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the transfer of funds from the Tree Trust Fund in the amount of $3,663.02 for the 2011 tree planting program. 3. Authorization—Westchester County Prisoner Transportation Agreement On motion Councilwoman Seligson,seconded by Councilman Odierna,it was RESOLVED, that the Mamaroneck Town Board does hereby approve of the agreement between the County of Westchester and the Town of Mamaroneck for the transporting of prisoners from the Town of Mamaroneck to the County Correction Facility in Valhalla, New York,as follows: For January 2, 2011 through December 31, 2011: $197.19 per round trip with the reimbursement for mileage at the rate of.50 cents per mile. For January 2, 2012 through December 31, 2012: $204.09 per round trip with the reimbursement for mileage at the rate of.50 cents per mile. and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. 9 JUNE 1, 2011 The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye 4. Authorization—New York State Department of Transportation—Snow&Ice Agreement On motion of Councilwoman Seligson,seconded by Councilwoman Wittner,the following was approved; WHEREAS, due to the severity of the 2010/2011 winter, the Department of Transportation has agreed to adjust the original agreement to reflect additional lane miles of State roads that were plowed and/or treated this winter,and WHEREAS,with the estimated expenditure being$14,278.40,and WHEREAS, the index adjustment proposed is $10,751.64, bringing the revised estimated expenditure to$25,030.04. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the "Amendment B"to the Snow and Ice Agreement—DOT Contract#DO010708 for the 2010/2011 Snow Season,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreement for the Town to receive the$10,751.64 adjustment. Urban County Consortium On motion of Supervisor O'Keeffe,seconded by Councilwoman Wittner,the following was approved: WHEREAS,the Town of Mamaroneck will not be applying for Community Development Block Grants(CDBG)over the next three years. NOW,THEREFORE, BE IT 10 JUNE 1, 2011 RESOLVED,that the Town of Mamaroneck will opt out of its membership in the Urban County Consortium for the years 2012, 2013 and 2014. the Board. Mr. Roniger asked why the Gardens' Lake was drained. Mr.Altieri responded that there are a number of plantings that did not'take'and therefore they are being replanted. Mr.Altieri also noted that the lake was drained in an effort to empty the sediment basins. WRITTEN COMMUNICATIONS Noted during the Public Hearing for Restricting Parking on Edgewood Avenue. SUPERVISOR'S REPORT Supervisor O'Keeffe will attend with Mr.Altieri the Westchester Municipal Officials(WMOA) Meeting. Great discussion is taking place with respect to the Governor's proposed Two Percent Tax Cap. A vote is expected on the Law in the next few weeks.The Association of Towns,the New York Conference of Mayors,as well as WMOA are lobbying the legislature about the consequences of a Two Percent Tax Cap without any relief from unfunded mandates. Mr.Altieri was away last week attending the Annual Meeting of PERMA. The Board congratulated Mr. Altieri on his continued Chairmanship. REPORT OF COUNCIL Councilman Fishman was unable to attend the last Zoning Board Meeting. Councilman Fishman asked Mr. Altieri to follow up on a Meeting of the Housing Authority, noting it has now been some time since they have met. Councilwoman Seligson noted the many Memorial Day services around the Town,adding it was a nice weekend of remembrance. Councilman Odierna added to Councilwoman Seligson's list of Ceremonies the Essay Contest held by Mamaroneck High School. Councilwoman Wittner attended the Larchmont Gardens'Civic Association's Annual Meeting instead of the Coastal Zone Management Commission Meeting. 15 JUNE 1, 2011 Councilwoman Seligson reminded the audience of the 3501"Anniversary of the Town of Mamaroneck. The celebration weekend will take place on September 16th—18th. Supervisor O'Keeffe announced the retirement of Diane Courtney as the Library Director.A retirement party will take place on June 7 from 6:00-8:OOpm at the Village Center. The Town Clerk announced an upcoming NYS Archives Workshop being held at the Town Center. The topic will be Managing Electronic Records. Ms. Battalia noted that this was the third workshop to be held at the Town,adding the Archives loves having workshops here. ADJOURNMENT Supervisor O'Keeffe closed the meeting in memory of Francis"Frank" McGahan. Mr. McGahan was a member of the Coastal Zone Management Commission.Supervisor O'Keeffe noted how generous he was with his time and his knowledge. Mr. McGahan had attended the Webb Institute for Naval Architecture and Marine Engineering. Mr. McGahan spent his career in heavy marine construction management and was a member of The Moles, known as the"most prestigious society of heavy construction in the world". Supervisor O'Keeffe also closed the meeting in memory of Rino Fraulini. Mr. Fraulini was a laborer for the Town of Mamaroneck Highway Department for many years.
