BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M.O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Supervisor O'Keeffe,seconded by Councilman Odierna,the Work Session was unanimously opened at S:OOPM. On Line Ambulance Charge Payment System Mike Liverzani,Ambulance District Director was present. Mr. Liverzani explained the proposal to enter into an agreement with ZirMed Financial Services to batch bill and collect credit card payments for ambulance bills.The approval for this item will be on the agenda for this evening. Pay As You Throw(PAYT)Solid Waste Program Mr.Altieri explained that he had previously presented to the Sanitation Commission a proposal for a PAYT waste plan for the Town of Mamaroneck and the Village of Larchmont. Mr.Altieri also explained a proposal to charge fees for the disposal of organic waste and use of the Maxwell Avenue Facility. The Board reviewed a memorandum prepared by Mr.Altieri,as well as literature on Pay As You Throw Plans. Ethics Law Mr. Maker explained that he and the Town Clerk recently discovered a number of non substantive items within the Ethics Law which the Town Board might want to address. Mr. Maker will make the proposed changes to the Ethics Law for the Board to review and set a Public Hearing for any amendments. Parking-Maxwell Avenue As previously discussed,the Town Clerk and Town Administrator have proposed changing the permit requirement for meter parking on Maxwell Avenue. These spaces are being under utilized by Area Business employees and would therefore, be better utilized by being offered to patrons of businesses along Myrtle and Maxwell as non-permit meter spaces.This item will be on the agenda for this evening. New Business The Board continued previous discussion of the Town's Boards and Commissions. The Board would like to invite the Planning Board and the Board of Architectural Review to meet with the Town Board. 1 October 6, 2010 On motion of Councilwoman Wittner,seconded by Councilwoman Seligson,the Town Board unanimously agreed to enter into Executive Session to discuss employment history of particular persons. EXECUTIVE SESSION Employment History of Particular Persons On motion of Councilwoman Seligson,seconded by Councilwoman Wittner,the Board unanimously agreed to re-enter Work Session. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, she then pointed out the location of exits. PROCLAMATION Supervisor O'Keeffe presented Lee Bloom with the following Proclamation, read by Councilwoman Wittner. UNITED NATIONS WEEK WHEREAS,The United Nations was founded in 1945,and the 65`" anniversary of the day on which the UN Charter came into effect will be observed on October 24,2010; and WHEREAS,The United Nations continues to act to promote peace and security, economic development and human rights around the world,and is vital now more than ever; and WHEREAS, In September of 2000,all United Nations member states,including the United States,agreed upon 8 Millennium Development Goals to meet the needs of the world's poorest; and WHEREAS,The Millennium Development Goals provide a common development strategy for the international community,allowing for improved coordination, coherence,and effectiveness at all levels; and WHEREAS,The United States has a long tradition of leading international efforts to improve health,education and economic growth in developing countries; and WHEREAS,The United States has shown its commitment to the Millennium Development Goals through foreign assistance, progressive trade initiatives,and debt relief measures; and WHEREAS,The United Nations Association of the United States of America (UNA-USA), in cooperation with other organizations, has declared"Engaging America in the Millennium Development Goals"as its theme for the 2010 United Nations Day commemorations; and WHEREAS,The citizens of the Town of Mamaroneck should join with others around the country in participating in events relating to UN Day. NOW,THEREFORE, BE IT RESOLVED,that I,Valerie Moore O'Keeffe,Supervisor of the Town of Mamaroneck,and the Town Board members, hereby officially proclaim October 24,2010 as UNITED NATIONS DAY IN THE TOWN OF MAMARONECK IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 6`"day of October 2010. 2 October 6, 2010 Mr. Lee Bloom,thanked the Town Board and addressed the audience by highlighting the work being done every day by the United Nations. It was stated that the United Nations: 1. Provides food for 108 million people in 74 countries 2. Vaccinates 40 percent of the world's children,saving 2 million lives a year 3. Assists over 34 million refugees and others fleeing war,famine and persecution 4. Fights climate change and leads a campaign to plant 1 billion trees a year 5. Keeps the peace with 116,000 peacekeepers in 17 operations on 4 continents 6. Fights poverty and helped 300 million rural poor achieve better lives in the last 30 years 7. Monitors, promotes, protects and develops human rights worldwide 8. Mobilizes$7 billion in humanitarian aid to help people affected by emergencies 9. Leads international efforts in clearing landmines in over 30 countries 10. Promotes universal primary education, reaching 88%enrollment coverage in developing countries PUBLIC HEARINGS Public Housing Agency Administrative Plan Amendment to the Tree Law Regarding Lot Size Amendment of Off-street Parking in Residential Districts The following Notice of Public Hearing was entered into the record as follows: NOTICE OF PUBLIC HEARING October 6,2010 PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, October 6, 2010 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to approve the Section 8 Housing Administrative Plan. Purpose: The Town under the regulations governing the Section 8 Housing Voucher Program is required to hold a public hearing each year on the Section 8 Housing Administrative Plan. The Section 8 Housing Administrative Plan may be examined and copies obtained at the Town Clerk's Office during regular office hours, Monday— Friday, 8:30 AM to 4:30 PM and during the months of June,July and August Monday— Friday, 8:30 AM to 4:00 PM. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: August 19,2010 On motion of Councilman Fishman,seconded by Councilwoman Seligson,the Public Hearing was unanimously opened. Anna Danoy, Director of Community Services addressed the Town Board with the details of the Administrative Plan. Supervisor O'Keeffe asked if anyone had any questions or comments. Ms. Danoy noted that there were no changes to the Administrative Plan since last year when a number of changes were made. 3 October 6, 2010 There were a number of questions from the audience regarding the differences in the Federally funded Section 8 Program and the Town's Housing Authority which is not Federally funded. On motion of Councilwoman Wittner,seconded by Councilman Fishman,the Public Hearing was unanimously closed. On motion of Councilwoman Wittner,seconded by Councilwoman Seligson,it was unanimously RESOLVED,that the Mamaroneck Town Board finds that the adoption of the Section 8 Housing Administrative Plan,is hereby declared to be a Type II Action, with no impact under the New York State Environmental Quality Review Act (SEQRA)and requiring no further action. On motion of Councilwoman Wittner,seconded by Councilwoman Seligson,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby accept the Public Housing Agency Administrative Plan for the Fiscal Year 2011. The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE,that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday,October 6,2010 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a Local Law entitled "Amendment to the Tree Law regarding lot size" Law. Purpose: The current law regarding the removal of trees applies only to lots which exceed 20,000 square feet in size. The Town Board finds that trees on lots of any size are valuable natural resources which should be protected. Accordingly this local law removes the exemption which lots that are 20,000 square feet or less in size currently have. The full text of this Local Law may be examined and copies obtained at the Town Clerk's office during regular hours, Monday- Friday,8:30 AM to 4:30 PM, In June,July and August until 4:00 PM at 740 W. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: September 20,2010 On motion of Councilman Fishman,seconded by Councilwoman Seligson,the Public Hearing was unanimously opened. Councilman Odierna explained the proposed Amendment,adding that his intention in proposing this Amendment is to have a public discussion regarding the removal and preservation of trees.Councilman Odierna explained that the recent removal of a large tree 'sparked'what he feels should be a better review of tree removal. His understanding was that a healthy tree was removed,whereby drastically changing the character of the neighborhood. Supervisor O'Keeffe countered stating she took Councilman Odierna's concerns seriously and visited the resident who removed the tree. The resident explained to Supervisor O'Keeffe that the neighbors around her were afraid of this tree falling. The resident had the tree looked at by an arborist who determined it was dead at the top and should come down. 4 October 6, 2010 Supervisor O'Keeffe is concerned that a tree removal situation such as this could spark a draconian amendment to the Town's Tree Law. Supervisor O'Keeffe asked the Town Clerk to read a letter from Mr.Jack O'Keeffe. The letter is entered into the record as part of the Public Hearing: Jack O'Keeffe 11 Dante Street Larchmont, NY 10538 September 30,2010 Supervisor and Members of the Town Council of the Town of Mamaroneck Re: Proposed Tree Law 1 frequently walk or ride around the Town of Mamaroneck just to admire the beauty of the place. On every street one can view a spectacular canopy provided by a wide variety of tall deciduous trees. Beneath and beside the taller trees we see an even wider variety of trees of medium height(both coniferous and deciduous)as well as shrubs, bramble and ground cover. How was this virtual Garden of Eden created, and how is it maintained? By the Town Board? By a commission of tree czars? No, it has been created and maintained by generations of your neighbors, each individually acting in his and her enlightened self interest to enhance the comfort, beauty, value and marketability of their individual parcels. You are proposing a"solution"when no problem exists. We are not about to be invaded by an army of crazed lumberjacks. It would be terribly presumptuous and really destructive of the community sense we share for you to attempt, either directly as a Board, or indirectly through a committee of tree commissars, to substitute your judgment for your neighbors'as to what vegetation should be planted, what should be pruned or what should or should not be removed from small residential parcels. Just trust me and your other neighbors. We will continue to make our personal decisions with the same motivations that have created our beautiful surroundings, and the results will be the same. The proposed law is not only unnecessary, it has a flawed premise, i.e., that the biggest trees are the most important ecologically and for flood control. Actually, in controlling runoff, the most important plants are ground cover, lower height shrubs, bushes and bramble and medium trees. The lower vegetation is also the most important for providing shelter, nesting and food to the widest variety of birds, mammals, reptiles, amphibians and insects. Only a very few species of birds nest in the high canopy of the tallest trees. One of the reasons people love to live in the Town of Mamaroneck is because our local government is known for its thoughtful action, restraint and non-intrusiveness! Please keep up the good work and reject this misguided proposed law. Very truly yours, Jack O'Keeffe Supervisor O'Keeffe read from a memo prepared by Mr.Altieri outlining and explaining the work currently involved in tree permitting by the Town's Building and Conservation Departments. The memo further explained the strain to these departments should this law be enacted. Supervisor O'Keeffe asked if anyone had any questions or comments. Ruth Campanelli,8 Barnum Road,asked if the property sub-division at 72 Cooper Lane is in excess of one half acre and if this ordinance applies. Ms. Campanelli is concerned about homes being built on 'spec' 5 October 6, 2010 and what seems to be a disregard for the neighborhood by builders who have no intention of living in the homes they build. Ms.Campanelli explained a situation in which she had to take down a dead tree,and understands there is concern in waiting to remove a potentially dangerous tree. Councilwoman Seligson stated there are trees in our community that are so beautiful and so significant that they feel as though they belong to the whole community,adding the removal of this type of tree can alter the character of the neighborhood. Councilwoman Seligson further stated that what she feels the Town is trying to accomplish with this Amendment is a sense of responsibility,a sense of stewardship for an important tree. Councilwoman Seligson noted the difficulty in trying to codify or even quantify such a thing. Councilman Fishman stated that this issue addresses a general concern for residential planning,for instance,when someone paints their home pink on a street full of Tudors. The Town does not have codes for every infraction that changes the character of our community. Councilman Fishman does think there are property rights issues involved,and he has concerns about that. He thinks this is less about enacting a law at this time, but rather about a conversation that needs to happen within our community. Ms.Gillette, President of the Garden Club,stated that a lot of what she planned to say has already been touched upon,adding she is glad to see this conversation taking place. Ms.Gillette is concerned that as a community we have not been good tree stewards. Ms.Gillette thinks the removal of trees on a small property can be even more significant than on a larger property. Of concern as well, is the health of our trees,and about an on-going evaluation and protection. During the last storm two-thirds of the tress that went down were rotten,the other third were abused by builders who had taken away major portions of their root systems. Supervisor O'Keeffe stated that possibly a trust for the preservation of significant or historical trees could be established. Councilman Odierna,was glad for this productive conversation,adding his intention is not to spend more money and therefore, perhaps an advisory committee could be established to evaluate and 'escalate'a potential tree issue as the committee would see fit. Supervisor O'Keeffe emphasized that she does not think the Town has a problem that would facilitate the need for legislation. Councilman Odierna stated that although this particular draft of an Amendment to the tree law may not be perfect as written,it has established a vehicle to open a discussion. Councilwoman Seligson added that a public education process needs to take place,adding residents should be reminded of the possible impact to their neighbors when removing trees. Abby Katz, Larchmont Gardens'Civic Association,stated that many residents have concerns about the number of trees being cut down,adding that these concerns seem to be aimed at builders and new residents. Ms. Katz asked for a clearer explanation of the current law,as well as of the amendment. Mr. Maker commented with an explanation of how the law currently works. On motion of Councilwoman Wittner,seconded by,Councilman Fishman the Public Hearing was unanimously closed. On motion of Councilman Odierna,seconded by Councilwoman Wittner,the Public Hearing was unanimously re-opened. Barbara Spiridon,20 Little Farms Road,stated that she found a lot of what she heard tonight very distressing. Ms.Spiridon sees this as less of an issue with individual homeowners, but rather of builders coming into our community and making money off of the land and changing the character of our community. Ms.Spiridon would like to have been notified that all the trees on the Cooper Lane property were to be removed. Supervisor O'Keeffe interjected that the property on Cooper Lane did not need a variance;the subdivision was built within the Town Law. Mr.Altieri responded by stating that the property on Cooper Lane was sent to the Planning Board and as part of that process signs were posted on the property announcing dates of hearings. 6 October 6, 2010 Councilman Odierna added that as a liaison he attended these meetings and almost no neighbors attended,adding a better mechanism for notifying residents needs to be in place. Councilwoman Witmer invited George Roniger,as a member of the Planning Board,to address the Board. Mr. Roniger supports the tree amendment as proposed. Mr. Roniger did state that the Planning Board did 'sign-off'on a replanting proposal,adding the Planning Board would never have allowed them to cut down these trees without a plan for replanting. Mr. Maker did note that there could be a 'loop hole'in the current law,whereas a property larger than one half acre is subdivided into two parcel each less than one half acre thereby not being affected by the current law. Mr. Maker did clarify however,that a subdivision is, by law,always referred to the Planning Board in which the removal of trees would be addressed as part of the site plan. Mr. Roniger did add that it's surprising the lack of limitation on what the Planning Board can do,adding a developer can really have a large say in what is going to happen on the property. Mr. Roniger further stated that frequently property owners seeking to remove trees are encouraged through the Planning Board and Tree Commission to work with their neighbors to find compromises. The Planning Board was very pleased with what was accomplished at Bonnie Briar with respect to tree removal. Mr. Roniger did also state that there is no forum for neighbors to voice their concerns with the one half acre law as it exists. On motion of Councilwoman Wittner,seconded by Councilman Fishman,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby adjourn the Public Hearing on the"Amendment to the Tree Law regarding lot size" Law,for November 17,2010 at 8:15PM in the Court Room of the Town Center. The following notice of Public Hearing was entered into the record as follows: NOTICE OF PUBLIC HEARING AUGUST 11,2010 ADJOURNED TO OCTOBER 6,2010 PLEASE TAKE NOTICE,that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday,October 6,2010 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a Local Law entitled "Amendment of Off-street Parking in Residential Districts" Law. Section 1—Purpose: Section 240-79 B. of the Zoning Ordinance provides restrictions on off-street parking which have become anachronistic. The law was enacted at a time when it was less common for households to have more than one automobile so that parking the family car either in a garage or more than 25 feet from the home's front lot line was feasible. Now it is the norm for each household to have two or three cars making it impossible to park all of them in a garage or more than 25 feet from the home's front lot line. In addition there were no SUVs or other extra large motor vehicles when the law was passed. Garages that were built prior to 1960 cannot accommodate some of today's vehicles. Hence such vehicles are parked in driveways. For these reasons, the Town Board finds it appropriate to repeal that portion of section 240-79 B. of the Zoning Ordinance which prohibits parking on a residential lot within 25 feet of a front property line; provided, however, that the repeal does not lead to the parking of motor vehicles in areas outside of driveways and less than 25 feet from the street in front of a home, such as in a parking space installed in front of a home and only 10 feet from the street. On motion of Councilwoman Wittner,seconded by Councilman Fishman,it was RESOLVED,that the Mamaroneck Town Board does hereby adjourn the Public Hearing on the Local Law entitled "Amendment of Off-street Parking in Residential Districts" until November 17,2010 at 8:15 in the Court Room of the Town Center. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe then on motion of Commissioner Wittner, seconded by Commissioner Odierna,the Board of Fire Commissioners was unanimously declared open. Commissioner Wittner noted that Deputy Chief Brendan Collins will be coming to address the Commission on October 20`". The Fire Department Open House at the Weaver Street Fire House will take place on October 3,from noon to 4:OOPM. On a sad note it was reported that Firefighter Ted Hecht lost his mother last week. The Commission sends their condolences to his wife Cindy and their children. Congratulations go out to Chief McCarthy on the birth of his baby girl yesterday. There being no further business to come before the Commission,on motion of Commissioner Wittner,seconded by Commissioner Seligson,the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Authorization—On Line Ambulance Charge Payment Agreement On motion of Councilwoman Wittner,seconded by,Supervisor O'Keeffe,it was RESOLVED, that the Mamaroneck Town Board does hereby approve the agreement with ZirMed Financial Services, in conjunction with Evolution Billing Concepts, and the Town of Mamaroneck Ambulance District to batch bill and collect credit card payments for the ambulance district billing,and BE IT, FURTHER RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute said agreement on behalf of the Town. 9 October 6, 2010 The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye 2. Resolution— Amended New York State Snow&Ice Agreement On motion of Councilwoman Wittner,seconded by Councilman Odierna,the following was approved: WHEREAS,on April 1,2009 the Town of Mamaroneck approved Snow&Ice Control Agreements with the New York State Department of Transportation for the years 2007/2008, 2008/2009 and 2009/2010,and WHEREAS,the New York State Department of Transportation has amended the reimbursement the Town of Mamaroneck will receive for the years 2009/2010. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby approve the Amended Agreement with the New York State Department of Transportation for the years 2009/2010 to reflect a reimbursement rate of$1,345 per lane mile for 9.17 lane miles for a total reimbursement of $12,333.65,and BE IT, FURTHER RESOLVED,that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute said amendment and agreement on behalf of the Town. Resolution—Re: Designation of Parking Lot#5—Maxwell Avenue On motion of Supervisor O'Keeffe,seconded by Councilwoman Wittner,the following was approved: WHEREAS, the Town has identified that the 11 Area Business and Overnight Parking Permits along Maxwell Avenue have been undersold,and WHEREAS, there is a need for parking by patrons of the Maxwell and Myrtle Avenue Businesses,who would be better served using these spaces. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve designating Maxwell Avenue as Parking Lot#5,and WHEREAS, the 11 parking spaces will be available as meter spaces requiring no permit 24 hours a day at a rate of $.50 per hour. 10 October 6, 2010 The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye 4. Salary Authorization Police Department On motion of Councilwoman Wittner,seconded by Supervisor O'Keeffe,it was RESOLVED, that the Mamaroneck Town Board does hereby authorize the promotion of Police Officer Anthony Hoffman to the position of Police Sergeant at an annual rate of $107,725, effective October 7,2010. ORAL COMMUNICATIONS George Roniger, Larchmont Gardens'Civic Association,addressed the Board noting that although better, the recycling bins are still being put back in driveways and sometimes the street. Mr. Roniger did note that the leaf blowers seem less this summer. Of additional note was the garbage truck that started at 6:30AM the other morning. Mr. Roniger said the lake looked bad,which was a good thing.The Halloween Parade was announced for October 23 beginning at West Garden. WRITTEN COMMUNICATIONS Read and entered into the record under Public Hearing for Local Law entitled "Amendment to the Tree Law regarding lot size" 12 October 6, 2010 SUPERVISOR'S REPORT Supervisor O'Keeffe noted her continued meetings with Westchester County regarding the implementation of the Court Order for Affordable Housing Settlement. Supervisor O'Keeffe noted she is always concerned with issues regarding the Westchester Joint Water Works. There have been continued talks with the County of Westchester,specifically Tom Lauro the County's Commissioner of Environmental Facilities with respect to sharing the County's ultraviolet Facility or the actual treatment facility. Supervisor O'Keeffe will be in Albany next week to talk with the Health Department. Supervisor O'Keeffe will report on this at the next Town Board Meeting. Councilman Fishman reminded residents of the upcoming LMC-TV's Annual Sunny Goldberg Award celebration. This year's recipient is Jim Millstein. As many of you know Jim is currently with the Obama Administration's Treasury Department and is the single individual who is crafting the AIG government payback. Locally Jim is being honored for his outstanding work negotiating the Cablevision and Verizon Franchise Agreements. The event is taking place at Orienta Beach Club on October 17,from 4:00 to 7:OOPM. Councilwoman Seligson was sorry she missed the Employee Recognition Ceremony,as she was at an important Long Island Sound Study Meeting held on Plum Island. The Island has been used for quite some time as an agricultural laboratory by the US Government. Plum Island is notable for its designation as one of Long Island Sounds Exemplary Stewardship site receiving recognition under the Federal Government's Long Island Sound Exemplary Stewardship Act.The Island is being considered for sale by the Government Services Administration and Homeland Security and its sale is seen by many as a great mistake on an environmental level. As liaison to the Traffic Committee,Councilwoman Seligson attended their meeting on September 28. It was a long and difficult discussion regarding stop signs. There is great concern about speeding and traffic in our Town but feels that stop signs are not the answer to this problem. Councilwoman Witmer attended the meeting of the Coastal Zone Management Committee. The meeting was jointly held with the Village of Mamaroneck. The speakers were Charles McCaffrey, retired Bureau Chief for the Department of State and Steven Resler. The meeting was regarding waterfront revitalization programs and their consistency within the Town and Village with respect to procedures and policies. It was a very productive meeting. Councilman Odierna was recently in Italy. He spoke fondly of his trip. Councilman Odierna did note the Village of Larchmont's Art Festival last weekend,it was very well attended. The Larchmont'Tour de Larchmont'is coming up as well.
