Fishman ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Supervisor O'Keeffe,seconded by Councilwoman Wittner the Work Session was unanimously opened at S:OOPM. Request of School District re: Noise Ordinance Exemption Present: Dr. Robert Shaps,Superintendant of Schools Mr. Briggs,Triton Construction The Mamaroneck School District is requesting a waiver of the noise ordinance in order to complete the work at the Hommocks Middle School. It was further explained that asbestos was found in the window frames causing delays in construction. The school is requesting that work be allowed to continue until 10:OOPM. On motion of Councilwoman Wittner,seconded by Councilman Fishman,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby grant a waiver of the noise ordinance and allow construction at the Hommocks Middle School to continue until 10:OOPM Monday thru Friday from mid August thru November,and BE IT, FURTHER RESOLVED,that the Mamaroneck Town Board does hereby grant this waiver until September 15`",whereby an automatic renewal will take place for the waiver to continue thru November unless the Town Board notifies the Mamaroneck School District of their intent to discontinue the waiver. Review of Management Letter—2009 Financial Audit Also present: Anthony Siligato,Town Comptroller The Town Board reviewed the report prepared by the Town's independent auditors. The Report contained recommendations on ways to improve internal controls in the Town's financial operations. Mr.Altieri and Mr.Siligato explained the Town's response to the eight recommendations. 1 AUGUST 11, 2010 Update—New York State Retirement Incentive At the last Town Board Meeting the Board reviewed a summary of the provisions of the New York State Retirement Incentive Program. This evening the Board reviewed a memo prepared by Mary Stanton,in which she summarized the actions the Town has undertaken with respect to familiarizing the staff with the provisions of this program,and the Town's analysis of whether it would be possible for any Town employees,or for the Town to participate in this program. It is the recommendation of Ms.Stanton and Mr.Altieri that the Town not participate in the New York State Retirement Incentive Program. Update—Westchester Joint Water Works(WJWW) The Town Board reviewed a memo prepared by Mr.Altieri outlining a meeting the WJWW held to apprise the participating municipalities on a variety of issues and capital project plans. Mr.Altieri informed the Town Board that the WJWW will be meeting with all the participating municipalities' management staff on an ongoing basis with respect to financial matters. Update—Senior Center Renovation—VFW The Town Board reviewed floor plans for the renovations at the Senior Center. An alternate location for the daily activities of the Town's Senior's is being investigated; one possibility being the Village of Mamaroneck's Pavilion at Harbor Island. Update—Byron Place Associates Mr.Altieri informed the Town Board that he recently sent a list of repairs that need to be made at the Parking Deck at Myrtle Blvd and N.Chatsworth Avenue. These repairs are part of the warranty the Town has with FCD Mamaroneck, LLC. On motion of Councilwoman Wittner,seconded by Councilwoman Seligson the Board unanimously agreed to enter into Executive Session to discuss Employment History of two particular persons,Collective Bargaining with the PBA. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, she then pointed out the location of exits. PUBLIC HEARING — "Amendment of Off-Street Parking in Residential Districts" Law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE,that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday,August 11,2010 at 8:15 PM or as soon thereafter as is 2 AUGUST 11, 2010 possible in the Court Room of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a Local Law entitled "Amendment of Off-street Parking in Residential Districts" Law Section 1—Purpose: Section 240-79 B. of the Zoning Ordinance provides restrictions on off-street parking which have become anachronistic. The law was enacted at a time when it was less common for households to have more than one automobile so that parking the family car either in a garage or more than 25 feet from the home's front lot line was feasible. Now it is the norm for each household to have two or three cars making it impossible to park all of them in a garage or more than 25 feet from the home's front lot line. In addition there were no SUVs or other extra large motor vehicles when the law was passed. Garages that were built prior to 1960 cannot accommodate some of today's vehicles. Hence such vehicles are parked in driveways. For these reasons, the Town Board finds it appropriate to repeal that portion of section 240-79 B. of the Zoning Ordinance which prohibits parking on a residential lot within 25 feet of a front property line; provided, however, that the repeal does not lead to the parking of motor vehicles in areas outside of driveways and less than 25 feet from the street in front of a home, such as in a parking space installed in front of a home and only 10 feet from the street. The full text of this Local Law may be examined and copies obtained at the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. Boston Post Road Mamaroneck, New York PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. Mr. Maker will revise the proposed Local Law to reflect these recommendations. It is therefore advised that the Public Hearing be adjourned. On motion of Councilwoman Seligson,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby adjourn the Public Hearing on the Local Law entitled "Amendment of Off-Street Parking in Residential Districts" Law until October 6,2010 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center,740 W. Boston Post Road, Mamaroneck, New York . AFFAIRS OF THE TOWN 1. Authorization IMA Village of Larchmont Water Tank Tax Exemption Mr. Maker explained that he and the attorney for the Village of Larchmont have finalized the agreement per the understanding and discussions between the Village of Larchmont and the Town regarding the Tax Exemption for the Village's water tanks located off Byron Place. On motion of Councilwoman Seligson,seconded by Councilman Fishman,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the Agreement between the Village of Larchmont and the Town of Mamaroneck for tax exemption status for the property 5 AUGUST 11, 2010 owned by the Village of Larchmont on Byron Place in the Town of Mamaroneck,and BE IT, FURTHER RESOLVED,that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute said Agreement on behalf of the Town. Set Public Hearing—Bond Requirements for Tank Removal The Town Board reviewed the proposed Local Law prepared by Mr. Maker. Supervisor O'Keeffe asked Mr. Maker to review the current Propane Law for any potential conflicts. On motion of Councilman Fishman,seconded by,Councilwoman Wittner,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the"Bond Requirements for Tank Removal" Law for September 15, 2010 at 8:15 in the Court Room of the Town Center,and BE IT FURTHER, RESOLVED,that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper,and that said notice, be posted. 3. Set Public Hearing—Section 8 Housing Administrative Plan On motion of Councilwoman Wittner,seconded by Councilman Odierna,it was RESOLVED,that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the Section 8 Housing Administrative Plan for October 6,2010 at 8:15 in the Court Room of the Town Center,and BE IT FURTHER, RESOLVED,that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper,and that said notice, be posted. 4. RENEWAL OF SERVICE AGREEMENT—BLACKBOARD CONNECT Mr.Altieri explained that Blackboard Connect maintains the Town's emergency notification system,adding the Town has been very happy with the service and the product. 6 AUGUST 11, 2010 On motion of Councilwoman Wittner,seconded by,Councilman Odierna,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the renewal agreement with Blackboard Connect for the operation of the Town of Mamaroneck's emergency notification system,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. AUTHORIZATION OF SETTLEMENT AGREEMENT On motion of Councilman Odierna,seconded by Councilwoman Seligson,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the Settlement Agreement and General Release and Waiver of All Claims between Ellen Donnelly,the Civil Service Employees Association and the Town of Mamaroneck,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. AUTHORIZATION—SCHOOL TAX WARRANTS On motion Supervisor O'Keeffe,seconded by Councilwoman Wittner,the following were approved, TOWN OF MAMARONECK SCHOOL TAX WARRANT FOR THE YEAR 2010 STATE OF NEW YORK ) COUNTY OF WESTCHESTER ) TO: Receiver of Taxes of the Town of Mamaroneck in said County 7 AUGUST 11, 2010 YOU ARE HEREBY COMMANDED, to receive and collect from several persons named in the assessment roll of the Union Free School District in the Town of Mamaroneck, hereunto annexed and herewith delivered to you, the sum of the School Taxes of said School District set opposite their respective names in accordance with provision of Chapter 852 of the Laws of 1948 (Title 16) and the acts amendatory thereof and supplemental thereto including the amendment made by Chapter 386 of the Laws of 1962 and the resolution adopted by the Town Board of the Town of Mamaroneck on August 11,2010. SALARY AUTHORIZATIONS PARAMEDICS On motion of Councilwoman Wittner,seconded by Councilwoman Seligson,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the salary increase for the Ambulance District Paramedics and per diem EMT's as budgeted for fiscal year 2010,as follows: 10 AUGUST 11, 2010 Hourly Rate from$27.50 to$28.50 per hour Per-diem EMT from 15.50 t0$16.50 The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye CENTRAL GARAGE On motion of Councilwoman Seligson,seconded by Councilwoman Wittner,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the promotion of Frank Caporale from an Assistant Auto Mechanic to an Auto Mechanic effective July 1,2010 at a salary of$64,695.00. This position is effective from Monday August 16,2010 through Friday November 12,2010,at a rate of$12.00 per hour. AUTHORIZATION—AMEND SNOW AND ICE AGREEMENT WITH THE COUNTY OF WESTCHESTER On motion of Supervisor O'Keeffe,seconded by Councilwoman Wittner,the following was approved: WHEREAS,on April 1,2009 the Town of Mamaroneck approved Snow&Ice Control Amended Agreements with the New York State Department of Transportation for the years TM 2007/2008,2008/2009 and 2009/2010,and 10-06-2010 WHEREAS,the original Agreement approved a reimbursement rate of$1,145.00 per lane mile for 9.17 lane miles for a total reimbursement of$1,145.00,and WHEREAS,the New York State Department of Transportation has amended the reimbursement the Town of Mamaroneck will receive for the years 2009/2010. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby approve the Amended Agreement with the New York State Department of Transportation for the years 2009/2010 to reflect a reimbursement rate of$1,345 per lane mile for 9.17 lane miles for a total reimbursement of$14,017.07,and BE IT, FURTHER RESOLVED,that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute said amendment and agreement on behalf of the Town. 12 AUGUST 11, 2010 The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye APPROVAL OF MINUTES — Deferred until September 15,2010 ORAL COMMUNICATIONS Abby Katz,of the Larchmont Garden's Civic Association,asked for an update on the Garden's Lake Project. Ms. Katz thanked the Board for the tree trimming along the Brook. WRITTEN COMMUNICATIONS None SUPERVISOR'S REPORT Supervisor O'Keeffe met with the Human Rights Committee. The Committee is actively working on the Dr. Martin Luther King,Jr.Celebration. It will be held this year at St.Thomas'Community Room. REPORT OF COUNCIL Councilman Odierna attended the Recreation Commission Meeting. The Commission discussed the summer camps.The Recreation Department is looking for donations of digital cameras to be used by the camps. The Memorial Park Concerts were again a big success;thanks went out to the many local businesses that donated. The Commission also discussed fees and the Ice Rink. This evening was the Planning Board Meeting,adding he might be able to catch the tail end. Councilman Odierna read from the Planning Board agenda,encouraging residents to attend. Councilwoman Wittner attended the Coastal Zone Management Commission, residents effected by the Avon Road Project attended and expressed their views.Councilwoman Wittner attended the County Committee on Soil and Water,then on August 2,the Fire Council Meeting. Councilwoman Wittner attended the groundbreaking for the Gardens' Lake Project with Supervisor O'Keeffe. At the Long Island Sound Watershed Intermunicipal Council(LISWIC),all were pleased by the attendance of the White Plains Councilman; LISWIC has been long awaiting the participation of White Plains. Councilwoman Seligson noted Traffic Committee did not meet this month. Councilwoman Seligson commended Steve Altieri for his culinary expertise at the Senior Citizen BBQ. Supervisor O'Keeffe congratulated Robert Herbst,on his achievements as a world heavy weight lifter. Mr. Herbst is an active Town resident and participates actively in Town Sports as well as the Boys Scouts. Councilman Fishman attended the Zoning Board of Appeals Meeting,adding residents are eager to see the Off-street Parking Law resolved. Councilman Fishman attended the Town of Mamaroneck Housing Authority Meeting,adding how well the Authority continues to be managed. The Authority received updates on Capital Projects and energy upgrades; a 20 year Capital Project Plan has been established.
