HomeMy WebLinkAbout2010_07_14 Town Board Minutes July 14, 2010 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON JULY 14,2010, BEGINNING AT S:OOPM IN CONFERENCE ROOM A AND CONTINUING AT 8:15 PM IN THE COURT ROOM OF THE TOWN,740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M.O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Nancy Seligson Councilman David J. Fishman (Absent from Work Session) ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Wittner,seconded by Councilman Odierna the Work Session was unanimously opened at S:OOPM. Tax Exemption for the Village of Larchmont Jaine Eney,Village of Larchmont Trustee,was present. The Town Board continued discussion on the tax exemption status for the Village owned property located on Byron Place in the Town of Mamaroneck,where the Village's Water Tanks are located. Once the Village of Larchmont approves their resolution, Mr. Maker will bring a resolution before the Town Board for approval. Sanitation Building Mr.Altieri explained that the Village of Larchmont continues to have concerns for the placement of the new Sanitation Building with respect to its location and the Village's Water Tanks. The Town will be moving the Sanitation Building back to its original site which is the current location of the temporary trailers. On this evening's agenda is an authorization to proceed with the redesign. Parking—Washington Square As has been previously explained by the Town Clerk,the Area Business parking permits on Maxwell Avenue continue to be undersold. It is the recommendation of the Town Clerk and Town Administrator that the permit requirement for these spaces be removed. The long term meters will remain. Gardens' Lake Mr.Altieri advised the Board that the Town has received approval from the Department of Environmental Conservation to remove and relocate the fish from the lake while the construction is taking place. This will take place thru a form of'zapping',where essentially the fish go to sleep and are moved to the other side of the pond. A good chuckle was had by all. Correspondence—Robert Freeman,Committee on Open Government The Town Board reviewed a letter from Robert Freeman of the Committee on Open Government. The letter was in response to correspondence he received from Brian Lobel. Mr. Maker commented that he was comforted by the letter from Mr. Freeman. 1 July 14, 2010 Request—Long Island Fiber Exchange The Town has received a request from Long Island Fiber exchange to install fiber optic cable. There was a recent meeting with the Town Attorney,Town Administrator,Town Comptroller and the President of Long Island Fiber Exchange. Currently,this company has an agreement with Verizon and Con Edison to attach cabling to the utility poles. It appears they are not required to pay the Town a franchise fee, but are willing to discuss some form of payment,or in-kind services. Mr. Maker and Mr.Altieri will continue to evaluate any continued discussions and keep the Board apprised. New York State Retirement Incentive Program The Board reviewed a summary of the provisions of the New York State Retirement Incentive Program. The Town is still assessing the feasibility of the incentive and will have a final recommendation at the August Town Board Meeting. Miscellaneous Updates The Supervisor reported that she recently met with the Town Police Chief and asked him for an analysis with respect to the consolidation of the detective units. Supervisor O'Keeffe asked Mayor Mandel of the Village of Larchmont for a similar analysis. The Town has been asked by the City of New Rochelle for a recommendation from the Town for an individual to sit on the Advisory Committee for David's Island. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:15 PM, she then pointed out the location of exits. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe then on motion of Commissioner Seligson, seconded by Commissioner Wittner,the Board of Fire Commissioners was unanimously declared open. The report of bids for Contract TA-10-07 Heavy Duty Rescue Fire Apparatus is entered into the record as: Attachment A On motion of Commissioner Wittner,seconded by Commissioner Seligson,the following was approved WHEREAS,on June 9,2010,the Town publicly opened and read two(2) bids for Contract TA-10-07 Heavy Duty Rescue Fire Apparatus. Approval-Sanitation Building Re-design On motion of Councilman Odierna,seconded by Councilwoman Seligson,the following was unanimously approved WHEREAS,the Town of Mamaroneck has prepared site plans for the construction of a new Sanitation Building to replace the temporary trailers that currently exist, and 10 July 14, 2010 WHEREAS,the new Building was designed to be located on an alternative site than the existing temporary trailers,and WHEREAS,the Village of Larchmont has objected to the proposed site for the Sanitation Building due to its proximity to the Village's water tanks,and WHEREAS,the Town of Mamaroneck has agreed to move the location of the new Sanitation Building to the current site of the temporary trailers. NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby authorize Calgi Construction to proceed with the re-design of the Sanitation Building,and BE IT, FURTHER RESOLVED,that the Mamaroneck Town Board does hereby authorize the Town administrator to issue bids for the re-design. APPROVAL OF MINUTES—June 16, 2010 On motion of Councilwoman Seligson,seconded by Councilwoman Wittner,it was Unanimously RESOLVED,that the Mamaroneck Town Board does hereby approve the Board Minutes from the meeting of June 16,2010. ORAL COMMUNICATIONS Bryan Rohman,of the Larchmont Gardens'Civic Association addressed the Board. He noted the start of the Gardens' Lake Project,adding the letter sent by the Town notifying residents was very helpful. Mr. Rohman gave the Board Members a series of photo's denoting various trees in the 'Brook'area in need of attention. The Town responded that these trees will be looked at immediately. Mr.Altieri noted that any tree issues can be brought directly to the attention of the Highway Department,as this would be the most expeditious way to have the Town look at any potentially hazardous trees. WRITTEN COMMUNICATIONS None SUPERVISOR'S REPORT Supervisor O'Keeffe noted her recent return from a family trip to Canada. Yesterday she met with the County of Westchester regarding legislation being introduced by the County Board of Legislators with respect to storm water management and flood mitigation.The County Planning Board is trying to map the County into six major drainage basins or watershed districts.Supervisor O'Keeffe noted Councilwoman Wittner's attendance at this meeting as a representative of Long Island Sound Watershed Intermunicipal Council(LISWIC). The County is introducing legislation that will enable the watershed districts to finance mitigation. The County complemented LISWIC as clearly being on the forefront of this issue. Supervisor O'Keeffe asked Councilwoman Wittner about her report. REPORT OF COUNCIL Councilwoman Wittner began by stating that the Long Island Sound Watershed Intermunicipal Council was comprised of twelve(12) municipalities who have been working for a number of years on Inter- municipal cooperation; knowing that working together is the only effective way to control flooding and improve water quality. LISWIC proposed legislation that required State approval for the establishment of 11 July 14, 2010 watershed districts,that languished at the NYS level. County Legislators Thomas Abinanti and Judy Myers, have developed legislation at the County level that includes numerous concepts proposed by LISWIC. Municipalities would have to develop stormwater management plans,adopt pertinent legislation and other criteria to be reviewed by an intermunicipal council before submission to the County for approval and funding. Councilwoman Wittner read the following: It was with great sadness that I read the obituary for Dr. Paul Steineck, Professor of Environmental Science and other scientific subjects at SUNY Purchase. Those of us who were involved in environmental issues in the 1970's thru the 90's, remember his research studies with his colleague, Dr.James Utter,also Professor at SUNY Purchase. The research studies published in 1975,were of the salt marshes at the Premium River, Hommocks and Greacen Point in the Village of Mamaroneck,which pointed out the need to expand the latter marsh. These studies and work done by our Tri-Municipal Conservation Advisory Commission led to the adoption in 1976 of Freshwater Wetlands Lawns in the Town and Village of Larchmont and Village of Mamaroneck. Dr.Steineck's and Dr. Utter's studies and lectures provided the best illustration that the Hommocks marsh is a study of marsh succession in progress. It has channel mud flats, low marsh, high marsh and uplands which include the 6.74 acre segment of the Hampshire Country Club Golf Course. Dr.Steineck also led frequent early morning bird walks. This was an active time for those of us with dedicated environmental interests. Paul Steineck's wife, Barbara Dexter,who was also teaching at SUNY Purchase,was the originator of Project Riverwatch,a volunteer based analysis of freshwater quality and water pollution in streams and rivers throughout Westchester County that flowed into Long Island Sound,which was done by walking and observing the waterways. She mentored our group of volunteers walking the Sheldrake River and was a strong advocate for Friends of the Reservoir in the 1990's. Councilman Odierna noted the joyous occasion of the Firemen's Parade on June 30. It was truly a great and well attended event.The Memorial Park concerts are in full swing. The Planning Board met this evening,so Councilman Odierna was unable to attend but noted some of the items on their agenda.Their agenda included 77 Cooper Lane, Bonnie Briar tree removal,Avon Road and the proposed Petco. Councilman Odierna will attend the Board of Architectural Review next Wednesday. Councilman Fishman attended the Zoning Board of Appeals Meeting,where some of the same items, specifically the issue of off street parking. The Housing Authority was pushed back to the end of July. LMC- TV Board of Control will meet next week. Councilwoman Seligson attended the Human Rights Committee Meeting on June 21,where they discussed their future goals. On June 22,2010 the Fire Department Bond Referendum for Fire Apparatus was held and approved. Councilwoman Seligson attended the Traffic Committee Meeting on June 23. Supervisor O'Keefe announced the upcoming C.A.P Center's Tag Sale and Raffle Fundraiser being held on Sunday,July 18 at 10AM thru 4PM. Mr. Maker noted the passing of long time resident,colleague and friend, Mr.Alan J. Flood. The Board gave Mr. Maker condolences on the passing of his mother-in-law, ADJOURNMENT Supervisor O'Keefe noted the passing of a Town resident John S.Whiteman,a WWII Veteran. He was a B-17 Bomber Pilot in the U.S.Air Force from 1941-1945. He was shot down behind enemy lines, but managed to skillfully land his plane in a field behind enemy lines. He was able to evade the Germans and find friendly citizens who gave him refuge. Supervisor O'Keefe posthumously thanked John Whiteman for his service to our Country and sends condolences to his family. On motion of Supervisor O'Keeffe,seconded by Councilwoman Wittner the meeting was unanimously adjourned at 10:10 PM.
