BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M.O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Wittner,seconded by Councilwoman Seligson the Work Session was unanimously opened at S:OOPM. Parking in the Washington Square Area The Town Clerk reported that her office is undersold for Area Business Parking Permits. The Board discussed various options,one being to turn these spaces into unpermitted long term parking. The Town Clerk was instructed to contact the area businesses to inform them of this potential change. Amend Tree Law The Board discussed whether the current Law should be amended. The Board discussed the half acre requirement needed to cut down trees suggesting that any tree over a certain size,on any size lot should receive a permit to be removed. Mr. Maker will draft an amendment for the Board to review and discuss. Proposed Local Law—Zoning Amendment Residential District The current Local Law,enacted in 1960,with respect to Over Night Parking on Residential Property is significantly outdated. Currently,a very large percentage of residents are in violation of this Law. As Mr. Maker explained, this law was enacted at a time when it was less common for households to have more than one car, as well as being able to park vehicles in a garage or 25 feet from the home's front lot line. It is now common for households to have multiple cars, and or impossible to park all of them in a garage or more than 25 feet from the home's front lot line. The Board feels this Law should be amended; a Public Hearing will be set at this evening's regular meeting. 1 JUNE 2, 2010 Zoning Law—Wooden Decks As Liaison to the Zoning Board, Mr. Fishman has been asked by the Zoning Board for the Town to readdress the issue of lot wooden decks and their impact on lot coverage. Mr. Maker will go back and review his previous notes on this subject and have something for the Board to review for a future Work Session. Resignation—Traffic Committee It was reported that Barbara Spiridon has resigned from the Traffic Committee. The Board reviewed the recommendation by Councilman Odierna to replace Ms.Spiridon with Robin Gensburg. The Board reviewed Ms. Gensburg's resume. This item will be added to this evening's agenda. Follow up to the comments made by Antonio Anselmo at the Town Board Meeting of May 5,2010. Steve stated that he and Jill Fisher have discussed redoing the signage at Hommocks field. Parking Enforcement Councilwoman Wittner asked Mr.Altieri to have the police enforce the one hour parking on Boston Post Road near the Mercedes dealership. Mr.Altieri reminded the Board that they had previously approved a parking enforcement officer in the amount of$15,000. At the next meeting he will have paperwork for this approval. Scarsdale Board of Assessment Review— proposed IMA The Town has recently been contacted by the Village of Scarsdale to enter into an Intermunicipal Agreement whereby the Town of Mamaroneck's Board of Assessment Review will hear an assessment grievance by a Member of Scarsdale's Board of Assessment Review. Municipal Law allows for this type of agreement.This item was added to this evening's agenda Village owned property in the Town of Mamaroneck—Byron Place The Village of Larchmont has approached the Town regarding the tax on the Village owned property located on Byron Place in the Town of Mamaroneck. This property houses the Village's Water Tanks. Previously,it was the understanding of both municipalities that taxes could not be waived. The Village has researched this and found a law from 1968 allowing tax exemption status for this property. Discussions continue with the Village of Larchmont. Village of Larchmont Water Tanks—Town (new)Sanitation Building The Village of Larchmont is concerned with the close proximity of the proposed new Town Sanitation Building with respect to the Village's Water Tanks. The Town has proposed creating a slender access way alongside the building,versus moving the building site. If the building site must be moved the Town would incur additional site plan costs. Supervisor O'Keeffe entered the Work Session at 6:15.She was given an update on the previous discussions. 2 JUNE 2, 2010 Update Human Rights Committee Supervisor O'Keeffe stated that the Committee will be meeting soon to discuss moving this committee forward,as well as addressing the lack of a current Chairperson. Boards and Commissions The Board stated their strong dissatisfaction with the current alterations to the Nautilus Diner and the High Tech Car Wash. They also discussed the difficulty applicants sometimes find by having to appear before multiple boards.They would also like the Board of Architectural Review(BAR)to be more stringent in their adherence to the Town's Zoning Laws. The Board discussed the City of New Rochelle's'model',whereby all Zoning applications are reviewed by a hired architect/consultant,as well as the Planning Board. The City of New Rochelle does not have a BAR. On motion of Supervisor O'Keeffe,seconded by Councilwoman Seligson the Board unanimously agreed to enter into Executive Session to discuss Collective Bargaining with the CSEA. EXECUTIVE SESSION Collective Bargaining—CSEA On motion of Councilwoman Wittner,seconded by Councilwoman Seligson,the Board unanimously agreed to reenter Work Session. Board of Assessment Review Mr.Altieri noted that Jaine Eney will meet with the Board of Assessment Review to do an informal training session. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:45 PM, she then pointed out the location of exits. PUBLIC HEARING —WATER DISTRICT IMPROVEMENTS The following Notice of Public Hearing is entered into the record as follows: 3 JUNE 2, 2010 NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the Town Board of the Town of Mamaroneck, Westchester County, New York, will meet in the Town Hall, in Mamaroneck, New York, in said Town, on June 2, 2010, at 8:15 o'clock P.M., Prevailing Time, for the purpose of conducting a public hearing upon a certain map, plan and report, including an estimate of cost, in relation to the proposed increase and improvement of the facilities of Water District No. 1, in said Town, being the construction of improvements to and reconstruction of the water supply, filtration and distribution system, including incidental improvements and expenses in connection therewith, at a maximum estimated cost of $1,550,000. It has been determined that said project is a TYPE II Action under the regulations promulgated under the State Environmental Quality Review Act and SEQRA compliance materials are available for inspection at the Office of the Town Clerk where they may be inspected during normal business hours. At said public hearing said Town Board will hear all persons interested in the subject matter thereof. Dated: Mamaroneck, New York, May 22,2010. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK,WESTCHESTER COUNTY, NEW YORK Christina Battalia Town Clerk Mr.Altieri explained that during previous meetings the Town Board has discussed at length the capital projects for the Water District.They include$900,000 for the design and engineering expenses associated with the original design of the water filtration plant at Rye Lake,$320,000 for the design of a possible filtration alternative and $330,000 for the Lundy Lane Water Main. On motion of Councilwoman Wittner,seconded by Councilwoman Seligson,the Public Hearing was unanimously opened. Supervisor O'Keeffe asked if anyone wished to comment on the proposed bonding. Councilwoman Seligson reminded residents that water is an expensive commodity—to carry it and provide it. On motion of Councilwoman Wittner,seconded by Councilwoman Seligson,the Public Hearing was unanimously closed. On motion of Councilwoman Wittner,seconded by Councilman Fishman,the following was approved: 4 JUNE 2, 2010 In the Matter PUBLIC INTEREST ORDER of The Increase and Improvement of Facilities of Water District No. 1 in the Town of Mamaroneck, Westchester County, New York WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York, has caused to be prepared a map, plan and report, including an estimate of cost, pursuant to Section 202-b of the Town Law, relating to the increase and improvement of the facilities of Water District No. 1, in the Town of Mamaroneck, Westchester County, New York (the "Water District"), being the construction of improvements to and reconstruction of the water supply, filtration and distribution system, including incidental improvements and expenses in connection therewith, at a maximum estimated cost of $1,550,00,and WHEREAS, at a meeting of said Town Board duly called and held on May 19, 2010, an Order was duly adopted by it and entered in the minutes specifying the said Town Board would meet to consider construction of improvements to and reconstruction of the water supply,filtration and distribution system, including incidental improvements and expenses in connection therewith of Water District No. 1 in said Town, at a maximum estimated cost of$1,550,00, and to hear all persons interested in the subject thereof concerning the same at the Town Hall, in Mamaroneck, New York, in said Town, on June 2, 2010 at 8:15 o'clock P.M., Prevailing Time; and WHEREAS, said Order duly certified by the Town Clerk was duly published and posted as required by law; and WHEREAS, a public hearing was duly held at the time and place set forth in said notice, at which all persons desiring to be heard were duly heard;NOW,THEREFORE,BE IT ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. Upon the evidence given at the aforesaid public hearing, it is hereby found and determined that it is in the public interest to make improvements to Water District No. 1, in the Town of Mamaroneck, Westchester County, New York, consisting of the increase and improvement of the facilities of Water District No. 1, in the Town of Mamaroneck,Westchester County, New York(the "Water District"), being the construction of improvements to and reconstruction of the water supply, filtration and distribution system, including incidental improvements and expenses in connection therewith, at a maximum estimated cost of$1,550,00. Section 2. This Order shall take effect immediately. A RESOLUTION AUTHORIZING THE ISSUANCE OF$1,550,000 BONDS OF THE TOWN OF MAMARONECK,WESTCHESTER COUNTY, NEW YORK,TO PAY THE COST OF THE INCREASE AND IMPROVEMENT OF WATER DISTRICT NO. 1, IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK. WHEREAS, the capital project hereinafter described has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed,will not result in any significant environmental effects; and WHEREAS, pursuant to the provisions heretofore duly had and taken in accordance with the provisions of Section 202-b of the Town Law, and more particularly an Order dated the date hereof, said Town Board has determined it to be in the public interest relating to the increase and improvement of the facilities of Water District No. 1, in the Town of Mamaroneck, Westchester County, New York (the "Water District"), being the construction of improvements to and reconstruction of the water supply,filtration and distribution system, including incidental improvements and expenses in connection therewith, at a maximum estimated cost of$1,550,00; NOW,THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. For the specific object or purpose of paying the cost of the increase and improvement of the facilities of Water District No. 1, relating to the increase and improvement of the facilities of Water District No. 1, in the Town of Mamaroneck, Westchester County, New York (the "Water District"), being the construction of improvements to and reconstruction of the water supply,filtration and distribution system, including incidental improvements and expenses, as well as original furnishing, equipment, machinery and apparatus, as well as incidental costs and expenses in connection therewith, at a maximum estimated cost of $1,550,000, there are hereby authorized to be issued $1,550,000 bonds of said Town pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the plan for the financing of said specific object or purpose is by the issuance of the $1,550,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. To the extent not paid from monies raised from said Water District No. 1 as applicable in the manner provided by law, there shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor,consistent with the provisions of the Local Finance Law. 6 JUNE 2, 2010 Section 6. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as she shall deem best for the interests of said Town, including, but not limited to, the power to sell said bonds to the New York State Environmental Facilities Corporation; provided, however, that in the exercise of these delegated powers, the Supervisor shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 7. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Supervisor, the chief fiscal officer of such Town. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals,in addition to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine consistent with the provisions of the Local Finance Law. Section 8. The Supervisor is hereby further authorized, at his or her sole discretion,to execute a project finance and/or loan agreement, and any other agreements with the New York State Department of Health and/or the New York State Environmental Facilities Corporation, including amendments thereto, and including any instruments (or amendments thereto) in the effectuation thereof, in order to effect the financing or refinancing of the specific object or purpose described in Section 1 hereof,or a portion thereof, by a bond, and/or note issue of said Town in the event of the sale of same to the New York State Environmental Facilities Corporation. Section 9. The power to issue and sell notes to the New York State Environmental Facilities corporation pursuant to Section 169.00 of the Local Finance Law is hereby delegated to the Supervisor. Such notes shall be of such terms, form and contents as may be prescribed by said Supervisor consistent with the provisions of the Local Finance Law. Section 10. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money,or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication,or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 11. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 12. This resolution, which takes effect immediately, shall be published in summary form in the official newspaper, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. AFFAIRS OF THE TOWN 1. PHASE II STORM WATER REPORT The Town Board reviewed the Report sent each year to the Department of Environmental Conservation. It is prepared by Liz Paul,the Town's Environmental Planner. 2. REPORT OF BIDS—TA-10-01-A RESTORATION OF GARDENS' LAKE Mr.Altieri stated that this is the second report of bids for this project,as the first was rejected due to it being well above the proposed estimates. Modifications were made to the dredging and dewatering methods and sent out for rebidding. On motion of Councilman Odierna,seconded by Councilwoman Wittner,the following was approved; WHEREAS,on May 26,2010 the Town publicly opened and read nine(9) bids for Contract TA-10-01-A Gardens' Lake Restoration Project. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby award Contract TA-10-01-A Gardens Lake Restoration Project,to the lowest responsible bidder,Galvin Bros.Construction, of Great Neck, NY at a total cost of 1,072,486.00. REFERRAL TO PLANNING BOARD: AMENDMENT ZONING CODE "OFF-STREET PARKING IN RESIDENTIAL DISTRICTS" Mr.Altieri explained that the Town has been working on amending this Zoning Law for some time.This Local Law is significantly outdated, but difficult to rewrite. The Planning Board has reviewed several redrafts and has sent their comments to the Town Board. Mr. Maker has drafted another version of this Law incorporating the comments and concerns of the Planning Board. The Town at this time would need to refer this redraft to the Planning Board for their comments as well as set a Public Hearing. On motion of Councilwoman Wittner,seconded by Councilman Fishman,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby refer the proposed Zoning Law"Amendment of Off-street Parking in Residential Districts"to the Planning Board for their advisory opinion. 4. SET PUBLIC HEARING—AMENDMENT ZONING CODE"OFF-STREET PARKING IN RESIDENTIAL DISTRICTS" On motion of Councilman Fishman,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the Proposed Zoning Law"Amendment of Off-street Parking in Residential Districts"for August 11,2010 at 8:15 in the Court Room of the Town Center,and BE IT FURTHER, RESOLVED,that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper,and that said notice, be posted. 5. SALARY AUTHORIZATIONS HIGHWAY DEPARTMENT On motion of Councilwoman Wittner,seconded by Councilman Fishman,it was RESOLVED,that as provided for in the 2010 Town Budget the Town Board does hereby re-authorize Joseph Giordano as a part time summer laborer with the highway Department,effective June 1,2010 through August 13, 2010 at an hourly rate of$12.00. 10 JUNE 2, 2010 The above resolution NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby appoint Jennifer Jordan Conley,as a Member of the Larchmont Library Board of Trustees,and 14 JUNE 2, 2010 BE IT, FURTHER RESOLVED,that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on May 31,2015. INTER-MUNICIPAL AGREEMENT WITH SCARSDALE — GRIEVANCE FOR MEMBER OF BOARD OF ASSESSMENT Mr.Altieri explained that the Town has been contacted by the Village of Scarsdale to enter into an Intermunicipal Agreement whereby the Town of Mamaroneck's Board of Assessment Review will hear an assessment grievance by a Member of Scarsdale's Board of Assessment Review. Municipal Law allows for this type of agreement. On motion of Councilwoman Wittner,seconded by Councilwoman Seligson,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby approve of an Inter- municipal Agreement between the Village of Scarsdale and the Town of Mamaroneck, whereby the Town of Mamaroneck's Board of Assessment review will hear the tax grievance of a Village of Scarsdale Board of Assessment Member,subject to drafting by the Town of Mamaroneck Attorney,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. 15 JUNE 2, 2010 APPROVAL OF MINUTES—May 5, 2010 On motion of Councilwoman Seligson,seconded by Councilwoman Witmer,it was Unanimously, RESOLVED,that the Mamaroneck Town Board does hereby approve the Board Minutes from the Meeting of May 5,2010. ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Odierna stated he was away in the Berkshires last week, but did manage to attend a few events and meetings. Councilman Odierna attended the Hispanic Resource Center opening,adding how wonderful it was to see so many people from the community attending. Supervisor O'Keeffe interjected saying how invaluable the Hispanic Resource Center has become to the community. After the 'flood'they became a mini social service-she just can't say enough about them. Councilman Odierna continued by stating his attendance at the Planning Board Meeting. The Planning Board Discussed signage for the proposed PETCO at the site of the previous Duane Reade,as well as signage for the High Tech Car wash on Boston Post Road.Councilman Odierna reminded residents of the upcoming Harbor Fest this Saturday,June 6.The venue has been moved back to the 'Avenue',adding this is a wonderful community event. Councilman Odierna attended the Village of Mamaroneck's Memorial Day Parade and the Veterans of Foreign War Memorial Ceremony at Tompkins Square Park on Monday morning. Tomorrow Councilman Odierna will attend the Chamber of Commerce Meeting,adding what a fine job Ms.Graziano is doing as President. SUPERVISOR'S REPORT Supervisor O'Keeffe gave a full report of all the Memorial Day events of which she attended seven, beginning with the Village of Larchmont Parade and ending at Tomkins Square Park on Monday morning. She was very proud to be representing the Town of Mamaroneck at these events. Councilwoman Seligson attended the Village of Larchmont Parade on Thursday and the Tomkins Square Park services on Monday morning.She was away in the middle of the weekend celebrating the 801" birthday of her father. Councilman Fishman congratulated the baseball team for a great run.
