BOSTON POST ROAD, MAMARONECK, NEW YORK. PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Nancy Seligson Councilman David J. Fishman ABSENT: Councilman Ernest C. Odierna ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney WORK SESSION On motion of Councilwoman Wittner, seconded by Councilman Fishman, the Board unanimously agreed to enter into Executive Session to discuss Collective Bargaining. EXECUTIVE SESSION Collective Bargaining On motion of Councilwoman Seligson, seconded by Councilman Fishman, the Board unanimously agreed to resume Work Session. Report from Police Chief Richard Rivera Chief Rivera gave the Board an update on the recent auto break-ins. 2009 Budget Anthony Siligato, the Town Comptroller was present. Mr. Altieri asked the Board if they had any comments before this evening's vote on the Proposed 2009 Budget. Supervisor O'Keeffe asked Mr. Altieri to clarify the $1,000.00 that is in the Budget for the project at the Mamaroneck Library. Mr. Altieri reminded the Board that these were for funds asked for by the Mamaroneck Library, to help with the cost of scanning and digitizing of the Daily News. Supervisor O'Keeffe asked for a vote to approve these funds in the budget. On motion of Councilwoman Seligson, seconded by Councilman Fishman, the Board unanimously RESOLVED, to retain the amount of$ 1,000.00 in the 2009 Town Budget, for the Mamaroneck Library's scanning and digitizing project of the Daily News. Mr. Siligato reported that the Mortgage Tax receipts were better than expected for 2008. Section 8 , Community Services The Board reviewed a memo from the Village of Mamaroneck Manager, Leonard Verrastro, regarding administrative expenses and terms and conditions of the transfer of assets and the dissolution of the Village of Mamaroneck Housing Authority and the Village of Mamaroneck Community Services effective December 31, 2008. 1 December 17, 2008 Mr. Altieri noted there were a number of items on the agenda this evening pertaining to the food service program with the County. Property at Fifth Avenue and Madison Avenue The Board reviewed the appraised property value they received of$210,00, for the land at Madison and Fifth Avenue at$210,000.00. At this time the Board dose not see the need, to purchase this land from the County. Mr. Altieri will send and letter to the County. FEMA Grant Supervisor O'Keeffe explained that the Town has received the FEMA Flood Mitigation Grant monies in the amount of$100,000.00. Memorial Park Supervisor O'Keeffe informed the Board of herself and Councilwoman Seligson's very informative meeting with Frank White at Memorial Park. Mr. White requested a survey of the property in order for him to complete a master plan. Boards and Commissions The Board reviewed upcoming reappointments to the Town's Boards and Commissions. The Board reviewed a draft letter by Mr. Maker to the Planning and Zoning Boards explaining their requirement for four hours of course work in order to remain on these Boards. Mr. Altieri will obtain some course options that can be sent along with a letter. The letter will be sent by Supervisor O'Keeffe. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20PM she then pointed out the location of exits. PUBLIC HEARINGS—2009 Preliminary Budget The following notice of Public Hearing was entered into the record: PUBLIC HEARING —2009 Preliminary Budget December 3, 2008, to reconvene on December 17, 2008 PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck, New York on Wednesday, December 17, 2008 at 8:15 PM in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck, New York to consider the Town of Mamaroneck's Preliminary Budget for the calendar year commencing January 1, 2009 and ending December 31, 2009. All citizens are invited to attend and provide the Board with written and oral comments and ask questions concerning the preliminary budget. The entire preliminary budget can be inspected by the public from 8:30 AM to 4:30 PM, beginning Monday, December 1, 2008, in the Town Clerk's Office, Town Center, 740 West Boston Post Road, Mamaroneck, New York. Copies of the Preliminary Budget will also be available at the Town Clerk's Office. PLEASE TAKE FURTHER NOTICE, that the proposed salaries of the members of the Town Board are as follows: Supervisor $37,500; Town Council (4) $6,000 each and the proposed salary for the Town Clerk is $82,000 and the Town Justices (2) $21,000. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: November 26, 2008 2 December 17, 2008 On motion of Councilman Fishman, seconded by Councilwoman Seligson, the Public Hearing was reopened. Supervisor O'Keeffe asked Mr. Altieri to reiterate the highlights of the Preliminary Budget that were presented in his `Power Point' presentation at the December 3rd Public Hearing. Supervisor O'Keeffe asked the Board members for their comments, prior to a vote. Councilwoman Wittner thanked Mr. Altieri, Tony Siligato and all the Department Heads for their hard work. She noted that there are no cutbacks in services, while still keeping up with infrastructure. Councilwoman Seligson commented that this was a responsible Budget, the lowest since she has been on the Board. This is not difficult due to the good financial situation the Town is in. She thanked Mr. Altieri and Mr. Siligato for their hard work. Councilman Fishman commented that the Board has not received input from the Public that they would like to see cuts in services. He is disappointed in the limited public input during the budget process. This is a responsible Budget, adding the Town has kept the revenue lines conservative. Supervisor O'Keeffe read from the comments of Councilman Odierna, that if he was able to be in attendance, he would vote yes for the Budget. Supervisor O'Keeffe stated she was very happy with the Budget, adding it is the lowest she has seen since before becoming Supervisor. She emphasized the Board's policy of slow and steady increases, not a spike budget policy. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the following was approved, WHEREAS, on October 15, 2008, the Budget Officer submitted to the Town Clerk and the Town Board the Tentative Budget for 2009, and WHEREAS, on October 29, November 7, November 12, and November 18 of 2008 the Town Board held public work sessions to consider amendments and changes to the Tentative Budget, and WHEREAS, on December 3, 2008 and December 17, 2008, the Town Board held Public Hearings on the Preliminary Budget for 2009. NOW THEREFORE, BE IT RESOLVED, that the Town Board does hereby convert the 2009 Preliminary Budget, to the 2009 Final Operating Budget for the Town of Mamaroneck, and hereby adopts it. AFFAIRS OF THE TOWN 1. Adoption of 2009 Town Budget The approval of the Proposed 2009 Budget took place during the Public Hearing (see above) 2. Transfer of Funds—Town Court Grant On motion of Councilman Fishman, seconded by Councilwoman Seligson, the following was unanimously approved, WHEREAS, the Town has been awarded two New York State Office of Court Administration Grants, totaling $36,542.92, for improvements to the Town Court, and WHEREAS, these grant funds will be used to make the following upgrades to the Town Court: Installation of Video/Audio Equipment Upgrade Court Room Lighting Install Security Chair Clamps as recommended by the Office of Court Administration Install enhanced signage for the Court Room Purchase office equipment NOW THEREFORE, BE IT 5 December 17, 2008 RESOLVED, that the Town Board does hereby authorize the Town Comptroller to establish Capital Project #28-04 — Justice Court Equipment, and BE IT, FURTHER RESOLVED, that the Town Comptroller is further authorized to transfer the Grant funds from Revenue Account H.3999 to the Capital Project Account H.1997.1110.5001. 3. Authorization — Renewal of Retainer—Town Auditors Deferred until January 7, 2009 4. Authorization — Housing Inspector Contracts On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the following was approved WHEREAS, as part of the certification process for the Section 8 Housing Voucher Program is the inspection of housing units contracted in the program, and WHEREAS, the Town will retain an independent contractor, as an economical approach, to perform these inspections. NOW, THEREFORE, BE IT RESOLVED, that the Town Board does hereby approve the `blanket' agreement, as drafted by the Town Attorney, to be used for the contracted inspectors as they become available, and BE IT, FURTHER RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Administrator to execute said agreements as they become written and entered into, on behalf of the Town. Authorization —Westchester County Contracts — Community Services On motion of Supervisor O'Keeffe, seconded by Councilwoman Wittner, it was unanimously RESOLVED, that the Town Board does hereby authorize the Town Administrator to execute and deliver to the Westchester County Department of Health, for and on behalf of the Town of Mamaroneck, an application for a permit to operate a Meals on Wheels Program, and BE IT, FURTHER RESOLVED, that that the Town Board does hereby authorize the Town Administrator to execute and deliver to the Westchester County 6 December 17, 2008 Department of Health, for and on behalf of the Town of Mamaroneck, an application for a permit to operate a Senior Center Nutrition Program. 6. Authorization — Hubbard Cubbard Contract— Lou's Lunch On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the following was approved WHEREAS, with the consolidation of the Village and Town Senior Citizen Programs the Town is preparing to provide meals for the Senior Citizen Center and Meals on Wheels Program, and WHEREAS, currently the Village of Mamaroneck has contracts with Hubbard Cubbard to provide meals at the Senior Center and Lou's Lunch for the Meals on Wheels Program, and WHEREAS, as an interim measure, until the Town and Westchester County complete a formal bid document, the Town wishes to enter into agreements with Hubbard Cubbard and Lou's Lunch , to provide meals for the Senior Citizen Center and Meals on Wheels. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Administrator to enter into contracts with Hubbard Cubbard and Lou's Lunch on behalf of the Town. Authorization -- Senior Center Trust Fund On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following was approved WHEREAS, as part of the overall consolidation of the Village of Mamaroneck and the Larchmont-Mamaroneck Senior Program it is necessary for the Town to establish a Town of Mamaroneck Senior Center Trust Account to handle the Larchmont Senior Center Trust currently held within the Village of Larchmont Accounts. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Comptroller to establish a Town of Mamaroneck Senior Center Trust Fund. Chatsworth Avenue commending the Fire and Police Department's for their handling of the fire at 21 N. Chatsworth Avenue. SUPERVISOR'S REPORT Supervisor O'Keeffe noted that the Village of Mamaroneck, will hold a presentation of the Town of Mamaroneck's Revaluation Report and Forum with Tom Frey, the Town of Mamaroneck Consultant, at their Board of Trustees Meeting on January 12, 2009. Supervisor O'Keeffe and her fellow officials collected phone cards for Soldiers - $3,000.00 in cards were sent abroad. She noted the generosity of the Nights of Columbus, the American Legion and the VFW. She wished Councilman Odierna, who is home recovering from knee surgery, a quick recovery. REPORT OF COUNCIL Councilwoman Wittner noted the many events she and her fellow Board Member's attended. The Larchmont Gardens' Civic Association's Tree Lighting, the Fire Council Meeting at which the Town presented Citations to the Department. Councilwoman Seligson attended the Planning Board Meeting. She also added the Town Holiday Party to the list of events the Board Members attended. Councilman Fishman noted the in person Little League sign up will be held on January 10, 2009.
