BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney WORK SESSION Proposed Zoning Amendment—Arthur Wexler, Chair Zoning Board of Appeals (ZBA) Mr. Wexler addressed the Board with concerns the ZBA has with the proposed Local Law "Clarification of Lot Coverage and Setbacks for Certain Improvements". After some discussion Mr. Maker was asked to review the proposed Local Law and consider revisions. Review of 2008 Financial Report Tony Siligato, Town Comptroller presented a 6 month financial report for 2008 with an updated format to the Board. The Board discussed the report and made comments regarding its content and format. Independent Financial Audit— Fiscal 2007 Domenick Consolo, of Bennett Kielson was present to review the Independent Financial Audit his firm has prepared. Mr. Altieri noted that this report is a few months later than usual due to the change in the position of Town Comptroller. Mr. Consolo noted key financial highlights for the fiscal year 2007 reported as follows: • On the government-wide financial statements, the assets of the primary government, which is reported separately from the component unit for which the Town is financially accountable, exceeded its liabilities at the close of the most recent fiscal year by $27,981,898. Of this amount, $6,024,591 is unrestricted and may be used to meet the Town's ongoing obligations to citizens and creditors. • As of the close of the current fiscal year, the Town's governmental funds reported combined ending fund balances of$12,150,027, an increase of$3,102,828 from the prior year. Exclusive of the Capital Projects Fund, the combined ending fund balances were $12,289,205, of which the total unreserved fund balance was $1 1,262,434 at December 31, 2007. • At the end of the current fiscal year, unreserved fund balance for the General Fund was $6,535,772 or 88% of total General Fund expenditures and other financing uses. • The Town retired $1,510,000 of general obligation debt and issued $3,838,000 new general obligation debt during the year ended December 31, 2007. In addition, the Town retired $2,277,000 of short-term debt obligations in the form of bond anticipation notes. Overall, combined long-term and short-term debt obligations of the Town increased $51,000 to $12,576,000 for the period ending December 31, 2007. 1 AUGUST 6, 2008 Property Revaluation Study as prepared by Frey Appraisal & Consulting Services, Inc. The Board noted the 2"d version of the report as being greatly improved and much more informative than the 1St draft. The Board reviewed specifically how a potential revaluation would be presented to the Town residents; agreeing that an extensive public relations campaign would need to be in place. The Board discussed the goals of revaluation and key areas for public relations. The Board would like to meet with consultants of Frey Appraisal Services in September and in October begin outreaching to the community. The Board would also like to meet with representatives from the State, for assistance in educating the public Traffic Committee Recommendations The Board discussed the recommendations, specifically the Myrtle Blvd and N. Chatsworth intersection. They will set a public hearing at the Regular Meeting. Councilman Odierna asked Mr. Altieri to review the no parking regulation on Eton Road. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the Board unanimously agreed to enter into Executive Session, to discuss Employment History, Certiorari, Litigation and Collective Bargaining. EXECUTIVE SESSION Employment History Certiorari Litigation Collective Bargaining CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:45 PM she then pointed out the location of exits. PUBLIC HEARINGS — 1. Moratorium on the Installation of Large Propane Tanks 2. Amendment to Parking Regulations- New Jefferson Street MORATORIUM ON THE INSTALLATION OF LARGE PROPANE TANKS The following notice of Public Hearing was entered into the record: NOTICE OF PUBLIC HEARING Adjourned 6/18/08 and 7/9/08, & 8/6/08 PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on August 6, 2008, at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled "Moratorium on the Installation of Large Propane Tanks" Law. Purpose Over the Memorial Day weekend, a leaking underground propane tank was detected. Due to the professionalism of the Town's personnel, the propane tank was emptied and the leaking gas burned off without injury either to person or property. If this corrective action had not been taken, the tank may have exploded and caused damage not only to the home on which the tank was installed but to neighboring properties and people as well. Because of the poor condition of the tank, it took over 24 hours for the gas to be burned off. Throughout this time, Town personnel were required to remain on site, causing the Town to incur thousands of dollars in overtime compensation. The cost would have been even higher had not so many of the responders been volunteers willing to sacrifice their time on a holiday weekend. 2 AUGUST 6, 2008 This incident has alerted the Town Board to the necessity of examining the use of propane and other hazardous substances within the Town, and if warranted, developing regulations to control such use and a procedure for recovering the cost incurred by the Town for responding to the discharge of propane or other hazardous substances within the Town. In order to study the issue, the Town Board has determined that it is necessary to impose a moratorium upon the installation of propane tanks with a capacity for 50 or more pounds of propane. The full text of this Local Law may be examined and copies obtained at the Town Clerk's office during regular hours (Monday through Friday, 8:30 AM to 4:30 PM, or until 4:00 PM during June, July and August) at 740 W. Boston Post Road Mamaroneck, New York. PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: June 10, 2008 On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the Public Hearing was unanimously opened. Supervisor O'Keeffe asked if anyone wished to speak for or against the proposed law. Mr. Maker gave a brief history of why this Public Hearing was set, with an overview of the initial Public Hearing of this matter on July 9th. Michael DiGiorgio, of Paraco Gas Corporation, addressed the Board. He spoke of his knowledge and experience in the propane industry. He distributed copies of his resume as well as copies of the National Fire Protection Agency's (NFPA) guidelines for the installation of propane tanks. He also noted correspondence he has submitted to Mr. Maker. There was a discussion on installation procedures and inspection protocol. More frequent and elaborate inspection of tanks, versus banning of installation was discussed as a more effective way towards increasing safety. Mr. DiGiorgio recommends tanks be inspected every year, and should include a half cell inspection and meter reading. There was also a brief discussion of the tank that leaked underground this past Memorial Day causing the Town to review the installation of propane tanks. A full evaluation by Paraco Corporation of the tank that failed is not complete; therefore, Mr. DiGiorgio was unable to give a final determination for the leakage. He noted it did not rupture or crack, but rather appeared to have isolated corrosion. On motion of Councilman Odierna, seconded by Councilman Fishman, the Public Hearing was unanimously adjourned until September 17, 2008. AMENDMENT TO PARKING REGULATIONS — NEW JEFFERSON STREET The following notice of Public Hearing was entered into the record: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on August 6, 2008, at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled "Amendment to Parking Regulations — New Jefferson Street" Law. 3 AUGUST 6, 2008 Purpose: As part of the overall plan to improve parking in the Washington Square neighborhood, the Traffic Committee is recommending that the parking prohibition be limited to just one week per month. Therefore, the recommendation is to amend the ordinance to prohibit parking in the southbound direction on the third Thursday of each month and in the northbound direction on the third Tuesday of each month. The full text of this Local Law may be examined and copies obtained at the Town Clerk's office during regular hours (Monday through Friday,8:30 AM to 4:30 PM, or until 4:00 PM during June, July and August) at 740 W. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: July 19, 2008 On motion of Councilwoman Wittner, seconded by Councilman Fishman, the Public Hearing was unanimously opened. Supervisor O'Keefe asked if anyone wished to speak for or against the proposed law. Mr. Altieri stated that as part of the continued effort to create more parking spaces in the Washington Square area, the Traffic Committee has proposed this amendment be considered. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the Public Hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was unanimously RESOLVED, that the Mamaroneck Town Board finds that the adoption of the proposed Local Law regarding amendment to parking regulations on New Jefferson Street, is hereby declared to be a Type II action under the New York State Environmental Quality Review Act (SEQRA) requiring no further action. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the following was unanimously adopted: Local Law No. 6-2008 This local law shall be known as the "Restricted Parking on New Jefferson Street" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 - Purpose: The purpose of this local law is to regulate parking on New Jefferson Street. Section 2 -No Parking (a) Except on holidays, parking on the northbound side of New Jefferson Street on the third (3rd) Tuesday of each month is prohibited. (b) Except on holidays, parking on the southbound side of New Jefferson Street on the third (3rd) Thursday of each month is prohibited. Section 3—Sign(s) to be Erected and Painting to be Done: 4 AUGUST 6, 2008 An appropriate sign or signs shall be erected on and/or striping shall be painted on the surface of New Jefferson Street indicating the area where parking is prohibited. Section 4—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5— Effective Date: This Local Law shall become effective upon filing with the Secretary of State BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe and on motion of Commissioner Seligson seconded by Commissioner Fishman the Board of Fire Commissioners was unanimously declared opened. Service Awards SEE ATTACHMENT "A" AT THE END OF THE MINUTES Commissioner Wittner stated the Firefighters Assistance Training (FAST) was up and running. There are 18 members fully trained to assist fellow firefighter should they need assistance during a fire. The Department is currently looking at applying for grants for this new program. On September 17, a Department Chief will come before the Board with a Fire Department report. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Fishman, the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. Property Revaluation Study Mr. Altieri explained that the Town Board initiated a impact study for property revaluation. The first draft was received a month ago, but was sent back to the consulting firm for clarification and additional information the Board thought it should conatin. The Town Board has discussed at length how it will educate the public on a potential revaluation. The report should not be seen as an endorsement by the Town for revaluation, but rather as a means for discussing whether revaluation would benefit the Town. The report will be available on the Town web-site so residents may review its contents. 2. Re-appointments — Coastal Zone Management Commission On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was unanimously RESOLVED, that Elizabeth Cooney be reappointed to the position of Chairperson of the Coastal Zone Management Commission; and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on 8/30/2009. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was unanimously RESOLVED, that Howard McMichael be reappointed to the position of Member of the Coastal Zone Management Commission; and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on 8/30/2011. 3. Traffic Committee Recommendations On motion of Councilman Fishman, seconded by Councilwoman Wittner, it was Unanimously 7 AUGUST 6, 2008 RESOLVED, that the Town Board does hereby set the date for public hearing to consider the recommendations of the Town of Mamaroneck Traffic Committee having to do with the intersection of Myrtle Boulevard and N. Chatsworth on September 17, 2008. BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. 4. Authorization — Capital Project Replacement of Telephone System On motion of Councilwoman Wittner, seconded by Councilman Odierna, the following was approved: WHEREAS, on July 9, 2008 the Town Board granted to award a contract to CBS Technologies for the replacement of the telephone system at the Town Center, Hommocks Ice Rink, Firehouse and Highway Garage. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Comptroller to establish Capital Project 28-02, Account# H1997.1650.5001, and BE IT, FURTHER RESOLVED, that the Mamaroneck Town Board does hereby Authorize the transfer of$180,000 from the unreserved surplus of the Townwide budget to the aforementioned Capital Project The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye 5. Resolution — Consolidation of Section 8 Housing Voucher On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was WHEREAS, the Village of Mamaroneck Housing Authority voluntarily wishes to totally and permanently divest itself of the Budget Authority and corresponding baseline units of 387 Housing Choice Vouchers from the Village of Mamaroneck Housing Authority's Consolidated Annual Contributions Contract effective December 31, 2008; and WHEREAS, the Town of Mamaroneck Public Housing Agency wishes to receive the total Budget Authority and corresponding baseline units of 387 Housing Choice Vouchers from the Village of Mamaroneck Housing Authority's Consolidated Annual Contributions Contract effective January 1, 2009; and WHEREAS, The Village of Mamaroneck Housing Authority and Town of Mamaroneck Public Housing Agency agree that the total and permanent transfer of the Village of Mamaroneck Housing Choice Voucher Program to the Town of Mamaroneck Public Housing Agency will offer greater access to rental assistance for low and moderate income residents of the Town of Mamaroneck and that portion of the Village of Mamaroneck that is within Rye Town (Rye Neck), with priority to those who are elderly, disabled, veterans, victims of domestic violence, dating violence or stalking, and working families earning less than 30% of the median income of Westchester County. Approval of Court Grant On motion of Councilwoman, seconded by Councilman Odierna, the following was unanimously approved. WHEREAS, annually the New York State Office of Court Administration accepts applications for grants for local justice courts. Each year the Town has submitted an application for funding and had been approved for such things as office equipment, computers and most recently the court's metal detector. NOW THERFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck does hereby authorize the submission of a grant application in an amount not to exceed $30, 000 for funding through the New York State Justice Court Assistance Program; and BE IT FURTHER, RESOLVED, that the Town Supervisor is hereby authorized to execute the grant application. APPROVAL OF MINUTES July 9, 2008 On motion of Councilwoman Wittner, seconded by Councilman Fishman, it was unanimously, RESOLVED, that the Town Board does hereby approve the Board Minutes from the meeting of, July 9, 2008. 15 AUGUST 6, 2008 ORAL COMMUNICATIONS Abby Katz, representing the Larchmont Gardens' Civic Association, asked for an update on the train station stairwell, paving at the Brook, the Duck Pond Project and the pillars at the Myrtle Blvd entrance to The Gardens. She asked about police presence and whether anything has changed with respect to tours or posts. Mr. Altieri responded, stating the stairwell is to be installed on August 14, the sidewalks are done at the Brook with the paving to be done this month. The Duck Pond Project by the County has received Department of Environmental Conservation (DEC) and is moving forward. As for the pillars the Town will get an estimate for the work. Ms. Katz asked if the Fire Chief presentations to the Board were something new, and asked why not for the Police Department as well. WRITTEN COMMUNICATIONS Supervisor O'Keeffe read a letter from Elizabeth Covington, on behalf of the Larchmont and Mamaroneck Seniors, thanking the Board and Maria Gallagher for the terrific Barbeque they hosted for the seniors. SUPERVISOR REPORTS Supervisor O'Keeffe noted the passing of Mary Ann Marks a resident who, although had no specific role in local government, was so helpful to our community. The passing of Pat Sterbenz, the husband of Nancy Sterbenz, who sat on the Town's Tree Commission. She also noted the very sad passing of April Farber, a previous member of the Mamaroneck School Board and most recently serving as Chair of the Town's Human Rights Committee. She was a generous, intelligent person who will be missed by so many. Councilwoman Seligson spoke warmly of April as a friend and colleague, as did Councilman Odierna. REPORTS OF THE COUNCIL Councilman Fishman stated the Housing Authority had an update meeting with the Supervisor and Mr. Altieri. The discussion centered on the current state of the Authority which continues to be in great shape as well as opportunities to grow. America's Most Wanted, is doing a special on the murder of Stephen Spina. Any one who might have pictures of him or video please contact the Spina family. Councilwoman Seligson noted the Boards and Committees will meet again in September; she will have more to report then. Councilwoman Wittner stated the Coastal Zone Commission is reviewing a number of interesting applications, one from the Mamaroneck School Board as well as an application regarding use of the Coastal Buffer Zone. Councilman Odierna attended the Recreation Commission Meeting on August 5. The Camp Directors gave a `wrap up' report.
