HomeMy WebLinkAbout2008_05_07 Town Board Minutes MAY 7, 2008 MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON MAY 7, 2008 AT 8:15 PM IN THE COURT ROOM OF THE TOWN, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia, Town Clerk Mary Stanton, Assistant to the Administrator William Maker, Jr., Town Attorney ABSENT: Stephen V. Altieri, Town Administrator WORK SESSION Update — Emergency Management Plan Revisions Due to Mr. Altieri's absence, this matter was deferred until next Work Session. Cemetery Evaluation Supervisor O'Keeffe reminded the Board that Mr. Donald March, the Town Historian, presented to the Board in 2006 a proposal for an assessment of the Town's Cemeteries. During that discussion, the Board was presented with a proposal from Lynette Strangstad of Stone Faces and Sacred Spaces. At that time the Board agreed that an assessment was needed and asked Mr. March if he would solicit donations from the Town and Village Historical Societies to offset the cost of the project. Mr. March has been able to obtain private funding in the amount of$ 2,125.00 and $1,000.00, from the Mamaroneck Historical Society. The Board would like to follow up with the Village Historical Society. Supervisor O'Keeffe noted the Town's legal obligation to maintain its cemeteries and would like to move this matter forward without any further delay. The Board will review a letter of agreement for the next Work Session. Floor Area Ratio The Board reviewed a memo from Mr. Altieri, as a follow up to the Board's previous discussion as to whether steps should be taken to further restrict the size of homes being built. Mr. Maker noted that a possible change in the side and rear setback requirements based on the size of the lot could help to restrict size. The Board agreed to contact Frank Fish to give the Town an analysis. Amendment— Peddler's Law The Board reviewed a memo from the Town Clerk recommending an Amendment to the Peddler's Permit. Currently the law is geared toward the individual peddler such as the ice cream man, and does not address a situation where a company obtains an individual permit for multiple individuals going door to door. The Clerk also recommended a photo for each individual be required. The Board agreed to have Mr. Maker draft an amendment for review. Housing Authority The Board received a resignation letter from Susan Sidel of the Housing Authority. The Board was made aware of a difference of opinion among the Authority's members as to the Housing Authority's goals. Supervisor O'Keeffe will draft a letter to the Authority; Mr. Maker was asked to obtain the Covenants establishing the Authority, for the Board to review. 1 MAY 7, 2008 Letter from Theresa Hunter The Town Clerk notified the Board of correspondence from Ms. Hunter. She is presently a 24 hour parker in Lot# 3. She is concerned that due to her handicap, the temporary lot is too far from her residence at 17 N. Chatsworth. The Board discussed making the first two new spaces being created along Vine Street. The Board will discuss this further at their next Work Session. Westchester Day School Councilman Fishman informed the Board that the Westchester Day School has offered their field to the community; little league in the spring and soccer in the fall. It was noted that this was a very nice offer by the School. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM she then pointed out the location of exits. PROCLAMATION — Retirement of Kenneth Wesley— Sanitation Commission Supervisor O'Keeffe introduced Kenneth Wesley and his family. She spoke warmly of the dedicated service he has provided to the Town. Carmine Deluca, Secretary Treasurer for the Sanitation Commission, also spoke affectionately about Mr. Wesley. The following proclamation was read by Supervisor O'Keeffe. PROCLAMATION - KENNETH G. WESLEY WHEREAS: Kenneth G. Wesley was hired by the Town of Mamaroneck Sanitation Department on January 16, 1969 and on January 1, 1974 was transferred to the expanded Larchmont-Mamaroneck Joint Sanitation Commission. Kenneth Wesley is retiring on May 31, 2008 after working for 39 %years; and WHEREAS: Kenneth Wesley, who was born in Port Chester, New York, is a life-long Village of Mamaroneck resident and has served the Town of Mamaroneck and the Village of Larchmont for 39 %years. During that time he has walked the 6.25 square mile area countless times; and WHEREAS: Throughout his career Kenneth Wesley has been conscientious and meticulous in his work. His respectful treatment of the residents on his route resulted in his receiving the largest number of letters of appreciation, commendations, and gratitude in the 34 year history of the Larchmont-Mamaroneck Joint Sanitation Commission. NOW, THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of Mamaroneck, and the Town Board members hereby thank KENNETH WESLEY for his service and wish him a long and happy retirement beginning on May 31, 2008, and continued success at the Winged Foot Golf links. While I am happy that he has reached retirement in a healthy state, 1 , and many of my neighbors on Wildwood Road will miss his dedication to his job and cheery countenance. I have lived at this address for 30 years and have had the privilege of being serviced by Mr. Wesley for all this time. I will miss seeing him with his friendly smile on Tuesday and Thursday mornings. Good luck and health on his well deserved retirement. John P. Ibelli ORAL COMMUNICATIONS Jan Northrup, President of the Kemper Memorial Fund, presented to the Board a compact disc of the Wreathes Across America service held last Memorial Day. Ms. Northrup noted the feedback from the participants of the convoy was terrific. She and all involved thanked the Board for their participation. She noted the essay contest and Memorial Ceremony will take place together beginning at 3:OOPM under the globe at Mamaroneck High School. The Ceremony will then continue outside in front of the Kemper Memorial. PUBLIC HEARINGS — Cold War Tax Exemption The following notice of Public Hearing was entered into the record: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on May 7, 2008 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled "Cold War Veteran's Tax Exemption" Law. The purpose of this local law is to add a section to the Code of the Town of Mamaroneck that would create a temporary partial exemption from real estate tax levied by the 1 own on property owned by a person who served on active duty in the United States armed forces, during the time period from September second, nineteen hundred forty-five to December twenty-sixth, nineteen hundred ninety-one, was discharged or released there from under honorable discharge conditions and satisfies any other requirements set forth in Section 458-b(1)(a) of the New York State Real Property Tax Law. Such section would conform the Code of the Town of Mamaroneck to the new Article III in Chapter 473 of the Laws of Westchester County that was enacted by Westchester County's Local Law No.1 of 2008. The full text of this Local law may be examined and copies obtained at the Town Clerk's office during regular hours (Monday through Friday, 8:30 AM to 4:30 PM, or until 4:00 PM during June, July and August) at 740 W. Supervisor O'Keeffe asked if anyone wished to speak for or against the proposed Law. She then read details of the proposed Law. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the Public Hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was unanimously RESOLVED, that the Mamaroneck Town Board finds that the adoption of the proposed local law regarding Real Estate Tax Exemption for `Cold War' Veterans is hereby declared to be a Type II action under the New York State Environmental Quality Review Act (SEQRA) requiring no further action. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following was unanimously adopted: Local Law No. 2-2008 This local law shall be known as the "Real Estate Tax Exemption for `Cold War' Veterans" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 — Purpose: The purpose of this local law is to create a temporary partial exemption from real estate tax levied by the Town of Mamaroneck on property owned by a person who served on active duty in the United States armed forces, during the time period from September second, nineteen hundred forty-five to December twenty-sixth, nineteen hundred ninety-one, was discharged or released there from under honorable discharge conditions and satisfies any other requirements set forth in Section 458-b(1)(a) of the New York Real Property Tax Law. Such section would conform the Code of the Town of Mamaroneck to the new Article III in Chapter 473 of the Laws of Westchester County that was enacted by Westchester County's Local Law No.1 of 2008. Section 2— Enactment of a new article for the Mamaroneck Code: ARTICLE VII Exemptions Pursuant To Real Property Tax Law Section 458-b §195-29. Purpose. The purpose of this local law is to create a temporary partial exemption from real estate tax levied by the Town of Mamaroneck on property owned by a person who served on active duty in the United States armed forces, during the time period from September second, nineteen hundred forty-five to December twenty-sixth, nineteen hundred ninety-one, was discharged or released there from under honorable discharge conditions and satisfies any other requirements set forth in Section 458-b(1)(a) of the New York Real Property Tax Law. Such section would conform the Code of the Town of Mamaroneck to the new Article III in Chapter 473 of the Laws of Westchester County that was enacted by Westchester County's Local Law No.1 of 2008. § 195-30. Definitions. As used in this Article: A."Cold War veteran" means a person, male or female, who served on active duty in the Armed Forces, during the time period from September second, nineteen hundred forty- five to December twenty-sixth, nineteen hundred ninety-one, was discharged or released 4 MAY 7, 2008 there from under honorable conditions and satisfies any other requirements set forth in Section 458-b(1)(a) of the New York Real Property Tax Law. B."Armed Forces" means the United States army, navy, marine corps, air force and coast guard. C."Active duty" means full-time duty in the Armed Forces, other than active duty for training. D."Service connected" means, with respect to disability or death, that such disability was incurred or aggravated, or that the death resulted from a disability incurred or aggravated, in line of duty on active military, naval or air service. E."Qualified owner" means a Cold War veteran, the spouse of a Cold War veteran or the unremarried surviving spouse of a deceased Cold War veteran. Where property is owned by more than one qualified owner, the exemption to which each is entitled may be combined. Where a Cold War veteran is also the unremarried surviving spouse of a Cold War veteran, such person may also receive any exemption to which the deceased spouse was entitled. F. "Qualified residential real property" means property owned by a qualified owner which is used exclusively for residential purposes; provided, however, if any portion of such property is not used exclusively for residential purposes, but is used for other purposes, such portion shall be subject to taxation and only the portion used exclusively for residential purposes shall qualify for the exemption provided by this article. Such property must be the primary residence of the qualified owner; unless the qualified owner is absent from the property due to medical reasons or institutionalization subject to such time limitations, if any, as are set forth in Section 458-b(1)(f) of the New York Real Property Tax Law. G. "Latest state equalization rate" means the latest final equalization rate established by the New York State Board of Real Property Tax Services for the Town of Mamaroneck pursuant to article twelve of the New York Real Property Tax Law. H. "Latest class ratio" means the latest final class ratio established by the New York State Board of Real Property Tax Services pursuant to title one of article twelve of the New York Real Property Tax Law for use in a special assessing unit as defined in section eighteen hundred one of the New York Real Property Tax Law. §195-31. Amount of Exemption: Limitations. A. Qualified residential real property shall be exempt from taxation to the extent of fifteen percent (15%) of the assessed value of such property; provided however, that such exemption shall not exceed twelve thousand dollars ($12,000) or the product of twelve thousand dollars ($12,000) multiplied by the latest state equalization rate, or, in the case of a special assessing unit, the latest class ratio, whichever is less. B. In addition to the exemption provided by section 195-31 A., where the Cold War veteran received a compensation rating from the United States veterans affairs or from the United States department of defense because of a service connected disability, qualified residential real property shall be exempt from taxation to the extent of the product of the assessed value of such property, multiplied by fifty percent (50%) of the Cold War veteran disability rating; provided however, that such exemption shall not exceed forty thousand dollars ($40,000) or the product of forty thousand dollars ($40,000) multiplied by the latest state equalization rate, or, in the case of a special assessing unit, the latest class ratio, whichever is less. C. If a Cold War veteran receives an alternative veterans' exemption under Article VI of this Chapter, the Cold War veteran shall not be eligible to receive an exemption under this Article. § 195.32. Duration of Exemption. The exemption provided by section 195-31 shall be granted for a period of ten years. The commencement of such ten year period shall be governed pursuant to this section. Where a qualified owner owns qualified residential real property on the effective date of this article, such ten year period shall be measured from the assessment roll prepared pursuant to the first taxable status date occurring on or after the effective date of this article. Where a qualified owner does not own qualified residential real property on the effective date of this article, such ten year period shall be measured from the assessment roll prepared pursuant 5 MAY 7, 2008 to the first taxable status date occurring at least sixty days after the date such qualified owner purchases qualified residential real property; provided, however, that should the Cold War veteran apply for and be granted an exemption on the assessment roll prepared pursuant to a taxable status date occurring within sixty days after the date of purchase of qualified residential real property, such ten year period shall be measured from the first assessment roll in which the exemption occurs. If, before the expiration of such ten year period, such property is sold and replaced with other qualified residential real property, such exemption may be granted for the unexpired portion of the ten year exemption period. § 195-33. Application for Exemption. Application for the exemption authorized by this article shall be made by the qualified owner, or all of the qualified owners, of qualified residential real property on a form prescribed by the New York State Board of Real Property Tax Services. The qualified owner or owners shall file the completed form in the assessor's office on or before the first appropriate taxable status date. They shall be required to refile at such times and under such circumstances as may be set forth in Section 458-b(4) of the New York Real Property Tax Law. Any person convicted of willfully making any false statement in the application for such exemption shall be subject to the penalties prescribed in the New York Penal Law. Section 3— Renumbering of an existing article and existing sections of the Mamaroneck Code: (a) (1) Article VII of the Mamaroneck Code hereby is renumbered Article VIII. (2) Section 195-29 of the Mamaroneck Code hereby is renumbered section 195-34. (3) Section 195-30 of the Mamaroneck Code hereby is renumbered section 195-35. (4) Section 195-31 of the Mamaroneck Code hereby is renumbered section 195-36. (5) Section 195-32 of the Mamaroneck Code hereby is renumbered section 195-37. (6) Section 195-33 of the Mamaroneck Code hereby is renumbered section 195-38. (7) Section 195-34 of the Mamaroneck Code hereby is renumbered section 195-39. (b) Except as renumbered each and every section listed in paragraph (a) of this section shall remain in full force and effect. Section 4—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5— Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Traffic Committee Recommendations On motion of Councilman Fishman, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby set the date for a Public Hearing on No Parking on Colonial Avenue for May 21, 2008 BE IT FURTHER, RESOLVED, that the Town Board does hereby set the date for a Public Hearing on a No Parking Zone Forest Avenue / Sheldrake Avenue for May 21, 2008 BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. Authorization -Appointment of Town Comptroller On motion of Councilwoman Seligson, seconded by Councilwoman Fishman, it was RESOLVED, that the Town Board does hereby authorize the appointment of Anthony Siligato as the Town of Mamaroneck, Town Comptroller/ IT Director at an annual Salary of $130,000 effective June 16, 2008. 8 MAY 7, 2008 The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye 3. Ratification — Settlement of Sanitation Commission Litigation On motion of Councilman Odierna, seconded by Councilwoman Seligson, the following was approved WHEREAS, In April of 2006 litigation was commenced by a group of sixteen private corporations against all the municipalities in Westchester County that transported solid waste to the Croton Point Landfill between the years 1937 and 1973. The litigation sought to recoup a contribution of costs associated with the closure of the Croton Point landfill, and WHEREAS, the Sanitation Commission joined a consortium of twenty three municipalities to defend the claim, and WHEREAS, the Sanitation Commission approved the settlement of this claim at their meeting on April 30. NOW THERFORE, BE IT RESOLVED, that the Town Board does hereby approve amending the Town's contribution to the Sanitation Commission to fund the settlement of the aforementioned claim, and BE IT, FURTHER RESOLVED, that the Village of Larchmont and the Town of Mamaroneck divide the settlement on a 50/50 basis, as recommended by the Sanitation Commission, for a total cost to the Town of Mamaroneck of$36,013.50. Set Public Hearing — Community Development Block Grant Application Item was deferred. Supervisor O'Keeffe noted that due to the timing of the grant application, the Board may need to set a Special Meeting to set this Public Hearing. 6. ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS Commending of Kenneth Wesley -submitted under Proclamations SUPERVISOR'S REPORT Supervisor O'Keeffe welcomed Paige Rentz of the Home Town News. Paige is replacing Kelechi Ubozoh who has recently left the paper to work for NBC News. Supervisor O'Keeffe noted the recent meeting she attended with the Sanitation Commission. She attended a shared services meeting with Mayor Savolt of the Village of Mamaroneck. 10 MAY 7, 2008 She noted the wonderful Senior Center Luncheon that she attended. REPORT OF COUNCIL Councilman Fishman attended the Traffic Committee meeting, some of which were already discussed at this evening's meeting. He will attend the Housing Authority Meeting later this month. Councilwoman Seligson attended the Zoning Board Meeting on April 30, noting many of the applications were deferred due to lack of proper signage. She was recently in Washington, DC, as an advocate for funding for the Long Island Sound. She and others met with staff members of the Legislature —they were very receptive. The bad news is the 2010 Federal Budget is dismal, the good news is New York State and Connecticut Legislators are very dedicated to Long Island Sound. She also noted the news that the Broadwater Liquid Natural Gas Plant on Long Island Sound was determined to be in non compliance with New York State's Coastal Management. She gave a brief explanation of this project. She did note that the Federal Regulatory Commission could go to the Commerce Department for appeal — even so, it is hard to imagine this moving forward. She attended the Greenway Meeting — noting the soft opening on May 18, at which the Sound Shore Runners will `test' the trail. A full grand opening is planned for the fall of 2008. She will be attending the I.C.L.E.I. Conference on Community Sustainability May 14t" and 15t", in New Mexico—she is looking forward to learning about what other communities are doing to reduce their carbon footprint. Councilwoman Wittner attended the Coastal Zone Management Commission on April 22. She attended in place of Supervisor O'Keeffe, a meeting with six municipalities regarding Senior Services. Councilman Odierna attended the League of Women Voters' Luncheon. He attended the Sheldrake Festival — it was great! He reminded residents of the upcoming Annual Meeting of the Larchmont Gardens' Civic Association on May 12; Supervisor O'Keeffe and Superintendent of Highway Louis Martirano will be speaking. Councilman Odierna also attended the Westchester Municipal Officials' Meeting. Councilman Odierna noted a resident comment regarding the temporary parking lot for the displaced parkers from Lot#3. He asked what research was used to determine the use of parkland. Mr. Maker responded that the temporary nature, with a finite date and immediate restoration of parkland was the determination used, adding, the Town Board acted in a legally defensible manner. Councilman Odierna noted his concern that the lot would not be ready in time for the displacement of the 24 hour parkers currently in Lot# 3. Supervisor O'Keeffe assured Councilman Odierna that the Town would be on top of this.
