THE TOWN OF MAMARONECK HELD ON APRIL 4, 2007 AT

WORK SESSION
Need for Speed Relay for Domestic Violence
The Town has received a request to use a small portion of Town roadways for the
Avon Foundation's Need for Speed Relay to be held Sunday, June 10, 2007.
On motion of Councilman Winick, seconded by Councilwoman Wittner, the following
was approved
WHEREAS, the Avon Foundation's Need for Speed Relay
Against Domestic Violence is a unique running event that
traverses approximately 50 miles through Westchester County.
The relay consists of 9 legs with mileage varying between 4 - 9
miles and 8 designated transition areas for runners to "pass the
baton." The anticipated participation is 125 teams with 6 -9
members per team. The total participation in the event will be
approximately 1,000 runners, there will never be more than one
person per team on the course and thus the impact on the roads
will be significantly reduced.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does
hereby approve persons participating in the Avon
Foundation's Need for Speed Relay Against Domestic
Violence to access a route through the Town of
Mamaroneck. Said route to begin at the entrance to the
Town of Mamaroneck via Fifth Avenue, run down Fifth
Avenue to Madison Avenue, turn onto Madison Avenue
and run to Myrtle Boulevard, turn onto Myrtle Boulevard
and run to Chatsworth Avenue, and then enter the
Village of Larchmont by way of Chatsworth Avenue, and
BE IT, FURTHER
RESOLVED, that due to the small number of individuals
passing through the Town and the short duration of the
course there will be no need to engage any additional
Town personnel.

Amendment to the Site Plan Law
On the request of Councilwoman Wittner, the Board is being asked to review the
Zoning Law as it pertains to height and bulk of residential homes. Arthur Wexler,
Chairman of the Zoning Board of Appeals, addressed the Board with an explanation of
current Zoning Law which states that a building shall be no higher than 35 feet to a flat
roof or mid point of an eve and ridge. Mr. Wexler demonstrated to the Board how
height is currently determined and how, if amended, it could minimize the potential
overall bulk of residential homes. It was determined that if the Board would like to
reduce the bulk of homes then the law must redefine height. It was agreed that the
next step was to do a comparison of other communities and how they determine
height. Mr. Wexler would do the comparisons and report back to the Board.
Coastal Zone Management Commission (CZMC) - letter to Planning Board
As part of a letter sent by the CZMC to the Planning Board they are requesting site
plan reviews for all "tear downs" in the Town. It was decided that the Town Attorney
would evaluate the current law and present his findings to the Board. Supervisor
O'Keeffe stated that if there is a "tear down" it should go before the Board of
Architectural Review. There was discussion regarding what exactly the site plan
review would be looking at. It was decided that Councilwoman Wittner would follow
up with the CZMC and confirm exactly what the issue(s) are that they are concerned
about. The Town Board will be meeting with the Planning Board on April 19; at that
time the Town Attorney will have some information that can be used for discussion.
Letter from Sound Waters
The Town is being requested to have a role in the upcoming Sound Harbors week in
early June. The Town of Mamaroneck is being selected, along with other
communities, because of their continued stewardship of the Long Island Sound. The
Town Board decided to accept their invitation to have a further discussion regarding
the Town's participation in this activity. The Sound Waters Schooner will be in
Mamaroneck harbor and available to the Town for excursion to bring people out on the
Sound.
Letter from David DeSanto, 450 Weaver Street
Mr. DeSanto would like to have a further discussion with the Town Board regarding
the concept of giving property owners tax incentives for mitigating flooding issues on
their properties, and penalties for those who do not. The Board noted that if Mr.
DeSanto wished, he was free to bring his ideas before the Town Board.
Residential Parking District-Washington Square
The Board was presented with draft legislation for the creation of a Special Parking
District in the Washington Square Area. Mr. Altieri recently spoke with Assemblyman
George Latimer who encouraged the Town to move quickly in order to have legislation
passed by the Legislature this spring. It was agreed that Mr. Altieri would forward the
legislation to George Latimer's office.
Proposed changes to Parking Fines
Mr. Altieri explained that the current fines reviewed at the last work session were
incorrect. An updated list was reviewed and the Board made further proposed
changes for a Public Hearing on April 18, 2007.
Mr. Gilliams, 21 Dillon Road
Supervisor O'Keeffe stated that Mr. Gilliams had e-mailed her regarding his recent
meeting with Mr. Altieri and Mr. Maker. The Board discussed the request made by Mr.
Gilliams to rename his street Premium River Road extension. He feels that when

Premium River Road was renamed Dillon Road, the portion known as Premium River
Road Extension was not addressed.
CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor
O'Keeffe at 8:25 PM. She then pointed out the location of exits.
SWEARING IN/APPOINTMENT - Town Clerk
On motion of Supervisor O'Keeffe, seconded by Councilwoman Wittner, it was
RESOLVED, that the Town Board does hereby appoint
Christina Battalia as Town Clerk at a salary of$72,660,
effective immediately, to fill the unexpired term of
Patricia DiCioccio, said term expiring December 31,
2007; and
BE IT, FURTHER
RESOLVED, that the Town Board does hereby appoint
Christina Battalia as Registrar of Vital Statistics
effective immediately, said term expiring December 31,
2007, and
BE IT FURTHER,
RESOLVED, that the Newly Appointed Registrar of
Vital Statistics, Christina Battalia, does hereby appoint
Cindy Atiencia as Deputy Registrar of Vital Statistics
effective immediately, and
BE IT FURTHER,
RESOLVED, that the Town Board does hereby appoint
Christina Battalia as Records Management Officer
effective immediately, at a per diem salary of$1,000,
and
BE IT FURTHER,
RESOLVED, that the Town Board does hereby appoint
Christina Battalia as Marriage Officer effective
immediately, said term expiring December 31, 2007,
and
BE IT FURTHER,
RESOLVED, that the Town Board does hereby
authorize Christina Battalia, Town Clerk, to sign
checks on the Account of the Town Clerk of the Town
of Mamaroneck Account# 04-120094, at JP Morgan
Chase, 1350 Boston Post Road, effective immediately.

PUBLIC HEARING -AMENDED ILLUMINATED SIGN LAW
NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town
Board of the Town of Mamaroneck on April 4, 2007, at 8:15 PM or as soon
thereafter as is possible in the Court Room of the Town Center, 740 W.
Boston Post Road, Mamaroneck, New York to consider the adoption of a
local law entitled "Revised Illuminated Sign" Law.
PURPOSE
The Town Board finds that the proliferation of illuminated signs
throughout the Town has had a negative impact upon the appearance of
the Town. This local law amends portions of Chapter 175 of the Code of
the Town of Mamaroneck to add restrictions and to tighten the rules and
regulations for illuminated signs.
The full text of this Local law may be examined and copies obtained at
the Town Clerk's office during regular hours (Monday through Friday, 8:30
AM to 4:30 PM, or until 4:00 PM during June, July and August) at 740 W.
Boston Post Road Mamaroneck, New York
PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons
interested will be given an opportunity to be heard and that all persons
are invited to submit written comments at or prior thereto.
On motion of Councilman Winick, seconded by Councilman Odierna, the Public
Hearing was unanimously opened.
Supervisor O'Keeffe asked the Town Attorney to explain the proposed law.
Supervisor O'Keeffe then asked if anyone wished to speak for or against the
proposed law.
Councilman Odierna stated he has been against this law since its inception,
adding that in its final form he feels more comfortable. He stated he will vote for
the proposed law if there is agreement by the Board members to review the law in
the future for possible loosening or tightening of certain aspects of it.
Councilman Winick stated it was bad application of the use of neon that forced
the Board to take this action. He stated that the Board of Architectural Review as
well as the Planning Board would be looking at standards that could be applicable
to signage along the Boston Post Road. He also reminded residents that this law
was not as restrictive as many others in Westchester County. It was also noted
that this was an amendment to an already existing law.
On motion of Councilwoman Wittner, seconded by Councilman Winick, the public
hearing was unanimously closed.
On motion of Councilwoman Wittner, seconded by Councilman Winick, it was
RESOLVED, that the Mamaroneck Town Board finds that
the adoption of the proposed local law regarding the
Amended Illuminated Sign Law is hereby declared to be a
Type II action under the New York State Environmental
Quality Review Act (SEQRA).

On motion of Councilman Winick, Seconded by Councilwoman Wittner, the
following was approved,
Local Law 5-2007
This local law shall be known as the "Revised Illuminated Sign" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
The Town Board finds that the proliferation of illuminated signs throughout the
Town has had a negative impact upon the appearance of the Town. This local law
amends portions of Chapter 175 of the Code of the Town of Mamaroneck to add
restrictions and to tighten the rules and regulations for illuminated signs.
Section 2–Amendments to a current section of the Code of the Town of Mamaroneck:
(a) Section 175-4 of the Code of the Town of Mamaroneck hereby is amended
by repealing the definition of ILLUMINATED SIGN contained therein and substituting
the following definition of ILLUMINATED SIGN in its place:
"ILLUMINATED SIGN — Any sign which (i) is illuminated by artificial light and
either (ii) (a) is located outside of a building or structure or (b) is located within a
building or structure but can be seen from outside that building or structure. A sign
shall not be considered an illuminated sign within the meaning of article II of this
chapter if it (1) is located within a building or structure, (2) is illuminated by an exterior
source and (3) can be seen from outside that building or structure if such exterior
source is not directed at or designed specifically to illuminate such sign."
(b) Section 175-4 of the Code of the Town of Mamaroneck hereby is amended
by adding the following definitions thereto:
"EXTERIOR SOURCE — any source of artificial light originating from a location
outside of a sign."
"INTERIOR SOURCE — any source of artificial light originating from within a
sign."
Section 3– Repeal of a current section of the Code of the Town of Mamaroneck:
Subsection J. of section 175-7 of the Code of the Town of Mamaroneck hereby
is repealed.
Section 4–Amendment to a current section of the Code of the Town of Mamaroneck:
Section 175-12 of the Code of the Town of Mamaroneck hereby is repealed and
the following is substituted in its place:
"A. Illuminated signs shall not be permitted in any residential district.
B. (a) Illuminated signs located within a building or structure may be lit by
either an exterior or an interior source but must be situated at least five (5) feet away
from every window and glass door of that building or structure. In addition to free-
standing signs, this subsection applies to machines that dispense products for sale
and to display cases, racks and refrigerators that contain products for sale if
illuminated signs are inextricably part of such machines, cases, racks or refrigerators.
(b) This subsection shall not apply to signs, such as exit signs, that by law are
required (i) to be within a building or structure and (ii) to be illuminated. Such signs, if
lit by an interior source, may be situated anywhere within a building or structure
except in such places where laws, other than this section, prohibit them from being
situated.
C. Illuminated signs located outside of a building or structure shall not be lit by
an interior source.

D. Illuminated signs and their exterior sources shall be situated so that the light
emitted by such sign or its exterior source does not obscure a traffic signal from the
vision of an operator of a motor vehicle driving toward such signal.
E. Illuminated signs shall not flash, have lights that glow on and off whether
randomly or in a sequence or pattern, contain words or numbers that stream across
the sign, contain pictorial displays, be animated, swing, revolve or otherwise move.
This paragraph shall not apply (i) to calendars, clocks or thermometers or (ii) to
illuminated signs located within a building or structure.
F. An illuminated sign shall not be lit after 11:OOPM (Prevailing Time) unless
such sign advertises a business which, by law, is allowed to receive patrons after
11:OOPM (Prevailing Time) and such business is open to patrons after11:00PM
(Prevailing Time). All illuminated signs for such business shall be extinguished when
the business closes.
G. Illuminated signs shall only contain words and numbers which (i) spell or set
forth the name of the business for which such sign advertises, (ii) spell or set forth the
street address of the business for which such sign advertises, (iii) spell or set forth
the hours of operation of the business for which such sign advertises or (iv) show the
date, time and/or outdoor temperature.
H. The light emitted by an exterior source for an illuminated sign shall (i) be
directed toward the sign, (ii) be oriented so that it is not emitted directly onto an
adjoining property, the sidewalk or the street, (iii) be enveloped by an opaque shade
for such length as is necessary so that except for the opening through which the light
shines, the source of the illumination is entirely covered and (iv) have a maximum
nighttime illumination level of twenty (20) foot candles when measured at a distance of
twenty-five (25) feet at right angles from the face of the sign.
I. The type, capacity, quality and installation of the wiring or other equipment
used to light an illuminated sign shall comply with all applicable codes, laws,
ordinances and regulations.
J. Any illuminated sign existing upon the effective date of this section that does
not comply with this section shall be permitted to remain in its current location until
the earlier of its removal by the owner of the sign or March 31, 2009. Thereafter, such
sign shall be removed and not replaced. While standing, such sign may not be
enlarged or substantially altered.
K. Subsections A, E, F and G of this section shall not apply to illuminated signs
that honor or commemorate a religious event, holiday or season.
L. This section shall not apply to illuminated signs that are erected to alert the
public of an emergency.
M. This section shall not apply to public utility companies, the United States of
America, the State of New York, the County of Westchester, the Town of Mamaroneck,
the Mamaroneck Union Free School District, the Villages of Larchmont, Mamaroneck
or Scarsdale or any independent contractors engaged by any of them.
Section 5—Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any
court of competent jurisdiction, such declaration of unconstitutionality or invalidity
shall not affect any other provisions of this Local Law, which may be implemented
without the invalid or unconstitutional provisions.
Section 6— Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

1. Appointment - Chairperson Human Rights Commission
On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was
RESOLVED, that April Farber is appointed to the
position of Chairperson of the Human Rights
Commission; and
BE IT FURTHER,
RESOLVED, that the foregoing appointment shall be
effective immediately upon the appointee taking and
subscribing the oath mandated by section 25 of the
New York Town Law and shall expire on March 5, 2008.

2. Authorization - Extension of License Agreement - 685 Weaver Street
On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was
RESOLVED, that the Town Board does hereby approve the
Extension of License Agreement for one year between the
Town of Mamaroneck and Michael and Karen Orchanian,
allowing them to reside, for a fee, at 685 Weaver Street, in
the Town of Mamaroneck, for a period ending May 31,
2008, subject to Permissive Referendum; and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby
authorized to execute said agreement on behalf of the
Town.

3. Approval of Certiorari
Mr. Maker explained the settlement in detail. He noted that this Certiorari has
been discussed during multiple work session with the Town Board.

Supervisor O'Keeffe noted this was the largest Certiorari the Town has settled in many
years.

4. Set Public Hearing -Amendment to Parking Fines
On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was
RESOLVED, that the Town Board does hereby
set the date for public hearing on Amendment
to Parking Fines for April 18, 2007; and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby
authorized to publish the notice of said hearing
in a newspaper appointed as an official
newspaper, and that said notice be posted.

5. Resolution - Use of Town of Harrison Pistol Range
On motion of Councilman Odierna, seconded by Councilwoman Wittner, the following
was approved,

WHEREAS, the Town of Mamaroneck Police Department
desires to use the Town of Harrison Police Department Pistol
Range, and
WHEREAS, the Town of Harrison and Village of Harrison
require from any municipality requesting use of its Pistol
Range proper insurance naming the Town of Harrison and
Village of Harrison as additional insured and a fully executed
Indemnification Agreement inuring to the benefit of the Town
of Harrison and Village of Harrison;
NOW THEREFORE, BE IT RESOLVED that an Indemnification
Agreement inuring to the benefit of the Town of Harrison and
Village of Harrison be executed, and be it further;
RESOLVED that the Town Board of the Town of Mamaroneck
authorize Stephen V. Altieri, Town Administrator, to execute
the attached Indemnification Agreement, and to deliver same
to the Town Attorney of the Town of Harrison, and be it
further;
RESOLVED that a certified copy of this Resolution be
forwarded to the Town Attorney of the Town of Harrison with
a fully executed copy of the Indemnification Agreement.

Mr. Altieri explained that this guide rail is the "missing link" for the Greenway Trail
project.

award the bid TA-07-07, to purchase material,

to Chemung Supply Corp., of Elmira, NY.

7. Salary Authorization — Recreation
On motion of Councilman Odierna, seconded by Councilman Winick, it was
RESOLVED, that as provided for in the 2007 Town Budget
the Town Board does hereby authorize the payment of
salary to the following:
Spring Hockey:
Sal Naclerio, Hommocks Park Ice Rink, Asst. Instructor, $7.50 per hour,
retroactive to March 24, 2007.
Alex Weisberger, Hommocks Park Ice Rink, Asst. Instructor, $9.00 per hour,
retroactive to March 24, 2007.
Tennis Courts:
David Conover, Memorial Park, Attendant, $11 per hour, effective April 1, 2007.
Michael Henry, Memorial Park, Maintenance, $11 per hour, effective April 1,
2007.

8. Amendment to CATV Sharing Agreement
On motion of Councilman Winick, seconded by Supervisor O'Keeffe the following was
approved
WHEREAS, the Larchmont Mamaroneck Cable Board of Control
is currently negotiating cable television franchise agreements
with Cablevision and Verizon; and
WHEREAS, it has been determined that the CATV Sharing
Agreement originally approved by the Town of Mamaroneck,
Village of Mamaroneck and Village of Larchmont in 1982 did not
contemplate the Board of Control negotiating with more than
one cable television provider; and
WHEREAS, Counsel to the Board of Control has recommended
an amendment to the CATV Sharing agreement.
NOW THEREFORE BE IT,
RESOLVED, that the Town Board hereby approves amending
Section 3 of the CATV Sharing Agreement to incorporate the
following language:
"and is further empowered to negotiate franchise agreements
with any other entity or party who proposes to provide video
access by cable, fiber or other technologies utilizing the public
right of ways; and thereafter to take such actions to any
franchise agreements authorized by the three governing bodies"

APPROVAL OF MINUTES - February 27, 2007
On motion of Supervisor O'Keeffe, seconded by Councilwoman Wittner, it was
RESOLVED, that the Town Board does hereby approve
the Board minutes from the meeting of February 27,
2007 as amended.

SUPERVISOR'S REPORT
Supervisor O'Keeffe received an email from Assemblyman George Latimer's
office informing the Town of the reestablishment of funds to the State budget for
Westchester County; this is good news for the Town of Mamaroneck.
Mr. Altieri met with a representative from Nita Lowey's office regarding the recent
flooding. They will be coordinating with other local municipalities to facilitate
federal funding for flood relief.
REPORT OF COUNCIL
Councilman Odierna attended, with Supervisor O'Keeffe, the League of Women
Voters Luncheon on March 23. Tom Suozzi, Nassau County Executive was the
keynote speaker. On April 14 the Larchmont Mamaroneck Seniors will be having
an art opening at the Larchmont Library. Councilman Odierna praised Maria
Gallagher, the new Assistant Superintendent for Senior Citizens for the
outstanding job she is doing.
He also attended the Chamber of Commerce meeting at Cafe Mozart.
Mary Stanton added that the Town is currently working on creating a spin-off to
the Town web-site for the seniors, similar to the format used by our ice rink.
Supervisor O'Keeffe reminded residents that the Chamber of Commerce is for
Town of Mamaroneck Commercial owners as well as the Village of Mamaroneck.
Councilwoman Wittner attended the Coastal Zone Management Commission
meeting. She attended a Special Fire Council meeting to discuss affairs of the
Fire District. She attended the LISWIC meeting in which a draft report by Malcolm
Purnie regarding the establishment of a Storm Water Management was discussed.
She noted that 10 municipalities were involved in the study. On April 27 a tree
donated by the League of Women Voters will be planted at the Hommocks
Conservancy. The LMC-TV Awards will be on May 24.
Councilman Winick attended the 6t" meeting of the Washington Square Parking
Committee. The committee has received the final report from Buckhurst Fish &
Jacquesmart. Comments from the committee are due back April 5. The Town is
moving forward with the help of Assemblyman George Latimer and Senator Suzi
Oppenheimer to establish a Special Parking District.
Supervisor O'Keeffe wished everyone a happy Passover and Easter. Mr. Maker
was congratulated by Supervisor O'Keeffe and the Town Board for his recently
published article in the Law Review. (??????)

ADJOURNMENT
On motion of Councilwoman Wittner, seconded by Councilman Odierna the meeting
was unanimously adjourned 10:45 PM, in memory of Bill Ponessa, former Building
Inspector, Fred Mason husband of Ellen Mason and Dominick Forti, former Police
Officer all of whom passed away last week.
