BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman Paul A. Winick ALSO PRESENT: Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney Christina Battalia, Acting Town Clerk Cindy Atiencia, Deputy Town Clerk WORK SESSION Cablevision Councilman Winick reported that the letter written by Larchmont Mamaroneck Cable TV Board to Cablevision was "off the table". The intent of the letter was to put pressure on Cablevision who has been unwilling to negotiate. Cablevision is functioning with an expired franchise. Any franchise negotiated with Verizon would be across the board. Councilman Winick stated that a new agreement has been created by Joe VanEaton of Ashpaugh & Sculco. Councilwoman Seligson noted that Emily Spaulding had requested that the Town formulate a resolution that would speed up Verizon. She would add this item to the agenda for April 4. Letter from Mr. Lienau, 3 Lakeside Drive The Board discussed the contents of Mr. Lienau's letter regarding his concerns with Larchmont Garden's Lake. The Board noted that residents need to be reminded that the project for the Lake was being facilitated with grant monies. Mr. Altieri stated that if this were a dredging project the Town would not have received this grant; this project was not meant to address flooding. The Board discussed the points of Mr. Lienau's letter in detail and agreed that Mr. Altieri would write a response to Mr. Lienau. Parking Fines The Board discussed the current fines for Town parking violations. There was agreement that fines were too low. The Board made recommendations for increases that will be drafted into a local law and set for a Public Hearing at the next Town Board meeting. Illuminated Sign Law The Board reviewed the proposed Local Law as written by Mr. Maker. Councilwoman Seligson recommended the Board reconsider the total ban on the use of neon. There was discussion regarding how the use of neon could be regulated without a total ban. Mr. Maker reminded the Board of the original intent of the law. Mr. Maker would draft a new version of the law including the Board's recommendations and will have it reviewed by the Board of Architectural Review prior to the Public Hearing on April 4. Elmcroft Estates Subdivision At issue is the way in which sanitary sewage will be handled for the new homes being built at the Elmcroft Estates Subdivision. Two alternatives were explored, a single pump station or individual sewer ejection pumps in each home. The Town objects to the use of a single pump station as the Town has tried to avoid their use in the Town sewer system. The second option, the use of individual pumps, was submitted to the Westchester County Department of Health for approval. Their approval is conditional upon the Town having some involvement in the emergency replacement of homeowner's pumps. This 1 MARCH 21, 2007 condition involves the Town making available 24 hours a day, 7 days a week a spare pump, purchased by the homeowner, to be stored on Town property. Supervisor O'Keeffe strongly objected to the proposal, as did other Board members. There was discussion involving Town liability as well as the repercussions for the Town not agreeing to the Department of Health conditions. It was agreed that the Town Administrator would contact the Department of Health with the Town's objection. Update- Larchmont Village Water Line Project Steve Altieri stated that he and Superintendent of Highways, Marco Gennarelli, attended a meeting with the Village of Larchmont officials and the Village's consulting engineers. It was explained that the Village of Larchmont is considering an alternate replacement plan for their 50 year old water main currently running over the thruway at Chatsworth Ave. The preferred method, although the most costly, is to run the main under the thruway. This involves the use of the Town parking lot#1 where the new parking deck will be located. Village engineers will be conducting soil samples to determine subsurface soil conditions. Supervisor O'Keeffe was most concerned about timing, and how it could impact the building of the new parking deck. Supervisor O'Keeffe was also concerned that the soil boring could disturb the soil and create a potential problem for the building of the deck. It was agreed that Mr. Altieri would get more information from the Village and report back to the Board. Housing Authority Currently two Town employees, a husband and wife, residing at the Hommocks Apartments have a gross income that exceeds the requirements as specified by Town policy. It was noted that Town employees are not bound by County income requirements. It was determined that the median for Town of Mamaroneck employees should be raised to a level not to exceed $115,000. It was further determined that the Housing Authority should formulate a policy for Town Employees. Human Rights Commission Supervisor O'Keeffe spoke with an individual referred by Mr. Maker as a possible member of the Human Rights Commission. That individual would consider the appointment and get back to the Supervisor. On motion made and seconded, the Board convened into an Executive Session to discuss Personnel and Litigation. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:35 PM. She then pointed out the location of exits. PUBLIC HEARINGS THE 2007 AMENDMENT TO THE SENIOR CITIZEN TAX EXEMPTION The following notice of public hearing was entered into the record: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on March 21, 2007 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled "SENIOR CITIZEN AND DISABLED PERSONS PROPERTY TAX EXEMPTION" The full text of this Local law may be examined and copies obtained at the Town Clerk's office during regular hours (Monday through Friday, 8:30 AM to 4:30 PM, or until 4:00 PM during June, July and August) at 740 W. Boston Post Rd Mamaroneck, New York 2 MARCH 21, 2007 PLEASE TAKE FURTHER NOTCE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the Public Hearing was unanimously opened. Mr. Maker explained the proposed law . Supervisor O'Keeffe asked if anyone wished to speak for or against the proposed law. On motion of Councilman Winick, seconded by Councilman Odierna, the public hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Mamaroneck Town Board finds that the adoption of the proposed local law regarding the 2007 Amendment to the Senior Citizens Tax Exemption is hereby declared to be a Type II action under the New York State Environmental Quality Review Act (SEQRA). The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe Aye On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following was approved, Local Law No. 3 -2007 This local law shall be known as the "The 2007 Amendment to the Senior Citizens Tax Exemption" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 — Purpose: The purpose of this local law is to amend Section 195-6 (B), Section 196-6 (C) and Section 196-6 (F) (3) of the Code of the Town of Mamaroneck to conform these sections of the Code, as they relate to real property tax exemptions for persons sixty-five years of age or over, to the recent amendments to Section 470.11 of the Laws of Westchester County made by Local Law No. 13 of 2006 of the County of Westchester. Section 2—Amendment to an Existing Section of the Code of the Town: Section 195-6 (B) of the Code of the Town of Mamaroneck hereby is amended by substituting "$26,000" for "$24,000" therein. Section 3—Amendment to an Existing Section of the Code of the Town of Mamaroneck: Section 195-6(C) of the Code of the Town of Mamaroneck hereby is repealed in its entirety and the following substituted in its place: "C. The owner or all the owners of real property located in the Town who are 65 years of age or older and whose income or combined income from all sources for said twelve- month period exceeded the maximum amount set forth in Subsection B of this Section by less than $8,400 shall be eligible for a partial exemption as set forth in the following table: 3 MARCH 21, 2007 i. Section 6— Effective Date: This Local Law shall become effective upon filing with the Secretary of State. BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows: Section 1 - Purpose: The purpose of this local law is to amend Section 195-31 of the Code of the Town of Mamaroneck to conform that section of the Code, as it relates to real property tax exemptions for persons with disabilities and limited incomes to the recent amendments to Section 472.11 of the Laws of Westchester County made by Westchester County's Local Law No. 14 of 2006. Section 2—Amendment of an Existing Section of the Code of the Town of Mamaroneck: Section 195-31 of the Code of the Town of Mamaroneck hereby is repealed in its entirety and the following substituted in its place: Except as provided in § 195-31 of this article, where the owner of real property is a person with a disability, or are one or more persons, both of whom have disabilities, or is a husband, wife, or both, and one of them is a person with a disability, or are siblings, at least one of whom has a disability and the income of the person with the disability is limited by reason of such disability, that real property shall be exempt from taxation by the Town of Mamaroneck to the extent set forth in the following table, provided an application for such exemption is made in accordance with the provisions of this article: i. O'Keeffe Commissioner: Phyllis Wittner Commissioner: Ernest C. Odierna Commissioner: Nancy Seligson Commissioner: Paul A. Winick 1. FIRE CLAIMS Commissioner Odierna presented fire claims for authorization of payment, thereafter on Commissioner Odierna's motion, seconded by Commissioner Wittner, it was RESOLVED that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office: AAA Emergency Supply Co. OTHER FIRE BUSINESS Supervisor O'Keeffe thanked the Fire Department for preparing a hot meal for the Highway Department personnel who were working day and night to clear the snow. There being no further business to come before the Commission, on motion of Commissioner Odierna, seconded by Commissioner Winick, the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. Authorization —Ambulance District Service Rates On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was 9 MARCH 21, 2007 RESOLVED, that the Mamaroneck Town Board does hereby approve the 2007 Ambulance District Fee Schedule as follows: BLS Emergency $425 ALS I Emergency $525 ALS II Emergency $675 Mileage $10 per loaded mile Oxygen $40.00 The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye 2. Authorization — Tax Warrants -Town of Mamaroneck &Westchester County On motion of Councilman Winick, seconded by Councilwoman Wittner, it was RESOLVED, that Denis Brucciani is hereby authorized by the Town Board of the Town of Mamaroneck pursuant to the provision of the Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, and by authority of Chapter 313 of Laws of 1934, to receive and collect from the several persons named in the Assessment Roll by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended, for the neglect to pay the Judicial, County, Town and Town District Taxes, charges for services, exemptions removed, and water arrears after the levy thereof as follows: Judicial and County Taxes - $33,144,606.00 Town and Town District Taxes 17,736,085.00 Charges for Services - - 0 - Exemptions removed - 0 - Water arrears - 0 - $50,880.691 .00 and BE IT, FURTHER RESOLVED, that you are hereby directed to deposit to the credit of the Town of Mamaroneck into the JP Morgan Chase Bank, all of such monies so collected by you by virtue of this resolution, and BE IT, FURTHER RESOLVED, that you are further commanded to make and file with the Supervisor of the Town of Mamaroneck, as required by the Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, the reports provided for therein, and BE IT, FURTHER RESOLVED, that you are further directed and commanded to proceed as directed and authorized by said Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, and 10 MARCH 21, 2007 BE IT, FURTHER RESOLVED, that in case any person named in said Assessment Roll shall neglect or refuse to pay his taxes or penalties (after giving the notices and waiting the time as specified in said Act) you are hereby authorized to collect the said taxes and penalties with the costs and charges of such collections in the manner provided by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended. Salary Authorization -Ambulance District Recreation AMBULANCE DISTRICT On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the increase in hourly paramedic rates from $24.50 to $25.50 per hour as budgeted for Fiscal Year 2007. The above resolution was put to a roll call vote: Winick Aye Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye ORAL COMMUNICATIONS Mary Stanton, Assistant to the Administrator, gave an update on the Town e-mail system. Residents were informed as to how they can sign up for Town Board agendas, Board and Committee agendas as well as emergency notifications. Brian Rohman, Larchmont Garden's Civic Association, thanked the Board for their work getting the stairwell at the train station replaced. He asked the Board for a Lake revitalization update. Mr. Altieri responded that the new start would be fall 2007. The residents were reminded that this is a County project funded by NYS whose objective is improvement of water quality. Mr. Rohman asked for an update on damage along Brookside Drive near Lansdowne Drive incurred during the last storm. The Board was not informed of any damage at Brookside and Lansdowne. Mr. Altieri said it would be added to the Highway Department's spring project list. Mr. Altieri stated that as for the paving project at the brook, bids will go out this June with a start date of July. REPORT OF COUNCIL Councilman Winick attended the Traffic Committee meeting on April 13, the major topic are concerns at Murray Ave School with regard to parking along Damon Terrace. The area was inspected by the Fire Chief, Police Chief, local officials and the Traffic Committee. It has been determined that there is an inability to get emergency vehicles down Damon Terrace during school hours. The recommendation of the Traffic Committee is a ban on parking along one side of Damon Terrace. There are possible parking replacement options that the School Board and PTA will need to address. Councilman Winick noted the Traffic Committee took no action regarding the request for overnight parking on Laurel Ave. Councilwoman Seligson attended the Zoning Board of Appeals meeting on April 6. The D.A.R.E. graduation on March 3, also attended by Supervisor O'Keeffe, Councilwoman Wittner and Councilman Odierna, was very successful. The Town Board had an all day meeting on March 3rd. She attended the Westchester County Global Warming Task Force, she will prepare a report for the Board later this month. Pat DiCioccio's retirement breakfast was on March 9th. She would like to remind residents of the No Idling Law recently passed by the Town Board. Councilwoman Wittner attended the Fields for Kids round table discussion. She attended the Senior's Saint Patrick's Day celebration, adding, the seniors are enjoying their new programs. Councilman Odierna attended the Westchester Municipal Officials meeting in Yonkers on March 3. On March 19th he attended the Human Rights Commission meeting. An issue concerning the Human Rights Commission is the use by the Journal News' police blotter in which a box is checked denoting whether the person(s) involved were of Hispanic origin. 13 MARCH 21, 2007 Supervisor O'Keeffe said she would discuss this with Police Chief Richard Rivera as well as the Town Attorney. Councilman Odierna continued stating he had attended the League of Women Voters meeting and the George Latimer and Judy Myers coffee. R.A.D.A.R. will have a kick-off campaign on April 12th to bring to the forefront the issue of underage drinking. It will take place at the Weaver Street Fire House, with attendance by school, municipal and legal officials. ADJOURNMENT On motion of Councilman Winick, seconded by Councilwoman Seligson the meeting was unanimously adjourned into Executive Session at 10:45 PM, in memory of Retired Fire Chief Ambiazi who passed away.
