BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson ABSENT: Councilman Paul A. Winick ALSO PRESENT: Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney Christina Battalia, Deputy Town Clerk Cindy Atiencia, Deputy Town Clerk WORK SESSION Preliminary 2006 Financial Report Denis Brucciani, Town Comptroller addressed the Board. For discussion were reports of Fund Balances ending December 31, 2006 and Comparative Statements of Budgeted and Actual Revenues and Expenditures ending December 31, 2006. It was noted that fund balances have increased in eight of the nine budget funds. Tax revenues were higher than budgeted; there was an increase in old tax payments. He added that Recreation had a great year. It was noted that the police budget was the only budget with an overage - having largely to do with more police officers going to college. The officers were utilizing something new in their contract in which the Town pays up to 12 credits per year for classes in criminal justice. There was discussion regarding the various categories used for analysis and how they relate to governance. Mr. Altieri will prepare a department by department analysis. Mr. Maker asked Mr. Altieri to ask the State whether monies collected from parking meters could be used to finance highway projects. There was discussion regarding tax arrears and how they could be collected. It was decided that after further analysis of the total arrears, the Board would further review how to proceed. There was a brief discussion regarding the water filtration plant and the law suit involving the placement of the plant which is currently stalling the project. Bridge at East Valley Stream Road Resident Esther Jay contacted Supervisor O'Keeffe stating damage had again been caused to the bridge at East Valley Stream Road. The bridge does belong to the resident but an easement agreement is in place for the Town use of the bridge. There is also an agreement not to send trucks across the bridge. Ms. Jay insists that trucks are passing and causing damage. Supervisor O'Keeffe will have a further conversation with Ms. Jay and report back to the Board. Letter from Charles Lenau Supervisor O'Keeffe received a letter from Mr. Lenau with questions and concerns regarding Garden's Lake. The Board agreed that Mr. Altieri and Supervisor O'Keeffe would respond in writing to Mr. Lenau. 2 MARCH 7, 2007 Cemeteries It was reported that Assemblyman George Latimer had offered the Town $5,000 in State funding, and asked the Town if they had a particular project in mind. The Board would contact Donald March regarding his proposal for the cemeteries which was discussed at the February 27, 2007 work session. Mamaroneck Artist Guild The Mamaroneck Artist guild has requested the use of the Town Center Court Room this June. They wish to hold a sale to raise funds to upgrade their store front on Boston Post Road. Supervisor O'Keeffe also noted that she had asked a member of the Guild to supply the Town with photographs depicting the Town to be hung at the first floor entrance to the Town Center. No Idling Signs Councilwoman Seligson provided the Board with various sign proposals. The signs will be used around the Town to alert residents of the Idling Law. There was discussion regarding which sign the Town would use. It was noted that the new law should be mentioned in the Spring Town Newsletter. Lester Place There was a letter received from a resident who lives on Lester Place requesting that the Town consider adding Lester Place to any potential legislation regarding a special parking district. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the Town Board convened into executive session to discuss Litigation. The Board reconvened into work session. Illuminated Sign Law Mr. Maker noted that the law was in its final draft, except for the foot candles section. It will then go to the Board of Architectural Review for their comment prior to the Public Hearing on April 4, 2007. Human Rights Commission Supervisor O'Keeffe reminded the Board that there is still an opening on the Human Rights Commission. Supervisor O'Keeffe asked the Board to continue to search for a member of the Hispanic community who might serve on the commission. Mr. & Mrs. Gilliams, 21 Dillon Road Supervisor O'Keeffe reported that the Gilliams had put forth a FOIL request for Town Board minutes. It was noted that the Gilliams' have some misinformation. The Town Assessor is in the process of answering their questions. Village of Larchmont Water Main It was reported that the Village of Larchmont would like to use parking Lot#3 as a starting point to re-pipe the Village's water main under the New York State Thruway. The Thruway Authority does not want the Village to run the pipe across the thruway. The concerns raised by the Town Board are how this would effect the proposed parking deck structurally as well as the timing of the project. There will be an upcoming meeting between the Village and the Town to discuss the matter further. Parking Deck Steve Altieri updated the Board on the parking deck. The issue of the arches was resolved; a modified arch would be utilized. 3 MARCH 7, 2007 Hommocks Pool The pool will be closed April 1St for four weeks to solve the drainage issues. A financial settlement between the construction company and the school district has not yet been settled. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20 PM. She then pointed out the location of exits. PROCLAMATIONS- National Red Cross Patricia A. DiCioccio, Town Clerk NATIONAL RED CROSS Councilwoman Seligson read the National Red Cross proclamation. PROCLAMATION NATIONAL RED CROSS WHEREAS: The Town of Mamaroneck is pleased to salute organizations that have throughout the years tirelessly dedicated their efforts to meeting the critical needs of people within our community and across the nation and toward improving the quality of human life, and WHEREAS: Foremost among these distinguished organizations is the NATIONAL RED CROSS, founded by Clara Barton, which remains the recognized leader in the field of humanitarian relief, assisting tens of thousands annually, and WHEREAS: The NATIONAL RED CROSS IN WESTCHESTER COUNTY has helped to improve the quality of life in our County for more than 100 years by creating a safer place to live and by enhancing individual self-reliance through emergency disaster relief, health education and training in life-saving skills, and WHEREAS: The NATIONAL RED CROSS IN WESTCHESTER COUNTY, which assists more than 70,000 individuals annually, translates our community's concern into immediate action, because when Red Cross services are needed, "Help Can't Wait,"and WHEREAS: The Town of Mamaroneck is pleased to commemorate NATIONAL RED CROSS MONTH by raising the prominent red and white flag, symbolic of the organization's efforts and achievements on behalf of those in need. NOW, THEREFORE, BE that I, Valerie Moore O'Keeffe, Supervisor of the Town IT of Mamaroneck, and the Town Board members hereby RESOLVED proclaim the month of March 2007 to be: NATIONAL RED CROSS MONTH in the Town of Mamaroneck and call upon our residents to join with us in acknowledging the manifold contributions to our community, the County of Westchester, and our nation, while expressing heartfelt gratitude for their unparalleled humanitarian efforts. 4 MARCH 7, 2007 Gwendolyn Winder thanked the Town Board and the Town of Mamaroneck. She presented the Town with a Red Cross Flag to fly on the flag pole for National Red Cross Month. PATRICIA A. DICIOCCIO Supervisor O'Keeffe announced that after more than 21 years the Town Clerk, Patricia A. DiCioccio, will be retiring and moving to Pennsylvania. Councilman Odierna read the Proclamation. PROCLAMATION- PATRICIA A. DI CIOCCIO WHEREAS: Patricia A. DiCioccio was elected Town Clerk in 1986 and is retiring after more than 21 years of dedicated service to the residents of the Town of Mamaroneck,and WHEREAS: Pat has worn many hats during her tenure in the Town including Records Management Officer, Registrar of Vital Statistics, Custodian of Elections, Notary Public, and Freedom of Information Law Officer to name a few, and WHEREAS: Prior to her election as Mamaroneck Town Clerk Pat was appointed and served as Deputy Village Clerk in the Village of Mamaroneck, and WHEREAS: Pat has over the years computerized many functions such as Burglar Alarm Billings, Parking Permits, Marriage Licenses, Hunting and Fishing Licenses and has been the official keeper of the Town Board Minutes; and WHEREAS: Pat has touched the lives of her colleagues and has been a mentor, confidant, and friend to many throughout the years;she has always been ready to "lend a helping hand",and WHEREAS: During her retirement Pat has decided to devote many of her energies to her family, including grandchildren Dakota, Julia, and Kaitleigh, as well as continue to crochet her beautiful blankets, scarves, and ponchos to her heart's delight,she will undoubtedly continue to display her generosity of spirit by involving herself in community affairs. NOW, THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of Mamaroneck, and the Town Board members hereby congratulate and thank Patricia A. DiCioccio, a true daughter of Mamaroneck, for her many years of outstanding service to our community and extend best wishes for whatever endeavors she pursues in her own inimitable way in the years to come. The Board members praised Pat for her years of wonderful service. Councilwoman Seligson said she will always remember Pat as synonymous with the Town. Mr. Altieri said the Town owed Pat a debt of gratitude for bringing computers to the Town. Councilwoman Wittner said Pat was the reason she was sitting on this Board today, as Pat was on the nominating committee. Councilman Odierna thanked Pat for all her wonderful ideas. The Board had many wonderful anecdotes to share about their many years together. The Board said they would all miss Pat very much. Ms. DiCioccio thanked everyone for their support throughout the years and for their kindnesses. She thanked her wonderful staff. PUBLIC HEARING — Creation of the Constables Law The following notice of Public Hearing was entered into the record: 5 MARCH 7, 2007 PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday March 7, 2007 at 8:15 PM in Town Center Court Room, of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled "Creation of the Constables" Law. Purpose By Local Law No.15-2006, the Town Board utilized the authority given to it by the Criminal Procedure Law and the Municipal Home Rule Law to bestow upon the Town's constables the power to issue an appearance ticket if a constable has reasonable cause to believe that the person to whom the appearance ticket is issued has violated one of the laws identified in Chapter 34 of the Code of the Town of Mamaroneck. By this amendment to Local Law No. 15—2006, the Town Board is appointing the persons who will be the constables. On motion of Supervisor O'Keeffe seconded by Councilwoman Seligson, the Public Hearing was unanimously opened. The Town Attorney explained the law. Supervisor O'Keeffe asked if anyone wished to speak for or against the proposed Local Law. Linda Harrington, 742 Forest Avenue, stated she was extremely against this law, adding there are too many people with the authority to write these tickets. David DeSanto, 450 Weaver Street, spoke against the proposed law. He was opposed to the vagueness of the title. He felt it was harassment, and it opened up civil rights issues. He felt people should not be over policed. George Roniger, 50 Stoneyside Drive, stated that this law does not add a new law, but rather enforces laws already on the books. Councilwoman Wittner further emphasized that those individuals designated as Constables would not specifically be sent out to police the Quality of Life Laws but enforcement would be an added responsibility to their current course of activities. Brian Harrington, 740 Forest Ave, questioned the Board on whether there has been an inordinate amount of violations burdening the Municipality. Supervisor O'Keeffe addressed specific laws being violated — emphasizing violations for garbage, dogs and leaf blowers as being numerous. Councilwoman Wittner stated that this issue and proposed law has been in the review process by the Board for a very long time. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the Public Hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Mamaroneck Town Board finds that the adoption of the proposed local law regarding the Creation of Constables, is hereby declared to be a Type II action under the New York State Environmental Quality Review Act (SEQRA). The above resolution was put to a roll call vote: Winick - Absent Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye On motion of Councilman Odierna, seconded by Councilwoman Wittner, the following was approved. 6 MARCH 7, 2007 Local Law No. 2 -2007 This local law shall be known as the "Creation of the Constables" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: By Local Law No.15-2006, the Town Board utilized the authority given to it by the Criminal Procedure Law and the Municipal Home Rule Law to bestow upon the Town's constables the power to issue an appearance ticket if a constable has reasonable cause to believe that the person to whom the appearance ticket is issued has violated one of the laws identified in Chapter 34 of the Code of the Town of Mamaroneck. By this amendment to Local Law No. 15–2006, the Town Board is appointing the persons who will be the constables. This local law also adds a chapter of the Code of the Town of Mamaroneck to the definition of"Quality of Life" laws. That chapter inadvertently was omitted in the prior legislation. Section 2–Amendment of a current section of the Mamaroneck Code: Section 34-2 of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: "As used in this chapter, the following terms have the meanings indicated below: CONSTABLES —The persons serving in any of the following positions in the Town of Mamaroneck: Assistant Building Inspector, Code Enforcement Officer, Director of Building Code Enforcement and Land Use Administration, Environmental Coordinator, Fire Inspector, police officer, Senior Engineer(Civil), Superintendent of Highways and Deputy Superintendent of Highways (if such a position is created). QUALITY OF LIFE LAWS –The following chapters and sections of the Code constitute the quality of life laws: A. Chapters. (1) Chapter 58, Animals. (2) Chapter 77, Conservation Areas. (3) Chapter 95, Erosion and Sediment Control. (4) Chapter 108, Fire Safety Zones. (5) Chapter 117, Garage Sales. (6) Chapter 141, Noise. (7) Chapter 148, Parks and Fields. (8) Chapter 161, Property Maintenance. (9) Chapter 173, Sewers. (10) Chapter 175, Signs. (11) Chapter 183, Solid Waste. (12) Chapter 207, Trees. (13) Chapter 231, Water. (14) Chapter 233, Waterfowl. 7 MARCH 7, 2007 B. Sections. (1) Section 106-49, Discharge compliance certificate required. (2) Section 106-58.1, Duration and hours for mechanical rock removal. Section 3—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4— Effective Date: This Local Law shall become effective upon filing with the Secretary of State. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Seligson, the Commission unanimously adjourned and reconvened the regular meeting of the Town Board. Report of Bids - TA-07-05— Grass Maintenance— Hommocks Field & Hommocks Pool The following report of bids was entered into the record: SEE ATTACHEMENT "B" AT THE END OF THE MINUTES On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby award the bid TA-07-05 - Grass Maintenance of the Hommocks Fields & Hommocks Pool to CSI Landscaping, for the years 2007 and 2008 at the total cost of$18,225.00; and BE IT FURTHER, RESOLVED, that the Town Administrator is authorized to execute said contract on behalf of the Town. Authorization to Establish Capital Project— Richbell Road Playground On motion of Councilwoman Seligson, seconded by Councilman Odierna, it was RESOLVED, that the Town Board hereby authorizes the Comptroller to establish Capital Project 27-08, account number H7197.4.7140.5002, for the Richbell Road Playground. The estimated cost of the project is $160,000.00 of which $120,000.00 will be funded through a Community Development Block Grant. Set Public Hearing - Illuminated Sign Law On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby set the date for public hearing on "Illuminated Sign" Law for April 4, 2007, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. Salary Authorization — Management & Non-Union Personnel Police Matron Substitute Crossing Guard MANAGEMENT & NON-UNION PERSONNEL Mr. Altieri explained that having now completed the re-negotiation of the CSEA collective bargaining agreement and having earlier in 2006 completed negotiations with Town Firefighters the Town Board will now consider the salary adjustments for the 20 staff members that are not associated with a bargaining unit or union. Consistent with the adjustments negotiated with the union employees, the proposed salary increases for non union and management personnel is for a 3.65% salary adjustment in 2006 and a 4% adjustment in 2007. In recognition of the Town Comptroller Denis Brucciani's accomplishments since his appointment in October 2004, the recommendation is that his 2006 salary adjustment be retroactive to October of 2005, as a form of bonus. It was also noted that this is Mr. Brucciani's first adjustment since his appointment in October of 2004. Mr. Altieri further recommended that one time bonuses in the amount of$1,500 be awarded to Town Highway Superintendent Marco Genarelli, Town Building Inspector Ron 11 MARCH 7, 2007 Carpaneto and Police Chief Richard Rivera. They are all being commended for their invaluable assistance as well as their many additional hours during the week of the US Golf Open held at Winged Foot Golf Club. The following salary schedule was entered into the record. SEE ATTACHMENT "C" AT THE END OF THE MINUTES On motion of Supervisor O'Keeffe, seconded by Councilwoman Seligson, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the salary adjustments for the 20 Management and Non Union Personnel listed above for the year 2006 at an increase of 3.65% and an increase of 4% for the year 2007; and BE IT, FURTHER RESOLVED, that the Mamaroneck Town Board does hereby approve that the 3.65% increase for Town Comptroller Denis Brucciani be retroactive to October of 2005; and BE IT, FURTHER RESOLVED, that the Mamaroneck Town Board does hereby approve the one time payment of$1,500 to Town Highway Superintendent Marco Genarelli, Town Building Inspector Ron Carpaneto and Police Chief Richard Rivera. The above resolution was put to a roll call vote: Winick Absent Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye POLICE MATRONS Mr. Altieri explained that Police Matrons assist the police department with female prisoners both in the cells and in preparing for court appearances. The increase as recommended by Detective Bob Reynolds will be the first adjustment since January 2003. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the hourly rate increase for Police Matrons from $20.00 to $25.00 per hour. Appointment of Substitute School Crossing Guard On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was 12 MARCH 7, 2007 RESOLVED, that the Mamaroneck Town Board does hereby authorize the appointment of Patricia Bargello as a substitute school crossing guard effective March 8, 2007 at a per diem rate of$69.00. Appointment of Senior Recreation Leader/Aquatics Director On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was RESOLVED, that the Mamaroneck Town Board does hereby authorize the appointment of Jennifer Williams as a Senior Recreation Leader/Aquatics Director, effective April 2, 2007at an annual salary of$48,849. The above resolution was put to a roll call vote: Winick Absent Seligson Aye Odierna Aye Wittner Aye O'Keeffe Aye ORAL COMMUNICATIONS George Roniger, Larchmont Garden's Civic Association, thanked the Board for their work on the Constable Law. Mr. Roniger stated that he as well as others in the Association were unaware of the recent Fire District bond vote for the purchase of the new fire truck. He stated that although the Town may have done due diligence-the spirit of the Law was not apparent. Councilwoman Wittner responded emphasizing that there were multiple public notices, it was on the Town web-site and the Gazette ran numerous articles as did the Sound and Town. Councilman Odierna asked Mr. Altieri for a report on the paving project at the Brook. Mr. Altieri answered that the project is moving forward with the east side of the Brook. Bids are due out in June 2007 with a start date of July 2007. Mr. DeSanto, 450 Weaver Street, stated he had called the Town last week regarding the recent flooding and had not received a call back. He stated that when he moved to his home he was told there was no significant flooding —we have had four major floods in 14 years. He asked the Board to make this a priority. Supervisor O'Keeffe responded that there has always been flooding in that area. Mr. Altieri stated that the reservoir was lowered to 80" below level, emphasizing that has never been done before. He mentioned that the Town worked to keep Bonnie Briar from developers to maintain its drainage capacity. The Board emphasized that over building throughout the County was straining the ability of land to absorb water and maintain existing infrastructure. Supervisor O'Keeffe stated that unfortunately you can not regulate other municipalities, adding the Town of Mamaroneck is considered by other municipalities as overly proactive in this area. 13 MARCH 7, 2007 The Board agreed that due to the late hour they would save Report of Council and the Supervisor's Report for the next meeting.
