BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O’Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman David J. Fishman ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Wittner, seconded by Councilman Odierna, the Work Session was unanimously opened at 5:00PM. Alarm Fees The Board discussed the current Alarm Permit fees and proposed increases. Animal Shelter Agreement As required by NYS Agriculture and Markets Law, the Town must enter into an agreement with an animal shelter for dog control services. The Town Administrator and Town Clerk reported on their meeting with the New Rochelle Humane Society. The Board would like the Town Administrator and Town Clerk to look into the services and fees charged by the Elmsford Shelter for a possible cost savings. Tree Law The Board reviewed the Town of Ossining’s Tree Ordinance, most notable the section on significant trees. ADDED ITEM School Crossing Guards The Town Board reviewed whether there were areas in the Town which do not require lunch time crossing guards. Before any changes are made the Board would need to clarify whether or not children go home for lunch. th 350 Town Anniversary th Councilwoman Seligson and Christina Battalia reported on their progress with respect to the Town’s 350 Anniversary. 1 December 15, 2010 Councilwoman Seligson noted there are still Government Efficiency Grants being offered. The Board discussed the arrear water charges that are on the regular agenda for this evening. They will be added to residents’ tax bills. The Board wondered why these arrears are allowed to go on for so long, adding the Westchester Joint Water Works needs to address this. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner the Board unanimously agreed to enter into Executive Session to discuss the employment history of a particular person. EXECUTIVE SESSION Employment History of a Particular Person On motion of Supervisor O’Keeffe, seconded by Councilwoman Seligson, the Board unanimously agreed to reenter into Work Session. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O’Keeffe at 8:30 PM, she then pointed out the location of exits. PUBLIC HEARING Amendment to Tree Law Regarding Lot Size The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING October 6, 2010 ADJOURNED TO NOVEMBER 17, 2010 ADJOURNED TO DECEMBER 15, 2010 PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, December 15, 2010 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a Local Law entitled “Amendment to the Tree Law regarding lot size” Law. Purpose: The current law regarding the removal of trees applies only to lots which exceed 20,000 square feet in size. The Town Board finds that trees on lots of any size are valuable natural resources which should be protected. Accordingly this local law removes the exemption which lots that are 20,000 square feet or less in size currently have. Section 1 – Purpose: Section 240-79 B. of the Zoning Ordinance provides restrictions on off-street parking which have become anachronistic. The law was enacted at a time when it was less common for households to have more than one automobile so that parking the family car either in a garage or more than 25 feet from the home’s front lot line was feasible. Now it is the norm for each household to have two or three cars making it impossible to park all of them in a garage or more than 25 feet from the home’s front lot line. In addition there were no SUVs or other extra large motor vehicles when the law was passed. Garages that were built prior to 1960 cannot accommodate some of today’s vehicles. Hence such vehicles are parked in driveways. For these reasons, the Town Board finds it appropriate to repeal that portion of section 240- 79 B. of the Zoning Ordinance which prohibits parking on a residential lot within 25 feet of a front property line; provided, however, that the repeal does not lead to the parking of motor vehicles in areas outside of driveways and less than 25 feet from the street in front of a home, such as in a parking space installed in front of a home and only 10 feet from the street. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: June 7, 2010 3 December 15, 2010 On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the Public hearing was unanimously reopened. Mr. Maker explained the proposed Law, adding changes were made to the previous draft based on the discussion from the previous Public Hearing, at which the Zoning Board Chair Arthur Wexler commented. The Board thanked Mr. Maker for his hard work on this long and arduous process. The Board also thanked the Zoning Board for bringing this issue to the Board. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the Public Hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was unanimously RESOLVED, that the Mamaroneck Town Board finds that the adoption of the proposed local law “Amendment of Off-street Parking in Residential Districts” Law is hereby declared to be a Type II Action, with no impact under the New York State Environmental Quality Review Act (SEQRA) and requiring no further action. On motion of Councilman Fishman, seconded by Councilman Odierna, the following Local Law was approved: Local Law No. 11 - 2010 This local Law shall be known as the “Amendment of Off-street Parking in Residential Districts” Law. Section 2 – Amendment of an existing section of Town Code: Section 240-79 B. of the Zoning Ordinance hereby is repealed and the following is substituted in its place: B. In residence districts, (i)motor vehicles shall not be parked in the portion of a lot which is bounded by the front lot line of such lot, an imaginary line running within that lot which is parallel to the front lot line and twenty-five feet distant from the front lot line and the imaginary straight lines which project from the front lot line to the points where the side walls of the dwelling on such lot meet the front wall of that dwelling and 4 December 15, 2010 (ii)(a) motor vehicles shall not be parked within five feet of a side lot line or five feet of a rear lot line nor (b) shall the area of a lot lying within five feet of a side lot line or within five feet of a rear lot line be developed for travel by, or the parking of motor vehicles and (iii)provided the requirements of section 240-79 B. (ii) are met, motor vehicles may be parked within twenty-five feet of the front lot line in one side yard but not in both side yards. (iv) Section 240-79 B. (i) shall not apply to a.any parking space that violates that section if that parking space existed on the effective date of this law or b.any parking space in a driveway which terminates at the door by which a motor vehicle would enter a garage located on a lot. (v) Section 240-79 B. (ii) shall not apply to a.any driveway which is used by more than one lot on the effective date of this law or b.any lot created by a subdivision approved by the Planning Board if such lot or lots are designed to contain a driveway which will be used by more than one lot. Section 3 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. All citizens are invited to attend and provide the Board with written and oral comments and ask questions concerning the Town’s entire preliminary budget. The entire preliminary budget can be inspected by the public from 8:30AM to 4:30PM, in the Town Clerk’s Office, Town Center, 740 West Boston Post Road, Mamaroneck, New York. The Preliminary Budget is also posted on the Town of Mamaroneck website www.townofmamaroneck.org PLEASE TAKE FURTHER NOTICE, that the proposed salaries of the members of the Town Board are as follows: Supervisor, $37,000; Town Council (4) $6,000 each and the proposed salary for the Town Clerk is $82,000 and the Town Justices (2) $21,000. All citizens are invited to attend and provide the Commission with written and oral comments and ask questions concerning the Fire District’s entire preliminary budget. The entire preliminary budget can be inspected by the public from 8:30 AM to 4:30 PM, in the Town Clerk’s Office, Town Center, 740 West Boston Post Road, Mamaroneck, New York. The Preliminary Budget is also posted on the Town of Mamaroneck website www.townofmamaroneck.org BY ORDER OF THE BOARD OF FIRE COMMISSIONERS OF THE TOWN OF MAMARONECK Christina Battalia Town Clerk Published November 23, 2010 On motion of Councilman Fishman, seconded by Councilwoman Wittner, the Public Hearings were unanimously reopened. Mr. Altieri stated that full presentations of the 2011 Budget occurred during the last two Town Board Meetings. The Tentative Budget presented to the Town Board on October 20, 2010 called for total appropriations of $30,663,000., representing an increase of $671,000, or 2.2% over the 2010 appropriations. It called for a 7.6% increase in the tax levy, increasing it to 20.9 million dollars. This represents a 7% increase in the tax rate for the unincorporated area residents and a 32% increase for residents of the two Villages. The original proposed increase for unincorporated area residents was $371.00 on a total tax bill based on a $20,000 assessed property and for the Villages the increase was $112.00. At the Public Hearing on November 30, the Preliminary Budget presented to the public, called for a 6.2 % increase in taxes in the unincorporated area and a 30% increase for residents in the Villages. The budget before the Town Board for consideration this evening has total appropriations of $30,483,132, that is a total expense increase over 2010 of 1.6%. It calls for a tax levy increase of 1.3 million of 6.7 % - the tax levy being $20,754,570. The tax increase for unincorporated residents is 6.1%, 6 December 15, 2010 meaning that a resident of the unincorporated area will see their property taxes increase by $328.00 to a total of $5,648. For residents of the Villages, the tax rate increase is $5.31 or 30%. Their taxes to the Town for 2011 will increase by 106.00 to $453.20. The most recent adjustment to the Budget was due to a Police retirement incentive that was offered to members of the Police Department. The goal of this incentive was to reduce the total number of Police Officers from 39 to 38; the Town Board had authorized a reduction in the Police Department in 2011 from 40 to 39. Over the last two years the Police Department has taken two Police Officers out of the Budget. Mr. Altieri stated that with the one Police Officer taking advantage of the retirement incentive there was a $24,000 reduction in expenses. Mr. Altieri stated that the Budget invariable causes some pain, but added it is a very responsible budget. Mr. Altieri noted the reduction in surplus applied to the Budget of 55%, adding this was done to reposition the Town for what will be tough budget years for the next few years, while maintaining all services to the residents. Mr. Altieri finished by stating where the Town could control costs we reduced, where we could not control them they went up. Supervisor O’Keeffe stated that a tremendous amount of time and energy went into this budget by everyone. The Town Board had originally intended on a 0% increase, but quickly realized that due to constraints beyond the Town’s control that was impossible. Supervisor O’Keeffe stated that contributions to healthcare benefits will now be made by all Town employees and Elected Officials. Supervisor O’Keeffe stated this is a responsible Budget which does not change levels of service. Councilman Fishman added that the numbers don’t tell the whole story. The reductions in the number of employees reduces the totals for pensions and healthcare, adding this sets the path for future years and future Town Boards to have a better control on these stems. Councilwoman Seligson commented that the fund balance or reserve fund is a huge part of this discussion and that negotiation of this Budget makes it more difficult to explain to the public. Councilwoman Seligson continued that in general we have been taught by our Comptroller that the Town should have 10-15% of its budget in a reserve fund. The Town Board wants to make sure we maintain that, adding that it does not allow us to lower the tax rate any further. Councilwoman Seligson emphasized that the Town Board does not want to present an artificially low increase in taxes, but use up our reserves. Councilwoman Wittner stated this has always been the way the Town has done its Budgets, adding to coin a phrase used by Mr. Altieri, we do the slow and steady. The Town has never taken advantage of our surplus as we could have, stressing that a large decrease in the Budget only gets paid for in the next year. Councilwoman Wittner stated it is going to be tight moving forward and that this budget puts us in a good position for next year. Councilwoman Wittner thanked Mr. Altieri and Mr. Siligato for their long hard work on this Budget. Councilman Odierna wanted to add to what Mr. Altieri had touched upon earlier, noting we will have less employees in 2011 than the Town did in 2010, 135 to 128 full time employee. This Budget moves things around and repositions the Town for the future, adding the savings come from more than just salary decreases, such as the 30% cost of benefits. The Town has set the ground rules for ‘give backs’ which will help in the future for negotiating contractual agreements. Supervisor O’Keeffe thanked Mr. Altieri and Mr. Siligato and all the Department Heads who worked so hard at putting this Budget together and for keeping the austerity measure we had established. On motion of Councilwoman Wittner, seconded by Councilman Fishman, the Public Hearings were unanimously closed. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the following was approved, WHEREAS, on October 20, 2010 the Budget Officer submitted to the Town Clerk, the Town Supervisor and Town Board the 2011 Tentative Budget for the Town of Mamaroneck, and WHEREAS, on October 27, October 29, November 10, November 16, November 23 and December 7 of 2010 the Town Board held public work sessions to consider amendments and changes to the Tentative Budget, and 7 December 15, 2010 WHEREAS, on November 30, 2010 the Town Board held a Public Hearing on the 2011 Preliminary Budget for the Town of Mamaroneck, and WHEREAS, the 2011 Preliminary Budget which was the subject of the November 30, 2010 Public hearing has been revised and the revisions are outlined in a memorandum from the Town Administrator/Budget Officer dated December 10, 2010. NOW THEREFORE, BE IT RESOLVED, that the Town Board does hereby adopt the revised 2011 Preliminary Town of Mamaroneck Budget as the final operating budget for 2011. Approval of Fire District #1 Budget for 2011 On motion of Councilman Odierna, seconded by Councilman Fishman, the following was approved, WHEREAS, on October 20, 2010 the Budget Officer submitted to the Town Clerk/Secretary to the Fire Commission and the Fire Commissioners, the 2011 Tentative Budget for the Town of Mamaroneck Fire District #1, and WHEREAS, on October 27, October 29, November 10, November 16, November 23 and December 7 of 2010 the Town held public work sessions to consider amendments and changes to the Tentative Budget, and WHEREAS, on November 30, 2010 the Town held a Public Hearing on the 2011 Preliminary Budget for the Town of Mamaroneck Fire District #1, and WHEREAS, the 2011 Preliminary Budget which was the subject of the November 30, 2010 Public Hearing has been revised and the revisions are outlined in a memorandum from the Town Administrator/Budget Officer dated December 10, 2010. NOW THEREFORE, BE IT RESOLVED, that the Fire Commission does hereby convert the 2011 Preliminary Budget for Fire District #1, to the 2011 Final Operating Budget for the Town of Mamaroneck Fire District #1, and hereby adopts it. The above resolution was put to a roll call vote: Commissioner Fishman Aye Commissioner Seligson Aye Commissioner Odierna Aye Commissioner Wittner Aye Commissioner O’Keeffe Aye 2.Other Fire Department Business It was noted by Commissioner Wittner that the Commission received the Minutes of Fire Council for November. Commissioner Wittner stated that at the recent meeting of the Fire Council, they announced that 65 Fire Fighters were now trained for interior fires and three remaining volunteers will be receiving this training. The Fire Department will be hiring a new career Fire Fighter after the first of the year. It is unclear whether training will take place in Westchester County or due to possible budget cutting at the County level, will need to travel upstate New York for training. Commissioner Seligson stated that this is an example of how cost savings at the County level are just forced down onto the local municipalities. 9 December 15, 2010 Commissioner Wittner asked Steve for an update on the communication tower located on top of the water tanks at Winged Foot. Mr. Altieri responded that the County is putting in a new microwave antenna and also coordinating with the Westchester Joint Water Works for its installation. Commissioner Wittner announced that the last Fire Council Meeting was the last for Chief McCarthy and welcomed the new Chief Brendan Collins, First Deputy Joe Russo and Second Deputy Noah Goldberg. Commissioner Wittner read the Fire Report for the Month of November as submitted by Chief McCarthy as follows: November 2010 ALARM TYPE NUMBER Generals 23 Minors 20 Stills 0 Out of Town (Mutual Aid) 4 EMS 21 Drills 4 TOTAL 72 Total number of personnel responding: 1012 Total time working: 35 hours and 56 minutes There being no further business to come before the Commission, on motion of Commissioner Fishman, seconded by Commissioner Seligson, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1.Adoption – 2011 Budget This was done during the Public Hearing located above. 2.Apportionment of Water Arrears to Tax Levy On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following was approved, WHEREAS, pursuant to Chapter 654 of the Laws of the State of New York of 1929, as amended, and to the resolution of the Board of Trustees of the Westchester Joint Water Works at a meeting held on November 23, 2010, at which the list of arrears for water charges to the various properties in the Town of Mamaroneck as of June 30, 2010, in the aggregate amount of $25,246.67, were certified. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby authorize the inclusion in the 2010 tax levy of the Town of Mamaroneck, the arrears for water charges to the various properties in the Town of Mamaroneck as of June 30, 2010, in the aggregate amount of $25,246.67. 10 December 15, 2010 The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O’Keeffe Aye 3.Set Public Hearing – Repeal of Parking Restriction – Washington Square Mr. Altieri explained that currently overnight parking is prohibited on the east side of Washington Square to make access for emergency equipment. With the change in size of fire apparatus the Fire Department is now able to operate on Washington Square with cars parked on both sides. It is the recommendation that the Town Board repeal the overnight parking restrictions on the east side of Washington Square. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the overnight parking restriction on the east side of Washington Square for January 19, 2011 at 8:15 in the Court Room of the Town Center, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice, be posted. 4.Set Public Hearing – Parking Restriction – Edgewood Avenue The Town Board would like to have the Traffic Committee review this matter further. 5.Salary Authorization School Crossing Guard On motion of Councilwoman Wittner, seconded by Councilman Fishman, it was RESOVED, that the Mamaroneck Town Board does hereby appoint Giovanni Bianco as a School Crossing Guard effective January 2, 2011 at a daily rate of $71.00. Appointment – Coastal Zone Management Commission On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Mamaroneck Town Board does hereby reappoint Pam Michels to the Coastal Zone Management Commission retroactively thru September 1, 2010, and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective (A) immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and (B) shall expire on August 31, 2013. Approval – Housing Pro Software Upgrade On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following was approved, 12 December 15, 2010 WHEREAS, the Town of Mamaroneck Public Housing Agency utilizes a proprietary software known as “HAPPY”, and WHEREAS, the software vendor maintains strict adherence to the regulatory requirement of the US Department of Housing and Urban Development (HUD) to ensure that the Town’s program administration meets all HUD guidelines and changes in regulations. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby authorize the Housing Pro Software Upgrade for the Town of Mamaroneck Public Housing Agency, in the amount of $16,587.30 to be paid through funds from the Section 8 Program. The above resolution was put to a roll call vote: Fishman Aye Seligson Aye Odierna Aye Wittner Aye O’Keeffe Aye APPROVAL OF MINUTES – November 17, 2010 On motion of Supervisor O’Keeffe, seconded by Councilman Fishman, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the Board Minutes from the meeting of November 17, 2010. ORAL COMMUNICATIONS Brian Rohman, Larchmont Gardens’ Civic Association asked the Town Board for clarification of the use of surplus, as well as the arrear water charges, of which the Board responded. Mr. Rohman mentioned that a resident was concerned that the new planting along the Gardens’ Lake would not be appropriate. Councilwoman Wittner responded that they were very appropriate and encouraged residents to come in and see the planting scheme. In closing, Mr. Rohman asked that the Larchmont Gardens’ Civic Association be involved in any plans for a celebratory Lake opening, of which Supervisor O’Keeffe said of course. WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Fishman noted due to this evening’s Town Board Meeting, he was missing the Zoning Board Meeting. He will report on this next Town Board Meeting. The Housing Authority Meeting scheduled for this month was put off due to scheduling conflicts. 13 December 15, 2010 Councilwoman Seligson was away and did not attend any meetings as liaison. Councilwoman Seligson did note that she and Christina Battalia met to begin working on plans for the Town’s 350th Anniversary. Councilwoman Wittner noted the wonderful retirement celebration of three Recreation employees, Kenny Paterno, Mary Ellen Faulkner and Dorothy Puleo and the retirement of Giovanni Bianco of the Highway Department. Councilwoman Wittner also noted the Town’s Tree Trimming Party. Councilman Odierna attended the Planning Board Meeting; discussion involved the Cooper Lane Project. Councilman Odierna gave a brief explanation of the larger runoff pipe that was installed at the Falls, adding it made great sense to incorporate this into the developer’s project. Councilwoman Wittner interjected that this was a discussion at the Coastal Zone Management Commission, as well. Councilman Odierna attended the Board of Architectural Review (BAR) on December 16, adding that residents should be more proactive in communicating with the BAR. Councilman Odierna noted the great turnout at the Senior Citizen’s Holiday Lunch. SUPERVISOR’S REPORT Supervisor O’Keeffe reported that the Human Rights Committee has chosen Kate Bialoo, founder of the Furniture Sharehouse, as the honoree at the Dr. Martin Luther King, Jr., celebration on January 12. This year the celebration will be held at Saint Thomas Church and the speaker will be our very own Mary Stanton! Mary Stanton is the author of four books and will hold a book signing during the event.
