Appointment—Board of Assessment Review REPORTS OF THE COUNCIL TOWN CLERK'S REPORT NEXT REGULARLY SCHEDULED MEETINGS— March 20,2013 &April 3,2013 Any physically handicapped person needing special assistance in order to attend the meeting should call the Town Administrator's office at 381-7810. 1 March 6, 2013 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON MARCH 6,2013, BEGINNING AT S:OOPM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN CENTER,740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,the Work Session was unanimously opened at S:OOPM. Preliminary Impact Evaluation—Federal Budget Sequester Senior Programs—Nutrition Site& Meals on Wheels Program& PHA Housing Choice Voucher Program Additionally Present:Anna Danoy, Director of Community Services and Housing The Town Board reviewed two schedules prepared by Anna Danoy illustrating the current income and expenses of the Town's Section 8 Housing Voucher Program and the Senior Congregate and Meals on Wheels Programs. Ms. Danoy explained that reductions in federal funding would be easier to manage in the Congregate Meal Program, whereas, the Meals on Wheels Program is much more vulnerable. Ms. Danoy gave some additional information about the programs' status. Ms. Danoy explained that should further federal reductions take place in these programs, alternative funding methods and or reductions in programming would need to be addressed. The Town Board discussed the use of the Senior Citizen Trust Account to fund active programs, as well as a Public Relations Campaign for funding. The discussion continued regarding administrative costs for these programs and the difficulty in receiving Housing and Urban Development (HUD) funding. Ms. Danoy and Mr. Altieri noted that no decision by the Board was needed at this time, adding that Ms. Danoy will come back to the Town Board once federal funding has been decided. Surplus Policy The Town Board reviewed a memo prepared by Mr. Altieri dated March 2, 2013, including recommendations for a Fund Balance Policy. As has been previously discussed, the Town's Fund Balances, particularly in the Townwide Fund, have been seriously depleted. It is the recommendation of the Town Comptroller and the Town Administrator that the Town begin a fund balance recovery plan. The Town Board reviewed in detail a Fund Balance Policy in accordance with GASB Statement No. 45. Mr. Altieri will redraft the policy according to the Town Board's comments. Debriefing—Hurricane Sandy The Town's Department Heads and Staff who were involved with the Town's Hurricane Sandy response, met on January 22, 2013, to debrief the Town's response to the Hurricane and ways to improve future responses.The Town Board reviewed and discussed a memo prepared from that meeting. 2 March 6, 2013 Health Insurance Policy The Town Board continued their discussion of health care benefits for Elected Officials in retirement, and reviewed a revised draft resolution prepared by Mr. Maker. Mr. Altieri confirmed for the Town Board that a surviving eligible dependent of a retired employee is eligible for continued coverage, but pays one hundred percent of the premiums. Mr. Altieri still needs to confirm whether at retirement an elected official can opt into the health care program even if they were not in the program before retirement. Mr. Maker was instructed to add to the resolution verbiage regarding the ability to go from single coverage to family coverage after the death of a spouse who was an elected official. Update—Madison Road Development(Cambium) No discussion ADDED ITEM Board of Assessment Review Supervisor Seligson stated that the Board of Assessment Review currently has only five Members and with Grievance Day approaching it is important to have an Alternate. The Town Board reviewed the resume of Eve Neuman as Alternate. On motion of Councilwoman Wittner,seconded by Councilwoman Katz,the Board unanimously Agreed to add the appointment of Eve Neuman as Alternate member#1 to the Board of Assessment Review to this evening's Agenda. On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,the Board unanimously agreed to enter into an Executive Session to discuss the Bargaining Agreement with the CSEA and a Grievance filed by the Fire Fighter's Union. EXECUTIVE SESSION On motion of Councilman Odierna,seconded by Councilwoman Elkind Eney the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. SUPERVISOR'S SUMMARY REPORT Supervisor Seligson stated that the Town continues to work on Reassessment,adding that Disclosure Statements will be mailed on March 8`". Supervisor Seligson encouraged residents to attend a Workshop offered by GAR Associates. Supervisor Seligson announced the dates and times for the next Workshops. Residents wishing an informal review of their Disclosure Statements should call GAR directly to make those appointments.The Town experienced another high wind day on a recycling collection day,adding residents are asked to help clean up debris from the properties and neighborhoods. Recycling bin covers are encouraged and can be purchased at the Town Center. Supervisor Seligson announced that the Meals on Wheels program is experiencing a decrease in federal funding and is currently in a deficit situation. Supervisor Seligson wanted residents to be aware of this serious situation. 3 March 6, 2013 CITIZEN'S COMMENTS None BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson then on motion of Commissioner Elkind Eney, seconded by Commissioner Wittner,the Board of Fire Commissioners was unanimously declared open. Present were the following Members of the Commission: Commissioner: Nancy Seligson Commissioner: Phyllis Wittner Commissioner: Ernest C. Other Fire Department Business Commissioner Wittner submitted Fire Reports for the Months of January and February as submitted by Chief Russo as follows: January 2013 ALARM TYPE NUMBER Generals 41 Minors 27 Stills 5 Out of Town (Mutual Aid) 1 EMS 46 Drills 5 TOTAL 125 Total number of personnel responding: 1079 Total time working: 54 hours and 15 minutes February 2013 ALARM TYPE NUMBER Generals 18 Minors 18 Stills 3 Out of Town (Mutual Aid) 6 EMS 40 Drills 4 TOTAL 89 Total number of personnel responding: 678 Total time working: 34 hours and 37 minutes On motion of Commissioner Wittner,seconded by Commissioner Elkind Eney,the following was approved, WHEREAS,the Town of Mamaroneck Professional Firefighters Association, Local 898,on July 16,2012 filed a grievance Pursuant to Section 26 of the Collective Bargaining Agreement, and WHEREAS,the parties have agreed to a stipulation of settlement in regards to this matter. 4 March 6, 2013 NOW,THEREFORE, BE IT RESOLVED,that the Town of Mamaroneck Fire Commission herby approves the terms of the Stipulation of Settlement between the parties and hereby authorizes the Town Administrator to execute said stipulation. The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye Commissioner Wittner stated that the County will not be conducting a Fire Academy this Spring,adding it would appear this is due to budgetary restraints; Chief Russo is trying to get approval to send applicants to the Academy in Utica.The Department will be participating in the upcoming 2nd Annual St. Patrick's Day Parade in the Village of Mamaroneck. Commissioner Wittner reported that David Commender has rejoined the Fire Council. There being no further business to come before the Commission,on motion of Commissioner Katz, seconded by Commissioner Elkind Eney,the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Report of Bids- TA-13-03 Grass Maintenance—Hommocks Field &Hommocks Pool TA-13-05 Landscape Maintenance—Cemeteries& Rights of Ways On motion of Councilman Odierna,seconded by Councilwoman Elkind Eney,the following was approved, WHEREAS,on March 19,2013 the Town publicly opened and read three bids for Contract TA-13-03 Grass Maintenance—Hommocks Field & Hommocks Pool. NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby award Contract TA-13-03 Grass Maintenance—Hommocks Field & Hommocks Pool to the lowest responsible bidder, Acocella,of Scarsdale, NY at a total price of$8,510 for 2013 and $8,800 for 2014,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said Contract on behalf of the Town. The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the following was approved WHEREAS,on February 13,2013 the Town publicly opened and read two bids for Contract TA-13-05 Landscape Maintenance—Cemeteries and various Locations—2013 &2014. 5 March 6, 2013 NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby award Contract TA-13-05 Landscape Maintenance—Cemeteries and various Locations—2013 &2014 to the lowest responsible bidder,Acocella Contracting,of Scarsdale, NY,at a total price of$ 12,700 for 2013 and $13,700 for 2014,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said Contract on behalf of the Town. Authorization—Renewal of Agreement-South East Consortium RESOLVED,that the Mamaroneck Town Board does hereby approve the renewal agreement for the year 2013 between the Town of Mamaroneck and South East Consortium, for a fee, unchanged from 2012, in the amount of $25,415.00, to provide special recreational programming for residents with various developmental disabilities and special needs. Salary Authorization—Comptroller On motion of Councilman Odierna,seconded by Councilwoman Elkind Eney,the following was approved, WHEREAS,the retirement of an Intermediate Account Clerk in the Comptroller/Tax Office this March of 2013,a vacancy needs to be filled. NOW,THEREFORE, BE IT, RESOLVED,that the Mamaroneck Town Board does hereby approve the appointment of Gabriel Hernandez as a part time Intermediate Clerk in the Comptroller/Tax Office at a rate of$22.00 per hour,for a work schedule that will generally be 17-18 hours per week. Appointment—Board of Assessment Review On motion of Councilwoman Elkind Eney,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that Eve Neuman be appointed to the position of Alternate Member 1 of the Town of Mamaroneck,and BE IT FURTHER RESOLVED,that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on September 30,2017. WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilwoman Elkind Eney had nothing to report since the Board met just last week, but noted her attendance at the senior arts show. Councilwoman Katz attended the League of Women Voters' Breakfast at which GAR Associates spoke about the Reassessment Project. Councilwoman Katz attended the Senior Center Art Show,adding how great and impressive it was. Councilwoman Katz reminded residents of the upcoming showings in the Town and Villages of the film 'Bag It'. 7 March 6, 2013 Councilman Odierna noted this afternoon's presentation of the Town's on-line Laws in an eCode360 presentation. Councilman Odierna noted that with the new visual screens in the Court Room a presentation of the Town's Code in the eCode360 format should be forthcoming. Councilwoman Wittner reported earlier on Fire Council. Supervisor Seligson noted that she and the Town Board attended the ribbon cutting for the new urgent care facility on Boston Post Road.Supervisor Seligson also noted her attendance at several of the events previously mentioned.Autism Speaks and NEMA(National Association of Mental Health) both requested the Town participate in activities to bring awareness to the issues of the organizations.Autism Speaks requested the Town shine blue lights on Town buildings for the month of April. NEMA requested permission to tie blue and white ribbons around trees in certain areas of the Town for the month of May. On March 19 the County Executive Rob Astorino will hold a Town Hall Meeting at the Town Center beginning at 7:OOPM. Supervisor Seligson reminded residents to sign up on the Town's web-site for information from the Town.
