BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Wittner,seconded by Councilwoman Katz,the Work Session was unanimously opened at S:OOPM. TAKEN OUT OF ORDER Zoning Board Request Regarding Hearing Notice Signs—Chairman,Zoning Board Additionally Present:Arthur Wexler,Chair of the Zoning Board of Appeals Mr.Wexler asked the Town Board to consider giving the Zoning Board some discretion in hearing applications from residents',who by unforeseen circumstances, may not have met the signage requirement for notifying the public of their application. For instance,the Zoning Board could not hear from an applicant,due to the applicant's signage being blown away during the last hurricane. Mr.Wexler would like the Zoning Board to be able to accept some forms of reasonable compliance. The Town Board also discussed a two tiered notification,so that when a Zoning application is received that will disturb more than 50%of the property,a broader notification would be required. Mr. Maker will review this legislation further. Reusable Bag Law Additionally Present: Jay Peitz, Vice President of Public Affairs for the Food Industry Alliance of New York State, Inc. Supervisor Seligson stated that the Town has received documents from the law firm of Shamberg Marwell &Hollis, P.C.that will require additional research by the Town.Supervisor Seligson stated that her office, with help from Mr. Maker,will be reviewing these documents,adding that this may take some time. Mr. Maker stated that the Town should consider cancelling the adjourned Public Hearing and at such time when the Town Board is ready to move forward,a new Public Hearing can be set and published. This was added as an item to Affairs of the Town for this evening. On motion of Councilwoman Wittner,seconded by Councilwoman Katz,the Town Board unanimously agreed to enter into a closed session in order to receive advice of Counsel. CLOSED SESSION Advice of Counsel 2 April 17,2013 Westchester County Housing Settlement Model Housing Ordinance Although listed separately on the Agenda these items were discussed in tandem. Supervisor Seligson wanted the Town Board to be aware of the recent ruling against the County Executive's policy of not requiring landlords to accept any 'sources of income' from tenants. The County says they will now comply with this requirement agreed to in the Housing Settlement. Supervisor Seligson and Anna Danoy attended the Urban County Consortium meeting with Norma Drummond and Mike Blau, including other Westchester Municipalities, to discuss the recent letter the Municipalities received from the Federal Monitor. The consensus was that the tone of this letter was quite different from previous correspondence and although not required, a response was seriously warranted. Supervisor Seligson stated that municipalities were advised to review the letters for inaccuracies.The Town asked for an extension of time to respond, and now has until May 18`", to respond. This Meeting was also an opportunity to notify attendees of which municipalities have adopted a Model Ordinance, as well as how many affordable units are currently under way in the County. Eleven out of 33 of the eligible municipalities have adopted a form of the Model Housing Ordinance. The Town Board reviewed the Town's timing regarding an adoption of a Model Housing Ordinance, and stated that Mr. Maker should include the Model Housing Ordinance in the Zoning Amendment the Town is currently working on. Supervisor Seligson and Mr. Altieri asked the Housing Authority to meet with them to discuss adding additional affordable housing to the Hommocks Apartments to meet the requirements of the Model Housing Ordinance. There are some legal issues that need to be discussed further, notably whether adding additional affordable housing would affect future bonding. Urban County Consortium Supervisor Seligson explained that the Town should consider rejoining the Consortium. Although there are some Municipalities that do not anticipate applying for funding through Community Development Block Grants anytime in the near future, there are other Municipalities that have a significant need for this funding and the Town's participation in the Consortium affects that. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. SUPERVISOR'S SUMMARY REPORT Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 PM this evening, adding this is an open meeting that all residents'are welcomed to attend. Supervisor Seligson announced that with the help of the Larchmont and New Rochelle Rotary Clubs,as well as the Iona Fraternity Pi Kappa Phi,a cleanup of the Premium March took place. The Town displayed photos on wide screen of the cleanup project. Supervisor Seligson explained that this area was hit hard by Super Storm Sandy, noting that the forest area was leveled. Tree stumps and limbs,as well as floatable garbage,were pushed up into the marsh. Supervisor Seligson is happy to report that the volunteers reestablished the trail,designated the entrance with logs,and removed construction debris from the river and many bags of garbage and recyclable debris from the marsh.On April 28,the Town will hold a clean-up day at the Hommocks Conservation Area,which was also hit hard by Super Storm Sandy. 3 April 17,2013 Construction at the Cambium,formerly known as Forest City, has begun and the Town, has received complaints from residents about the noise. Residents asked for clarification of the Town's Noise Ordinance. Supervisor Seligson described the Town's Noise Ordinance and the three phases that will take place for the project,over the next 22 months. Notices explaining the construction timing and noise ordinance will be distributed to the residences in the affected area. Informal meetings for revaluation continue until April 22 with GAR Associates. On April 21,the League of Women Voters will hold a Sustainable Yard Sale,with the proceeds going to the Hommocks Ice Rink Trust Fund for the renovationof the ice rink.Supervisor Seligson stated that she has heard from a number of residents who are unhappy with the parking increase for seniors'in the 24 Hour Parking Lot.Supervisor Seligson explained the Town's parking fee policy was to bring the fees in line with other municipalities;this is a policy the Town has been working with for the past few years. Supervisor Seligson also noted that the Town is the only municipality to offer a discounted senior rate. Supervisor Seligson stated that the Town is among the 31 eligible Westchester municipalities who received correspondence from the Federal Monitor.The Monitor is working for the Office of Housing and Urban Development(HUD)on the Westchester County Affordable Housing Settlement. Supervisor Seligson stated that this letter was the most focused and personalized that the Town has received. There has been a flurry of meetings in response to the letters',and concern over possible inaccuracies. The Town will respond tothe Monitor's letter by May 18. Supervisor Seligson noted that although these letters were addressed to the local Municipalities,we are not a party to the suit. Supervisor Seligson noted the sadness we all feel over the bombings in Boston and what a tragedy it is. Residents'should feel confident that our emergency responders are well trained and well equipped. CITIZEN'S COMMENTS Ruth Campanelli addressed the Town Board,stating that although she frequently comes representing the Larchmont Gardens'Civic Association,tonight she is here as a resident. Ms. Campanelli is requesting the Town consider issuing temporary train station parking passes for those residents who may only need station parking a few times a year. Ms. Campanelli stated that although she understood that revaluation was not supposed to take into account basement areas,she thinks the difference between a 'cellar'and a finished basement should be assessed differently. Supervisor Seligson responded that GAR is using a mass appraisal process versus an appraisal process used for selling a home,adding that the general condition and size of the home is evaluated and not on dollar amounts for specific finishes. Ms. Campanelli asked whether the fencing in the Gardens' Lake is meant to be visible and Mr.Altieri responded yes. PROCLAMATIONS -Arbor Day ARBOR DAY TREE CITY U.S.A.AWARD WHEREAS, Friday,April 26,2013 is recognized by the Town of Mamaroneck as Arbor Day,a special day set aside for the celebration and planting of trees. WHEREAS, This year marks the 22nd year the Town of Mamaroneck has been recognized as a "Tree City U.S.A." by the National Arbor Day Foundation. The Tree City U.S.A. Award indicates that the Town of Mamaroneck takes its tree-care responsibilities seriously with an effective community forestry program; and WHEREAS, Trees make a world of difference in our communities. Trees have long been recognized for the beauty and value they lend to homes, neighborhoods, parks and business areas. At the same time,those trees conserve energy, help clean the air, protect rivers and streams, and provide a home for wildlife in our towns and cities. 4 April 17,2013 NOW,THEREFORE, BE IT RESOLVED that I, Nancy Seligson,Supervisor,and the members of the Town Council of the Town of Mamaroneck urge all citizens to participate in programs and activities designed to furthering the establishment of trees in our community. AFFAIRS OF THE TOWN 8. Authorization—Transfer of Funds to Hommocks Ice Rink Trust Fund On motion of Councilman Odierna,seconded by Councilwoman Elkind Eney,the following was approved, WHEREAS, in March of 2013,the Hommocks Ice Rink was used as a television site by NBC Universal,and WHEREAS, the fee of $15,000.00 was debited to the Town's use of money accounts as a lease payment,and WHEREAS, as this revenue was not anticipated in the Town's 2013 Budget, the recommendation is to transfer these funds to the Hommocks Ice Rink Trust Fund. Authorization—Acceptance of FGEIS SBR/BR Zoning Amendment Supervisor Seligson stated that the Town Board has been working on this zoning change for many months. Supervisor Seligson stated that the next steps are to send out the Notice of Completion, to draft an Ordinance,and then send that draft to the Planning Board for their 45 day review period. On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the following was approved, WHEREAS, the Town Board, as Lead Agency for the SEQRA review of the proposed amendments to the Town's "B" and "SB" zoning districts (the "Project"), has completed a Final Generic Environmental Impact Statement dated March 2013. NOW,THEREFORE, BE IT RESOLVED, that the Final Generic Environmental Impact Statement dated March 2013 for the Project hereby is accepted by the Town Board, as Lead Agency for the SEQRA review of the Project,and BE IT FURTHER RESOLVED, that the Town Administrator hereby is directed to file and serve a Notice of Completion of this Final Generic Environmental Impact Statement in the manner prescribed by law. Resolution—Community Purchasing Alliance WHEREAS, In the ongoing effort to reduce Town costs for goods and services in compliance with New York State purchasing laws and the Town's Internal Control Policy, Town purchases are secured through competitive bidding, New York State Contract Pricing and various intermunicipal agreements; and WHEREAS, New York State recently amended the General Municipal Law as it relates to participation in purchasing contracts allowing municipalities the opportunity to participate in certain federal contracts as well as contracts let by out of state political subdivisions(cities,towns, villages,counties,states); and WHEREAS, the U.S, Communities Purchasing Alliance is a government purchasing cooperative that reduces the cost of goods and services by aggregating the purchasing power of public agencies nationwide; and WHEREAS, this is accomplished through the execution of so-called Master Intergovernmental Cooperative Purchasing Agreement between "Lead Public Agencies" who competitively solicit goods and services and "Contract Suppliers"who supply said goods and services,and WHEREAS, in accordance with the U.S. Communities Alliance, Master Agreements are made available by Lead Public Agencies to "Participating Public Agencies" who may purchase the goods and services available through the agreements under the same terms, conditions and pricing provided to the Lead Public Agencies,and WHEREAS, there is no cost to Public Agencies participating in the U.S. Communities Purchasing Alliance 8 April 17,2013 and as a Participating Public Agency, the Town of Mamaroneck is afforded another competitive pricing approach to procuring goods and services; now therefore be it RESOLVED, that the Town of Mamaroneck is hereby authorized to register the Town of Mamaroneck as a member in the U.S. Communities Purchasing Alliance. Cancellation of Public Hearing—Retail Bag Law On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz,the following was unanimously approved, WHEREAS,the Town Board is reviewing additional information regarding this Proposed Legislation and will reset and publish a new Public Hearing date in the near future. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby cancel the Public Hearing on the Legislation "Limiting the Use of Specific Types of Plastic Bags Law" that was previously adjourned until May 1,2013. APPROVAL OF MINUTES On motion of Councilwoman Wittner,seconded by Councilman Odierna,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby approve the Board Minutes from the Meeting of April 3,2013. WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilwoman Elkind Eney attended the Board of Architectural Review Meeting,at which they approved the Winged Foot employee residence and continue working on the fencing application from Bonnie Briar. Although the Recreation Commission did not meet this month,Councilwoman Elkind Eney announced the closing of the Memorial Park Tennis Courts for resurfacing.Councilwoman Elkind Eney announced that registration for tennis is open and spring and summer program registration is on-going. Councilwoman Elkind Eney attended the Library Board Meeting,adding that two additional writing classes are now taking place,a memoir writing class and an on-line genealogical class. The next Friends of the Library reading will be by the author of The Gift of an Ordinary Day and an upcoming Jazz Concert by the University of Albany 10 April 17,2013 professor will take place on April 28`". Councilwoman Elkind Eney also noted her attendance at the Human Rights Committee Meeting regarding the Martin Luther King,Jr. Celebration,their topic was where do we go from here? Councilwoman Elkind Eney attended the Summit Breakfast at which the Superintendants'of the local School Districts'spoke.Councilwoman Elkind Eney noted her attendance at the League of Women Voters Breakfast and the Westchester Municipal Officials Association Dinner. Councilwoman Katz noted the well attended Spelling Bee sponsored by the Library, noting that Supervisor Seligson was a wonderful Judge. Councilwoman Katz attended the 'George and Judy Coffee'at the Nautilus Diner.Councilwoman Katz attended the Traffic Committee Meeting,at which they discussed the recent incident involving a child who was struck by a car. The Committee is discussing additional signage at the Hommocks School to better alert drivers that they are in a school zone.Councilwoman Katz attended the Planning Board Meeting,at which they continue to discuss the applications' regarding Bonnie Briar and Durham Road.Councilwoman Katz attended the Village of Larchmont Committee on the Environment,as well as those events previously noted by Councilwoman Elkind Eney. Councilman Odierna attended the Library Spelling Bee,as well as the League of Women Voters Breakfast. Councilman Odierna noted the League of Women Voters topic of mentoring,adding the men should be represented by a similar organization.Councilman Odierna attended the Westchester Municipal Officials Association Dinner, noting that Brian Conybeare from News 12 spoke of the Tappan Zee Bridge Project. Councilman Odierna noted he is very pleased to see the addition of the public transportation future option to the Tappan Zee Project.Councilman Odierna spoke of the wonderful cleanup of the Premium Marsh, emphasizing what a worthy cause this was.Councilman Odierna wished his Grandson Noah, Happy Birthday! Councilwoman Wittner added to the discussion of the Premium March Conservation Area an announcement that the area was visited by the Department of State(DOS). Individuals from the DOS who represent the State's Significant Habitats came on April 8`". Councilwoman Wittner is happy to report that the representatives'from the DOS were very pleased with what they saw,adding that the Premium Marsh will continue with its'distinguished designation as a Significant Habitat. Councilwoman Wittner thanked Elizabeth Paul for maintaining the biological integrity so effectively over the years for this Town treasure. Councilwoman Wittner noted the sad passing of a former Volunteer Fire Fighter and Board Member of the Town's Ethics Committee,Valerie Kaufman. Ms. Kaufman was a dedicated nurse and a wonderful example to her profession. Supervisor Seligson advised residents of the Washington Square Area to please sign up for the Town's notification system.Supervisor Seligson stated that the Town considered sending a robo call to residents of the Washington Square Area about the construction beginning on Byron Place, but learned that only 150 residents,among thousands who live there,were actually signed up to receive them.
