HomeMy WebLinkAbout1995_04_01 Town Board Minutes SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON SATURDAY, APRIL 1, 1995 AT 8:00 AM IN THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor: Elaine Price Councilwoman: Kathleen Tracy O’Flinn Councilman: Paul A. Ryan ALSO PRESENT: Stephen V. Altieri, Town Administrator Steven M. Silverberg, Town Attorney CONVENE SPECIAL MEETING The meeting was called to order by Supervisor Price at 8:00 AM Strategic Planning The Supervisor indicated that the purpose of the meeting was to initiate a new strategic plan for the Town government. It was decided that the Board would focus on the services provided by the Town and determine those that are essential to quality of life in the community. The Board will devote its first task to a review of the services of the Highway Department. A listing was prepared of the services of the department. The listing will distinguish between those services necessary to the maintenance of the Town’s infrastructure and physical plant versus direct services to the residents. The Board specifically discussed the possibility of altering the way certain services were provided to not only save money but to also improve services in other areas by increasing the utilization of existing manpower. The Town Administrator will prepare for the Board alternatives for leaf collection and will also survey other communities with regard to the collection of recyclables of holiday weeks. Shared Services As another component of the strategic plan the Board reviewed opportunities for shared services. Shared services can be explored with regard to public works functions and the use of technology. The Town will speak to the Villages to pursue these alternatives. Resolution Cable Television Councilman Ryan presented to the Board a resolution in regard to the rates charged for TCI for the installation of cable service. On motion by Councilman Ryan and seconded by Supervisor Price it was unanimously, 11 April 1, 1995 RESOLVED, under federal and local law, the Town of Mamaroneck is permitted to regulate rates for basic cable service and equipment; and WHEREAS, on March 3, 1995, TCI East, Inc. submitted Form 1205 filings purporting to justify a reduction in basic rates proposed by UA-Columbia Cablevision of Westchester, Inc. d/b/a TCI Cable of Westchester (“TCI”); and WHEREAS, based upon the recommendation of the Larchmont-Mamaroneck Cable TV Board of Control (“Board”), the Municipality finds that additional time is required to investigate the filings; and WHEREAS, based upon the recommendation of the Board, the Municipality tolls the proposed equipment and installation rates, subject to further investigation and possible later reduction and refund, and orders TCI to cease computing certain rates in a manner that does not comply with the FCC’s rules; NOW THEREFORE, BE IT RESOLVED by the Town Board that: Section 1. Pursuant to 47 C.F.R. 76.933(a), the deadline for acting on the filings § submitted by TCI is tolled for reasons stated above. TCI’s current rates for equipment and installation shall not be increased without the prior approval of the Municipality, except as may be provided by federal law, and are being and shall be collected subject to refund and further investigation, in accordance with applicable law. Nothing in this Resolution approves or endorses the rates that were, are being or will be charged by TCI, and those rates may be further reduced to the extent those rates violate applicable laws or contracts. Section 2. TCI shall immediately cease charging on an hourly basis for aerial installations in excess of 150 feet, underground installations in excess of 150 feet, jack wall plates and fishing through walls. TCI shall immediately cease charging for restoration on any basis, other than as part of an average installation charge. TCI shall immediately cease charging on an hourly basis for installations over 150 feet and shall not add any premium or materials charge to any of its rates. Finally, TCI shall cease charging on a per- foot basis for boring of sidewalks and driveways, cutting of driveways, or any other work. As discussed in the Board’s recommendation, which are hereby made as part of this Resolution, all of the foregoing charges are contrary to the FCC’s rules. Section 3. Public notice shall be given that this Resolution has been adopted and is available for review. Land Use Regulations Counsel advised the Board that as part of its long-range planning process it may with to consider reviewing its land use regulations. Changes in the state statues warrant a review of our site plan, special permit and zoning regulations.
