HomeMy WebLinkAbout2000_01_12 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON JANUARY 12, 2000 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator Charlene Indelicato, Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. Supervisor O'Keeffe then introduced the newly elected and reelected council members, welcoming them all and saying she knew that everyone would work well together. PRESENTATION - Chair - Human Rights Commission Glenna Grey, Chair of the Human Rights Commission was introduced. Ms. Grey gave each of the Board members a copy of the Annual Report and then said that the Tri-municipal Commission had, on December 13, signed into the Westchester Human Rights Community Network. She said that the first Human Rights Commission in New York had been established in 1945 by then Governor Thomas Dewey, and on December 10, 1948 Human Rights Day in New York had been established. The Commission will be presenting the Annual Martin Luther King Jr. Awards this year on January 19, 2000 at the Emelin Theatre. She invited everyone to join in the festivities and to show support of the students who have prepared the program and responded to the Human Rights Commission sponsored logo contest. The winning logo will be unveiled at the ceremony. Ms. Grey said that the Commission is comprised of three members from the Town and three from each of the Villages of Larchmont and Mamaroneck, and there is currently a vacancy in both villages. She said that they would be discussing the establishment of a Human Rights Award for children, which would promote awareness at a younger age. She asked if there were any comments or questions. Supervisor O'Keeffe asked if the Annual Report would be made available at the local libraries, and was told they would be. She thanked Ms. Grey and reiterated the invitation to the Martin Luther King, Jr. Ceremonies to be held on January 19, at 7:30 PM at the Emelin Theatre in Mamaroneck. APPOINTMENT - Town Board Member Councilwoman Wittner moved the appointment of Nancy Seligson to the vacancy created when Supervisor O'Keeffe was elected as Supervisor. She said that Ms. Seligson was a seven year resident of the Village of Larchmont, and four year resident of the Town of Mamaroneck. Ms. Seligson had served as Co-Chair for four years on the Coastal Zone JANUARY 12, 2000 Management Commission, was President of Save the Sound, and is a respected environmentalist and is skilled in working with people and warmly regarded. Councilwoman Myers seconded the motion, saying a long search had been conducted to fill the vacancy, and many people had been interested. RESOLVED, that the Town Board of the Town of Mamaroneck does hereby appoint Nancy Seligson to fill the vacancy caused by the election of Valerie Moore O'Keeffe to the position of Supervisor, said term normally to expire on December 31, 2001, except pursuant to New York State law said position shall appear on the next general election ballot November 2000, therefore the appointment expires December 31, 2000. Ayes: Odierna, Myers, Wittner Nays: None Abstain: O'Keeffe The Town Clerk then administered the Oath of Office to Ms. Seligson, who thereupon, took her newly appointed seat. ORGANIZATIONAL MATTERS OF THE TOWN OF MAMARONECK Supervisor's Appointments Deputy Supervisor Budget Officer Supervisor O'Keeffe said that the authority to appoint a Deputy Supervisor and Budget Officer was given to the Supervisor by State law. She said Steve Altieri was therefore her appointment to the position of Budget Officer. She then announced that Paul Winick was her appointment as Deputy Supervisor. She said Mr. Winick has a distinguished career, having graduated from George Washington University Law School and the University of Buffalo with honors and had received his graduate degree from Tulane, and is presently a partner in the law firm of Thelen Reid and Priest. She met him first when he was appointed by then Supervisor Price to the Housing Authority created in the Town to develop the Hommocks Park Apartments. He has taken part in many projects including performing the citizen's survey concerning the "kiddie" pool at Hommocks School, and has shown himself to be a capable, respected person, always willing to give of himself. RESOLVED, that pursuant to the Supervisor's recommendation Stephen V. Altieri, Town Administrator be and is hereby appointed Budget Officer as of January 1, 2000 terminating December 31, 2001. RESOLVED, that pursuant to the Supervisor's recommendation Paul A. Winick be and he is hereby appointed Deputy Supervisor of the Town of Mamaroneck to serve in the absence of the Supervisor, said term to run concurrent to the Supervisor's term of office. The Town Clerk then administered the Oath of Office to Mr. Winick. 2 JANUARY 12, 2000 Mr. Winick thanked Supervisor O'Keeffe and spoke on his past involvement in the pool project and the Housing Authority. He said that he had enjoyed working to help make this a better community and felt it a privilege to serve and to live here. Councilwoman Myers congratulated Mr. Winick, adding that she was shocked at the appointment since it was the first time the appointment was not of a Board member. She said that Mr. Winick had been considered, but that she herself was fearful of appointing someone who has a spouse on the School Board as it has potential for a conflict of interest, and felt he was being inflicted on the public, without their vote. Supervisor O'Keeffe replied she would not say "inflict". She felt that she could trust Mr. Winick's judgement, and he would be sure to recuse himself when necessary. But if you disallow appointments based on spouse's position, you are diminishing an already shrinking pool. Councilwoman Wittner asked if the attorney would prepare a synopsis of duties of the Deputy Supervisor and of Mr. Winick's position as Chair of the Housing Authority and member of the Zoning Board of Appeals. Supervisor O'Keeffe said that the Board had held a Work Session this past Monday to help the Board work together in a professional manner. It had been a pretty frank and open discussion on the role of the Administrator, Supervisor and Council members as to who has what responsibility. No individual council member can represent the Town independently, we hoped we could agree to have a copy of all communications, so we could all stay informed. Fred Baron, Murray Avenue resident asked if Councilwoman Seligson had a statement to make. Councilwoman Seligson thanked Councilwoman Wittner for her kind words and interest in environmental matters. She was looking forward to working with everyone and said she had a love of this Community. Councilman Odierna said he had met with all his fellow Board members, and had interviewed Mr. Winick, and knows that he has a wonderful commitment to this Community. Civil Officers: One Year Term 3 Appointees The Supervisor then read into the record the following resolutions and asked the attorney if they could all be read then adopted. The attorney said that would be fine. RESOLVED, that Jay Reynolds is hereby reappointed as Civil Officer of the Town of Mamaroneck to serve a term of office of one year, effective January 1, 2000 and terminating on December 31, 2000; and BE IT FURTHER, RESOLVED, that Joseph Mitchell is hereby reappointed as Civil Officer of the Town of Mamaroneck to serve a term of office of one year, effective January 1, 2000 and terminating on December 31, 2000; and BE IT FURTHER, RESOLVED, that Daniel Tutolo is hereby reappointed as Civil Officer of the Town of Mamaroneck to serve a term of office 3 JANUARY 12, 2000 of one year, effective January 1, 2000 and terminating on December 31, 2000. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the above resolutions were put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye TREE COMMISSION 1 Year Term 2 Appointees RESOLVED, that Nancy Sternbenz is hereby reappointed a member of the Tree Commission of the Town of Mamaroneck to serve a term of office of one year effective January 1, 2000 and terminating on December 31, 2000; and BE IT FURTHER, RESOLVED, that Irma Volk is hereby reappointed a member of the Tree Commission of the Town of Mamaroneck to serve a term of office of one year effective January 1, 2000 and terminating on December 31, 2000. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the above resolutions were put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Comptroller: RESOLVED, that Carmine DeLuca is hereby appointed Comptroller of the Town of Mamaroneck for a term of two years commencing January 1, 2000 and terminating on December 31, 2001. Receiver of Taxes: RESOLVED, that Carmine DeLuca is hereby appointed Receiver of Taxes for the Town of Mamaroneck for a term of two years commencing January 1, 2000 and terminating on December 31, 2001. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the above resolutions were put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye 4 JANUARY 12, 2000 Wittner - Aye O'Keeffe - Aye Police Pension: RESOLVED, that Supervisor O'Keeffe and Councilwoman Myers be, and they are hereby appointed Trustees of the Police Pension Fund of the Town of Mamaroneck for the year 2000; and BE IT FURTHER, RESOLVED, that Carmine A. DeLuca be and he is appointed Treasurer of the Police Pension Fund of the Town of Mamaroneck for the year 2000. DiCioccio is hereby appointed Registrar of Vital Statistics for a term of office of four years commencing on January 1, 2000 and terminating on December 31, 2003 without additional salary compensation; and BE IT FURTHER, RESOLVED, that Carol A. Acocella is hereby appointed Deputy Registrar of Vital Statistics for a term of office of four years commencing January 1, 2000 and terminating on December 31, 2003, without additional salary compensation; and BE IT FURTHER, RESOLVED, that Patricia A. Acocella is hereby authorized to sign on the Town Clerk's checking account with the Bank of New York, Mamaroneck, New York; and BE IT FURTHER, RESOLVED, that Patricia A Samela is hereby authorized to sign on the Town Clerk's checking account with the Bank of New York, Mamaroneck, New York. 5 JANUARY 12, 2000 Town Board Meetings: RESOLVED that the regular meetings of the Town Board be held in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck at 8:15 PM on the first and third Wednesdays of each month except only one meeting will be held in July and in August, said dates to be scheduled at a later time; and BE IT FURTHER, RESOLVED, that said meetings, dates and places may be changed at the pleasure of the Board upon adequate notice being given. Official Newspapers: RESOLVED, that The Journal News, The Soundview News, Sound and Town Report and The County Press be, and they hereby are designated as the official newspapers of the Town of Mamaroneck for the purpose of publishing legal notices during 2000. Councilwoman Myers asked the reason for two official newspapers, if that did not cost more to have to publish notices in each. The Town Clerk explained it does not cost more since the notices are published in one or the other, not in both. Depositories of Funds: RESOLVED, that the following banks and trust companies are hereby designated as depositories for funds of the Town of Mamaroneck for the year 2000 to be continued in their present status: MBIA CLASS Investments, Armonk The Bank of New York County Trust Region, Mamaroneck; The Chase Manhattan Bank, N.A., Larchmont; Hudson Valley Bank, Mamaroneck; Fleet Bank, Larchmont First Union Bank, Larchmont Bank Signatures: RESOLVED, that all authority heretofore granted to withdraw funds from and to draw checks, drafts and other orders upon the Town of Mamaroneck accounts maintained at the aforesaid banks hereby is rescinded and revoked and hereafter such withdrawals, checks, drafts and other orders shall be authorized when signed by signature or facsimile signature of the Town Supervisor and Comptroller, Deputy Comptroller; and BE IT FURTHER, RESOLVED, that all withdrawals, checks, drafts and other orders relative to the Community Services Discretionary Fund located at the Bank of New York shall be authorized when signed by the signatures of Kathie Kopa, Director of 6 JANUARY 12, 2000 Community Services, and Stephen V. Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Commissioner O'Keeffe announced that Commissioner Wittner had been appointed as liaison to the Fire Council. Commissioner Wittner said that she had attended the Jan 3rd meeting of the fire council and it was impressive, Chief Liverzani conducted a tight meeting. She said that 32 of 37 men had made the points towards the service award; they were in the process of rewriting the constitution and by-laws and they had made a request to replace the mini attack vehicle. They would take the current one and give it to our Highway Department and they would purchase a larger one to help them when responding to emergencies. Commissioner O'Keeffe said the new mini attack would hold the EMS equipment which is not possible with the current vehicle. The Supervisor then read a letter received from Captain David Commender. 2. Fire Report FIRE REPORT FOR THE MONTH OF DECEMBER 1999 8 JANUARY 12, 2000 Commissioner Wittner read the following report as submitted by Chief Michael Acocella, which outlines responses to calls made during the month of December 1999. It summarizes the nature and origin of calls, the number of men responding and the total times spent at fire calls. Salary Authorizations - Police Department - Highway Department - Computer Services - Recreation POLICE OFFICER On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby authorize the payment of salary to Donn Edmonds for the position of Probationary Police officer at an annual rate of$40,012 filling the vacancy created by the December 31, 1999 resignation of Peter Persaud, effective January 6, 2000. HIGHWAY DEPARTMENT RESOLVED, that the Town Board does hereby authorize the promotion of Joseph Tunno to the position of General Foreman of the Highway Department effective retroactively to January 1, 2000 at an annual rate of$51,115. COMPUTER SERVICES RESOLVED, that the Town Board does hereby authorize the hiring of Ali Gursel as a part-time systems analyst/programmer at rate of pay of$65 per hour for the regular work schedule and an hourly rate of$90 for those hours outside the regularly scheduled day, effective immediately. Councilman Odierna said the Town should be looking at finding interns from the community and the YES office at the high school, which could be a resource for us. He added that we need to be more pro-active in this area. Councilwoman Seligson asked about a web site for the Town. Councilman Odierna said there would be a focus meeting on January 18th to outline the site and what we may want or could have available on the site. He said that there would also be a meeting of the Town Board on Monday to discuss keeping track of requests made to staff. The Supervisor said it would be a good idea to put together some kind of system, maybe a spreadsheet to track requests. RECREATION RESOLVED, that as provided for in the 2000 Town Budget that the Town Board does hereby authorize the payment of salary to the following: Tracy Augustine, Lifeguard, $9.25 per hour, effective January 12, 2000. Request Use of Voting Machines -Village of Larchmont The Town Clerk requested authorization to lend the Town's voting machines to the Village of Larchmont to enable them to hold their yearly election on March 21, 2000. She explained that other than the cost of the technicians, who set up the machines, all expenses are paid by the Village. On motion of Councilwoman Seligson, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby authorize the use of 11 voting machines by the Village of Larchmont for the March 21, 2000 election. Authorization to Consolidate Election Districts for March 7t" Primary The Town Clerk said there will be a Presidential Primary on March 7, 2000, we must adopt a Resolution consolidating the election districts and polling places to three (3). The Town Clerk has requested that we consolidate into three districts, one district for the Town, one for the Village of Larchmont and one for the Village of Mamaroneck. Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 13 JANUARY 12, 2000 ORAL COMMUNICATIONS Linda Harrington, Forest Avenue resident, said that what Councilman Odierna said about requests and complaints being tracked is a good idea, there needs to be some system to monitor and follow up on requests, especially when they occur during non-working hours. She said a few weeks ago her son had witnessed a cat being crushed by a car, which was horrible. She had called the Police to complain about cars speeding well over the 15 mph limit, and it is never enforced. But they said that there was no one available to pick up the cat from the street, that everything was closed during the weekend. She said the Police used to be able to help but they have lost their authority to handle these matter. She thought it a good idea to have someone available for these type of emergencies and Forest Avenue should go back to being a one way street, her neighbors are all in agreement. The Supervisor asked the Administrator to look into it, and he said that he would speak to the Police about radar enforcement, but there is only a limited amount of time they can do this. He said the Police had put into the budget a mechanical sign which shows the speed of cars. The Supervisor suggested that Ms. Harrington go to the Traffic Committee to voice her concerns and see what they recommend and that she would speak with Police. The Administrator said he would put the matter on the agenda for the February 15 meeting of the Traffic Committee. Councilwomen Wittner suggested a policy be established for taking care of after hours emergencies. There was then a discussion on hours for a code enforcement officer, the putting up of signs to slow traffic, and the Supervisor said that she would put same on the agenda for discussion at the next Work Session, saying speeding has been a long standing problem. Jack Bower, 17 No Chatsworth Avenue, suggested putting in speed bumps to slow traffic. He said he was here to talk about the parking problem in his area and thought the Town should consider permits for residents to park on the street. The Attorney explained special legislation would be needed for on street parking but this was a good idea because no transient would buy a permit. Mr. Bower added the signs were very confusing. The Supervisor agreed with him but the area is presently being studied and the Board is looking at the Myrtle and Chatsworth area for those type of problems. Alan Mason, Weaver Street, said there was an area north of Rockland on Weaver where there is a depressed curb, which cars tend to drive over. He said there was a bad accident with a Toyota which was speeding, went up on the curb, hit the pole, and took off. If the curb was at the correct height, it would hinder cars from going up on it. He said the other problem is that the pole looks like it's part of the line running down the street, it's an optical illusion, so maybe a reflector can be put up. Councilwoman Seligson said that traffic is a national problem, there seems to be less enforcement, or a lack of it. Peggy Miralia, 210 Hommocks Road, congratulated all the newly elected Board members and said traffic is a long standing problem, especially in her area. She said that for the last ten years she has struggled with it. There are signs around the school saying no stopping, standing or parking which are ignored and there is no enforcement around the school. She said the School Bond issue which had passed will further increase the problem. She said that she has called the Police, who have come down and given warnings, and the next day, after she called again, there was a different officer sent who when she told him the same people had been parked there the day before, responded he only saw the offense today, not 14 JANUARY 12, 2000 yesterday, so again no tickets were given. What about the safety of children, what if a fire truck couldn't make it through. Last year when she called the Police, rather than give a ticket, they went inside the school, looking for the owner of the illegally parked cars. Supervisor O'Keeffe said some action is necessary, we can't allow people to block egress and ingress for safety reasons. Enforcement is not with the school, it's the Town's responsibility. She said she had met with Sherry King, Superintendent of Schools, Debbie Chapin, Mayor of the Village of Mamaroneck, Sara Tate, Mike Blau, and Cheryl Lewy and had put it on the table that some action has to be taken. She suggested staggered hours at the start and end of the school day. But she agreed with Ms. Miralia that ticket have to be given, especially to ensure safety. There was then a lengthy discussion on possible solutions to speeders and illegal parkers. Ms. Miralia asked if someone moves into the Town do they get a packet informing them of rules and laws, since a new neighbor who pays taxes to the Village of Mamaroneck and Town had taken down a tree and the Village has no prohibition against it. Mr. Altieri said new residents are sent a packet with Town codes, description of departments, recreation brochures, etc. REPORTS OF COUNCIL Councilman Odierna said he had attended a Recreation meeting and announced a trip to see Beauty and the Beast for$45,just go to the Recreation Department to sign up or call . He said they had discussed the impact of the School Bond on our field that we just renovated at a cost of$500,000, the increased traffic with the influx of 200 more students, which includes more teachers, making the problem there even worse. Councilwoman Myers thanked the Town for sending her to the Association of Towns school in Albany. She found it informative and extremely helpful to her in her position on the Board. Councilwoman Wittner said there will be a Beautification meeting on January 22, 2000. ADJOURNMENT The Supervisor said that the next scheduled meetings would be January 26 and February 2, and wanted to adjourn the meeting in memory of James Johnston, former Town Attorney.
