CONVENE WORK SESSION
The Board convened into a Work Session at 6:45 PM in Conference Room of the Town Center.
On motion duly made and seconded the Board adjourned at 7:30 PM to Reconvene into an Executive
Session to discuss Personnel and the Sale of Land.
On motion duly made and seconded the Board adjourned at 8:00 PM to the Court Room to
Reconvene the Regular Meeting.
CALL TO ORDER
The Regular meeting of the Town Board was called to order by Supervisor Price at 8:15 PM, who
pointed out the exits.
PROCLAMATION - Bernardino DiSotto - Retirement
Present were members of Benny's family and also employees from the Building Department. The
Supervisor read the following Proclamation:

They presented a draft copy to the Board members of Controlling Nonpoint Source Pollution in
Long Island Sound. A Management Plan for the Watersheds of Stephenson Brook, Burling
Brook, Pine Brook and Larchmont Harbor, which had been prepared by the Watershed
Advisory Committee 5 and the Westchester County Department of Planning. They outlined the
plan remarking that it was in two sections, Section 1 provides for the understanding and planning
for the Long Island Watershed, outlining the County's nonpoint source pollution control program
and makes specific recommendations for controlling nonpoint source pollution in our area. They
said that it includes results of watershed analyses and recommendations to reduce the volume of
nonpoint source pollution entering Long Island Sound. Section 2 of the plan emphasizes the
threats to the water resources and identifies pollutants, and illustrates management practices to
help protect our waterways. They noted that there were also recommendations to each of the

communities on actions that could be considered in their future planning, which incorporates Best
Management Practice guidelines.
There was a discussion regarding the recommendations made for the Town for the Master Plan,
and LWRP when they are updated.
A Resolution was passed unanimously by the Town Board endorsing the principles of the WAC 5
plan titled "Controlling Nonpoint Source Pollution in Long Island Sound: A Management
Plan for the Watersheds of Stephenson Brook, Burling Brook, Pine Brook and Larchmont
Harbor' and the Town Board recommended that the Town of Mamaroneck work with the other
municipalities and the Committee on Nonpoint Source Pollution in Long Island Sound to implement
the WAC 5 plan to further the protection of water quality in the Long Island Sound watershed.
On motion of Councilman Ryan, seconded by Councilman Weprin, the following was unanimously
adopted:
WHEREAS, the Long Island Sound Study researched, monitored and
assessed the water quality of Long Island Sound, which is designated an
Estuary of National Significance under the National Estuary Program and has
produced a Comprehensive Conservation and Management Plan (COMP) for
the Sound; and
WHEREAS, the CCMP recognizes that nonpoint source pollutants
significantly degrade the quality of the Sound, and threaten the economic and
biologic values of the Sound; and
WHEREAS, the Westchester County Executive established a Committee on
Nonpoint Source Pollution in Long Island Sound (Committee) in 1992 to
respond to the concerns raised by the Long Island Sound Study; and
WHEREAS, the Committee produced a report and recommendations which
were adopted by the County Executive in 1993 to control nonpoint source
pollution in Westchester County's Long Island Sound watershed; and
WHEREAS, a Steering Committee was established to implement the
Citizen's Committee recommendations and has worked for three years to
implement an intermunicipal planning program to protect and enhance the
natural resources and water quality of the Long Island Sound watershed,
forming Watershed Advisory Committees (WACS) to further its goal of
intermunicipal watershed planning; and
WHEREAS, the Town Board of the Town of Mamaroneck recognizes that
the economic and biologic importance of Long Island Sound and its
tributaries is directly linked to water quality; and
WHEREAS, the Town of Mamaroneck's representatives on Watershed
Advisory Committee 5 (WAC 5) have been involved in the development of
the plan and its recommendations;
NOW THEREFORE, BE IT
RESOLVED, that the Town Board endorses the principles of the WAC 5
plan titled "Controlling Nonpoint Source Pollution in Long Island
Sound:A Management Plan for the watersheds of Stephenson Brook,
Burling Brook, Pine Brook and Larchmont Harbor," and
BE IT FURTHER,
RESOLVED, that the Town Board recommends that the Town of
Mamaroneck work with other municipalities and the Committee on Nonpoint

Source Pollution in Long Island Sound to implement the WAC 5 plan to
further the protection of water quality in the Long Island Sound watershed.
PUBLIC HEARING - SENIOR CITIZEN TAX EXEMPTION
On motion of Councilman Ryan, seconded by Councilwoman Wittner, the public hearing was opened
at 9:00 PM.
Supervisor Price explained that this amendment to our local law would bring the Town Code into
conformance with recent amendments to the Tax Law. She added that seniors within a certain
income level are eligible for up to a 50% reduction in their assessed valuation.
She asked if anyone wished to speak in favor or against this matter.
St. Clair Richard thought it was a great idea, and asked about some of the guidelines. The Supervisor
replied that an applicant must make a yearly application; the income of the owner or owners could not
be above $18,500, which is the maximum allowed for the full 50% reduction; and they must be 65 or
older.
Ed Clarke acknowledged that he was very much in favor of this amendment, and any Board action
that could economically help our seniors to stay in this community is applauded.
Supervisor Price noted that the exemption was a State initiative, and it had been brought to her
attention by Ed Clarke, who believed that this amendment had just been passed by the County of
Westchester Board. She then contacted George Latimer, our County Legislator, who sent the
resolution that had indeed been recently passed by the County. The Supervisor then thanked Mr.
Clarke and County Legislator Latimer for their promptness.
Ernie Odierna asked what was the maximum amount someone could make and still be eligible for a
reduction. He was told that it was $26,900 and the reduction would be 5%.
Bill O'Gorman commended the Town Board.
On motion of Councilman Ryan, seconded by Councilwoman Wittner, the public hearing was closed
at 9:20 PM.
Then on motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, the following local law
was unanimously adopted.
LOCAL LAW NO. 4 - 1997
Senior Citizen Tax Exemptions
This Local Law shall amend Local Law 12-1993, Senior Citizen Tax Exemptions
Section 1 Purpose:
The purpose of this Local Law is to amend Section 74-7 of the Code of the Town of
Mamaroneck to conform with recent amendments to the enabling provisions of Real Property
Tax Law Section 467 as it relates to income level.
Section 2 Amendments:
Section 74-7 shall be amended to read as follows:

Real property owned by persons sixty-five (65) years of age or over shall be exempt from
Town taxes, except district taxes, to the extent of fifty per centum (50%) of the assessed
valuation of such lesser percentum of accessed valuation as hereinafter specified, subject to
the following conditions:
A. The owner or all of the owners must file an application annually in the
Assessor's Office of the Town in which the real property is located. Applications must be
filed in the Assessor's Office on or before the taxable status date of the Town Assessment
Roll, which is June 1 of each calendar year.
B. In order to be eligible to apply for a partial exemption in the amount of fifty
per centum (50%) of the assessed valuation, the income of the owner or the combined
income of the owners must not exceed eighteen thousand five hundred dollars ($18,500)
from all sources as set forth in such Section 467 as amended for the twelve (12) consecutive
months prior to the date that the application is filed. Where title is vested in either the
husband or wife, the combined income may not exceed such sum.
C. The owner or all the owners of real property located in the Town who are
sixty-five (65) years of age or older and whose income or combined income from all sources
for said twelve month period exceeded the maximum amount set forth in Subsection B by
less than eight thousand four hundred dollars ($8,400) shall be eligible to apply for a partial
exemption as set forth in the following table:

D. The real property tax exemption provided herein on real property owned by
husband and wife, one (1) of whom is sixty-five (65) years of age or older, once granted,
shall not be rescinded solely because of the death of the older spouse so long as the surviving
spouse is at least sixty-two (62) years of age.
E. Title to the property must be vested in the owner or, if more than one (1), in all
the owners for at least twenty-four (24) consecutive months prior to the date that the
application is filed.
Section 3 Effective Date:
The Local Law shall take effect immediately.

PUBLIC HEARING - Proposed Sewer District Extension
Laurel Manor Subdivision
1001 Fenimore Road
On motion of Councilman Ryan, seconded by Councilwoman Wittner, the public hearing was opened
at 9:25 PM.
The Administrator recounted that in the last few months the Town Planning Board had granted
subdivision approval for the property at 1001 Fenimore Road, which is located just east of the
Scarsdale and Mamaroneck Border across from Bonnie Briar Country Club. There will be six single
family homes constructed, and as part of the subdivision approval, the developer has to provide
sanitary sewer service to each of the homes. Since the property is not part of the Town's Sewer
District, the developer petitioned the Board to extend the district, which would mean that the Town
would also levy the taxes for it. He noted that the developer would bear all costs relating to the
extension of the sewer line.
The Board questioned aspects of the proposal: the timing, the impact, they reviewed the comments
from Malcolm Pirnie, what the Town's future cost might entail.
Supervisor Price asked if anyone wished to speak in favor or against this matter.

Dear members of the Town Board:
The proposed Extension of Sewer District was heard by the Coastal Zone Management
commission (the "CZMC') at its meeting held on March 18, 1997.
By letter dated November 12, 1996, the CZMC informed the Town of Mamaroneck Planning
Board that it had determined that the Laurel Manor Subdivision proposal(which included the
extension of the sewer district) was consistent with policies 7A, 14, 17 and 44 of the Local
Waterfront Revitalization Program (the LWRP). The CZMC has further determined that the
extension of the sewer district is consistent with Policy 32A of the LWRP which promotes
direct connection to the public sewage disposal system.

Then on motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, it was
unanimously agreed to close the public hearing at 9:25 PM.

RESOLVED, that the Town Board does hereby approve the Sewer
District Extension for the Laurel Manor Development, 1001 Fenimore
Road as outlined in the Subdivision Maps and as defined by the Town
Planning Board; and
RESOLVED, that the Town Administrator be authorized to execute
all documents on behalf of the Town on the above agreement.
PRESENTATION -ANNUAL REPORT
COASTAL ZONE MANAGEMENT COMMISSION
PRESENTATION - 1996 Annual Report of Coastal Zone Management Commission
The Supervisor introduced Nancy Seligson, who was presenting the 10Th Annual Report of the
CZM.
Ms. Seligson reported that:
The Tenth Annual Report covers the year October 1995 through September
1996. That the document as did the other Annual Reports emphasizes the
ongoing nature of many of the CZMC's projects -to provide everyone with
background information, and to emphasize the ongoing nature of the CZMC's
considerations.
Thank you for this opportunity. The CZMC meets on the 4th Tues. of the
month at the Town Center- Conference Room A. All are welcome.
The Supervisor and Board members thanked her and asked if there were any questions.
Ernie Odierna informed everyone that he was opposed to the stenciling of storm drains - he felt that it
was a form of graffiti. Supervisor Price explained that the paint was of an nonpermanent nature. Bill
O'Gorman asked Nancy Seligson questions regarding any of their dealings with the Thruway
Authority.
AFFAIRS OF THE TOWN
1. SET PUBLIC HEARING DATE -ADJUSTMENT TO INCOME SCALE -
SENIOR CITIZENS TAX EXEMPTION
On motion of Councilman Ryan, seconded by Councilwoman Wittner the Public Hearing date was set
for May 7, 1997.
RESOLVED, that the Town Board does hereby set the date for the Public
Hearing on the Adjustment to Income Scale - Senior Citizens Tax Exemption for
at 8:15 PM on the 5th day of May, 1997; and
BE IT FURTHER,
RESOLVED, that the Town Clerk is authorized to publish in an official
newspaper of the Town, a notice of Public Hearing on the Senior Tax
Exemption.

2. AUTHORIZATION - RENEWAL OF LEASE AGREEMENT - MOVIEFONE
Mr. Altieri requested authorization to renew the lease agreement between the Town of Mamaroneck
and Moviefone, disclosing that Moviefone rents 36 square feet on the third floor to house a computer
that answers the phone to announce movie information, for $1320 a year. He said the renewed lease
would increase the rent amount to $1440 per year.
On Motion of Councilwoman O'Keeffe, seconded by Councilman Ryan, the lease agreement was
approved.
RESOLVED, that the Town Board does hereby authorize the
renewal of the lease agreement with Moviefone for $1440 per year
for their use of 36 square feet of space on the third floor of the Town
Center; and
BE IT FURTHER,
RESOLVED, that the Town Administrator hereby is authorized to
execute the agreement on behalf of the Town.
3. RESOLUTION TO CLOSE WAITING LIST - SECTION 8 HOUSING AGENCY
A communication was received from Kathie Kopa, Community Development Director, informing the
Board that her department would no longer be accepting requests for assistance under the Section 8
Housing, and that the Board's approval was necessary. She stated in her memo that the Budget and
Finance Department of the HUD had repeatedly urged that this action be taken by the Town Board.
Her agency had over 200 applicants on the waiting list and continuing to accept applications would be
falsely making applicants hopeful that they would receive assistance, especially since the annual
contract to the Town has been reduced by $200,000 for 1997.
On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe the resolution was
approved.
WHEREAS, the Budget and Finance Department of the US
Department of Housing and Urban Development, had repeatedly
urged the Town of Mamaroneck Public Housing Agency to close its
waiting list; and
WHEREAS, the Agency has over 200 applicants on our waiting list,
so continuing to add names seems cruel, giving false hop; and
WHEREAS, the federal government has reduced the budget by
$200,000 for fiscal year 1997;
NOW THEREFORE, BE IT
RESOLVED, that the Town Board does hereby authorize the official
closing of the Waiting List for Section 8 Housing Agency, effective
immediately, and
BE IT FURTHER,
RESOLVED, that the Town authorizes official notice of closing of
the waiting list to be published by the Public Housing Agency.

4. AUTHORIZATION - CONSULTING AGREEMENT -WARD ASSOCIATES
Ward Associates prepared the original feasibility study for the renovation of the Hommocks Fields.
Since the decision has been made to go on with the project in August, authorization was requested to
execute an agreement with Ward Associates to complete the planning for the project.
The Town Board approved said agreement with the stipulation that only Phase 1. Schematic Design
Phase and Phase 2. Design Development Phase be approved as stated on page 7, Section A. VI of the
agreement.
On Motion of Councilwoman Wittner, seconded by Councilman Ryan the Agreement was approved.
RESOLVED, that the Town Board does hereby authorize the
consulting agreement with Ward Associates of Long Island, who
will prepare plans and specifications for the bidding process on
the Hommocks Field Project, and
BE IT FURTHER,
RESOLVED, that Phase 1. Schematic Design Phase, and Phase
2. Design Development Phase be approved as stated on page
seven (7) Section A. VI of the agreement; and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized
to execute the agreement on behalf of the Town.
5. AUTHORIZATION - RETAINER AGREEMENT - RAINES & POGREBIN
Mr. Altieri requested authorization to renew the retainer agreement with Raines and Pogrebin, who
serve as the Town's special counsel for labor and personnel matters.
On motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe, the authorization was
unanimously approved.
RESOLVED, that the Town Board, Town of Mamaroneck
does hereby approve the retainer agreement with the law
firm of Rains & Progrebin for a period of two years, from
June 1, 1997 through May 31, 1999, at a fee of$5,000 per
annum; and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby
authorized to execute said agreement on behalf of the Town.
6. RESOLUTION - ADOPTION OF POLLING PLACES AND WAIVER OF

ACCESSIBILITY
The Town Clerk had sent a memo to the Board stating that the State Board of Elections requires a
Waiver be obtained for any polling site that is not accessible to the handicapped. A discussion arose
regarding handicapped accessibility at Saints John and Paul and the difficulty with accessing the
building. Councilwoman Wittner said that she would look into the matter.
On Motion of Councilwoman Wittner, seconded by Councilwoman O'Keeffe the Resolution for a
waiver was approved.
RESOLVED, that the Town Board of the Town of Mamaroneck does hereby approve the following

7. SALARY AUTHORIZATIONS - HIGHWAY DEPARTMENT
The Administrator said that Joseph Paterno had been picked to replace Benny DiSotto as General
Foreman.
On motion of Councilman Ryan, seconded by Councilwoman Wittner, it was unanimously
RESOLVED, that the Town Board does hereby authorize the
payment of salary to Joseph Paterno for services as General
Foreman, at the annual salary of $47,600 effective May 1, 1997.
On motion of Councilman Ryan, seconded by Councilman Weprin, it was unanimously
RESOLVED, that the Town Board does hereby authorize the
payment of salary Pietro Balsamo, as a part-time laborer at a rate
of$12.50/hour effective April 7, 1997.

Commissioner Wittner read the fire report for the month of March 1997.
Commissioner O'Keeffe briefly discussed the WVOX radio show on which she appeared with Dave
Commender.
Thereafter on motion made and seconded the Board of Fire Commissioners adjourned back to the
regular town meeting at 10:30 PM.
ORAL COMMUNICATIONS
Supervisor Price read a letter from Julie Gilligan regarding the expiration date of the Emergency
Tenant Protection Act. A brief discussion followed.

Enclosed please find a copy of an article in last Sunday's NY Times showing local communities in Westchester which
support extension of the Act.
Have been in touch with Suzy Oppenheimer's office and written to Larchmont trustees regarding this matter. Actually,
according to Suzy's letter it affects only a small number of older buildings and does not impede or prevent new
construction. Opponents present the issue incorrectly as affecting many more buildings/residents.
The Act not only helps long time residents stay in the community as they get older-but lowers rental costs attract
young people to Larchmont and the Town because of the easy commute and the wide variety of recreation activity.
Many of these young people buy homes in the area and they are important consumers supporting store keepers and
local professionals.
We hear a lot about low cost and middle income housing needs-but-much it to be said for the kind of old building
which I live in on Palmer Avenue. It has a mixture of older,young married and single tenants. It is convenient to
stores, shops, houses of worship, library, transportation and other professionals important to "quality of life"for all.

WHEREAS,Benny DiSotto has conscientiously and diligently served
the Town of Mamaroneck for thirty-one(31)years as general
foreman of the Highway Department;and
WHEREAS, Ben's professional expertise and attention to detail have
been repeatedly demonstrated in implementing effective town-wide
projects;and
WHEREAS, in his many years of service Benny combated blinaMs,
floods, hurricanes, and almost every other disaster known to
man with perseverance and dedication;and
WHEREAS, Benny has been an int art of the physical, aesthetic, and
structural well being of our com over three(3)decades;and
WHEREAS, Benny was aiway yone who needed him
and never turned arty op his advice;and
WHEREAS, Benny's w cerity, and wo ethic will be greatly
