HomeMy WebLinkAbout2003_09_03 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON SEPTEMBER 3, 2003 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20 PM, who then pointed out the location of exits. PUBLIC HEARING - Extension of the Boston Post Road Moratorium The Town Attorney explained adoption of this amendment would extend the moratorium from expiring on September 4, 2003 to December 31, 2003. The following Public Hearing Notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, September 3, 2003, at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider adoption of a local law Extending the Moratorium on the Boston Post Road. The purpose of this local law is to amend the local law establishing the Moratorium which the Town Board enacted Local Law No. 3-2003 which created a moratorium on development along a section of the Boston Post Road. The firm of Buckhurst, Fish and Jacquemart studied that section of the Boston Post Road and submitted to the Town Board alternatives for the zoning of the affected properties. Those alternatives were discussed at the July 9, 2003 work session of the Town Board where Buckhurst, Fish and Jacquemart was instructed to modify its proposed zoning amendment to reflect the Town Board's reaction to it. It is anticipated that the revised proposal will be received within the next thirty days at which point the Town Board can commence the procedures for amending the Town's zoning ordinance. Since such an amendment will require adherence to (i) the procedures for studying possible environmental impacts that could be wrought by such a change in zoning and (ii) the mechanisms for amending the Town's zoning laws contained in the Town's zoning ordinance, the process for amending the Town's zoning ordinance cannot be concluded by September 4, 2003 ---the date on which the moratorium is scheduled to expire. This law extends the moratorium for slightly less than four months to afford the Town Board the opportunity to complete that process. September 3, 2003 On motion of Councilwoman Myers, seconded by Councilwoman Wittner, the hearing was declared open. The Supervisor asked if there were any comments. Councilwoman Myers said she was in favor of extending the moratorium to give enough time to come up with a well thought-out plan. Councilwoman Seligson stated that originally six months was given for this, but they did not know how long the study would actually take. It seems reasonable to now allow the extension. Councilwoman Wittner also said she was in favor. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the hearing was closed. RESOLVED, that the Town Board finds that the adoption of the proposed local law will constitute a Type II action under the New York State Environmental Quality Review Act (SEQRA); and BE IT FURTHER RESOLVED, that the Town Board hereby declares itself to be lead agency with respect to the proposed action. On motion of Councilwoman Myers, seconded by Councilwoman Wittner, the following local law was unanimously adopted: LOCAL LAW NO. 16 -2003 This local law shall be known as the "Extension of the Moratorium on Development Along a Section of the Boston Post Road" Law. Section 2 -Amendment Section 240-83 (C) (2) Code of the Town of Mamaroneck hereby is amended by deleting the words "September 4" therein and substituting the words "December 31" in their place. Section 3 - Severability 2 September 3, 2003 Should any court of competent jurisdiction declare any provision of this Local Law invalid or unconstitutional, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 - Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Ayes: Seligson, Odierna, Myers, Wittner, O'Keeffe Nays: None , PUBLIC HEARING - Section 8 Administrative Plan NOTICE OF PUBLIC HEARING: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday September 3, 2003, at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to present the annual Public Housing Agency plan for the year 2004 as prescribed by HUD. PLEASE TAKE FURTHER NOTICE, that at said Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments prior thereto. On motion of Councilman Odierna, seconded by Councilwoman Seligson, the hearing was opened. Kathy Kopa, Community Services Director, presented the Plan to the Town Board (at end of minutes). She added this was the tenth year her department had received a perfect score on their plan. Supervisor O'Keeffe congratulated her. Councilwoman Wittner added the plan was detail oriented and said she had done a fine job. Councilwoman Myers asked how many people were on the waiting list for housing. Mrs. Kopa answered there are over 150 people on the list. She gives first preference to residents. The list was only open for one week because it immediately ran up to 200 names. She said to qualify depends on how many people are applying on an application. For one person $19,000 a year or under qualifies, and the scale slides up from there for more people in the household. Councilwoman Myers noted there were 260 units available in the plan but only 254 contracts signed, because she learned the program had actually maxed out on funds. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was closed. Then on motion of Councilwoman Myers, seconded by Councilwoman Wittner, the following resolution was unanimously adopted: PUBLIC HOUSING AGENCY ANNUAL PLAN FOR FISCAL YEAR 2004 WHEREAS, the Quality Housing and Work Responsibility Act of 1998 and the ensuing Housing and Urban Development requirements mandate the preparation and adoption of an annual plan for the operation of a municipal public housing agency; and 3 September 3, 2003 WHEREAS, the Town Board has reviewed the Town of Mamaroneck Public Housing Agency's annual plan for the year 2004; and WHEREAS, the Town Board has held a public hearing to present this plan to the public. NOW THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck hereby adopts the Public Housing Agency Fiscal Plan as prepared and submitted by the Public Housing Agency Administrator. Ayes: Seligson, Odierna, Myers, Wittner, O'Keeffe Nays: None , NOTICE OF PUBLIC HEARING - Rock Removal PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, September 3, 2003, at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider adoption of a local law entitled Days and Hours When Removal of Rock is Prohibited in the Town of Mamaroneck Law. The purpose of the local law is to resolve methods, dates and times of rock removal in the Town of Mamaroneck. On motion of Councilwoman Myers, seconded by Councilwoman Seligson, the Public hearing was adjourned to September 16, 2003 NOTICE OF PUBLIC HEARING - Design Requirements PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of, the Town of Mamaroneck on Wednesday, September 3, 2003, at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. , Boston Post Road, Mamaroneck, New York to consider adoption of a local law , entitled Design Requirements and Guidelines for the Improvement of Properties in Certain Non-Residential Districts of the Town of Mamaroneck. The purpose of the local law is to create the orderly and proper development of Mamaroneck's business community. On motion of Councilwoman Myers, seconded by Councilwoman Seligson, the Public hearing was adjourned to October 1, 2003 BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 9:15 PM. It summarizes the nature, the number of personnel responding, and the total time spent. Alarm Type Number , Generals 44 Minors 26 Stills 17 Out of Town (Mutual Aid) 3, EMS 9 Drills 3 TOTAL 99 Total number of personnel responding: 1508 , Total time working: 81 hours and 56 minutes , 5 September 3, 2003 The following letters were read into the record: Mamaroneck Board of Fire Commissioners, 740 West Boston Post Road, Mamaroneck, NY 10543, Re: Blackout August 14 - 15, 2003, Dear Fire Commissioners: The following is brief description of the activities of the Town of Mamaroneck Fire Department during the blackout on August 14 & 15, 2003. The fire department responded to 40 requests for assistance most notably for malfunction of a fire alarm. Over 30 members were in fire headquarters staffing the apparatus for over 24 hours. The fire department detailed R-46 with a crew to the ambulance district to assist with EMS calls as LVAC and MEMS each had one ambulance out of service. We placed a portable generator at the Winged Foot water tower to supply power to the fire department and police radios. R-6 with a crew was sent to Mamaroneck High School Post Road Gym to supply lighting and fans for the shelter. An officer of the fire department was stationed in the EOC during its operation. Your assistance to the Village in response to this unfortunate incident helped minimize any further damages to adjacent property owners. We appreciate the time your department spent in assisting the Village of Mamaroneck Volunteer Fire Department. Thank you again for your leadership and service to the Village of Mamaroneck and please extend our appreciation to your staff. AFFAIRS OF THE TOWN 1. Authorization - Settlement of Certiorari This matter was held over to the next meeting 2. Authorization - Intermunicipal Agreement - Garden's Lake The Administrator reported this was a windfall grant for the Town, which would allow for putting in a sedimentation filter to slow down the need for dredging at Garden's Lake. Councilwoman Wittner added the Town will be obligated to maintain the filter but agrees this is a wonderful grant. Councilwoman Seligson asked that the Board be kept up to date on the progress. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the Town Administrator to execute the Intermunicipal Agreement with the County of Westchester for the grant to put in a filtration system at Garden's Lake; and WHEREAS, the County desires to undertake on the Municipality's property and at no cost to the Municipality the project described herein which is designed to improve the water quality of Gardens Lake and Long Island Sound; and WHEREAS, the Municipality is willing to permit the County access to its property in order to undertake the aforementioned project NOW, THEREFORE, the Municipality is willing to permit the County access to its property in order to undertake the aforementioned project. 1. The Municipality hereby grants to the County and its authorized representatives, agents, contractors and consultants (the County ) permission to enter in and upon the property described in Schedule A (the property ), which is attached hereto and made a part hereof, in order to undertake and complete the project described in Schedule A (the project ) on the property. 2. The County shall provide at its sole cost and expense all necessary labor, supervision and equipment to undertake and complete the project other than post-construction maintenance to be performed by the Municipality. , 3. Upon completion of the project, title to the project will rest in the Municipality, and the Municipality will be responsible for maintaining the project. In no event will the County be liable for the project installed on the property. 7 September 3, 2003 4. This Agreement shall not be enforceable until signed by both parties and approved by the Office of the County Attorney (the Effective Date). The Agreement shall commence upon the Effective Date and terminate on July 30, 2005 except as extended by mutual agreement in writing by the County and Municipality. 5. The work to be performed pursuant to the terms of this Agreement shall commence on or about July 30, 2003 and shall be completed no later than July 30, 2005 except as extended by mutual agreement in writing by the County and Municipality. , 6. The County or its designee shall have the right to access the property to monitor the project for the term of this Agreement. 7. The County, upon ten (10) days notice to the Municipality, may terminate this Agreement in whole or in part when the County deems it to be in its best interest and, if at that time the project is not complete, the County will restore the property to the condition it existed at immediately prior to the County undertaking the project. Authorization - NYS DOT Snow & Ice Control Agreement On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby agree to extend the current agreement with New York State Department of Transportation for the removal of snow and ice on State roads in the Town; and BE IT FURTHER, RESOLVED, that the Town will be reimbursed in a lump sum of $9,124.15 for removal of snow and ice on Weaver Street and the Boston Post Road. This agreement is for the 20042005 season; and BE IT FURTHER , RESOLVED that the Town Board authorizes the Town Administrator to execute above-said agreement on behalf of the Town. Referral to Planning Board -Amend Environmental Forms 8 September 3, 2003 Mr. Maker explained Liz Paul had pointed out the zoning code requires an environmental form when submitting an application for a special permit. This form is no longer necessary because of the new short & full assessment forms. Therefore, in order to remove it, a referral must be made to the Planning Board and a public hearing must be held. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the amendment to the Zoning Code for November 5, 2003, at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted; and BE IT FURTHER, RESOLVED, that the matter be referred to the Planning Board for comment. 5. Set Public Hearings - a) Amendment to Chapter 147 - Parking Lots On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the amendment to Chapter 147 - Parking Lots for September 16, 2003, at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Set Public Hearing - b) Amendment to Sackett Drive Parking Ordinance On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the amendment to Sackett Drive Parking Ordinance at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted 9 September 3, 2003 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye 6. Report of Bids - Hommocks Park Ice Rink - TA 03-7 In a memo the Administrator stated the Town publicly opened and read bids for the above referenced contract. The contract was for the construction of an eating platform that would overlook the ice rink. The Town received two bids of$184,000.00 and $187,000.00. Both of these bids are far in excess of our original cost estimate of approximately $80,000.00. Why the bids were so high is yet uncertain and we will be speaking with the contractors directly to determine what is driving the cost of the project. In view of the bids received, the recommendation to the Town Board is that they be rejected at this time. On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was, RESOLVED, that the Town Board does hereby reject the bids for the Ice Rink Terrace, contract TA -03-7. Salary Authorizations - School Crossing Guard On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby authorize the payment of salary to Salvatore Margagliotta at an hourly rate of$15.00 per hour for his services as a School Crossing Guard, he will be scheduled on an as-needed basis by the Police Department. John C., Heinbockel, Key Attendant, Hommocks Pool, $7.75/hr., retroactive 08/04/03. Katelyn O'Connor, Lifeguard, Hommocks Pool, $7.50/hr., active 8/29/03. Frank Commrade, Skate Guard, Hommocks Park Ice Rink, $8/hr., active 8/29/03. Dan Smith, Alternate Manager, Hommocks Park Ice Rink, $14/hr., active 8/29/03. Approval of Minutes -June 11, 2003 On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby approve the Board minutes from the meeting of June 11, 2003 as amended. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye PROCLAMATION - CONSTITUTION WEEK WHEREAS, September 17, 2003 marks the 216th anniversary of the signing of the Constitution of the United States of America by delegates to the Constitutional Convention; and WHEREAS, No other country has been formed from so many diverse cultures, and none has ever sheltered more refugees fleeing tyranny; and WHEREAS, It is fitting and proper to accord official recognition to this magnificent document and its memorable anniversary, and to the patriotic celebrations which will commemorate it. Altieri, Town Administrator, Town of Mamaroneck Town Center, 740 W Boston Post Rd, 11 September 3, 2003 Mamaroneck, NY 10543, Dear Mr. Altieri, , I recently visited the Town Clerk's office to attain a marriage license. The clerk, Patricia DiCioccio, was extremely kind and very helpful. My fiance and I left the office so satisfied and happy after dealing with Ms. DiCioccio. , I usually don't write letters of this type but I was so impressed I wanted you to know what type of employee Ms. DiCioccio was, if you did not already know., Sincerely, Edward W. Sinclair SUPERVISOR REPORTS Supervisor O'Keeffe thanked all the volunteers and staff who helped during the blackout. She read a list of names which included: Mike Liverzani, Mike Acocella, Mary Stanton, Lt. Cindrich, Mike Orchanian. She said there were so many volunteers to thank that she has asked that a report be made to the Board by the Fire, Police and Ambulance so we can commend all the efforts made by them. She also thanked the Highway Department and the School District, especially a woman named Debbie who was extremely helpful. The Board then discussed the blackout, noting how professionally it was handled by all. REPORTS OF COUNCIL Councilman Odierna reminded everyone about the third annual walk being held by the Friends in Deed to benefit children of Larch mont-Mamaroneck casualties of 9-11. All monies raised will go into a trust for the children. The Supervisor said last Friday Governor Pataki signed a bill lowering the allowable blood alcohol level from .10 to .08 for DWI. Mayor Trifiletti, Jeanine Pirro, the four trustees from the Village of Mamaroneck, herself and Councilman Odierna attended. Councilwoman Myers said there were many upcoming events, the Youth Council will be starting up again, anyone in the tenth, eleventh, or twelfth grades living in the Town or the two villages is eligible, they can pick up applications in the Recreation Department. She said she had attended the BAR meeting. Councilwoman Seligson attended the Zoning Board meeting where they discussed the proposed Duane Reade and Commerce Bank. Councilwoman Wittner read a letter from E. Robert Wassman as follows: "E. The Highway Dept. and the Acocella Contracting Co. have done just an outstanding job. Their job organization, neatness and timely execution was most convenient to the residents. Ben Acocella kept a close eye on the crew and your Department Engineer David Goessl was right on top of everything. They were all most polite, helpful and constructive. I am very appreciative of the storm sewer extension and the other drainage work that was done to divert excess water from our sewage system. Thank you for the follow up on my request.
