BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Wittner,seconded by Councilwoman Katz,the Work Session was unanimously opened at S:OOPM. Meeting with Mayor Joshua L. Mandell Mayor Mandell spoke about the increased costs of healthcare benefits to retired employees and elected officials. Mayor Mandell feels municipalities must confront these ever increasing costs. Mayor Mandell stressed that unlike pension costs, that are 'ranged based' as a percentage of salary, healthcare costs are not 'range based' and continue to grow at an average of 8% and up. In the near future, municipalities will find that healthcare premiums exceed salaries of the highest paid employee. Mayor Mandell believes the target for reducing these costs lies with retirees, specifically post retirement healthcare. Mayor Mandell believes that before local governments can push the State on mandate relief, municipalities need to address their own set of 'mandates'. Mayor Mandell stated that the Village of Larchmont has made some critical changes in their recent collective bargaining agreements, adding the Village was helped by a number of recent retirements. New hires now contribute 25% to their healthcare costs, and post retirement the Village will contribute 50% towards retiree healthcare. Mayor Mandell stated that elected officials are a special case in that you are bargaining with yourselves; elected officials should be above this and set a precedent. Meeting with Board of Architectural Review Supervisor Seligson stated that the BAR was not invited this evening, adding she believes the Town Board first needs to create an agenda for that meeting.The Board, again, reviewed the Town Legislation creating the BAR. Supervisor Seligson asked the Board if they would object to her putting together an agenda to send to the BAR for their review prior to a meeting. The Board agreed, stressing that this will keep the discussion on point. The Town Board would like the BAR to participate in creating guidelines for Boston Post Road; creating a 'look'for the Boston Post Road. Update -EPA Order The Town Board reviewed the Illicit Discharge Study Plan submitted to the Federal Environmental Protection Agency and New York Department of Environmental Conservation by the Town's consulting engineer, Dolf Rotfeld Associates. The plan lays out the process the Town will follow to investigate the illegal discharges found in the stormwater system at Pryor Manor Road/Dillon Road and Fenbrook subdivision. Testing should be completed by the end of this summer, at which time repairs will be assessed. 1 MARCH 7, 2012 Update -Murray Avenue School Crossing The Town Board reviewed a letter from the Westchester County Department of Transportation outlining the requirements that will be imposed in order to establish a school crossing at Murray Avenue. There is a handicapped requirement in which a ramp will need to be created, and a portion of the double yellow lines will need to be removed. Councilwoman Wittner read from the County's letter in which they question the need for this,adding the County thinks it is better for the children to cross at the existing crosswalk. Due to the added costs and issues, the Board would like this readdressed with the PTA and the Traffic Committee. Mr. Altieri will put this on the agenda for the Traffic Committee, and give an estimated cost projection for the project. Added Items Meeting—George Oros,Westchester County Department of Facilities Mr. Altieri and Supervisor Seligson stated that at a recent meeting with George Oros, chief of Staff to Westchester County Executive Rob Astorino, there was discussion regarding the County's proposal for the Town taking over County Roads, specifically Murray Avenue and Palmer Avenue. The Board noted concerns about taking over such large infrastructure, but added the pluses could outweigh the minuses. The Board will await word from the County regarding an incentive program. Joint No-Idling Day Supervisor Seligson noted the upcoming event and asked if any Council Members knew who to contact at Murray Avenue School to help promote this. Councilwoman Katz suggested contacting the School Traffic and Safety Committee. The Board then briefly discussed the recent legislation passed by the City of Rye, banning the use of plastic bags. The Board would like to keep abreast of how this is working. Town Services Survey/2013 Budget The Board discussed how best to facilitate public input in the budget process. One approach the Town Departments have discussed is to use the 2004 Services Survey within a focus group approach. The Board discussed the focus groups,the use of a facilitator, costs and concerns. The Board will begin to think about who could be contacted as a facilitator and analyze those costs. Supervisor Seligson and Councilwoman Elkind Eney will reach out to their contacts for more information. Update—Reassessment Project Supervisor Seligson and Councilwoman Elkind Eney noted a recent meeting with Town resident Robert Engel. Mr. Engel has been very vocal regarding his concerns about reassessment. The Board felt this meeting went extremely well. An idea Mr. Engel suggested,was to have a weekly news article with an FAQ format.The Town has already facilitated this with Paige Rentz,of the Sound and Town. Supervisor Seligson noted that the Town will have to address the Homestead Option. The Board would like Tom Frey to come and address this during the July/August Town Board Meetings. Added Item Supervisor Seligson asked the Board to bring their calendars to the next worksession as she has a request to move the May 16`" meeting to May 17`". At the next worksession the Board will also set the July and August meeting dates if possible. Taxable Status Date Local Law Valuation Date Amendment Mr. Altieri clarified for the Board the difference in the Taxable Status Date versus the Valuation Date. This evening the Board will hold a Public Hearing on the Taxable Status Date and set a Public Hearing for the Valuation Date. 2 MARCH 7, 2012 Model Housing Ordinance At a previous worksession,the Board discussed asking Frank Fish of BFJ Planning to review a previous study they conducted regarding the inclusion of residential zoning in the B-Business Zone and the SB-Zone.The Board reviewed the current proposal from Mr. Fish,which at$14,000 was higher than they had anticipated. The Board would like Mr. Fish to resubmit a proposal without Task 3- Zoning Text and Map Amendment' work,as the Board felt Mr. Maker could do that work.The Board would like to address the Boston Post Road Corridor with respect to the Housing Settlement,adding that being proactive is beneficial to the Town. On motion of Supervisor Seligson,seconded by Councilwoman Wittner,the Board unanimously agreed to enter into an Executive Session to discuss Certiorari and a License Agreement. EXECUTIVE SESSION Certiorari License Agreement On motion of Supervisor Seligson,seconded by Councilwoman Katz the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:10 PM, she then pointed out the location of the exits. TAKEN OUT OF ORDER 1. Appointment—Town Justice Supervisor Seligson asked that the agenda be modified to move up the Appointment of Town Justice. Supervisor Seligson stated that she and the Board are pleased to announce the appointment of Ronald Meister to replace Dolores Battalia as Town Justice. Justice Battalia served for many years until her retirement at the end of January. Supervisor Seligson invited Mr. Meister to come forward to be sworn in by the Town Clerk. Mr. Meister,was accompanied by his wife Jane and their children David,Sara and Beth. Town Clerk,Christina Battalia administered the Oath of Office to Ronald Meister Justice Meister addressed the Town Board and the audience.Justice Meister thanked the Town Board for its'confidence and hopes he will repay that by serving justice wisely and fairly through his term. Justice Meister is proud to be a part of the Town team that makes living here so wonderful. SUPERVISOR'S REPORT Supervisor Seligson announced the new Web-site for the Reassessment Project,adding it will be linked very soon to the Town Web-site. Residents can visit www.mamaroneckreassessment.com. The Committee on the Environment has spearheaded an effort in which all three municipalities are involved in showing environmentally focused films.The Town hosted No-Impact Man last Monday evening. Supervisor Seligson encouraged residents to attend the upcoming films; details are on the Town's Web-site. The Town continued discussing the Housing Settlement that has been imposed on the 31 communities in Westchester County. The Town continues to look at ways to increase fair and affordable housing; one of those being the Boston Post Road Corridor. Specifically,the Town is revisiting a study done eight years ago 3 MARCH 7, 2012 that looked at adding residential zoning to that area.The Town is considering moving forward with a modest contract to update the previous study. CITIZEN'S COMMENTS Irving Scharff,of 334 Richbell Road addressed the Board and asked for a hard copy of the items that would be on the Reassessment Web-site. The Board responded,yes of course! Councilwoman Katz noted for Mr.Scharff,that the Libraries have free computer access and that they are a good resource for computer use and access to the web. PUBLIC HEARING — "Amendment to Taxable Status Date" Law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York,and pursuant to a resolution of the Mamaroneck Town Board,adopted on February 15,2012,a Public Hearing will be held on Wednesday, March 7,2012 at 8:00 PM or as soon thereafter as is possible in the Court Room of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider "Amendment to Taxable Status Date" Law Purpose: To co-ordinate the Town's taxable status date with the taxable status date of the Town of Rye so that the Village of Mamaroneck can discontinue being an assessing unit if it chooses to do so and to give the Town's assessor additional time within which to determine the taxable status of properties within the Town. The full text of this Amendment may be examined and copies obtained at the Town Clerk's office during regular hours, Monday-Friday,8:30 AM to 4:30 PM, In June,July and August until 4:00 PM at 740 W. Supervisor Seligson asked if anyone wished to comment on the proposed Local Law. Councilman Odierna noted that it is very important for property owners receiving tax exemptions to be alerted of this change. On motion of Councilwoman Katz,seconded by Councilwoman Wittner,the Public Hearing was unanimously closed. 4 MARCH 7, 2012 On motion of Councilwoman Wittner,seconded by Supervisor Seligson,it was unanimously RESOLVED,that the Mamaroneck Town Board finds that the adoption of the proposed "Amendment to Taxable Status Date" Law is hereby declared to be a Type II Action,with no impact under the New York State Environmental Quality Review Act(SEQRA)and requiring no further action. On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the following Local Law was approved: Local Law No. 3-2012 This local law shall be known as the"Election to use May 1,instead of June 1 as the Taxable Status Date" law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1—Purpose: Under section 283.141 of the Laws of Westchester County,the taxable status date for towns in Westchester County is June 1 of each year. By Local Law No.3 of 2008,the County of Westchester amended section 283.141 to allow a town to elect May 1 of each year to be its taxable status date. The Town Board finds it is in the public interest to use a taxable status date of May 1 because it will alleviate the timing difficulties with respect to accepting and processing exemption applications,finalizing other work relating to valuation and meeting the annual deadline for publishing the Tentative Assessment Roll. It also will make it possible for a Village within the Town to cease being an assessing unit if it chooses to do so, by following the procedure set forth in Real Property Tax Law§1402. Section 2—Addition of a new Article to the Mamaroneck Code: The Code of the Town of Mamaroneck hereby is amended to add Article IX to Chapter 195 thereof. Article IX Taxable Status and Valuation Dates §195-40 Legislative Findings and Intent Under section 283.141 of the Laws of Westchester County,the taxable status date for towns in Westchester County is June 1 of each year. By Local Law No.3 of 2008,the County of Westchester amended section 283.141 to allow a town to elect May 1 of each year to be its taxable status date. The Town Board finds it is in the public interest to use a taxable status date of May 1 because it will alleviate the timing difficulties with respect to accepting and processing exemption applications, finalizing other work relating to valuation,and meeting the annual deadline for publishing the Tentative Assessment Roll. It also will make it possible for a Village within the Town to cease being an assessing unit if it chooses to do so, by following the procedure set forth in Real Property Tax Law§1402. §195-41 Taxable Status Date. The taxable status date in the Town of Mamaroneck shall be May 1 of each year. Section 3—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction,such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law,which may be implemented without the invalid or unconstitutional provisions. Section 4—Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Other Fire Department Business Commissioner Wittner noted that at the past Fire Council Meeting,there was significant discussion regarding the homes on Premium Point. Many of these homes have no house number listed or visible and many of these homes refer to their address as Point Road. There are problems with dispatching through the County's Central System. This issue is being addressed with Ron Carpaneto, Director of Land Use and Building Administration and the Fire Department. The Council discussed a computer response program that displays the home and the exact location of the nearest water supply. Unfortunately,the Department did not receive a grant for this.The Village of Larchmont and the City of New Rochelle have this program and the Town Department feels it would be very beneficial for them to have it as well. The Department is working on outsourcing their Web-site maintenance,adding that continuing to do this in house is too difficult. The Department is currently in training for non firematic situations such as small space training. Mr.Altieri added that a number of Town Departments will be participating. This was approved by the Commission at a previous meeting. Mr. Hecht's letter was distributed to the Commissioners. Commissioner Wittner read,and the Commission accepted,the Service Awards Report for 2011 as submitted by Frank J.Cioffi,Service Awards Chairman. Commissioner Wittner announced the upcoming Fire on Ice Fundraiser. This year's proceeds will go to support the education of Milo DelVecchio. Robert"Bobbie" DelVecchio who was killed last year was a member of the Fire Department for many years before starting his career with the Town Highway Department. The Town Clerk noted that Greg Hubbard the Fire Department Secretary has been busy utilizing the new part-time Records Clerk in the Clerk's Office to archive and database old Fire Department records. There being no further business to come before the Commission,on motion of Commissioner Councilwoman Witmer,seconded by Commissioner Councilwoman Katz,the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN ADDED ITEM Appointment—Zoning Board of Appeals On motion of Supervisor Seligson,seconded by Councilwoman Wittner,the following was unanimously approved, WHEREAS,with the resignation of Robert Viner as member B of the Zoning Board of Appeals a vacancy now exists. NOW THEREFORE, BE IT RESOLVED,that Jeffrey L. King be appointed to fill the unexpired term of Member B,of the Zoning Board of Appeals,and BE IT FURTHER RESOLVED,that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on December 31, 2013. 2. Amendment to Administrative Manual Supervisor Seligson explained that the Town's Employee Manual did not clearly address nepotism.Through the advice of the Town's Labor Lawyer an amendment to the Employee Manual has been drafted. On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby approve the Amendment to the Employee Manual, Section 2.20 Employment of Relatives, as drafted by the Town's Labor Lawyer. 8 MARCH 7, 2012 3. Authorization—Selective Traffic Enforcement Program Agreement On motion of Councilwoman Wittner,seconded by Councilman Odierna,the following was approved, WHEREAS,the Town of Mamaroneck wishes to continue an agreement with the County of Westchester for the enforcement of various traffic laws and to reduce unsafe driving habits. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby approve the Selective Traffic Enforcement Program Grant—Intermunicipal Agreement between the Town of Mamaroneck and the County of Westchester,at an annual stipend to the Town in the amount$1,060,for the term October 1,2011 through September 30,2016,and BE IT, FURTHER RESOLVED,that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. NOW THERFORE, BE RESOLVED,that the Mamaroneck Town Board does hereby apply for recertification as an assessing unit,and BE IT, FURTHER RESOLVED,that the Town Assessor,Susan M.Thomas is hereby authorized to execute said application on behalf of the Town. 5. Report of Bids—TA-12-03 Catch Basin Cleaning Services 2012&2013 PART ONE On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,the following was approved, WHEREAS, since the first award in 2012 of an outside contractor for the catch basin cleaning,the success of the program has been an effective means of maintaining this infrastructure,and WHEREAS, because of this success the Town appropriated funds in the 2012 Budget of$29,000 to clean 273 catch basins,and WHEREAS,due to the mild 2011/2012 winter,savings can be realized in other areas within the Highway Fund Budget to make the recommendation to clean 500 catch basins. Authorization—Amendment to Capital Project 28-04 Justice Court Equipment Mr.Altieri explained that the Court has received additional grant funds in the amount of$12,000. Previous grants awarded to the Court have been for lighting in the Courtroom,office furniture and business equipment. In 2012,the Town plans to install electronic equipment including flat screen televisions and electronic connections for use by the court and the Town for presentations in the Courtroom. Set Public Hearing—Change of Valuation Date Mr.Altieri explained that in addition to the Local Law passed this evening,changing the Taxable Status Date to May 1 from June 1,the Town must also consider changing the Property Valuation Date.The following explanation is from Mr.Altieri's memo dated March 5,2012, as follows: "The Valuation Date is the date upon which the value of each property is based.The assessed value established on May 1 uses the valuation date of July 1(of the prior year)for the calculation of taxes for each property. As an example,assessed values established on July 1, 2012 will be used for the following year's calculation of taxes. WRITTEN COMMUNICATIONS None REPORTS OF COUNCIL Supervisor Seligson attended the Association of Towns'Annual Conference in New York City during Presidents'Week,adding overall it was a valuable experience. Supervisor Seligson and Steve Altieri recently met with Robert Hoch of Cablevision, regarding an upcoming rate change.Cablevision will be offering a new type of digital service. Customers with older televisions will need a converter box, but added that Cablevision has informed the Town that these boxes will be free and delivered to residents who request them. Residents should look out for mailings from Cablevision regarding these changes. Due to the lack of snow,Supervisor Seligson is happy to report that this has been good for the Highway Budget,adding the Department is very happy to be getting some additional projects done with the extra time and funds. Councilwoman Elkind Eney,attended the Mamaroneck Chamber of Commerce Meeting.The Chamber, unfortunately,will not be holding their annual Harbor Fest.The Larchmont Chamber of Commerce is planning a Restaurant Week for March 26 thru April 1; details can be found at www.larchmontchamber.com . Local author Bill Broad has anew book titled,"The Science of Yoga"and will be speaking about it at the Larchmont Library on March 25`"at 4:OOpm. Councilwoman Elkind Eney also attended the Association of Towns; of note were the workshops on Code Enforcement and Disaster Preparedness. Councilwoman Elkind Eney attended the Board of Architectural Review Meeting at which they discussed the expansion of Trader Joe's into the Bellizzi location. Councilwoman Katz also attended the Association of Towns,and found the workshops on Freedom of Information and Contract Negotiations to be very good.Councilwoman Katz attended the Planning Board Meeting,at which they discussed the new parking area for Acura on Fifth Avenue, noting it is almost complete.The Planning Board will be hearing from Trader Joe's,Winged Foot and the Durham Road Subdivision in the coming months. Councilwoman Wittner attended the Coastal Zone Management Commission Meeting.The Commission discussed the application by Bonnie Briar County Club. Although the Club was not in attendance,the Board did make the determination that the application would be detrimental to the site,adding they would rather see them take water from where it floods instead of disturbing the conservation area.The Commission heard a referral from the Manor Park Society. The issue,or question,is whether the Park Society will need a Department of Environmental Conservation Permit to do repairs to the pilings. The Coastal Zone Management Commission will be advising them on that.Councilwoman Wittner advised the Board that Marc Godick of the Coastal Zone Management Commission will be the liaison to the Town Board,adding should the Town Board have any questions,they should contact Mr.Godick. The Coastal Zone Management Commission accepted their 17'h Annual Report of which the Town Board will soon see. The Commission also agreed to revisit the Local Waterfront Revitalization Plan which was originally created in 1986, updated in 1999 and is due for an update. The Board Members all attended the Memorial Service for Lee Bloom. Councilwoman Wittner noted the eloquent remarks made by Steve Altieri. The service was a moving tribute to Lee. As a reminder the Sheldrake Environmental Center will host its Annual Fundraiser on March 301"at the Bonnie Briar County Club,adding everyone is invited. Councilman Odierna noted his enjoyment of the added time between the last meetings in which he spent time in Barbados aboard the largest sailing vessel in the world.
