Re: Renewal of Agreement Southeast Consortium 2024
Date: February 8, 2024
Attached is the proposed renewal agreement between the Town and the Southeast Consortium. The
Consortium is a group of eleven communities in Westchester that have joined together to provide
special recreation programs and opportunities for residents with intellectual and/or developmental
disabilities.
The Town of Mamaroneck was one of the original founding members of the Consortium in 1981.
Since then they have provided specialized programming for eligible residents of the Town that would
otherwise be difficult for the Town government to provide through its traditional recreation
programming. If approved, the Town's contribution to the Consortium will increase to $26,685. This
is the first price increase in eight years.
Action Requested:
Resolved that the Town Board hereby approves the 2024 agreement with the Southeast
Consortium and hereby authorizes the Town Administrator to execute the agreement and
any related documents necessary to carry out its implementation.

amount reflects a 5% increase from 2023.

' /. Inter-Agency Agreement for 2024—Town of Mamaroneck
This agreement made by and between the SEC, a not-for-profit corporation of the state of New York;
City of Rye, a municipal corporation of the state of New York; Town of Harrison/Village of Harrison, a
municipal corporation of the state of New York; Town of Mamaroneck municipal corporation of the
state of New York;Town of Pelham, a municipal corporation of the state of New York;Town of
Eastchester, a municipal corporation of the state of New York; Village of Rye Brook, a municipal
corporation of the state of New York; Village of Scarsdale, a municipal corporation of the state of New
York; Village of Port Chester, a municipal corporation of the state of New York; and the Village of
Mamaroneck, a municipal corporation of the state of New York shall enable said component
municipalities the opportunity to provide collective programs of special recreation services and respite
opportunities for residents with Intellectual and /or Developmental Disabilities(I/DD) through
participation in SEC as appropriate and available.
Now, therefore, the parties hereto agree as follows:
FIRST: The parties shall jointly operate a special recreation program for residents with
Intellectual and/or Developmental Disabilities (I/DD) residing or domiciled within the corporate limits of
their respective municipalities to the best of its capabilities and available resources.
SECOND: The program shall be funded through each municipality in accordance with a schedule
attachment hereto and main part hereto establishing respective shares which shall be in addition to any
third-party sources of funding. Said local share shall be paid to SEC at the municipalities' earliest
convenience in the current calendar year unless otherwise mutually agreed upon.
THIRD: The substantive program policy shall be the joint responsibility of all the parties, but
shall be carried out administratively by the SEC in the same manner as any other program(s) for which
said council would otherwise individually be responsible. Administrative services include, but not limited
to accounting, payroll, legal, personal, insurance and risk management. In addition, the SEC on the
behalf of the program, may apply and receive grants and other third party sources of revenue and may
further enter into agreements on behalf of the program which other governmental agencies and not-
for-profit organizations providing partial or full support of any program or activity to be provided
hereunder.
FOURTH: The Board of Directors, consisting, in part, of a designee from each component
municipality shall have policy- making power for the program, and which shall further have the power
to adopt rules, regulations, and procedures for the governing of the program affairs in a manner
consistent herewith.
FIFTH: The SEC shall procure and maintain liability insurance at its own cost and expense
relating to all activities sponsored by and performed by the program which insurance shall protect the
interest of the parties hereto as named insured's. Said insurance limit and amounts will be determined
by resolution by the Board of Directors.
SIXTH: The Chief Fiscal Officer of the SEC shall be the Treasurer.

SEVENTH: Programs shall be held through the component municipalities, utilizing existing and
available municipal/community/commercial facilities and resources.
EIGHTH: The SEC shall provide special recreation programs and respite opportunities for
component municipalities and will accommodate participants from outside the consortium area in
accordance with agency guidelines currently enforced and in place.
NINTH: The agreement shall be in effective for the calendar year 2024 and upon further
agreement of the parties, may be amended and/or extended from year to year thereafter.
TENTH: The SEC shall deliver to each component municipality a current Certificate of Insurance
verifying the existence of such insurance and naming said component municipality as Additional Insured.
The SEC shall hold harmless, indemnify, and defend the Town of Mamaroneck, its employees, officials,
and agents from any and all claims, suits and actions arising out of the activities of the special recreation
and respite programs provided by the SEC. The SEC shall provide the Town of Mamaroneck a copy of the
Certificate of Insurance naming the Town of Mamaroneck as an Additional Insured.

General:
A review of the status of capital projects is completed quarterly and reviewed with the Town Board.
The attached report is a complete listing of all open capital projects. The projects are sorted by
Department and Completed/Closed projects are provided at the bottom of the list.
In total there is $70.7 million of open projects of which the Town has expended or committed $35M
or 49% of the total value of the open projects. For each project we have listed the original project
budget, expenditures and encumbrances to date and the unexpended balance. There is also a brief
status provided for each project.

General:
In compliance with the Budget Policy the following 2023 Operating Budget amendments are
recommended for approval as they increase appropriations and close out the fiscal year.
1- Part Town Fund (Fund B)
There are several large budget transfers that were required to fund Police overtime, workers comp
settlement and a legal judgement. These expenses were covered by revenues that exceeded the budget
and some savings in employee benefits.
2- Highway Fund (DB)
Vehicle repair costs that included parts and outside services exceeded their budgets and then costs
were covered by savings in gasoline/fuel. The price of gasoline/fuel came in under budget. Organic
waste disposal exceeded budget as waste will increase as more trees are planted.
3- Fire Department (Fund SF)
Overtime and vehicle repairs were the most significant lines that exceeded their budgets. Vacancy
savings and service awards budget lines have savings that covered the expenses.

General:
In compliance with the Budget Policy, the following 2024 budget amendments are recommended for
approval:
1- Brookside Place Water Main (H1401)
Replacement of approximately 170 linear feet of 4 inch diameter asbestos water main pipe with 6
inch diameter ductile iron pipe. This project will be funded through a bond issuance that is scheduled
for a public hearing. A budget amendment is recommended below to establish a budget for the
project.
2- Ice Rink HVAC (H7224)
The bid results for the upgrade of the HVAC system at the Hommocks Ice Rink came in higher than
estimated. The ice rink emergency drainage project was completed and has funding available to
transfer. Additional funding is needed of$62k. A budget amendment to transfer the available funds
from the drainage project and a transfer from contingency is recommended to complete the project.
3.Town Center Elevator (H1614)
Additional funding is required for the installation of a fire alarm system in Town Center elevator as
part of the modernization project. A transfer from contingency is recommended below to fund the
project.
4-11. Various Projects
There are many completed projects that have remaining balances. Balances will be returned to the
fund from which the original transfer was made from for the project. Balances for projects that were
funded through the issuance of a bond, will be transferred to the debt service fund. Budget transfers
are recommended to close these projects that have been completed.

I attach a redlined version of a revised proposed amendment to the current law regarding
power tools and leaf blowers. Following up on the discussion at the February 7th work session,
the redline expands the "Purpose" clause (§141-10), pinpoints the various outlawed activities
through introductory captions (§141-12) and exempts the Town's two country clubs from the
prohibition on the use of gasoline-powered leaf blowers(§141-12[E]).
I have added new §141-14 (D) and (E) that allows an owner to defend a summons by
establishing that there is a lease that imposes the responsibility for the clean-up of leaves upon
the tenant. Concomitantly a tenant can defend a summons by proving that there is no lease that
shifts such responsibility to him/her/it. In either case, the person summoned also would have to
prove that he/she/it did not engage the person who used the Ieaf blower at a prohibited time.

This local law shall be known as the"Phase-out of Gasoline-Powered Leaf Blowers" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 —Purpose:
WILL MATCH THE PURPOSE PROVISION IN§ 141-10
Section 2—Amendment of a current article of the Mamaroneck Code:
Article II of Chapter 141 of the Code of the Town of Mamaroneck hereby is repealed and the
following substituted in its place:
Article II Restrictions on Outdoor Power Tools and Leaf Blowers
§ 141-9 Title
This article shall be known as "Restrictions on Outdoor Power Tools and Leaf Blowers."
§141-10 Purpose
In 1995, citing the unacceptable noise levels heard by residents in dozens of homes
surrounding the site where a gasoline-powered leaf blower is being used, the negative impact of
their constant use on the peace, quiet, health and welfare of the community, and noting
that their use diminishes the quality of life in our community, the Town passed a local law
that limited the use of such devices to certain months and to certain hours.
In that same local law, the Town also limited the time of day and the days when other
types of power tools or other types of equipment powered by an internal combustion engine
can be used.
Much more is now known about the effects of gasoline-powered leaf blowers upon the
environment. They emit greenhouse gases into the atmosphere and noxious fumes at ground level
that can be inhaled by persons and animals in the vicinity of their use. They generate a louder
noise over a longer distance than leaf blowers that are not powered by internal combustion
engines. Moreover, advances in technology have made electric-powered leaf blowers increasingly
more efficient and a viable alternative to gas-powered ones.
Accordingly, the Town Board finds that for the benefit of the overall the health and welfare of the
community, the use of gasoline-powered leaf blowers in the unincorporated area of the Town of
Mamaroneck should be phased out.

§141-11 Definitions
As used in this article, the following terms shall have the meanings indicated:
GASOLINE-POWERED LEAF BLOWER
Any leaf blower powered by an internal combustion engine which discharges a stream of forced
air and which is used or designed to move grass, leaves, clippings, dust, dirt or other matter by
blowing them with air emitted by such device.
LEAF BLOWER
Any motorized device that is used or designed to move grass, leaves, clippings, dust, dirt or other
matter by blowing them with air emitted by such device.
PERSON
An individual, a firm, an association, a partnership, a limited liability company or a corporation
§141-12 Restrictions
A. Times of Day when Operation of Power Tools, Equipment powered by Internal Combustion
Engines or Leaf Blowers is Illegal.
It shall be unlawful for any person in the unincorporated area of the Town to operate any power
tool, any equipment powered by an internal combustion engine or any leaf blower before 8:00 a.m.
or after 9:00 p.m. on any weekday and before10:00 a.m. and after 5:00 p.m. on Saturdays, Sundays
and on New Year's Day, Dr. Martin Luther King, Jr. Day, President's Day, Memorial Day,
Juneteenth, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and
Christmas Day.
B. Months of the Year when Operation of Leaf Blowers is Illegal.
The use of leaf blowers shall be unlawful in the unincorporated area of the Town from the first
day of June through and including the thirtieth day of September of each year. On and after
January 1, 2025, it shall be unlawful for any person in the unincorporated area of the Town to

On and after January 1, 2025, it shall be unlawful for any person in the unincorporated area of the
Town to operate a gasoline-powered leaf blower.

D. The restrictions contained in sections 141-12 A.L and B. and C. shall not apply to the Town of
Mamaroneck, the County of Westchester, the State of New York, the Mamaroneck Union Free
School District, of utility companies-or persons engaged by any of the foregoing to perform such
work.
E. The restriction contained in section 141-12 C.shall not apply to properties located in the zoning
district known as the Recreation District: R.
§ 141-13 Suspension of Title II
In the case of a severe weather or non-weather-related event, the Supervisor, in such official's sole
and unfettered discretion, may suspend this title for such period of time as the Supervisor deems
necessary or desirable to protect the overall welfare of the residents of the unincorporated area of
the Town.
§ 141-14 Penalties for offenses
A. A person shall be guilty of an offense if such person operates any power tool or any equipment
powered by an internal combustion engine in violation of any provision of this title.
B.
A person shall be guilty of an offense if such person employs a person to operate a leaf blower and
that person operates such leaf blower in violation of any provision of this title.
C.
A person who owns or leases property where a violation of this title occurs shall be guilty of an
offense.
D.
In any prosecution under this title, it is an affirmative defense that the person who owns the
property where a violation of this title occurs (1) entered into an agreement with a tenant of such
property that either allows the tenant to engage, or places upon the tenant the responsibility to
engage persons who use leaf blowers and (2) did not engage the persons who used leaf blowers on
the date and at the time specified in the summons issued to the owner.
E.
In any prosecution under this title, it is an affirmative defense that the person who leases the
property where a violation of this title occurs (1) did not enter into an agreement with the owner
of such property that either allows the tenant to engage, or places upon the tenant the

responsibility to engage persons who use leaf blowers and (2) did not engage the persons who
used leaf blowers on the date and at the time specified in the summons issued to the tenant.
PF.
A person convicted of an offense under this title shall be punished as follows:
1. For the first offense during a calendar year, with a fine of not less than $125 and not more than
$250,
2. For a second offense during the same calendar year, with a fine of not less than $250 and not
more than$500,and
3. For additional offenses during the same calendar year, with a fine of$500 for each such offense.
Section 3—Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4—Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

which as proposed, it has been determined will not result in a significant environmental effect;
and
WHEREAS, it is now desired to call a public hearing on the question of the increase and
improvement of the facilities of said Water District, in the matter described above, and to hear all
persons interested in the subject thereof, concerning the same, in accordance with the provisions
of Section 202-b of the Town Law; NOW, THEREFORE, IT IS HEREBY
ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County,
New York, as follows:
Section 1. A public hearing will be held in the Town Center, in Mamaroneck ,
