The garden will be constructed on a hillside located behind the War Memorial and across from 14 North Chatsworth Avenue. I attached a location map and some photographs of the site. Ms. Ward grew up in the community and remembers how beautiful the hillside once looked.Her family used to take photos there with her and her siblings wearing their Easter clothes when she was growing up. The hillside has become less and less attractive over the years and she wanted to have it redone in memory of her late father. She approached us with the idea last year and has been working with a Landscape Designer to prepare the attached plan for a pollinator garden with a small, stone retaining wall. The staff has reviewed the plan and are in support of its installation this fall. The Town's responsibilities on the project would be limited to the installation of a drip irrigation system, the future maintenance of the garden, and the purchase and installation of a dedication plaque. A copy of the correspondence from Barbara Ward and the design proposal from Zavaglia Associates are attached. I am requesting that the Town Board accept this donation. Criminal Procedure Law § 160.10 (1) mandates fingerprinting of persons charged with the commission of felonies or misdemeanors. A violation of Chapter 148 of the Town Code is neither a felony nor a misdemeanor. However, though not mandatory, an arresting officer is allowed to fingerprint an arrested person if the officer "(a) Is unable to ascertain such person's identity; or (b)Reasonably suspects that the identification given by such person is not accurate; or (c) Reasonably suspects that such person is being sought by law enforcement officials for the commission of some other offense" (see Criminal Procedure Law § 160.10 [2]).: I attach a revised proposed local law which expands upon the one reviewed by the Board earlier this year. It outlaws smoking in parks and fields just like the earlier version. However,the revised law also amends the definition of Park to include the open areas around the Ice Rink and the Pool(see paragraphs [4], [5] and [6] in the proposed definition of Park) and eliminates incarceration as a punishment for violating this chapter. The first three paragraphs within the new definition of PARK are taken verbatim from the current law. The new section 148-9 matches that section's current language except for its possible 15-day jail term for violators. Page 31 of 124 Attachment/s: 2023-7-07-LL-revision of 148 Page 32 of 124 Local Law No. -2023 This local law shall be known as the "Update to Chapter 148 of the Code to prohibit smoking in Parks and Fields and to remove incarceration as a form of punishment for violating Chapter 148" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 -Purpose: Chapter 148 of the Code, entitled "Parks and Fields", needs to be updated. For public health reasons, smoking should be prohibited in the Town's parks and fields and on certain Town-owned land and the archaic potential punishment of incarceration for violating the provisions of Chapter 148 should be eliminated, This local law updates Chapter 148 accordingly. Section 2--Amendment of a current section of the Mamaroneck Code: The definition of Park in section 148-1 A. of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: PARK (1)Memorial Park which is bisected by Myrtle Boulevard with the northerly portion lying along Myrtle Boulevard and Baldwin Avenue and the southerly portion lying between Myrtle Boulevard, North Chatsworth Avenue and Vine Street, (2) Gardens Lake Park which lies between Lakeside Drive and the New York State Thruway, (3)The unnamed park located at the corner formed by the intersection of Palmer Avenue and Weaver Street, (4) The open area outside the Hommocks Park Ice Rink, (5) The Hommocks Pool complex and (6) The paths leading to the Hommocks Park Ice Rink and the Hommocks Pool complex. Section 3 --Amendment of a current section of the Mamaroneck Code: Section 148-2 of the Code of the Town of Mamaroneck hereby is amended to include the following new paragraph U: Page 33 of 124 § 148-2 Prohibited activities. No person shall: U. Burn a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco or cannabis or use an electronic smoking device that creates an aerosol or vapor. Section 4-Amendment of a current section of the Mamaroneck Code: Section 148-9 of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: The violation of any provision of this chapter is a violation within the meaning of NY Penal Law § 10.00 (3). Upon conviction for violating any of sections of this chapter, the convicted person shall be punished by a fine not exceeding$250. Bid documents were published on the Town's bidnet portal beginning on April 14th. A total of three (3) contractor proposals were received by the Town on May 12th and subsequently reviewed by Town consultant AI Engineers. Please refer to the enclosed memorandum that has been prepared based upon our consultant's review. The lowest responsive and responsible bid proposal was submitted by ELQ Industries, Inc. in the amount of$793,821.00. No errors or omissions were found during the review of ELQ's proposal. The Town is familiar with ELQ's experience through their performance record on numerous Town projects. The existing bridge crossing incurred structural damage due to floodwaters carried in the watercourse during Storm Ida. The Town has submitted all supporting documentation to FEMA for their review and determination of reimbursement as an eligible storm related damage expense. FEMA has indicated that the project request remains under their review and cannot provide an expected date for determination at this team. FEMA has clarified, however,that the Town's decision to award the project prior to conclusion of eligibility review will not impact the Town's ability to receive reimbursement for the project. Temporary bridge crossing installed to serve residences at #159 and #163 E. Valley Stream Road remains the sole means of access to the two impacted properties. Further delay of construction of the permanent replacement bridge is not recommended. The Engineering Department recommends that the Town Board consider authorization of bid award to ELQ industries in their bid amount of$793,821.00 so that the project may be completed within the current construction season. The Town will continue to diligently pursue its reimbursement request with FEMA so that additional funding may be recognized towards the capital project. Revised project scope is designed to provide a consistent aesthetic finish inclusive of the archways and stone walls. On June 22nd, 2023,three (3)bid proposals for the revised scope were received as summarized on the attached bid tabulation table. The apparent low bidder is "Sierra Contractors Corp", however, review of the bid submission found it to be incomplete. Thus, the lowest responsive bidder is "Arista Renovation" at the submitted total price of$85,000.00. Town consultant"AI Engineers"has completed review of the proposal inclusive of technical experience and references provided for the apparent low bidder. No errors or omissions have been identified. Sierra Contractors did not submit a completed proposal and therefore cannot be considered for this contract. Arista Renovation Inc., was the next lowest bidder with a total base bid price of $85,000. This office has had no previous work experience with Arista Renovation Inc., however last year when this contract was first posted, Arista was the lowest bidder. At that time an extensive reference check was performed on Arista to determine the ability of their work. We contacted multiple references listed by the bidder and we received responses from four in total.All reviews were positive and noted professionalism, cleanliness, responsiveness and having limited or no changes to the approved schedule or original bid price. It was noted in the Town of Hempstead Reference check that Arista Renovation completed a historical style restoration for the Town with suitable results. A RESOLUTION AUTHORIZING THE ISSUANCE OF $22,552,700 BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY THE COST OF THE INCREASE AND IMPROVEMENT OF THE FACILITIES OF WATER DISTRICT NO. 1,IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK. WHEREAS, pursuant to the provisions heretofore duly had and taken in accordance with the provisions of Section 202-b of the Town Law, and more particularly an Order dated the date hereof, said Town Board has determined it to be in the public interest to improve the facilities of Water District No. 1, in the Town of Mamaroneck, Westchester County, New York, at a maximum estimated cost of$22,552,700; and WHEREAS, the capital project hereinafter described, as proposed, has been determined to be an Unlisted Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, which it has been determined will not have a significant adverse impact on the environment NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. For the specific object or purpose of paying the cost of the increase and improvement of Water District No. 1, in the Town of Mamaroneck, Westchester County, New York, consisting of the Town's share of the cost of the following projects and expenses of the Westchester Joint Water Works being: a) the Rye Lake turbity curtain ($168,200), b) Country Lane water main replacement ($252,500), and c) improvements to the Rye Lake Filtration Plant ($22,132,000), in each case including incidental improvements, equipment and Page 60 of 124 expenses in connection therewith as applicable, there are hereby authorized to be issued $22,552,700 bonds of said Town pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the maximum estimated cost of the aforesaid specific object or purpose is $22,552,700, which specific object or purpose is hereby authorized at said maximum estimated cost, and that the plan for the financing thereof is by the issuance of the $22,552,700 bonds of said Town authorized to be issued pursuant to this bond resolution. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is each 40 years pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. To the extent not paid from monies raised from said Water District as applicable in the manner provided by law, there shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and Page 61 of 124 shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as she shall deem best for the interests of said Town, provided, however, that in the exercise of these delegated powers, the Supervisor shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 7. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Supervisor, the chief fiscal officer of such Town. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine consistent with the provisions of the Local Finance Law. Section 8. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or Page 62 of 124 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 10. This resolution, which takes effect immediately, shall be published in summary form in the official newspaper, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. The staff has reviewed the plan and are in support of its installation this fall. The Town's responsibilities on the project would be limited to the installation of a drip irrigation system, the future maintenance of the garden, and the purchase and installation of a dedication plaque. Criminal Procedure Law § 160.10 (1) mandates fingerprinting of persons charged with the commission of felonies or misdemeanors. A violation of Chapter 148 of the Town Code is neither a felony nor a misdemeanor. However, though not mandatory, an arresting officer is allowed to fingerprint an arrested person if the officer "(a) Is unable to ascertain such person's identity; or (b)Reasonably suspects that the identification given by such person is not accurate; or (c) Reasonably suspects that such person is being sought by law enforcement officials for the commission of some other offense" (see Criminal Procedure Law § 160.10 [2]).: I attach a revised proposed local law which expands upon the one reviewed by the Board earlier this year. It outlaws smoking in parks and fields just like the earlier version. However,the revised law also amends the definition of Park to include the open areas around the Ice Rink and the Pool(see paragraphs [4], [5] and [6] in the proposed definition of Park) and eliminates incarceration as a punishment for violating this chapter. The first three paragraphs within the new definition of PARK are taken verbatim from the current law. The new section 148-9 matches that section's current language except for its possible 15-day jail term for violators. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 -Purpose: Chapter 148 of the Code, entitled "Parks and Fields", needs to be updated. For public health reasons, smoking should be prohibited in the Town's parks and fields and on certain Town-owned land and the archaic potential punishment of incarceration for violating the provisions of Chapter 148 should be eliminated, This local law updates Chapter 148 accordingly. Section 2--Amendment of a current section of the Mamaroneck Code: The definition of Park in section 148-1 A. of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: PARK (1)Memorial Park which is bisected by Myrtle Boulevard with the northerly portion lying along Myrtle Boulevard and Baldwin Avenue and the southerly portion lying between Myrtle Boulevard, North Chatsworth Avenue and Vine Street, (2) Gardens Lake Park which lies between Lakeside Drive and the New York State Thruway, (3)The unnamed park located at the corner formed by the intersection of Palmer Avenue and Weaver Street, (4) The open area outside the Hommocks Park Ice Rink, (5) The Hommocks Pool complex and (6) The paths leading to the Hommocks Park Ice Rink and the Hommocks Pool complex. Section 3 --Amendment of a current section of the Mamaroneck Code: Section 148-2 of the Code of the Town of Mamaroneck hereby is amended to include the following new paragraph U: Page 89 of 124 § 148-2 Prohibited activities. No person shall: U. Burn a lighted cigar, cigarette, pipe or any other matter or substance which contains tobacco or cannabis or use an electronic smoking device that creates an aerosol or vapor. Bid documents were published on the Town's bidnet portal beginning on April 14th. A total of three (3) contractor proposals were received by the Town on May 12th and subsequently reviewed by Town consultant AI Engineers. Please refer to the enclosed memorandum that has been prepared based upon our consultant's review. The lowest responsive and responsible bid proposal was submitted by ELQ Industries, Inc. in the amount of$793,821.00. No errors or omissions were found during the review of ELQ's proposal. The Town is familiar with ELQ's experience through their performance record on numerous Town projects. The existing bridge crossing incurred structural damage due to floodwaters carried in the watercourse during Storm Ida. The Town has submitted all supporting documentation to FEMA for their review and determination of reimbursement as an eligible storm related damage expense. FEMA has indicated that the project request remains under their review and cannot provide an expected date for determination at this team. FEMA has clarified, however,that the Town's decision to award the project prior to conclusion of eligibility review will not impact the Town's ability to receive reimbursement for the project. Temporary bridge crossing installed to serve residences at #159 and #163 E. Valley Stream Road remains the sole means of access to the two impacted properties. Further delay of construction of the permanent replacement bridge is not recommended. The Engineering Department recommends that the Town Board consider authorization of bid award to ELQ industries in their bid amount of$793,821.00 so that the project may be completed within the current construction season. The Town will continue to diligently pursue its reimbursement request with FEMA so that additional funding may be recognized towards the capital project. The apparent low bidder is "Sierra Contractors Corp", however, review of the bid submission found it to be incomplete. Discussion - Revise July Meeting Dates Town Supervisor Jaine Elkind Eney proposed moving a scheduled Town Board work session from July 12th to July 26th. The Town Board discussed their availability for a July 26th work session. 2. Discussion -Stormwater Study Supervisor Elkind Eney provided an update on the anticipated Stormwater Study Grant, which will fund in-depth research into fifteen different areas within the Town of Mamaroneck. Town Administrator Meredith Robson added that the Town is committed to doing the study and ready to bid but is awaiting confirmation on the award of funding from the County. The Town is hopeful that the County funding will cover the full $300,000 cost of the study. 3. Discussion -Cambium Affordable Housing Consultant Proposal Administrator Robson presented a proposal for SJY Management LLC to provide the affordable housing for the Town of Mamaroneck at the Cambium. Administrator Robson reminded the Town Board that SJY Management, namely Ms. Lela Yasin, has been the Town's consultant for our Section 8 and Affordable Housing Services since the Community Services department director left. Ms. Yasin has been of tremendous assistance to the Town during this transition period, managing the transfer of the Town of Mamaroneck Section 8 program to HUD. The only piece of the Community Services department that will remain is the affordable housing services, which includes the ten units at the Cambium development. This proposal from SJY Page 103 of 124 Town Board June 26, 2023 Management covers the creation and maintenance of Cambium affordable housing wait lists, including, but not limited to, sending out applications as requested, gathering eligibility documents, updating applications, and answering inquiries from both management and applicants. This agreement would take effect starting July 1, 2023, until June 30, 2024. 4. Discussion -Section 8 Office Proposal Administrator Robson explained that this proposal, from SJY Management LLC (Ms. Lela Yasin), covers closeout services for the Town of Mamaroneck Section 8 program. The original contract to run this program expires on June 30, 2023. This new proposal will cover any additional work to finalize the Town's dealings with Federal, State, and nonprofit agencies. This will wrap up the Section 8 work in the Community Services office of the Town and should take just a few weeks. 5. Discussion -2023 Bond Resolutions Town Comptroller Tracy Yogman presented the 2023 Bond Resolutions and answered several questions from the Town Board. This project consists of pavement resurfacing an. e.ted work on various streets throughout the Town, including Carol Lane, .r 'age House Lane, Deerfield Lane, Forest Ave, Gate House Lane, Holly Place, Hudson Place, Jenny Close, Katie Lane, Marbourne Drive, Wagon Wheel Road, and Wellhouse Close. Roads included in this year's project are consistent with the recommended list published in the Town's 2021 Three Year Paving Plan document. The Board asked about removing Valley Stream Road, as an alternate, or confirming that it will not be done until after the bridge work is complete. Administrator Robson pointed out that one of the capital budget amendments tonight includes an increase in the ConEdison reimbursements. The Administrator added that Valley Stream Road will have to be repaved next summer, as Town Engineer Robert Wasp wants the bridge work to be prioritized and completed before the winter. The Town Board questioned if Holly Place and Hudson Place should have been included as alternate roads, noting that they are quite a distance from the other roads being resurfaced. Discussion -2024 Budget Calendar The Town Board noted that only two meeting dates for the Town Board to review the 2024 Budget Calendar—one on the 18th of October at the Senior Center, and then another on November 8th—seemed a bit light. Supervisor Elkind Eney agreed that she would like to add another meeting to discuss and recap the big picture,the philosophy, and generally tie everything up.Administrator Robson suggested holding that review during the Saturday, October 21st meeting, which is the extra evening meeting already scheduled for the budget.Administrator Robson pointed out that the December 20th `Final Adoption of the 2024 Budget' is the statutory deadline. 10. Discussion -Authorization of Architectural Consultant Proposal -Tree Garage Rehabilitation Administrator Robson told the Town Board that the Tree Garage has been sinking for years and the roof needs restructuring, adding that the Tree Garage project has been included in the Town's capital improvement plan for several years.This proposal from Lothrop Associates Architects DPC is to finally get a plan in place to ge the work done and the Engineering Department recommends authorizing the ..r:-ment. 11. Ms. Cathy Sears of the Larchmont Gardens Civic Association (LGCA)stood to speak with the Board and requested an update on the Arches. Administrator Robson said that she believed that the project would be presented to the Town Board at their meeting on July 19th. Ms. Sears then asked about the Hickory Grove Drive East sidewalk which stops at the Village. The Town Board said that they are hopeful that the Village of Mamaroneck might extend the sidewalk on the Village of Mamaroneck's side of Hickory Grove Drive East. The Town Board mentioned that the Town had offered on several occasions to the Village of Mamaroneck that the Town could continue extending the sidewalk on Hickory Grove Drive East, and the Village could pay the Town back. The Village never accepted the offer. Ms. Sears informed the Town Board that the LGCA channels had requested comments to Page 106 of 124 Town Board June 26, 2023 the Comprehensive Plan. In addition, Ms. Sears mentioned that one member of the LGCA had witnessed a Town contractor dumping grass clippings into the Brook. The LGCA requested that the Town address with our contractors. Adoption of 2023 Bond Resolutions Administrator Robson explained that, while most people probably know the process, for those that do not, once the Town goes through the budget process and projects are approved for capital expenditure, then we must bond the projects that require financing. Supervisor Elkind Eney added that this is a way of funding our projects without taking the money from our cash reserves. Comptroller Yogman stated that most of these projects are in the Town's 2023 adopted capital plan. There are three additional projects that were added since the '23 capital plan was adopted. In speaking with our financial advisors who are assisting us with the bonding, she added, the interest rates that we will be borrowing at will most likely be from about 3.6 to 3.85 percent. While this is a bit higher than what we have paid in the past, interest rates are on the rise, and as Supervisor Elkind Eney pointed out our rates are most favorable given our AAA bond rating. The Town Board thanked Comptroller Yogman for having garnered the Town that rating. Before going into the resolutions for each bond, Comptroller Yogman mentioned the schedule which is in the agenda packet and stated that we will be closing in September on the bonds for all of t►-se projects, but the financial advisor will go through all of these projects as we g- c riser to the close and will advise on how many years we should bond for and e' mentioned we have a few bonds for which we may do a short term bond beca e expect some revenue against those bonds that we can pay down more qu.'
