Robson, Town Administrator Re: Extension to the Agreement for Pace Land Use Law Center Date: May 29, 2023 Attached please find the enclosed amended agreements between the Town of Mamaroneck and Pace University regarding Comprehensive Plan services and the original agreement that was approved on October 6, 2021. The first amendment extended the agreement from December 30, 2022 to May 30, 2023. If approved, this second amendment would allow for an additional extension to September 30, 2023 to complete all services. Term. This Agreement shall commence on October 1, 2021 and terminate on December 30,2022(the"Term"). 2. Duties. (a)The Town hereby retains Pace to perform the following services(the "Work"), which Work shall not include lobbying or campaign-intervention activities or services within the meaning of state or federal law: (a) Scope of Work stated in Appendix A (b) Pace shall meet or exceed the customary standards of care and professionalism expected in its industry or area of expertise in performing all Work. Pace shall comply with all federal, state, and local laws regarding business permits, certificates, and licenses and Pace shall obtain and maintain such permits, certificates, and licenses that may be required to perform the Work. The Town agrees that Pace's sole and exclusive obligation with respect to the Work covered by this limited warranty shall be, in Pace's sole discretion, to correct proven nonconformity(ies)or to refund the fees paid to Pace for the nonconforming Work. (c)Notwithstanding anything to the contrary contained in this Agreement,the Work shall not include lobbying or campaign-intervention activities or services within the meaning of state or federal law; shall not include evaluation of the Town or other personnel; and shall not include the provision of legal advice to the Town or to third parties. 3. Fees and Expenses. In exchange for its performance of the Work, Pace shall be paid up to, but not exceed, $135,000 upon Pace's submission of an invoice. Pace shall also be reimbursed for such expenses as it incurs in connection with its provision of the Work. 4. Termination. Either party may terminate this Agreement with thirty (30) days prior written notice to the other party. The Town hereby acknowledges and agrees that, notwithstanding anything to the contrary contained in this Agreement, in the event of such termination, Pace shall be paid in full for all Work performed through the effective date of termination. 5. No Employment Relationship Created. It is understood and agreed between the parties that Pace's relationship to the Town hereunder is solely and exclusively that of an independent contractor. Pace shall be permitted to engage in any business and perform services for its own accounts. Except as specifically permitted in this Agreement, neither party shall use the name or trademarks of the other party or incur any obligation or expense for or on behalf of the other party without the other patty's prior written consent in each instance. Page 7 of 120 2 6. Binding Effect. This Agreement is binding upon the parties hereto and upon their respective successors and assigns. 7. Force Majeure. Notwithstanding anything to the contrary contained in this Agreement, Pace shall not be liable, nor shall any credit or other remedy be extended, for Pace's failure, in whole or in part, to fulfill its obligations under this Agreement where such failure arises from or in connection with causes beyond Pace's control, including, but not limited to,acts of God, flood, extreme weather, fire or other natural calamity,terrorist attack,any law,order, or regulation or action of any governmental entity or civil or military authority, power or utility failure, cable cuts, unavailability of rights-of-way, national emergencies, riots, wars, strikes, lock-outs, work stoppages, or other labor difficulties (each a "Force Majeure Event"). If a Force Majeure Event occurs during the term hereof, Pace shall be excused from performance hereunder. 8. Governing Law and Jurisdiction. Except as may be preempted by federal law, this Agreement shall be governed by the laws of the State of New York, without regard to its choice of law principles. Litigation of all disputes between the parties arising from or in connection with this Agreement shall be conducted in a court of appropriate jurisdiction in the State of New York, County of New York. 9.Notices. Failure of either party to enforce any of its rights hereunder shall not constitute a waiver of such right(s) or of any other rights and shall not be construed as a waiver or relinquishment of any such provisions, rights, or remedies; rather, the same shall remain in full force and effect. Robson, Town Administrator CC: William Maker Jr., Town Attorney Re: Consideration of Acceptance of Title to a Portion of Pryer Manor Road Date: May 12, 2023 Attached is a memo from Town Attorney,Bill Maker,regarding the acquisition of the title to the portion of Pryer Manor Road, located within the unincorporated area of the Town of Mamaroneck, that is owned by the City of New Rochelle. The transfer of this title would be of no cost to the Town and would provide for clear and appropriate municipal service areas on that road. It was originally anticipated that New Rochelle would approve this back in May, but it was inadvertently left off that agenda. It is expected to be approved by the City on June 13, 2023. Action Requested: RESOLVED,that the Town of Mamaroneck will accept a deed from the City of New Rochelle transferring to the Town the portion of Pryer Manor Road that is located within the unincorporated area of the Town but owned by the City, and BE IT FURTHER RESOLVED,that the Town Administrator is authorized and directed to sign all documents necessary in order for the deed transferring such title from the City of New Rochelle to the Town to be recorded by the Westchester County Clerk, and BE IT FURTHER RESOLVED,that the Town Administrator arrange to have such deed recorded by the Westchester County Clerk as soon as possible after the requisite documents have been signed. The City has no use for these slivers but the Town should have title to them so that it will own all of the portion of Pryer Manor Road that is located within its borders. The City Council appears to be amenable to transferring its title to these areas at no cost to the Town. Corporation Counsel advised me that she expects the Council to vote on a motion to do so at its May 16 meeting. Accordingly, it is appropriate for this Board to vote to accept such a conveyance. A proposed resolution is being submitted to you with this memorandum. Attachments: Q1 2023 Operating Budget Report Page 14 of 120 TOWN OF MAMARONECK Q1 2023 OPERATING BUDGET REPORT The Town's financial performance for the first four months of the year is provided below by fund as compared to 2022 for the same period and includes an initial budget projection. This budget year is challenging as the economic climate is fluctuating. This may be the new normal which makes effective budgeting challenging as we move forward. The most significant revenues the Town relies upon include mortgage tax and sales tax revenue. As inflation causes general prices to increase, sales tax is expected to meet the budget. However, home sales have significantly slowed down and as a result, mortgage tax will be affected. FINANCIAL SUMMARIES Overall, it is anticipated that fund balance of $5.9 million will be utilized of which $3.8 million will be for one-time capital projects and the balance of $2.1 funds the operating budget. It is very early to project savings, but this year, inflation will continue to be a major factor in managing the Town's expenses. Fortunately, the 2023 budget was prepared with that in mind. Since it is early on in the fiscal year, you will note that projected expenses are at budget with some savings projected. Typically, the Town has significant cost savings as a result of conservative budget practices. At this early stage, only vacancy savings have been projected along with revenue projection variances. This will be refined as we move through the fiscal year. Fund balances will remain in compliance with the Town's fund balance policy with the exception of the Fire District. It will be monitored and will be replenished if needed in the 2024 budget. Please note that the Housing Program will be transferred back to the State as of July 1, 2023. A budget amendment will be submitted to close the program when the finances have been settled with HUD. The 2023 projection shows one half of the budget to be received and spent. 1 Page 15 of 120 REVENUES In total, revenues are collectively 4% higher in 2023 than 2022 for the first four months of the fiscal year. It is anticipated that revenues will be lower than the $54.0 million budget. This is mainly due to the transfer of the Housing Program to the State on July 1, 2023. It is early in the fiscal year and projections will be updated quarterly. Tax Collection The 2023 Town & County tax collection began on April 1st and collection is slightly higher than it was for the same period last year. The Town has collected 99.8% of the 2022 Town & County levy and 96.8% of the 2023 levy as of today. Mortgage Tax Mortgage tax is based on an October- September fiscal year and is paid semi-annually in June and December of each year. The County Clerk has reported that the Town's mortgage tax for the 7 months (October 2022 — April 2023) is $795k as compared to the same period in 2022 of $1,042k. Revenue has dropped by $247k or 44% on a year-to- date basis. The month of April 23 ($38k) alone is 81% lower than April 22 ($198k). The budget of $1.6m was 75% of the 2022 collections with the forethought that this revenue would drop as home sales slowed. However, the actual decline in revenue is running about 50% as compared to last year. Year to date revenue represents 36% of the $1.6m budget when we should be at 58%. The first quarter sales tax of $753k is 6% lower in 2023 as compared to the same quarter in 2022. That is largely due to the fact that sales tax was waived in January and February 2023 for heating oil and the County's estimates were trued up. If trends continue at 6% lower than in 2022, it is projected that sales tax will meet the budget for 2023. Interest Earnings Interest rates have increased over the last few months. Investments are currently earning 4.8%. Annual revenue will be approximately $648k or $468k over budget. This is good news for investment earnings, but the cost of borrowing has increased correspondingly that will affect the 2024 Budget. EXPENSES As it is early in the year, it is anticipated that all expenses will be incurred. The Town has a few vacancies which will hopefully be filled in the coming months but has generated some savings for a few vacant positions. You will note that expenses were significantly higher for the same period in 2022 as compared to 2023. That is due to a timing difference of transferring funds for debt service. The full transfer in each fund was made in April 22 and this year in May 23. The Capital Budget has been reviewed and budget amendments have been included in the packet and have been reflected in the projections. FUND BALANCE Although all of the fund balances are in compliance and anticipated to remain that way through year end, it is important to note that fluctuating pricing, interest rates and slowing home sales will be monitored and may continue to affect the projected use of fund balance. The Town Board approved a contract for January - June 2023. A budget transfer from contingency is recommended for the cost of the additional funds needed for the annual cost. 2. Town Center Generator The Town Center generator is at the end of its useful life and was not working when a minor electrical issue occurred. As a result,the Town is now renting a generator on a monthly basis until the repair can be done. The total cost of the rent for April, May and June and the repair is approximately $23,000. A budget amendment is recommended below to fund this one-time cost from fund balance. 3. Ice Rink Chiller Pumps Two chiller pump motors for the ice rink failed. It was less expensive to replace both motors than to repair them. A budget transfer from contingency is recommended below to fund the repairs. 4. Diesel Fuel The annual invoice for diesel fuel for the Mamaroneck ambulances is significantly higher than budgeted. A budget amendment is recommended below to fund this cost from fund balance. 5. Crosswalk Signals A donation was received in 2022 for the purchase of the necessary parts and equipment to replace the crosswalk buttons at the traffic signal on N. Chatsworth Ave/Myrtle Blvd. In addition, the Town received an insurance reimbursement for the replacement of the crosswalk signal at Palmer/Richbell as a result of an accident. Subsequent to this action, the Town received notification from the NYS Comptroller's office that they had sent us the incorrect form of resolution and that the adoption of 375-e and 375-g was required in order to adopt 375-i. Under the revised terms, employees shall be eligible for the benefits provided by Section 375-e, 375-g and 375-i of the Retirement and Social Security Law, as determined by the New York State Police and Fire Retirement System (PFRS). Under this MOA, current and future employees, shall be responsible for the payment of any increased cost to the Town arising out of eligibility for the 375-i benefit on a pro-rata basis, however, at the present time,there is no additional cost. Action Requested: Resolved that the Town Board hereby approves the revised agreement with the Town of Mamaroneck Professional Firefighters Association, Local 898, IAFF, AFL-CIO to authorize addition of the 375-e and 375-g pension plans, in addition to the enhanced retirement plan 375-i originally adopted in May by the Town Board and hereby authorizes the Town Administrator to execute the agreement and file the resolution with the New York State Comptroller. WHEREAS, the Town of Mamaroneck ("Town") is a public employer within the meaning of Article 14 of the New York State Civil Service Law; WHEREAS, Local 898 and the Town are parties to a collective bargaining agreement ("CBA") for the period of January 1, 2020, through December 31, 2023; WHEREAS, the parties wish to amend CBA Section 22 ("Pension and Benefit Plans"); NOW THEREFORE, the Town and Local 898 (collectively, "the Parties") desire to enter into this Memorandum of Agreement("Agreement") and agree as follows: 1. Eligibilityfor the 375-e,375-g, and 375-i Benefit is not retroactive in nature and shall be effective on and after the date the Town Board's resolution electing to provide said 375-e,375-g, and 375-i Benefit is filed with the New York State Comptroller. 2. This Agreement modifies the parties' CBA and shall be annexed to said CBA and deemed incorporated therein. 3. This Agreement is subject to approval by the Town Board and ratification by the membership of Local 898. 4. This Agreement may be executed in any number of counterparts, each of which so executed shall be deemed original, such counterparts shall together constitute but one agreement. The project scope consists of traffic signal replacement at the aforementioned intersection along with associated pedestrian improvements in this location. The signal at this intersection is directly coordinated with the adjacent signal at Myrtle Boulevard and North Chatsworth Avenue. Both signals will be upgraded with video detection resulting in improved signal timing and operation and maintenance. Pedestrian improvements include installation of new pedestrian signals and modification to existing sidewalks and curb ramps for ADA-compliance and improved pedestrian safety. On March 16th, 2023, one (1)bid proposal was received from Verde Electric Maintenance Corp. at the submitted total bid of $660,900.00 for the full project scope. Subsequently, a bid breakdown was requested from Verde Electric Maintenance Corp. to facilitate detailed analysis of the lump sum proposal. After review by Department staff and the Town's design consultant, Barton & LoGiudice, it was noted that the estimated quantities provided by the contractor were significantly higher than the Engineer's Estimate. The contractor agreed to maintain proposed unit prices while revising estimated quantities to meet the engineer's estimate where significant discrepancies were observed. The revised schedule of values results in a total project price of$588,570.50. Deduct-alternate price for the removal of a backup battery system included on the submitted bid form reduces the project cost to $568,934.50, if elected. The Engineering Department recommends inclusion of the backup battery component in contract award for storm resiliency and public safety function. The Contractor has extensive experience executing contracts with various agencies throughout Westchester County. No errors or omissions that could potentially impact the viability of their bid price have been identified at this time. Fees and Expenses. In exchange for its performance of the Work, Pace shall be paid up to, but not exceed, $135,000 upon Pace's submission of an invoice. The Town Board approved a contract for January - June 2023. A budget transfer from contingency is recommended for the cost of the additional funds needed for the annual cost. 2. Town Center Generator The Town Center generator is at the end of its useful life and was not working when a minor electrical issue occurred. As a result,the Town is now renting a generator on a monthly basis until the repair can be done. The total cost of the rent for April, May and June and the repair is approximately $23,000. A budget amendment is recommended below to fund this one-time cost from fund balance. 3. Ice Rink Chiller Pumps Two chiller pump motors for the ice rink failed. It was less expensive to replace both motors than to repair them. A budget transfer from contingency is recommended below to fund the repairs. 4. Diesel Fuel The annual invoice for diesel fuel for the Mamaroneck ambulances is significantly higher than budgeted. A budget amendment is recommended below to fund this cost from fund balance. 5. Crosswalk Signals A donation was received in 2022 for the purchase of the necessary parts and equipment to replace the crosswalk buttons at the traffic signal on N. Chatsworth Ave/Myrtle Blvd. In addition, the Town received an insurance reimbursement for the replacement of the crosswalk signal at Palmer/Richbell as a result of an accident. WHEREAS, the Town of Mamaroneck ("Town") is a public employer within the meaning of Article 14 of the New York State Civil Service Law; WHEREAS, Local 898 and the Town are parties to a collective bargaining agreement ("CBA") for the period of January 1, 2020, through December 31, 2023; WHEREAS, the parties wish to amend CBA Section 22 ("Pension and Benefit Plans"); NOW THEREFORE, the Town and Local 898 (collectively, "the Parties") desire to enter into this Memorandum of Agreement("Agreement") and agree as follows: 1. Wasp, Town Engineer Subject: Recommendation of Bid Award for TA-23-03 -Myrtle Blvd&Murray Ave Traffic Signal Replacement General: Bid procurement was recently completed for the Myrtle Boulevard & Murray Avenue Traffic Signal Replacement Project. The project scope consists of traffic signal replacement at the aforementioned intersection along with associated pedestrian improvements in this location. The signal at this intersection is directly coordinated with the adjacent signal at Myrtle Boulevard and North Chatsworth Avenue. Both signals will be upgraded with video detection resulting in improved signal timing and operation and maintenance. Pedestrian improvements include installation of new pedestrian signals and modification to existing sidewalks and curb ramps for ADA-compliance and improved pedestrian safety. On March 16th, 2023, one (1)bid proposal was received from Verde Electric Maintenance Corp. at the submitted total bid of $660,900.00 for the full project scope. Subsequently, a bid breakdown was requested from Verde Electric Maintenance Corp. to facilitate detailed analysis of the lump sum proposal. After review by Department staff and the Town's design consultant, Barton & LoGiudice, it was noted that the estimated quantities provided by the contractor were significantly higher than the Engineer's Estimate. The contractor agreed to maintain proposed unit prices while revising estimated quantities to meet the engineer's estimate where significant discrepancies were observed. The revised schedule of values results in a total project price of$588,570.50. Deduct-alternate price for the removal of a backup battery system included on the submitted bid form reduces the project cost to $568,934.50, if elected. The Engineering Department recommends inclusion of the backup battery component in contract award for storm resiliency and public safety function. The Contractor has extensive experience executing contracts with various agencies throughout Westchester County. No errors or omissions that could potentially impact the viability of their bid price have been identified at this time. Regarding Ms. Ransom's employment with the Town, she started working part-time as an Office Assistant in the Building Department in November 2017. In her current position she deals with the public, by issuing residential and commercial permits for new construction, additions, alterations, plumbing, electrical and signage in accordance with all applicable local and state building codes. As a result of the retirement, Ms. Ransom expressed interest in being considered for the position. There is sufficient funding in the 2023 budget to cover the salary increase. His current annual salary is $94,509 and, if promoted, it would be increased to $98,560, retroactive to January 1, 2023. Mr. Lacerenza took the test for Senior Account Clerk in February 2022 and is reachable on the Civil Service eligibles list, given he scored 100 on the exam. In order to place Mr. Lacerenza in that title we needed Civil Service's approval to do so. The initial request was submitted in June of 2022, and it was not until early May, that we were notified they approved the Town's use of that title. During that time, we followed up on numerous occasions as to the status of the pending request with Civil Service. Mr. Lacerenza was hired in March in 2020. His primary duties include the following,manages,records, and reconciles revenue deposits and receivables, performs monthly bank and various general ledger account reconciliations, assists in tax collections, supervises clerical staff, assists with budget preparation, and performs cash management functions, such as transfers and deposits, as well as manages cash balances. According to Tracy Yogman, Town Comptroller,Mr. Lacerenza's is very professional in all aspects of his position. He has demonstrated the ability to work independently and has been willing to assist co- workers and take on additional responsibilities as necessary. He assists residents with excellent customer service skills and follows through with all issues.He has proven to be an essential team player and an asset to the overall operations of the Comptroller's office. Discussion -Grassroots Grocery Presentation Mr. Daniel Zauderer presented Attachment A on the Grassroots Grocery. Mr. Zauderer detailed how a Grassroots Grocery refrigerator is maintained, noting that too much or too little food has not been an issue. Currently the Larchmont-Mamaroneck Food Pantry brings some of their extra food items from their fresh market produce distribution to the Bronx. A Grassroots Grocery in the community would allow the extra food to stay local and go directly into a refrigerator. When the Board asked about liability, Mr. Zauderer explained that a refrigerator host receives the benefit of'hold harmless' protection and additional protection from the Good Samaritan Act. The Board discussed possible locations for a Grassroots Grocery refrigerator, agreeing that it should be easily accessible by foot to those most in need in our community. The Town Board suggested that an easy-to-walk-to location may be more likely in the Village of Mamaroneck and a location near the Community Resource Center may be ideal. Mr. Zauderer thanked the Board for their time and insights. Page 110 of 120 Town Board May 3, 2023 2. Discussion --Comprehensive Plan Ms. Tiffany Zezula, of the PACE Land Use Law Center, went through the draft Town Comprehensive Plan, reviewing the draft for corrections and stylistic changes with the Town Board. The Town Comprehensive Plan Committee reviewed the document and made proposed changes, noted by redlining within the document supplied to the Town Board. Once the group completed the review, Ms. Zezula planned to correct the document and return the draft Comprehensive Plan to the Town to share with the community for broader input. 3. Discussion -2023 Millennium Strategies Service Agreement Town Administrator Robson presented the proposed 2023 service agreement with Millennium Strategies for grant consulting services, which is a continuation of the 2022 agreement. The Board discussed the possibility of a grant consultant that charges by the hour but also discussed how an hourly option may be difficult to manage and might possibly limit the Town's interest in going after smaller grants and opportunities. Administrator Robson noted that there were no changes to the existing service model or pricing from the 2022 contract. Should the Board wish to approve the agreement, the contract would take effect retroactively from March 1, 2023, to February 28, 2024, for a monthly retainer fee of$3,500.00. The contract contains a provision allowing for cancellation with 30 days' notice. 4. Discussion - Renewal of Agreement Southeast Consortium 2023 The Town Administrator provided two handouts and proposed a renewal of the agreement between the Town and the Southeast Consortium. (See Attachments B and C.)The Town Administrator highlighted that the Town has a lower per participant cost than some of the other municipalities, because we have so many participants. The Town's proposed contribution to the Consortium for 2023 is $25,415, which has remained constant for the last seven years. The Board requested that the word 'citizen' be changed to 'resident in the contract, if possible. 5. Discussion - HVEA Engineers Contract Amendment-Waverly Avenue Bridge Replacement Town Administrator Robson introduced this standard New York State contract with HVEA Engineers in the amount of$548,033.79, for the construction inspection services to be added to the scope of the Waverly Avenue Bridge Replacement Project. Administrator Robson pointed out that this contract amendment is covered by the original grant, which will be completed in phases with several more amendments to come. 6. Discussion - Permit Waiver-2-116 Hommocks Road; Property#4-11-169 Town Administrator Robson explained the Housing Authority's request to waive the permit fees for their project at 2-116 Hommocks Road; Property#4-11-169. In 1993, the Town Board waived permit and board application fees for the original construction of the property. The current applications for the renovations have an estimated cost of construction of$1,684,000. Should the Town Board wish to waive the fees, this would equate to a total fee of$42,500. The Town Board discussed the pros and cons of waiving the fees, acknowledging that the Housing Authority and the Hommocks Apartments are a benefit to the community. 7. Request for Executive Session Moved by Councilwoman Nichinsky, seconded by Councilman King, the Town Board agreed to enter into Executive Session to discuss the employment history of a particular individual. After a late-night Town Board meeting on April 19, I got up at the crack of dawn on the 20th to speak, at 7:00am with a class of OCRA students at MHS about one of my favorite subjects, Local Government, and my role in it. The students were engaged and engaging, even at that hour! I envy them the opportunity to participate in a program like this. Kudos to Joe Liberti! On April 21, Sabrina and I attended the annual LWV Luncheon. The speaker was Attorney General Letitia James. She is an impressive woman—her speech was amazing. I feel we in NYS are so fortunate to have her protect our interests. I had the opportunity to speak with her after the luncheon. As tough as she is when she is protecting our interests, is how lovely she is on a personal level. April 22 was a day I wish I had roller blades to get around. I was pleased to attend, with Deputy Supervisor Abby Katz, the Larchmont Gardens Civic Association (LGCA) Earth Day celebration. The LGCA hosted a coffee on the Fernwood Bridge and organized a cleanup of litter along (and in)the Brook. Approximately 50 residents attended the event. Volunteers filled three large trash cans with the debris they collected. Thank you to all who help keep our neighborhood clean. Then I attended The Town of Mamaroneck Fire Department open house. It was a chance for the community to come see the firehouse, the firetrucks, and learn about volunteer opportunities. On April 23, Sabrina, Meredith, and I attended the Annual 5K run and Lil' Bunny Hop. Despite cloudy/rainy weather, Memorial Park was filled with eager runners of all ages, ready to hit the road in the Annual 5K Run and Lil' Bunny Hop. We had 209 runners registered for the 5K and another 218 signed up for the Lil' Bunny Hop. All ages were accounted for; we even had four runners ages 65 and up! I would like to thank the Town's Recreation and Fire Departments for hosting another terrific event. Much gratitude as well goes out to the Highway Department, the Police Department and LVAC who ensured the participants'safety while out running in wet conditions. Later that day I was proud to be a judge with County Executive George Latimer and Village of Larchmont Mayor Sarah Bauer of the 8th Annual Friends of the Larchmont Library Spelling Bee. The winning "swarm"was the team from At Home on the Sound, proving that their spelling was simply extra o r d i n a r y! Proceeds of this popular event benefit the Larchmont Public Library. I find it ironic that I now judged at an event that I have participated as a contestant every year and never made it past the first round. On April 25 I attended a TVS meeting with Meredith. This is a quarterly meeting attended by the Chief Elected Officials and Administrators of the 3 municipalities and the Superintendents and members of the Board of Ed of the 2 school systems. We discussed the effects of proposed road closures and affordable housing. On April 27, Robin and I participated in the Annual LWV Event, Running and Winning. At the event, several women elected officials told personal stories of their lives, how they reached this point in their lives, and gave the students words of encouragement. There were tables comprised of elected officials with HS students and we each spoke about our stories. The students told us of their goals. It was a wonderful experience. April 28, we observed Arbor Day in the Town. Each year we celebrate with a new tree planting. This is the 31st year the Town has been honored by the National Arbor Day Foundation with "Tree City USA"status. Planted last Friday at Memorial Park was a beautiful Red Maple, already standing at a statuesque 15 feet high! Just behind the new tree is the new Memorial Park playground, soon to be completed and dedicated! After the festivities were over, I spoke at a MCAH zoom about affordable housing in the Town of Mamaroneck. Councilman Jeffery King and I attended the annual Ice Breaker Tournament at the Hommocks Park Ice Rink this past weekend. 15 teams made up of approximately 240 players played 27 games over four days. 24 feet of wedges, 40 pizzas, about 500 hotdogs and about 1300 wings were consumed. I looked around over the 4 days of the tournament and saw generations of families who have come back to our community and our rink for this tournament. Players brought their parents, their grandparents, their siblings, their spouses, and their children. Spectators ranged in age from almost 3 months to almost 90 years. They enjoyed 4 days of food, love, and hockey. And this year's tournament was special because it was the first year that there was an all-women's game featuring Mamaroneck's own women's team, The Motherpuckers. I was so proud to drop the puck with State Senator Shelley Mayer and County Legislator Catherine Parker. All tournament proceeds go to the Hommocks Ice Rink Trust Fund which is used to pay for improvements to our rink. Thank you, Dan Demasi, for doing all of the lifting that brings so much joy to the Town Hockey World each year! Finally, this morning, I was on hand to cheer on members of our police department as they ran in the Law Enforcement Torch Run which raises money for the special Olympics. Police Officers throughout the county participated in the run that stretched from NR to Peeksill. We thank them for their commitment to community service. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 —Purpose: Modern technology has advanced to the point where individuals, acting alone or with other members of their household or their business only, can make recordings for commercial purposes while within their homes or places of business. The Town Board finds that such activity is not disruptive for it does not interfere with the day-to-day activities of the Town's residents or merchants. For that reason, licensing such activity serves no purpose. This local law exempts such activities from the scope of Chapter 99 of the Code. Section 2—Amendment of a current section of the Mamaroneck Code: The definition of FILMING contained in section 99-2 of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: FILMING The recording, by any medium, of advertising, motion-pictures,television shows, productions that can be viewed on computers, telephones or other devices and the taking of photographs to be used in commercial enterprises. Notwithstanding the previous sentence, "filming" does not include recordings done by or on behalf of the Town, the coverage of news, political, cultural, local sports or school events, the recording of public service announcements or recordings done by individuals, acting alone or with other members of their household or their business only,who perform such recordings inside buildings on properties which they occupy as their residence or their place of business. Section 3—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law,which may be implemented without the invalid or unconstitutional provisions. Section 4—Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Carried RESIDENT COMMENTS Town Supervisor Elkind Eney asked if anyone in the audience wished to address the Town Board. Ms. Mary Beth Sullivan from White Plains introduced herself as being part of a group of citizens throughout the State that has a copy of the New York State Voter Registration Role (Role). Ms. Sullivan explained that the Role is like a spreadsheet with 21 million records on it. They have four full copies of the Role created at four different times. Ms. Sullivan noted that there are 15.7 million voting age residents in New York State, so with 21 million records on the Role, there are 4 million excess records on that Role. Ms. Sullivan stated that she or someone else from the group will be analyzing and presenting their findings of the NYS Voter Role to the Town of Mamaroneck Board over the next few weeks. Other Fire Department Business Commissioner Elkind Eney mentioned the Fire Council meeting the past Monday night, which was a brief meeting where they continued to discuss improving procedures and equipment. Then, Commissioner Katz thanked the Fire Department for bringing the fire trucks to the Larchmont Gardens Civic Association Clean Up. Commissioner Elkind Eney added that the Fire Department's recruiting event was successful,with seven new applicants and mentioned that we are working with Catherine Parker to improve training time at the County level. Lastly, Commissioner Elkind Eney added that the Fire Department wanted to thank the Town Board for passing the tax incentive for them so quickly. There being no further business to come before the Fire Commission, on motion of Commissioner King, Seconded by Commissioner Nichinsky, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN OF MAMARONECK 1. Authorization -2023 Millennium Strategies Service Agreement Town Administrator Robson presented the proposed 2023 service agreement with Millennium Strategies for grant consulting services.This agreement would be a continuation of the 2022 agreement,with no changes to the existing service model or pricing. The contract would take effect retroactively from March 1,2023, and remain until February 28, 2024, for a monthly retainer fee of$3,500.00. Authorization - Renewal of Agreement Southeast Consortium 2023 Moved by Councilwoman Fiddelman, seconded by Councilwoman Katz, it was RESOLVED that the Town Board hereby approves the 2023 agreement with the Southeast Consortium and hereby authorizes the Town Administrator to execute the agreement and any related documents necessary to carry out its implementation. Authorization - HVEA Engineers Contract Amendment-Waverly Avenue Bridge Replacement Moved by Councilman King, seconded by Councilwoman Katz, it was RESOLVED that the Town Board hereby approves Contract Amendment No. 1 with HVEA Engineers in the amount of$548,033.79 for construction inspection services to be added to the scope of the Waverly Avenue Bridge Replacement Project and hereby authorizes the Town Administrator to execute the agreement and any related documents necessary to carry out its implementation. Authorization - Permit Waiver-2-116 Hommocks Road; Property#4-11-169 Town Supervisor Elkind Eney explained that the Housing Authority is renovating the Hommocks Park Apartments and the Town has been asked to waive the building permit fees. The Town Supervisor added that the Housing Authority and the Hommocks Park Apartments are a benefit to our community. Councilwoman Fiddelman • The next Larchmont Mamaroneck Local Summit meeting will be "Keeping us Safe on the Sound: Working together with our local police to keep our community a safe place to work and live", May 9th at 8am via Zoom. The audit was approved, and their finances are in good shape as they proceed with their improvements. • Reported attending the Sustainability Collaborative meeting: Compost Day moved to this Saturday 9am to noon. • Tree Walk at 90 Rockland Avenue, May 7th, visit the Town website for details. • Attended the Running and Winning event at Manhattanville College, with Supervisor Elkind Eney. • Mentioned speaking with OCRA Students this morning about a new project. It is nice to have such civic minded students at Mamaroneck High School, thanks to teacher Joe Liberti. TOWN CLERK'S REPORT 1. The Town Clerk announced that there are several jobs still available for high school and returning college students on the Summer Conservation Crew. The jobs begin Monday, June 26th through Friday August 11th and the hours are Monday through Friday 7:30am until 3pm. If you are interested in joining this crew that marks trails and helps our Town environment, please contact the Town's Environmental Planner Elizabeth Aitchison at 914-381-7845.
