HomeMy WebLinkAbout2022_12_14 Planning Board MinutesMINUTES OF THE REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK HELD IN THE SENIOR CENTER ON DECEMBER 14, 2022 Present: Ralph Engel, Chairman, Elizabeth Cooney, Edmund Papazian, Ira Block Also Present: Robert Wasp, Town Engineer, Lisa Hochman, Counsel to Planning Board, Francine M. Brill, Secretary Absent: Ron Mandel, Sarah Dunn, Alternate, Carol Murray, Assistant Civil Engineer, Anthony Oliveri, Town Consulting Engineer, Elizabeth Aitchison, Town Environmental Planner, Robin Nichinsky, Town Board Liaison CALL TO ORDER The meeting was called to order at 7:31 P.M. and Mr. Engel welcomed everyone. Mr. Engel further stated that Mr. Cuddy has resigned from the Board. Ms. Hochman asked if all documents to be discussed this evening had been posted on the website for more than 24 hours and whether this meeting and all public hearings to be conducted tonight had been duly noticed and whether all required referrals were made. Ms. Brill answered yes to all. MINUTES Motion: To adopt the draft minutes of November 9, 2022, as modified Moved by Ira Block, seconded by Edmund Papazian Action: Approved Vote: Yes: Ralph Engel, Chairman, Edmund Papazian, Ira Block Abstain: Elizabeth Cooney 1. 18 Pryer Manor - Kevin Doherty - Subdivision - Consideration Mr. Wasp stated that the applicant requested an adjournment because their lawyer is researching the easement, as had been requested by the Board. The matter was adjourned to January 25, 2023. 2. 43 Mohegan - James and Sarah Coady- Residential Site Plan — Consideration 3. 43 Mohegan - James and Sarah Coady - Wetlands and Watercourses - Consideration Paige Lewis, the applicant's architect, addressed the Board. Sarah Coady, the owner, was also present. Ms. Lewis gave a brief overview of the revised plan. She further stated that they responded to Mr. Oliveri's comments and dug additional test pits and Mr. Salanitro, the applicant's engineer, will address this at the next meeting. Mr. Wasp stated that the plans should be updated to reflect the proposed driveway. The matter was referred to the Coastal Zone Management Commission. 1 Ms. Lewis requested a public hearing in January but the Chair responded that the application will remain on the agenda for further consideration. 4. 15 Holly Place - Dominick Marchese - Residential Site Plan - Public Hearing Frank Marsella, the applicant's architect addressed the Board, along with Mr. Marchese, the applicant's contractor, and Mr. Beresford, the applicant's landscape architect. Mr. Wasp stated that he heard from the Town's consulting engineer, who stated that all of their comments have been addressed. Motion: To open the public hearing Moved by: Elizabeth Cooney, seconded by: Edmund Papazian Action: Approved Vote: Yes: Elizabeth Cooney, Edmund Papazian, Ralph Engel Abstain: Ira Block Mr. Marsella explained the project. Board members and the applicant discussed the proposed plans, the dimensions of the lot and zoning requirements. Mr. Marsella referenced similar projects approved and developed within the Town The Board discussed a zoning compliance letter prepared by the Building Inspector. The Board discussed the Town's regulations pertaining to development of undersized lots (Section 240-70 of the Town Code). Mr. Block asked if there had been any discussions between the neighboring property owners Mr. Mr. and Mrs. Cuddy, and Mr. Marchese. Mr. Marsella responded that there has been some discussion about tree pruning and the retaining wall. Mr. Block and Mr. Engel recommended further discussion between the applicant and the Cuddys. Ms. Hochman stated that the Cuddys have submitted an application to the Town's Zoning Board of Appeals to appeal the Building Inspector's interpretation of Section 240-70. Mr. Engel made several comments about trees, landscape screening, fencing, a retaining wall, and proposed sloping of the roof and dormers. Public Comments Mr. Cuddy, of 11 Holly Place, stated that he approves of the applicant's plan to remove one tree near his large window overlooking the applicant's property because his arborist said it would not survive construction and is leaning over his house. Mr. Vincent Fiore, of 19 Holly Place, expressed concerns about flooding and shadows. Mr. Engel asked whether a shadow study was done. 2 Mr. Marsella responded that no shadow study was done and explained why he believed it is unnecessary.
