BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Phyllis Wittner Councilman Ernest C.Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia,Town Clerk Stephen V.Altieri,Town Administrator William Maker,Jr.,Town Attorney CALL TO ORDER-WORK SESSION On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,the Work Session was unanimously opened at S:OOPM. Update—Hazard Mitigation Plan Additionally Present: Michael Liverzani,Ambulance District Director William Seevers and James Brower, PhD,Consultants for the Town with ETG Mr. Seevers and Dr. Brower are the consultants for the Town implementing a grant to create a Hazard Mitigation Plan. The Town Board reviewed the outline for a Multi-Hazard Mitigation Plan, including a Table of Contents and Tasks (12 Sections).The Board also reviewed, as presented, the Projected Timeline and Executive Summary. Mr. Brower addressed the Board with a recap of the current process and the accomplishments thus far. Supervisor Seligson asked that the MS4 language be included in the plan. The Board discussed the format for public input as required by FEMA. It was also noted that the other municipalities, the Village of Larchmont and Village of Mamaroneck are working on their own plans. Supervisor Seligson stated that the school district often asked for a master plan which addresses the issue that as a school district they serve three municipalities. Supervisor Seligson asked that the plan include language pertaining to overlapping of services and or responses, and address the school district as well. Mr.Seevers and Dr. Brower asked the Board to give those comments and feedback prior to any public meeting. TAKEN OUT OF ORDER Boards&Commissions Supervisor Seligson stated that a number of Boards have openings, specifically for the Traffic Committee with the retirement of Nancy Anguilo,and the Zoning Board of Appeals with the retirement of Fred Baron.Alternates will be needed for Planning and Zoning as well. Expansion of the Mailing Area for Notification of Land Use Applications 2 November 6, 2013 The Town Board reviewed the latest version of this legislation.The Board will set this for a public hearing this evening. Update—Winding Brook Road Bridge The Town Board reviewed the latest information regarding the bridge, including a report from the Town's consultant emphasizing that the bridge has deteriorated to a point where action is required.. It is therefore the recommendation that a temporary bridge be installed while the Town is finalizing the work plan for the full replacement of the bridge.On the regular agenda for this evening is a funds transfer for the temporary bridge. New Business The Board discussed the issue of sign proliferation at the public triangle at Weaver Street and Palmer Avenue. Residents complained about the number of signs. The Board discussed the resolution that created the public area and determined that although during election time it can become unruly, it serves a purpose as a place for public display. Councilwoman Katz reported that the web-site is being monitored for numbers of'hits'and where on the site people are visiting. Brian Foy Design is putting a proposal together for a web site redesign. On motion of Councilman Odierna,seconded by Councilwoman Katz,the Board unanimously agreed to enter into an Executive Session to discuss compensation for non-union and management personnel. EXECUTIVE SESSION Compensation for Non-Union and Management Personnel On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,the Board unanimously agreed to resume the Regular Meeting. CALL TO ORDER-REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:10 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o'clock this evening, adding this is an open meeting that all residents'are welcomed to attend. SUPERVISOR'S SUMMARY REPORT Supervisor Seligson congratulated local Officials who recently won reelection,especially the Town of Mamaroneck Elected Officials. She reminded residents that leaf collection is taking place and emphasized that sticks, branches and pumpkins are not allowed to be bundled with the leaves.The Town is diligently working on the 2014 Budget,adding that staff has been working on this for months,and the Board is now working on this extensively. Supervisor Seligson reminded residents that all Budget meetings are open to the public.Supervisor Seligson noted that there were many meetings and events in the Town this last week, but will let the Councilmembers'elaborate during their reports. In closing,Supervisor Seligson was glad it was a safe and happy Halloween in the Town. CITIZEN'S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board,and there was not. 3 November 6, 2013 PROCLAMATION Nancy Angiulo WHEREAS: Nancy Angiulo has served on the Traffic Committee for thirteen years; and WHEREAS: Due to her longstanding tenure with the Traffic Committee, Nancy has been able to fill the role of historian and educate residents and committee members on traffic issues that are pervasive in the community; and WHEREAS: Nancy approaches applications with a no-nonsense attitude and a wry sense of humor that will be truly missed; and WHEREAS: Nancy has also been a valued member of the community through her work with the senior citizens at St.Augustine's church and as founder of the Senior Citizens of Larchmont; and NOW,THEREFORE, BE IT RESOLVED,that I, Nancy Seligson,Supervisor of the Town of Mamaroneck,and the Town Board members hereby thank Nancy Angiulo for her years of hard work and service to the Town as a member of the Traffic Committee and volunteer in the community. Other Fire Department Business Westchester County Fire Mutual Aid Plan On motion of Councilwoman Elkind Eney,seconded by Councilwoman Wittner,the following was approved, WHEREAS,there are no resolutions in effect that restrict outside service and training by the Town of Mamaroneck Fire District 1,and WHEREAS,the Board of Fire Commissioners'of the Town of Mamaroneck Fire District 1 have not imposed any limitations,conditions or restrictions on the Fire Department from providing prompt assistance,and the Commissioner of Emergency Services shall be notified in writing if any such limitations are imposed subsequent to the adoption of this resolution. NOW THEREFORE, BE IT RESOLVED,that the Town of Mamaroneck Fire Department shall respond to all calls for assistance from another Fire Agency through the Westchester County Emergency Communications Center a/k/a "60 Control",and BE IT, FURTHER RESOLVED that the Town of Mamaroneck Fire District 1 hereby acknowledges and accepts its financial responsibility pursuant to applicable law,and BE IT, FURTHER 5 November 6, 2013 RESOLVED,that the Board of Fire Commissioners of the Town of Mamaroneck Fire District 1 approves participation in the Westchester County Fire Mutual Aid Plan ("Plan"),as amended from time to time, and further certifies to Westchester County,through its Commissioner of Emergency Services,that it shall comply with the provisions of the Plan,and BE IT, FURTHER RESOLVED,that a copy of this resolution shall be filed with the Westchester County Commissioner of Emergency Services. PUBLIC HEARING(S)—Petition to remove trees in the Town's right-of-way in front of 274 Rockingstone Avenue The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York,and pursuant to a resolution of the Mamaroneck Town Board adopted on October 7,2013 a Public Hearing will be held on Wednesday, November 6,2013 at 8:00 PM or as soon thereafter as is possible in the Court Room of the Town Center,740 W. Boston Post Road, Mamaroneck, New York to consider Purpose: The Town Board will consider an application to remove trees in the Town's right-of-way in front of 274 Rockingstone Ave. Plans for the proposed tree removal can be examined and copies obtained at the Town Clerk's office during regular hours, Monday - Friday, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. Boston Post Road Mamaroneck, New York PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: October 11,2013 Supervisor Seligson asked the applicant,Steve Mr. Marsh,to address the Board and explain his application. Mr. Marsh explained his reasons for requesting the tree removal. Mr. Marsh explained that he has purchased the property at 274 Rockingstone Avenue after it was severely damaged by Super Storm Sandy. He plans to tear down the existing home and rebuild.The plans which he had available for review showed a side by side 6 November 6, 2013 driveway that would be placed in the line of the two trees currently in the Town's right-of-way. Mr. Marsh stated his willingness to replace the removed trees with alternative trees suitable to the Tree Commission. Mr. Marsh distributed a letter from Ambrose Laboratories stating the biological and structural assessment of the two Norway spruces. Supervisor Seligson asked if anyone wished to comment on the proposed application. Mr.Chapman,of Rockingstone Avenue addressed the Board and is opposed to the removal of these trees. He questioned why Town owned trees that have been there for so long would be approved for removal. Councilwoman Wittner questioned the validity of the report by Ambrose Laboratories that the condition of the trees was hazardous. On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,the Public Hearing was unanimously closed. On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the application of Steve Marsh to remove two Norway spruce trees in the Town's right-of-way at 274 Rockingstone Avenue,and BE IT FURTHER RESOLVED,that Mr. Marsh will replace the two removed trees with two additional trees to be located on the Town's right-of-way,a location to be determined,at a value$250.00 each,a diameter of two and one half inches,and a minimum height of eight feet.To be done in consult with the Town's Tree Commission as to the type of trees to be planted. Authorization—Stipulation of Settlement—CSEA Bargaining Unit Mr. Altieri explained the Stipulation of Settlement noting key points from his letter to the Board dated October 31,2013. On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the Stipulation of Settlement between the Town of Mamaroneck and the Civil Service Employee Association for the period of January 1,2013 through December 31, 2016 The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye 7 November 6, 2013 9. Authorization—Salary Adjustments—Management&Non-Union Personnel On motion of Councilman Odierna,seconded by Councilwoman Wittner,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the salary adjustments for the 19 Management and Non-Union Personnel, at an increase of 3%for the year 2013, retroactive to January 1,2013 and a 2.5% increase for the year 2014. Set Public Hearing—Expansion of the Mailing Area for Notification of Land Use Applications On motion of Councilman Odierna,seconded by Councilwoman Elkind Eney,it was unanimously RESOLVED,that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the"Expansion of the Mailing Area for Notification of Land Use Applications in Certain Zoning Districts" Law for November 20, 2013 at 8:OOPM in the Court Room of the Town Center,and BE IT FURTHER, RESOLVED,that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper,and that said notice, be posted. 11. Set Public Hearing—Model Housing Ordinance On motion of Councilwoman Wittner,seconded by Councilwoman Elkind Eney,the following was approved, WHEREAS, the Town Board of the Town of Mamaroneck has decided to explore a rezoning which would allow the development of fair and affordable housing in the Town's residential zoning districts while continuing to allow the uses currently permitted, either as of right or by special permit,in these districts("Proposed Action"),and WHEREAS, the Town Board has determined that it should be the Lead Agency (as that term is defined in SEAR)for the public review of the Proposed Action pursuant to SEAR,and WHEREAS, the Town identified the entities on the annexed list as either an involved or an Interested Agency(as those terms are defined in SEQR).And WHEREAS, the Environmental Officer of the Town sent a notice of the Town Board's designation of itself as the Lead Agency for the Proposed Action to the aforementioned entities in which he advised such entities that unless, within 30 days from the date on which this notice was received, any of them notified the Town that it or they wished to act as lead Agency for the Proposed Action,the Town Board would confirm its designation of itself as the Lead Agency for the Proposed Action and would commence public review in accordance with SEAR and the regulations promulgated thereunder,and 8 November 6, 2013 WHEREAS, more than 30 days have elapsed since the Environmental Officer of the Town of Mamaroneck sent those notices,and WHEREAS, none of the entities responded by claiming that it wished to act as Lead Agency for the Proposed Action. Salary Authorizations—Highway Department On motion of Councilwoman Wittner,seconded Councilwoman Elkind Eney,it was RESOLVED,that the Mamaroneck Town Board does hereby approve the appointment of Brandon Brooks to the part-time/seasonal position of Laborer with the Town's Highway Department at an hourly rate of$15.00, beginning October 28,2013. The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Wittner Aye Seligson Aye On motion of Councilwoman Elkind Eney,seconded by Councilwoman Katz,the following was approved, WHEREAS,on October 7,2013 the Town Board approved the appointment of Michael Sullivan to the part-time/seasonal position of Laborer with the Town's Highway Department,and WHEREAS,the hourly rate for the position was incorrectly stated. NOW,THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby approve the appointment of Michael Sullivan to the part-time/seasonal position of Laborer with the Town's Highway Department at an hourly rate of$15.00, beginning October 28,2013. Authorization—Transfer of Funds Highway Department—Winding Brook Bridge On motion of Councilwoman Katz,seconded by Councilwoman Elkind Eney,the following was approved WHEREAS, because the condition of the Winding Brook Bridge has deteriorated to the point where action is needed,it is recommended that the Town proceed with the procurement and installation of a temporary bridge. NOW THEREFORE, BE IT RESOLVED,that the Mamaroneck Town Board does hereby approve the transfer of funds in the amount of$15,000.00 as outlined by the Town Comptroller as follows: ESTABLISH CAPITAL PROJECT&BUDGET-WINDING BROOK RD BRIDGE IMPROVEMENTS 11/6/2013 TOWN BOARD MEETING CAPITAL PROJECTS FUND(FUND H): 10 November 6, 2013 ESTABLISH BUDGET: EXP H.5110.0400.2013.35 WINDING BROOK ROAD BRIDGE IMPROVEMENTS $ 15,000.00 REV H.0000.5033.2013.35 TRANSFER FROM HIGHWAY FUND $ 15,000.00 HIGHWAY FUND(FUND DB): INCREASE BUDGET: EXP D13.9900.9950 TRANSFER TO CAPITAL PROJECTS FUND $ 15,000.00 REV D13.0000.5995 APPROPRIATED FUND BALANCE $ 15,000.00 (CAPITAL PROJECT#2013-35) Establish Capital Project&Budget for restoration of bridge at Winding Brook Road. WRITTEN COMMUNICATIONS None REPORT OF COUNCIL Councilman Odierna attended the Larchmont Gardens'Civic Association's(LGCA) Halloween Parade,and on October 201" he attended the Sheldrake's Annual Fall Festival.Councilman Odierna attended the Zoning Board Meeting on October 23rd,and on October 24`"the LMC-TV's 301"Anniversary Dinner.On October 291" Councilman Odierna attended the Housing Action Council Reception at the Scarsdale Golf Club,at which a very informative presentation and discussion took place regarding fair and affordable housing in Westchester County.On October 301"the Town held a work session to discuss the Town's web site. Finally,the group Healthier Mamaroneck met at the Hispanic Resource Center. Healthy Mamaroneck is an outreach of the Rye YMCA and is in its beginning stages,so stay tuned. Councilwoman Wittner noted her fascinating conversation recently with Doug Bloom. Mr. Bloom,an ardent birder, has found new species of birds at the Hommocks Conservation Area. Mr. Bloom informed Councilwoman Wittner that he identified 20 different species on a recent walk from the Conservation Area to Red Bridge,adding he is very excited about this. Councilwoman Katz attended the Oktoberfest at the Senior Center and the Traffic Committee Meeting,adding that the agenda for the Traffic Committee was light. Councilwoman Katz,along with Councilman Odierna attended the Town's meeting to discuss the web site. She stated that unfortunately there were not a lot of responses to the on-line web site survey, but the Town will continue to address possible changes to the web site. 11 November 6, 2013 Councilwoman Elkind Eney attended the Emelin Theatre Gala on Octoberl7th and the High School Homecoming on the 18`",adding what a fantastic community event this was.On October 191"she attended the Town of Mamaroneck Fire Department's Open House,the Scare Fair,the Rag-a-Muffin Parade,and the Larchmont Gardens'Civic Association's Halloween Parade,as well as the Village of Mamaroneck's Spooktacular.On October 201"she attended the Sheldrake Fall Festival and the Senior Center Oktoberfest on the 215` Councilwoman Elkind Eney also attended the League of Women Voters Candidates' Debate,a Human Rights Committee Meeting and the 301"Anniversary Dinner for LMC-TV. She and Councilman Odierna participated in the Candidates' Day at the Senior Center and with Supervisor Seligson she attended two Human Rights Committee Meetings, noting that a number of loose ends still need to be tied up for the upcoming event. She attended the Library Board Meeting,at which they discussed reorganizing the Library space.Councilwoman Elkind Eney also attended a meeting regarding the Ice Rink renovations noting that the hockey community is doing fundraising for added facilities to the Ice Rink project. Supervisor Seligson noted her attendance at the Town Village School(TVS) Meeting as well as the Gala for the Washington Housing Alliance.Supervisor Seligson congratulated Elaine Chapnick and Eileen Mason on being honored at LMC-TV's 301"Anniversary.The Town was glad to present Proclamations to them. .Supervisor Seligson noted the enthusiastic Halloween party held by employees of the Town,especially how wonderful and creative the costumes were. ADJOURNMENT Supervisor Seligson closed the meeting in memory of two wonderful women in our Community.Colleen Hagan, who unfortunately passed away at way too young an age,and Ruth Lowey the mother of her best friend,Alison Lowy. Both of these women were loved by our Community,they were active in many ways and incredibly civic minded.They were inspirations to all of us in the Town and our thoughts and condolences go out to their families. Councilwoman Wittner spoke of how Ruth demonstrated the spirit of giving,and stated that her passing was a true loss to our Community.
