BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Jaine Elkind Eney Councilwoman Abby Katz Councilwoman Sabrina Fiddelman Councilman Jeffery L. King Councilwoman Robin Nichinsky ALSO PRESENT: Allison May, Town Clerk Meredith S. Robson, Town Administrator Connie Green O'Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney Lindsey Luft, Assistant to the Town Administrator Pamela Valenza, Assessor CALL TO ORDER - WORK SESSION The Work Session of the Town Board was called to order by Supervisor Elkind Eney, then on motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, the Work Session was unanimously opened at 5:00 p.m. Out of Order — Presentation by Assessor Pamela Valenza Assessor Valenza has prepared the tentative role and the notices of change of assessment will go out June 15Y. The grievance period will then last until June 21't. Property valuation equity remains the goal. The tentative assessment roll and assessment data will be on the website on June V. (Details on memo Attachment A.) The Town has seen a little over 650 sales in the past year, significantly higher than around 400 sales in the previous year. Assessor Valenza reviewed the map (Attachment B), noting the increases by neighborhood code. The Assessor reviewed the process for revaluing the properties each year and explained how outlier properties are handled to ensure that a neighborhood is not unfairly affected by a single sale, such as a property that has undergone extensive renovation before resale. The Assessor then pointed out they are switching from SDG to Pro Site /GAR along with website rollout after June 1st. All information that can be accessed will be the same and will have the potential for online submissions in the future. The new system will be more intuitive and more user friendly, will include the historical property card, and will link to tax maps. It will be more flexible in terms of uploading new information anytime, not twice a year, and it is good timing to do with website relaunch. 1. Review— Bid TA-22-05 —Senior Center Parking Lot Administrator Robson reviewed the bid, noting that six proposals were received. The Administrator, Town Engineer Wasp and the County recommend Landi, Inc. Administrator Robson agreed to investigate whether the exterior lighting was included in the bid, as well as the lighting of the sign on the Post Road, as it is not visible at night. 2. Review— Bid TA-22-06 — Municipal Sidewalks and Curbing Administrator Robson noted that also on this project we had received six bids and recommended the Town Board approve Laura Li Industries. 3. Review — Recreation Consulting Agreement May 18, 2022 Supervisor Elkind Eney presented the proposed consulting agreement with Rob Lunde, the Town's retiring General Manager of the Ice Rink. The Town has now divided Mr. Lunde's role into two positions. The Town has filled the Managerial role and is awaiting the County's approval of a newjob title for the Mechanical role. In the interim, Mr. Lunde will be working as a consultant to fill the Mechanical role. Once the new role is approved, the Town can begin recruiting for the position. The Town Board will approve this consulting agreement later this evening. 4. Review —Town Court Consulting Agreement The proposed agreement is with Denise Cookingham, the soon to be retired Court Clerk. This agreement will allow her to ensure a smooth transition to the new Court Clerk. Ms. Cookingham will assist on an hourly basis as needed through mid -September. The Town Board will approve this agreement later this evening. 5. Updates — Out of Order Supervisor Elkind Eney noted that the public listening session will be Tuesday for the Comprehensive Plan. Supervisor Elkind Eney asked the Town Board to bring their summer meeting preferences to the next Town Board meeting, so that they can set the dates together for the July and August meetings. Attorney William Maker reviewed the enclosed proposed Local Law on Videoconferencing Meeting. (See Attachment C.) Mr. Maker updated the Town Board on his research into the process for changing the Town Clerk position from elected to appointed. The Town Board agreed to review the local law, which will be subject to a special election, at the next meeting. 6. Out of Order -- Discussion — Draft Tree Ordinance Supervisor Elkind Eney noted that several people have asked for a moratorium. Supervisor Robson pointed out that from an operational standpoint it is very difficult to put a moratorium in effect, and it may have unintended consequences. Attorney Maker advised it would be preferable to work to create a new Tree Ordinance as quickly and efficiently as possible. Supervisor Elkind Eney created a list of relevant issues, and the Town Board had an initial discussion of several of the items: 1. The Town Board discussed including all lot sizes, suggesting that there could be different restrictions on the number of trees removed based on the lot size. 2. The Board suggested that a proposal to cut nine and less trees might go to Elizabeth Aitchison, the Town's Environmental Planner, and then if denied go to Zoning. If it's a site plan, the application might go to Planning. Mr. Maker pointed out that the Town Board would need to amend the ordinance. Also, since the Planning Board is subject to State statute, it may or may not be allowed to review. Mr. Maker agreed to review. 3. Next, the Town Board discussed the Buffer Zone and whether it should exist with different criteria. There was concern about the size of the buffer. With only 10 feet next to a house, for instance, does the Buffer Zone or proximity to the house take priority? The Town Board agreed to perhaps look at by lot size not Zone. Thought it might be restrictive, but agreed they are trying to do what is environmentally necessary. If a tree is problematic, you can address in other ways. The Board agreed to review and revisit at the next meeting. 4. The Town Board suggested that the Town's Environmental Planner could perhaps review proposals up to nine trees. 5. Next the Town Board discussed criteria and numbers, for example how many trees a year could be cut down? What sizes need approval, and what sizes do not? Supervisor Elkind Eney presented a scenario of purchasing a house, asking if the new homeowner has the right to cut down tree in middle of yard for a swing set? The Town Board suggested the need to get a permit no matter what, so that the Town can catalogue and list and so that the homeowner is required to plant more trees. They agreed certain things are an automatic yes, but you need to replant, and it would not apply to a specimen tree. In addition, they agreed a diseased tree could come down, but you would still need to replace it. There should be size and age 2 May 18, 2022 specificity in criteria. The Town Board reiterated that every tree that comes down should have a replacement requirement. The Town Board then agreed because of time constraints to review again at the next meeting. 7. Request for Executive Session On motion of Supervisor Elkind Eney, seconded by Councilwoman Fiddelman, the Board unanimously agreed to enter an Executive Session to discuss litigation, the proposed acquisition or lease of real property and the employment history of a particular person. On motion of Councilwoman Fiddelman, seconded by Councilman King the Board unanimously agreed to resume the Work Session. 8. Discussion --Maintenance Agreement— 27 Marbourne Drive Attorney Maker presented the proposed maintenance agreement for a deck in the easement area of a sewer. Mr. Maker pointed out that if the deck ever came down, we would not allow it to be rebuilt. The Town Board agreed to approve the agreement, and it will be added to tonight's public agenda. 9. Discussion — 46 Villa Attorney Maker presented the proposed maintenance agreement. The Town Board agreed to add to tonight's agenda, intending to approve subject to modifications. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Elkind Eney in the Courtroom of the second floor at the Town Center at 8:10p.m. On motion of Councilwoman Katz, seconded by Councilman King the Board unanimously agreed to begin the Regular Meeting. SUPERVISOR'S REPORT Welcome to the May 18, 2022 meeting of the Town Board of the Town of Mamaroneck. The Town Board met today for a Work Session in Conference Room C starting at 5:OOpm, which is open to the Public. NATIONAL EMS WEEK May 15-21, 2022 National EMS week. National Emergency Medical Services Week brings together local communities and medical personnel to publicize safety and honor the dedication of those who provide the day -day lifesaving services of medicine's front line. I want to thank VAC for providing these essential services to our community. COMPREHENSIVE PLAN I want to update you about the Comprehensive Plan. As you may recall, a critical part of the Comprehensive Plan process is input from the Community. We want to know what you want for the future of our community. We have 3 public listening sessions scheduled for May 24-10:00-11:00 at the Senior Center, 1:30-3:30 at the TMFD and 7-9 at the Hammocks Park Ice Rink. Come out to voice your thoughts and suggestions on such topics as: Trails, Open Space and Recreation; Transportation; Community Services; Housing Needs and Choices; Economic Development; what you love about the TOM and what you don't. Again, Public Engagement is critical to the success of the Plan so please, please try to come to one of the sessions. REAL PROPERTY ASSESSMENT NEWS Each year the Town is required by the State Office of Real Property Tax Services to update its assessment role so that we can maintain full value assessments. The Town is currently preparing for our 2022 Tentative assessment role update. Adjusting assessments to appropriately reflect market value shifts and/or physical changes due to changes in property inventory data is required by the NYS Office of Real Property Tax services. As in past years, all property owners will receive an "assessment notice" regardless of whether there is a change in your assessment. The notices will be mailed on June 1, 2022. 3 May 18, 2022 Property tax fairness remains a goal of the Town of Mamaroneck and the Town Assessor's Office and, as always, the tentative assessment roll and assessment data may be found on our Town Website on June 1, 2022. If you disagree with your full market value assessment, you are entitled to challenge your assessment through the Board of Assessment Review from June 1, 2022 through June 21, 2022 Grievance applications (Form RP-524), instructions and procedures are available on our website under the Assessor's Department and can be mailed or submitted in the lobby of the Town Center M-F 8:30am-4:30pm 611122-6121122. pm 611122-6121122. You can also make an appointment in the Assessor's office to appear before the Board of Assessment review on 611122 Redistricting: The Congressional District Lines have been redrawn by a Special Master appointed by the NY Court of Appeals. The new district lines were issued on May 16. People who wish to comment had until today to make their comments. The final districts will be issued on Friday, May 20. We are currently in CD 16 which comprises all of Westchester County below Route 287, as well as a small portion of the Bronx. Our incumbent Congressman is Jamaal Bowman who has already stated that he plans to run in this new district. The State Senate District lines have also been redrawn. We continue to be in senate district 37 and Shelley Mayer continues to be our state representative. Stay tuned. Fven is On May 91 was invited by the County Executive to speak at the weekly county update. I spoke about my favorite topic, the Town of Mamaroneck! On May 9, Abby and I met with representatives of LMC Media where they showed us their plans for the renovation of the third floor of the Town Center. They have scaled back their plans, per our request. On May 101 listened to the Summit presentation on Affordable Housing. Rose Noonan, Executive Director of the Housing Action Council, and Melissa Kaplan -Macey, a planner and a member of the Town's Comprehensive Plan Steering Committee spoke. The presentation was informative and interesting. On May 12, I attended a Mamaroneck Chamber of Commerce Meeting where I was invited, once again, to speak about the Town of Mamaroneck. On May 15, Abby, Robin and I attended the celebration of the newly refurbished lower level of the library. It had been flooded during IDA. Congratulations Laura Eckley, Library Director, and Lauren Gottfried, Library Board Chair, on a job well done! Memorial Day Events: 5126 Parade Route from Chatsworth Avenue at the Train Station to the LFD where there will be free hot dogs served. Parade Starts at 7:00. Being that there are no public hearings tonight, the next item on the agenda is Resident comments. RESIDENT COMMENTS Supervisor Elkind Eney noted that there were no residents wishing to address the Town Board. BOARD OF FIRE COMMISSIONERS Commissioner Elkind Eney called the Meeting to order, then on motion of Commissioner Katz, seconded by Commissioner Fiddelman, the Board of Fire Commissioners was unanimously declared open. AFFAIRS OF THE TOWN 1. Authorization — Contract Award — Bid TA-22-05 — Senior Center Parking Lot On motion Councilwoman Nichinsky, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board hereby approves the agreement with Peter J. Landi, Inc. for work on the Town Senior Center Parking Lot and hereby authorizes the Town Administrator to execute the agreement and any related documents necessary to carry out its implementation. Salary Authorization — Court Clerk On motion of Councilwoman Katz, seconded by Councilwoman Fiddelman, it was unanimously RESOLVED, that WHEREAS, Denise Cookingham, has retired from her position as Court Clerk, effective at the later this month, NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby appoint Dominique Patterson as Court Clerk, at annual salary of $ $79,169, effective May 31, 2022. Appointment —Zoning Board Alternate Member B On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, it was unanimously RESOLVED, that Arthur Katz be appointed to the position of Alternate Member B, of the Town of Mamaroneck Zoning Board, and BE IT FURTHER RESOLVED, that the foregoing appointments shall be effective immediately upon the appointees taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on December 31, 2025. A RESOLUTION REPEALING A BOND RESOLUTION ADOPTED BY THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK ON FEBRUARY 20, 2019. WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York (the "Town") has heretofore duly adopted a purchase and installation of computer software for various departments bond resolution of said Town on February 20, 2019, including incidental improvements and expenses in connection therewith subject to permissive referendum; and WHEREAS, it has now been determined that said financing authorization will not be required for said capital project and it is now desired to repeal said serial bond authorization thereof; NOW, THEREFORE, BE IT RESOLVED, by the affirmative vote of not less than a majority of the total voting strength of the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: 7 May 18, 2022 Section 1. The serial bond authorization of the bond resolution dated February 20, 2019 for the purchase and installation of computer software for various departments is hereby repealed; provided, however, such repeal shall only be effective to the extent any such authorization to be repealed has not heretofore been utilized for the issuance of obligation of the Town therefor: Section 2. THIS RESOLUTION SHALLTAKE EFFECT IMMEDIATELYAND NEITHER PUBLICATION NOR POSTING SHALL BE REQUIRED. A RESOLUTION AUTHORIZING, SUBJECT TO PERMISSIVE REFERENDUM, TOWN CENTER BUILDING RECONSTRUCTION, IN AND FOR THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $765,000 AND AUTHORIZING THE ISSUANCE OF $765,000 SERIAL BONDS OF SAID TOWN TO PAY THE COST THEREOF. WHEREAS, the capital project hereinafter described, as proposed, has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, which regulations state that Type II Actions will not have a significant adverse impact on the environment; NOW, THEREFORE, WHEREAS, it is now desired to authorize the financing of such capital project; NOW, THEREFORE, BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total voting strength of the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. Town Center building reconstruction, in and for the Town of Mamaroneck, Westchester County, New York, being roof replacement and elevator modernization, including original furnishings, equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, is hereby authorized at a maximum estimated cost of $765,000. Section 2. The plan for the financing of the aforesaid maximum estimated cost is by the issuance of $765,000 bonds of said Town, hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is fifteen years, pursuant to subdivision 12(a) of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the bonds herein authorized will exceed five years. Section 4. The faith and credit of said Town of Mamaroneck, Westchester County, Newyork are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. All other matters, except as provided herein relating to such bonds, including determining whether to issue such bonds having substantially level or declining annual debt service and all matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the name of the Town by the facsimile signature of the Supervisor, providing for the manual countersignature of a fiscal agent or of a designated official of the Town), the date, denominations, maturities and interest payment dates, place or places of payment, and also including 91 May 18, 2022 the consolidation with other issues, shall be determined by the Supervisor. Such bonds shall contain substantially the recital of validity clause provided for in section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by section 52.00 of the Local Finance Law, as the Supervisor shall determine. Section 7. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150 - 2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 8. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 9. Upon this resolution taking effect, the same shall be published in summary form in the official newspaper of said Town for such purpose, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. Section 10. THIS RESOLUTION IS ADOPTED SUBJECT TO PERMISSIVE REFERENDUM. On motion of Councilwoman Fiddelman, seconded by Councilman King, the above resolution was put to a roll call vote: Nichinsky Aye Ki ng Aye Fiddelman Aye Katz Aye Elkind Eney Aye C. A RESOLUTION AUTHORIZING, SUBJECT TO PERMISSIVE REFERENDUM, THE PURCHASE OF A FINANCIAL MANAGEMENT SYSTEM, FOR THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $203,400 AND AUTHORIZING THE ISSUANCE OF $203,400 SERIAL BONDS OF SAID TOWN TO PAY THE COST THEREOF. The plan for the financing of the aforesaid maximum estimated cost is by the issuance of $203,400 bonds of said Town, hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid class of objects or purposes is ten years, pursuant to subdivision 81(a) of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the bonds herein authorized will exceed five years. Section 4. If it is contemplated that videoconferencing will be used at a meeting, the public notice for that meeting shall inform the public that videoconferencing will be used, where the public can view and/or participate in such meeting, where required documents and records will be posted or be available and identify the physical location where the public can attend the meeting. § 228-5 Videoconferencing. A. Except in the case of executive sessions, the videoconferencing shall enable members of the public body to be heard, seen and identified while the meeting is being conducted, including those portions of the meeting where any motions, proposals, resolutions and any other matter are discussed and voted upon. B. Members of the public shall have the opportunity to view such meeting through video and to participate by way of videoconferencing in real time at times when public comment or participation is authorized by law or by the procedural rules of the public body in a way similar to the way members of the public who are physically present at the meeting are allowed to comment or participate at such meeting. § 228-6 Requirements for the videoconferencing media. The videoconferencing media shall utilize technology that permits access by members of the public with disabilities in a manner that is consistent with the 1990 Americans with Disabilities Act, as amended, and its corresponding guidelines and regulations. § 228-7 Minutes. The minutes of any meeting where videoconferencing is used shall include which members participated remotely and shall be made available to the members of the public pursuant to New York Public Officers Law § 106. § 228-8 Recordings of a meeting where videoconferencing is used. The public body shall provide that each meeting where videoconferencing is used be recorded and that such recording be posted or linked on the public website of the Town of Mamaroneck within five business days following the meeting. The recording shall not contain discussions during an executive session or during recesses to obtain advice of counsel. The recording shall remain available on the website for a minimum of five years after the meeting was adjourned. Such recordings shall be transcribed upon request at a cost equivalent to the rate charged by a court reporter for transcribing the minutes of a trial or hearing. § 228-9 Compliance with the written procedure requirement. This local law is deemed to be the written procedures governing member and public attendance required by New York Public Officers Law § 103-a (2) (b). It shall be posted conspicuously on the Town of Mamaroneck's web site. § 228-10 Exemption. The requirement for physical presence by members of a public body contained in § 228-3 of the Code shall not apply during a state disaster emergency declared by the Governor pursuant to section twenty- eight of the New York Executive Law, or a local state of emergency proclaimed by the County Executive of Westchester County or the Supervisor of the Town of Mamaroneck pursuant to section twenty-four of the New York Executive Law, if the public body determines that the circumstances that led to the declaration of a state disaster emergency or a local state of emergency would affect or impair the ability of the public body to conduct an in -person meeting. § 228-11 Sunset provision. This local law shall expire and be deemed repealed on July 1, 2024. CLOSING COMMENTS COUNCILMAN KING Councilman King said a few words on behalf of the victims of the Buffalo mass killing which took place in just the past week. Councilman King began by sharing a text from a friend. It said, 'Jeff, the shooting in Buffalo has me thinking of you and the family. It is so disturbing on so many levels to think that hatred of a person for their skin color can lead to random killing. The kid is sick, yes, but he has been seduced by other ideas ... I can't imagine what it feels like to live in this world with greater risk and challenges in everyday life.' Councilman King thanked this dear friend for his thoughts, noting that although they live on separate coasts, we are at a point in this country that if you are black, or if you are a woman, you have to ask yourself, 'Where can I live? In what state? In what city can I live? In what community? That is not only tolerant, but is accepting of opposing views and beliefs? No one wants to live in a community of only like-minded individuals. We want to engage in conversation with people of different viewpoints. Unfortunately, due to the circumstances which we now live in, the middle ground has been stripped away. If we continue down this slippery slope, we only have to look at Nazi Germany in the 1930's to see what we might become.' As a parent, any mass killing is disturbing, but this one in particular was bone -chilling for me. When we read that Tops Supermarket was frequented by students attending the University of Buffalo, I looked at my children. 'Oh my God, that could have been one of my children.' My heart goes out to the parents, the grandmothers, the grandfathers, the nieces, the nephews, the friends, everyone who is suffering right now from this tragic event that took place last Saturday in our country. Make no mistake about this, this is a plague that is affecting all of our country. Unless we rise, we act, this will only continue. Councilman King summed up by saying, 'You are not alone. My heart goes out to you. And, someday we will be able to turn the tide!' CLOSING COMMENTS SUPERVISOR ELKIND ENEY On another sad note, Supervisor Elkind Eney closed the meeting in memory of the one million Americans that had died of COVID.
