BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman Paul A. Winick ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney Christina Battalia, Deputy Town Clerk WORK SESSION Premium River Road Karen DiBicardi and Elizabeth Gilliams were here to discuss changing the name of the street (Dillon Road). They said, that they do not receive 75% of deliveries and even the police don’t know where they are, its confusing to everyone. Councilman Winick said he did not think changing the name will solve the problem. Councilwoman Wittner said the residents are doing things that are illegal by using the Pryer Manor Road address when they live on Dillon Road. Supervisor O’Keeffe asked if it was a mapped road. Yes, 21 & 23 Dillon Road appear on maps. Councilwoman Wittner replied that the hill might be a right-of-way. The only way to get to these two houses now is via the Premium Conservation Area right-of-way. The Board then held a lengthy discussion on how to handle this matter and it was decided to do some legal research and put this on for further review at the next work session. PHA – Administrative Plan Anna Danoy explained that the plan had to be amended and the Board would have to have a public hearing to adopt the amendments. She said basically they were changing how they handle domestic violence victims by giving them priority in housing. BAR Councilwoman Seligson said there was discontent amongst the members and she felt the channels of communication need to be defined. Councilman Winick suggested an architect be retained as a consultant. A discussion ensued and it was decided by consensus that the BAR is an advisory board. FOREST CITY RESIDENTIAL There was a discussion with Harlan Sexton about the wording of the Special Permit and the need for new wording for the funding of the parking deck. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O’Keeffe at 8:30 PM. She then pointed out the location of exits. September 6, 2006 PUBLIC HEARINGS Bond Resolution – Water District Financing The following notice was entered into the record: NOTICE IS HEREBY GIVEN that the Town Board of the Town of Mamaroneck, Westchester County, New York, will meet at the Town Hall, 740 West Boston Post Road, in Mamaroneck, New York, on September 6, 2006, at 8:15 o'clock P.M., Prevailing Time, for the purpose of conducting a public hearing upon a certain map, plan and report, including an estimate of cost, in relation to the proposed increase and improvement of the facilities of the Water District No. 1, in said Town, consisting of the Town's share of the cost of the construction of the Rye Lake Filter Plant (Project A-1172A of the Westchester Joint Water Works), including original equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith, at a maximum estimated cost of $11,700,000. Said capital project has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act ("SEQRA"), the implementation of which as proposed, it has determined will not result in any significant environmental effects. SEQRA documentation is available in the Office of the Town Clerk where they may be inspected during normal business hours. At said public hearing said Town Board will hear all persons interested in the subject matter thereof. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the hearing was unanimously opened. The Town Administrator explained that as previously discussed there is a court order to build this facility. Of the $62.8 million cost of the plant, the Town of Mamaroneck share of 18.8% is $11.6 million. The recommendation is for a two phase borrowing, beginning with $4,000,000 in the fall of 2006 and the balance of $7,600,000 in April 2007. The reason for the two phase borrowing is the Town is eligible for low rate funding from the State Revolving Loan Fund at a greatly reduced rate, about half of what is normal. Finally, whenever there is borrowing a public hearing must be held. Supervisor O'Keeffe noted that at a previous Town Board meeting John Hoch, WJWW Administrator, and his consultants presented in detail the necessity for building this plant. Mr. Altieri expressed the need for the board to analyze what mechanism the Town would use to finance the debt, specifically would a tax levy be employed or would water rates be increased. His recommendation is for the Board to adjourn this matter to the September 20th Town Board Meeting to give the Board additional time to analyze this. Supervisor O'Keeffe added the Comptrollers Office has been working diligently to format recommendations. Mike Dandry, Journal News, stated he was under the impression that a court order was in effect to begin construction. Supervisor O'Keeffe answered yes, as of today there are people beginning work, adding that not all construction bids are out. We are unhappy with some of the bids received, some were higher than estimated. We have therefore hired an estimator to help with this process. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was 2 September 6, 2006 RESOLVED, that the Town Board does hereby adjourn the public hearing on borrowing for the Water Filtration Plant to September 20, 2006 at 8:15 PM or as soon thereafter as possible. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye PUBLIC HEARING – Moratorium on Illuminated Signs The following notice was entered into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, September 6, 2006 at 8:15 PM in Conference Room A, of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled “Second Amendment to the Moratorium on Illuminated Signs” Law. Section 1 - Purpose: The Town Board is concerned about the potential proliferation of brightly illuminated signs within the Town’s business and industrial districts. By Local Law No. 6-2006, it enacted a moratorium on the erection of new illuminated signs to afford the Town Board an opportunity to examine ways to control the erection of such signs. That moratorium expired on August 31, 2006. Since the moratorium went into effect, the Board has been studying ways in which such lighting can be controlled without creating an undue economic burden upon the Town’s commercial enterprises. The Board needs additional time to complete its examination. Hence, a short extension moratorium on the erection of illuminated signs is warranted. Section 2 - Amendment to a current section of the Code of the Town of Mamaroneck: Section 175-12 G of the Code of the Town of Mamaroneck hereby is amended by deleting the words “August 31, 2006” therefrom and substituting the words “November 30, 2006” in their place. On motion of Councilman Winick, seconded by Councilwoman Wittner, the hearing was unanimously declared open. The Supervisor asked if anyone wished to address the board on this matter. Burt Mandel, 3 Washington Square, Apt D, said the New York Sports Club put in flood lights which are obnoxious and too bright. The Supervisor said they can direct the light downward to be much less disturbing. There being no further comments, on motion of Councilman Odierna, seconded by Councilman Winick the hearing was declared closed. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the board unanimously adopted: Resolved, that the Town Board finds that the adoption of the proposed local law regarding illuminated signs is hereby declared to be a Type II action under the New York State Environmental Quality Review Act (SEQRA). 3 September 6, 2006 On motion of Councilman Winick, seconded by Councilwoman Wittner, the following local law was unanimously adopted: Local Law No. 14- 2006 This local law shall be known as the "Second Amendment to the Moratorium on Illuminated Signs" Law. Section 4 - Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Salary Authorization - Firefighter On motion of Councilman Odierna, seconded by Councilman Winick, it was RESOLVED, that the Town Board does hereby authorize the appointment of John V. Service Award Program - Update Councilwoman Wittner updated the Board on the quarterly report of the Service Awards: See end of Minutes, Appendix A & B 4. Other Business The Fire Department had 78 calls in 24 hours with 25 men on the job and involved with the storm. th The 100 Anniversary of the Town of Mamaroneck Fire Department will be celebrated with a dinner on June 9, 2007, and an open house for the community on September 15, 2007. AFFAIRS OF THE TOWN 1. Report of Bids – Contract TA 06-04 – Myrtle Boulevard Improvements Mr. Altieri reported that only one bid was received for this project and the bid was much higher than expected. The project was bid by Verde Electric for a total of $373,580.78, we estimated the cost to be $275,000. He therefore recommended the Board reject the bid and the bid documents would be repackaged by separating the 6 September 6, 2006 traffic signal installation from roadway improvements. After some discussion, on motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does reject the bid submitted by Verde Electric for $373,580.78; and BE IT FURTHER, RESOLVED, that the Town Administrator is authorized to prepare new bid specifications for the Myrtle Boulevard Improvement project by separating the Traffic Signal work from the roadway project. 2. Salary Authorization – Ambulance District School Crossing Guard Recreation Ambulance District On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby authorize the appointment of Kevin Bunch and Jason Marrero as per diem paramedics in the Town of Mamaroneck Ambulance District at a rate of $23.50 per hour, effective August 31, 2006; and BE IT FURTHER, 8 September 6, 2006 RESOLVED, that after a successful completion of a six month probationary period their hourly rates will be increased to $24.50 per hour. Set Public Hearing on FCD, Mamaroneck (Forest City Daly) RESOLVED, that the Town Board does hereby set the date for public hearing on the proposed legislation for FCD Mamaroneck LLC (AKA Forest City Daly) for October 4, 2006; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted on the Town Clerk’s Bulletin Board. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye SUPERVISOR’S REPORT Supervisor O’Keeffe said our area had suffered a tremendous storm over the Labor Day Weekend, the Town was hit bad with loads of people in Town without power. There were live wires all over which caused people to be housebound because of the danger. Things are better now, but power is still out on Cooper, Forest and Old White Plains Road. She drove around with the Highway Superintendent for two hours assessing the damage. She thanked Fran Antonelli, Gayle Edmonds, and Carol Braiotta for fielding hundreds of calls. She thanked Councilwoman Wittner who talked to Con Edison and thanked Steve Altieri who did a terrific job. Councilwoman Wittner said Con Edison said their first priority was to hospitals and schools. The sanitation workers were out cleaning up and they did a fantastic job. Councilwoman Seligson said one wire came down in Larchmont that burned the earth and melted the asphalt. REPORTS OF THE COUNCIL Councilman Winick said with the help of Erik Lewis and Steve Altieri, starting Monday, LMC/TV will be keeping three meetings available at the Town website. In 2007, we will be able to go to the agenda and click to see a particular item. Councilwoman Seligson went to the Planning Board meeting and to Zoning. She said our volunteers on those boards do a tremendous job. She also attended BAR. Councilwoman Wittner attended a barbeque for the Town’s US Open workers, and went to the Senior Citizen Barbeque. CZM was postponed, and last night she went to the Fire Council meeting. Councilman Odierna said the Human Rights Commission meeting was coming up and there were many 9-11 events planned. The Supervisor said this Sunday there would be a 9-11 Memorial service at 4:00 PM at Memorial Park with a short presentation. She also read certificates of appreciation to Esther Thaule for serving 40 years as a Crossing Guard and to Dorothy Batsakis for her service as a Crossing Guard for 22 years. 10 September 6, 2006 Adjourned at 10:20 PM in memory of Rita Grunbaum, a longtime resident who will be remembered for her many talents, bravery, sympathy and determination.
