BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman Paul A. Winick ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney Cindy Atiencia, Deputy Town Clerk CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O’Keeffe at 8:25 PM. She then pointed out the location of exits. Work Session The work session was called to order at 5:10 PM. Email Notifications There was a discussion on sending out agendas to meeting via email – a company was found who will track usage, and create the email list. Forest City The Board discussed the documents which will be necessary to move forward with the special permit for Forest City. The Board then entered into an Executive Session at 6:30 PM. PRESENTATION – Mamaroneck High School Girls Field Hockey Coach Supervisor O’Keeffe presented Mr. John Savage, Coach to the Mamaroneck High School Girls Field Hockey and KJ Warren a junior and captain to the Varsity Team. Mr. John Savage spoke about the Girls Field Hockey Championship in 2004. In 2005 the team had a sign created for their Championship. KJ and Mr. Savage presented a Welcome and leaving sign to the Town Board. The sign will be placed somewhere in the Town to the discretion of the Town Administrator and the Highway Superintendent. Councilwoman Seligson stated that this was the first time ever that the Girls Field Hockey Team has won a State Championship. PUBLIC HEARING – Special Permit – Forest City Residential Mamaroneck, LLC The following notice of Public Hearing was entered into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, March 15, 2006 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider a Special Permit Application - Forest City Residential , LLC. On motion of Councilwoman Wittner, seconded by Councilman Winick, it was March 15, 2006 RESOLVED, that the Public Hearing – Special Permit – Forest City Residential, LLC be adjourned until April 5, 2006 The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O’Keeffe and on motion of Councilwoman Wittner, seconded by Councilman Winick, the Board of Fire Commissioners was unanimously declared open. Present were the following members of the Commission: Commissioner: Valerie M. O’Keeffe Commissioner: Phyllis Wittner Commissioner: Ernest C. Other Fire Department Business Fire Commissioner Wittner commented on the professional group of volunteers that the Town has working at the Weaver Street Fire House. Westchester County has been teaching some classes in the facility and excited by the turn out of all the volunteers. There was a League of Women Voters breakfast where Commissioner Sutton from the Westchester County Emergency Planning was the speaker. Commissioner Sutton complimented the seasoned emergency retirements, and praised the new young employees and especially pointed out the good work of Fire Chief Matthew Peloso which bought out great cheer for all. There being no further business to come before the commission, on the motion of commissioner Odierna, seconded by Commissioner Winick, the commission unanimously adjourned AFFAIRS OF THE TOWN 1. Report of Bids – Hommocks Pool Lockers TA - 06 – 02 Supervisor O’Keefe asked for the Town Administrator to describe the bid. Town Administrator, Steve Altieri stated that the Hommocks Pool renovation has started the pool is expected to open in June. Part of the renovations are the male and female lockers rooms. The Mamaroneck School District and the Town of Mamaroneck agreed that the Town will pay for the repairs/replacement in the locker room: 248 new lockers and replacement of 43 benches that are located in front of the lockers. The original lockers were metal with the tendency to rust or acquire dents so in the specification of the bid we asked the lockers to be made of high density plastic. Only two (2) vendors picked up bid documents and only one responded. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby award contract TA 06-02 to Young Equipment Sales of Hauppauge, New York to furnish and install new lockers and benches at the Hommocks Pool, at a total cost of $97,888.00 for lockers, and BE IT FURTHER, RESOLVED, that the Town Board does hereby authorize the Town Administrator, Stephen V. Altieri, to execute a contract with Young Equipment Sales. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye 2. Authorization – Mamaroneck Town and Westchester County Property Tax Warrant The Town Administrator explained that under the Westchester County Administrative Law, it’s the Town’s responsibility to collect taxes. This County is the only one in the State of New York where the Town’s collect for the County. Town Administrator also went on by saying that this is the time of year when the Town must collect both the property tax levies for the town of Mamaroneck and the County of Westchester. The Tax Warrant must be signed by the Town Supervisor to authorize the collection of taxes. The County Tax warrant increases in 2006 by $952,819. The Town of Mamaroneck tax warrant increases by $574,170 to $16,905,720. On motion of Councilwoman Seligson, seconded by councilwoman Wittner, it was 3 March 15, 2006 RESOLVED, that the Town Board does hereby authorize the Town Supervisor, Valerie Moore O’Keeffe, to execute the following Town of Mamaroneck and County of Westchester Tax Warrant. STATE OF NEW YORK } COUNTY OF WESTCHESTER I }SS: TOWN OF MAMARONECK } THE PEOPLE OF THE STATE OF NEW YORK To Raymond Bingman, Receiver of Taxes of the Town of Mamaroneck in said County: You are hereby commanded pursuant to the provision of the Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948. as amended, and also pursuant to resolution of the Town Board of the Town of Mamaroneck adopted March 15, 2006, by authority of Chapter 313 of Laws of 1934, to receive and collect from the several persons named in the Assessment Roll hereunto annexed by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended, for the neglect to pay the Judicial, County, Town and Town District Taxes, charges for services, exemptions removed, and water arrears after the levy thereof as follows: Judicial and County Taxes - $32,274,367.00 Town and Town District Taxes - 16,905,720.00 Charges for Services - - 0 - Exemptions removed - - 0 - Water arrears - 5,572.53 49,185,659 53 And you are hereby directed to deposit to the credit of the Town of Mamaroneck in the Bank of New York, County Trust Region, all of such monies so collected by you by virtue of this warrant. And you are further commanded to make and file with the undersigned, the Supervisor of the Town of Mamaroneck, as required by the Westchester County Tax Law, Article 16. Chapter 852. Laws of 1948. as amended, the reports provided for therein. And you are further directed and commanded to proceed as directed and authorized by said Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended. And in case any person named in said Assessment Roll shall neglect or refuse to pay his taxes or penalties (after giving the notices and waiting the time as specified in said Act) you are hereby authorized to collect the said taxes and penalties with the costs and charges of such collections in the manner provided by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended, and for so doing this shall be your sufficient warrant. Approval of Certiorari On motion of Councilman Odierna, seconded by Councilman Winick, it was RESOLVED, that the Town Board does hereby authorizes the settlement of tax certiorari on the following terms, as recommended by the Town Attorney: Ten Park, LLC 10 Park Avenue Larchmont, NY 10538 Block: 728 Lot: 165 Town of Mamaroneck/Village of Larchmont Year Current Assessment Reduced Assessment 2005 $70,000 $47,000 The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye 4. Salary Authorization – Recreation On motion of Councilman Odierna, seconded by Councilman Winick, it was RESOLVED, that as provided for in the 2006 Town Budget the Town Board does hereby authorize the payment of salary to the following: John Carnes, Custodian, Hommocks Park Ice Rink, $12/hour, effective 3/9/06, replacing Richard Garner. Allocation – Funding for 911 Memorial Sculpture Supervisor O’Keeffe mentioned that she received a letter from County Executive, Andrew Spano to all chief elected officials asking municipalities to send $200 to donate a gold brick to the Valhalla plaza for the 911 memorial sculpture. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the payment of $200.00 for the funding of the 911 Memorial Sculpture. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye APPROVAL OF MINUTES – January 18, 2006 5 March 15, 2006 On motion of Councilwoman Seligson, seconded by councilwoman Wittner, it was RESOLVED, that the Town Board does hereby approve the Board minutes from the meeting of, January 18, 2006 as amended. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye SUPERVISOR REPORT Supervisor O’Keefe stated that she has been receiving written communication from residents of Howell Park about power outages in their neighborhood. A meeting was held with Con Edison and the residents of Carleon Avenue. Con Edison did locate the problems and corrected the issues. The last power outage was fixed within hours. Some residents of the Village of Larchmont would like to have an impact by forming the Quiet Skies Committee on landing patterns at LaGuardia Airport so that planes can fly over the middle of the sound instead off the sound shore. Supervisor O’Keeffe attended a meeting with the Village of Mamaroneck and Village of Larchmont Mayors to discuss finding a site for the day laborers. Mayor Trifelletti is in talks with the County, and with LegislatorJudy Myers, to find a temporary site for the day Laborers since Columbus Park is no longer an official site in the Village of Mamaroneck. REPORT OF COUNCIL Councilman Odierna said that on Friday March 17, 2006 there would be a League of Woman Voters Luncheon with Special Guest Speaker District Attorney Janet DiFiore, at the Orienta Beach Club. He said he went to the Recreation Commission meeting to discuss a web site for the Hommocks Park Ice Rink. Also the Town web site has a new innovation, from the Town web site you can now sign up for agendas and notifications. He will be attending to a viewing of the proposed voting machines will be held at the County Center, in White Plains on Thursday, March 30, 2006. Councilwoman Wittner did attend the meeting with Con Edison, and was impressed with the professionalism of Con Ed. Councilwoman Seligson attended the Westchester Municipal Officials dinner in Tarrytown, the food was great. The speaker was Dr. Joshua Lipsman, who spoke about county health issues. She said that both her and Supervisor O’Keeffe attended the DARE Graduation, adding that Sergeant Houlihan did an extraordinary job, the children just love him. They learned so much and thought the ceremony was wonderful. Supervisor O’Keeffe mentioned that this Friday, March 17, 2006 is Saint Patrick’s Day and that soda bread and Zeppolis for Saint Joseph’s Day would be served starting at 9:00 AM, if you would like to attend please do so in Supervisor’s corridor at the Town Center.
