BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman Paul A. Winick ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O’Keeffe at 8:30 PM. She then pointed out the location of exits. PUBLIC HEARINGS – Proposed Parking Ordinance – Cooper Lane The following notice of public hearing was entered into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, February 1, 2006 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a local law entitled “No Parking and No Standing on the Northeast Side of Cooper Lane Between Weaver Street and Mardon Road” Law PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. The Town Attorney explained this change was recommended by the Traffic Committee because cars traveling along Cooper Lane are forced into the adjacent lane when cars are parked there. The Supervisor asked if anyone had comments on this proposed law. Henry Ausenburg, Cooper lane resident asked which side was north. It was explained. He then said it’s an important distinction since then there would be no parking or standing on either side, which would cause him a hardship. There is a fire hydrant across from him and a handicapped child space. He also pointed out that on Sundays during church services parking regulations are not enforced. The Supervisor read a letter from Abby Katz: Carol Dracona, Cooper Lane, said she was a long time resident and was in favor of creating a smaller section of no parking than proposed. Ruth Campanelli said she had originally raised this issue with the Traffic Committee because of safety issues and was in total agreement with Abby Katz’s letter. She also mentioned the non-enforcement on Sundays. Supervisor O’Keeffe said she would contact Sts. John & Paul about parking around the church. Maria Bastone said she was in favor of people making a right onto Mardon. When people are going right onto Cooper they don’t pay attention, yes she is in favor of this law. FEBRUARY 1, 2006 A resident said this is right where his property is so the issue for him is speeding. He has a hidden driveway, coming out of it is a death trap. He asked if the Board could put in a speed bump or a hidden driveway sign which was previously there. He would also like to see a lower speed limit, he was not in favor of this law. Dr. Eisenberg asked if there has ever been an accident or is this over-regulation. Then on motion of Councilwoman Wittner, seconded by Councilman Odierna the hearing was closed. The Board members discussed modifying the law to no parking or standing from Weaver Street to the pole in front of 28 Cooper Lane. Supervisor O’Keeffe noted that the notification sign had a great effect. On motion of Councilman Winick, seconded by Councilwoman Wittner, the following was unanimously adopted: RESOLVED, that the Town Board finds that the adoption of the proposed local law regarding “No Parking and No Standing on the Northeast Side of Cooper Lane Between Weaver Street and Mardon Road” is hereby declared to be a Type II action, which will constitute an Unlisted Action with no impact under the New York State Environmental Quality Review Act (SEQRA) On motion of Councilman Odierna, seconded by Councilman Winick, the local law was adopted: LOCAL LAW This local law shall be known as the “No Parking and No Standing on the Northeast Side of Cooper Lane between Weaver Street and 28 Cooper Lane” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The purpose of this local law is to create a no parking and no standing zone on the northeast side of Cooper Lane between Weaver Street and 28 Cooper Lane. This law is necessary because when cars are parked in this area, vehicles traveling along Cooper Lane toward Mardon Road are forced to move to the oncoming lane of traffic, thereby causing a potentially dangerous situation. Section 2 – No Parking or Standing: Parking and standing on the northeast side of Cooper Lane from the point where Cooper Lane begins at Weaver Street to the telephone pole in front of 28 Cooper Lane is prohibited. Section 3 – Sign(s) to be Erected: An appropriate sign or signs shall be erected on, and striping shall be painted on the surface of Cooper Lane indicating the area where parking is prohibited. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. The above resolution was put to a roll call vote: 2 FEBRUARY 1, 2006 Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O’Keeffe and on motion of Councilman Odierna, seconded by Councilwoman Wittner, the Board of Fire Commissioners was unanimously declared open. Odierna Commissioner: Nancy Seligson Commissioner: Paul A. Winick 1. Councilwoman Seligson added it was a lovely event and we are proud to have such a good department. Councilwoman Wittner announced the Fire Council will meet next Monday. On motion of Councilman Odierna, seconded by Councilman Winick, the Board of Fire 3 FEBRUARY 1, 2006 Commissioners was unanimously adjourned. AFFAIRS OF THE TOWN 1. Establish Trust Fund – Rouken Glen Improvements On motion of Councilman Winick, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby authorize the Town Comptroller to establish a trust account entitled ‘Rouken Glen Gateway Improvements.’ The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner -Aye O’Keeffe - Aye 3. Designation of Delegate – Association of Towns Annual Conference On motion of Councilman Winick, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby designate Ernest A. Odierna as the voting delegate to the New York Association of Towns meeting in New York City on February 22, 2006. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye APPROVAL OF MINUTES December 7, 2005 On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby approve the Board minutes from the meetings of, November 16, 2005 as amended. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O’Keeffe - Aye SUPERVISOR’S REPORT The Supervisor said because of the storms many people were without electricity for days. Con Edison prioritizes to whom they restore power and when. We had an outstanding response from the Highway crew, especially Alan Casterella who encountered a downed 13000 volt wire. Councilwoman Seligson said people were frustrated by the lack of communication from Con 5 FEBRUARY 1, 2006 Ed, who did not have the manpower to handle the situation. We need to figure a way to have better communication links to them. There will be a meeting with Con Edison. She said her street was closed for five days because of a tree that came down on some wires. Councilman Odierna said he was away during the storms. He said he will be at the Larchmont Seniors this Friday at 1:00 o’clock to do a presentation on the internet. Councilwoman Wittner reported she had attended the Coastal Zone Management Commission meeting last week where they discussed two subdivisions. One has a house with a large lot the other was a landscape plan for Carmel property, it was a very well done plan, they will use native plants. Councilman Winick said the Housing Authority had their annual budget meeting and they are in good shape, the long term reserve is now $900,000, which is well past the goal. They are freezing rents this year because rents are coming down and gas prices for heat are up th for them. Everyone is invited to the 11 year celebration to be held in June. Councilwoman Seligson reported on the Board of Architectural Review meeting held on January 19, where they discussed the illumination of signs in Town. The Zoning Board of Appeals denied two signs – there was a lengthy discussion on the Sleepy’s store sign. ADJOURNMENT Supervisor O’Keeffe said next Wednesday, February 8, at 7:30 PM, there will be a special meeting on the Forest City Daily Special Permit, then the regular meeting of the Board will be held on February 16, and March 1. There will be a joint meeting with the Villages of Mamaroneck and Larchmont on February 3, to discuss Day Laborers. She sent her condolences to Betty Mack and her daughter on the loss of their son. She said they would like to adjourn the meeting in memory of Mary Hodde. On motion of Councilwoman Wittner, seconded by Councilman Winick the meeting was unanimously adjourned into at 9:55 PM.
