BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman Paul A. Winick ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney WORK SESSION Special Exemption Law The Administrator explained this law will help in the process when we have to deal with the US Open at Winged Foot. Noise is the biggest concern, parking is taken care of. There was then a discussion on the how fire, police and emergency services would be handled. Forest City Residential The Board discussed the trees which will act as a barrier at the site, and they talked about the different kinds of trees to be put in as well as other plantings. CAP In attendance was Beverly Brewer-Villa who spoke about the budget and how the monies are handled. Capital Budget Mr. Altieri spoke about the water filtration plant that has to be put in saying he thought it best to borrow the funds over 30 years through New York State. He said that he and the Comptroller had met with representatives who said the state funding was limited but to try anyway. He said with permission he would like to proceed. Denis Brucciani said if we get the funds through the state the interest would be knocked down from 4.59% to 3.2%, which would save two million dollars over the life of the loan. Gardens Lake The Administrator said the cost for this project was originally $150,000. Assuming Town staff does the labor, the price would go down to about $73,000. He would like to go back and talk about screening and enlarging the catch basin, which our staff could do, and originally the County was going to do. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM. She then pointed out the location of exits. PUBLIC HEARING —2006 Preliminary Budget 2 December 7, 2005 The following notice of Public Hearing was entered into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck, New York on Wednesday, December 7, 2005 at 8:15 PM in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck, New York to consider the preliminary budget for the calendar year commencing January 1, 2006 and ending December 31, 2006. All citizens are invited to attend and provide the Board with written and oral comments and ask questions concerning the Town's entire preliminary budget. The entire preliminary budget can be inspected by the public from 8:30 AM to 4:30 PM, beginning Monday, December 5, 2005 in the Town Clerk's Office, Town Center, 740 West Boston Post Road, Mamaroneck, New York. PLEASE TAKE FURTHER NOTICE, that the proposed salaries of the members of the Town Board are as follows: Supervisor, $30,000; Town Council (4) $6,000 each and the proposed salary for the Town Clerk is $72,660 and the Town Justices (2) $21,000. On motion of Councilman Winick, seconded by Councilwoman Wittner, the public hearing was unanimously opened. Based upon the revenues and appropriations included in the 2006 budget, property owners in the Town will realize the following change in property taxes. Impact Upon Unincorporated Area Properties 2005 2006 Change Property Tax Rate $217.65 $227.20 $9.55 or 4.4% Change in Town Property Taxes $4,353.00 $4,544.00 $191.00 Impact Upon Properties in the Villages of Mamaroneck and Larchmont 2005 2006 Change Property Tax Rate $14.65 $11.65 ($3.00) or(20%) Change in Town Property Taxes in Villages $293 $233 ($60.00) Calculation of Property taxes is based upon a property with an average assessment of$20,000 z Property tax rate is a combined tax rate that includes the Town wide tax rote and Ambulance District tax rate both of which are levied upon all properties In the Town of Mamaroneck Councilwoman Seligson said the budget was uneventful except for the large borrowing which actually happens in 2007. 3 December 7, 2005 Councilman Odierna commended Mr. Altieri and Mary Stanton on the presentation — it gave the budget outline a lot more depth and more detail. Councilwoman Wittner also thanked the Administrator for doing a fine job on the budget. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the hearing was closed. On motion of Councilwoman Wittner, seconded by Councilman Winick, the following was unanimously adopted: Resolved, that the Town Board finds that the adoption of the proposed amended local law regarding the 2006 Town Budget is hereby declared to be a Type II action, with No Impact on the environment under the New York State Environmental Quality Review Act (SEQRA). BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe and on motion of Councilman Odierna, seconded by Councilwoman Wittner, the Board of Fire Commissioners was unanimously declared open. Authorization —Westchester County Mobile Radio Agreement On motion of Councilwoman Wittner, seconded by Councilman Winick, it was RESOLVED, that the Town Board does hereby approve the agreement between the Town of Mamaroneck and the Westchester County Department of Emergency Services, to install Mobile Radios and Control Stations with the Police Department and the Ambulance District; and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Set Public Hearing —Amendment to the Ethics Law RESOLVED, that the Town Board does hereby set the date for public hearing on the Amendment to the Ethics Law on December 20, 2005; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. Salary Authorization — Police Recreation On motion of Councilman Odierna, seconded by Supervisor O'Keeffe, the following resolutions were adopted: POLICE DEPARTMENT RESOLVED, that the Town Board does hereby authorize the Salary Authorization to Joshua Shoemaker, to the position of Police Officer at an annual Salary of$44,766 effective December 15, 2005. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye RESOLVED, that the Town Board does hereby authorize the Salary Authorization to Michael Downes, to the position of Police Officer at an annual Salary of$44,766 effective December 15, 2005. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye RESOLVED, that the Town Board does hereby authorize the Salary Authorization to Thomas Hollywood, to the position of Police Officer at an annual Salary of$44,766 effective December 15, 2005. 6 December 7, 2005 The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye RECREATION On motion of Councilman Odierna, seconded by Supervisor O' Keeffe, it was RESOLVED, that as provided for in the 2005 Town Budget the Town Board does hereby authorize the payment of salary to the following: John Bostiz, Assistant Coach, Youth Hockey Program, $14/hour, retroactive to 11/12/05. Brain Connor, Assistant Instructor, Youth Hockey Program, $5.50/hour, effective 12/3/05. Rory Fugazy, Jr., Assistant Instructor, Youth Hockey Program, $6.50/hour, retroactive to 11/12/05. Michael Tarnow, Assistant Instructor, Youth Hockey Program, $5.50/hour, retroactive to 11/12/05. Alex Weisberger, Assistant Instructor, Youth Hockey Program, $6.50/hour, retroactive to 11/12/05. Matthew Albert, Assistant Instructor, Youth Hockey Program, change in salary from $5.50 to $7.00/hour, retroactive to 11/12/05. Frank Commarde, Assistant Coach, Youth Hockey Program, change in salary from $7.50 to $9.00/hour, retroactive to 11/12/05. Michael O'Byrne, Assistant Coach, Youth Hockey Program, change in salary from $7.00 to $9.00/hour, retroactive to 11/12/05. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye On motion of Supervisor O'Keeffe, seconded by Councilman Winick, it was RESOLVED, Donald Sutherland is appointed as a member to the Traffic Committee; and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on December 2006. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye 7 December 7, 2005 Odierna - Aye Wittner - Aye O'Keeffe - Aye APPROVAL OF MINUTES—September 21, 2005 & October 6, 2005 On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the following was unanimously approved: RESOLVED, that the Town Board does hereby approve the minutes of September 7, 2005 & October 6, 2006 as amended. ORAL COMMUNICATIONS George Roniger invited everyone to the tree lighting around Gardens lake on Saturday at 4:15 PM. He said that Betty Miller a long time resident will be moving on December 11 and there would be a reception to say goodbye. SUPERVISOR REPORTS Supervisor O'Keeffe praised the Police Department and especially Donn Edmonds and Jerry McCarthy who were instrumental in making an arrest of a person pilfering credit cards. She said there was an excellent article in The Journal News about it and it was just terrific detective work. She commended the whole detective bureau. She reported that she had attended the Westchester Municipal Officials Dinner where the Help America Vote Act had been discussed. REPORTS OF THE COUNCIL Councilman Odierna said Human Rights was making good progress on the Martin Luther King Jr., Day celebration. They have two great speakers, Dionne Warwick and Ruby Dee. He would be attending the Recreation Commission meeting next Tuesday Councilwoman Wittner attended CZMC on November 22 where they heard about a subdivision of property. She went to the appellate court hearing on the Kemper property case, it was very interesting. Carol Loggeshall was honored by the County Soil &Water District at TeaTown Conservation. Councilwoman Seligson went to the Board of Architectural Review meeting, they discussed the Forest City project. She went to a Greenway meeting —ten volunteers showed up to clear the trail in Saxon Woods, it looks really beautiful. There's a meeting on Monday and we have great designs on blazers, we are hoping for a soft opening in the fall of 2006, then in the spring of 2007 the runners club will have a race. Councilman Winick said the Traffic Committee will be meeting next Tuesday, they will be discussing a traffic control device around the lake. All of the Board attended the LMC/TV award benefit program on Sunday.
