HomeMy WebLinkAbout2005_09_07 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON SEPTEMBER 7, 2005 AT 8:15 PM IN THE COURT ROOM OF THE TOWN, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman Paul A. Winick ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney WORK SESSION Forest City Daly There was a discussion on the revised plan submitted by Forest City Daly. The nine affordable housing units will be kept but the board debated the best way to market them either by sale or by keeping them as rental units. They also discussed how they could be monitored in the future and who would do the monitoring. Councilman Winick said he was concerned about the impact on the school if there should be more than one or two children in the units. It may require an additional teacher at the school. They also discussed if a new SEAR process would be necessary and the process the board would follow. Lakeside Drive — Right of Way Encroachment Supervisor O'Keeffe introduced Dr. Farca, explaining he had put up a wall on the right of way and in the past when someone built in the right of way the owner was made to take them down. Dr. Farca said he moved here from Queens and he takes exception to the right of way in this instance. This stemmed from a misunderstanding after talking to Mr. Goessl who told him he could build a wall as long as it was under six feet. The stop work order was therefore a shock. Mr. Altieri said there is a survey monument which marks the right of way. Dr. Farca said he was unaware of it until the highway department came by after the fact. He said if he hadn't been given false information by Mr. Goessl it wouldn't have happened and he could sue for the toxic chemicals being dumped into Gardens Lake. He said his wife was brought to the emergency room because of fumes coming into his house. Mr. Altieri said according to his paperwork the fumes were caused by workers redoing the floors in Dr. Farca's house. After further discussion it was decided the wall must come down. Hommocks Pool Mr. Altieri said during construction parking will be a problem because 30 to 40 spaces will be taken away. He met with the school and they have come up with a plan with some of the cars parking in front of the American Legion. Amend — Tree Preservation Law 1 September 7,2005 Mr. Maker explained there had been some thought of having Coastal Zone Management be referred too. No decision was made. Myrtle Boulevard Kiosk Ms. Stanton reported the kiosk was stocked and electrified and we are looking into putting in a cop detail and tonight we are hiring a part time person to man it. Neon Lights Supervisor O'Keeffe said we should pass the law to keep people from skirting this. Councilwoman Wittner said the signs are terrible; we have to change the law and suggested a moratorium on the neon. It was decided to set a public hearing for a moratorium on this matter. FAR Law Mr. Altieri passed out a synopsis of permits issued and questioned whether the board wanted to make the law more restrictive or not. No decision was made. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20 PM. She then pointed out the location of exits. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe and on motion of Councilman Odierna, seconded by Councilwoman Wittner, the Board of Fire Commissioners was unanimously declared open. Fire Protection 530.00 Poland Spring Water 86.47 Robert's 111.99 TCD 36.00 TOTAL: $11,471.73 The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye Commissioner Wittner said the Fire Council had met last night where they discussed a letter of opinion to the Police Chief on dispatching which clarifies the procedure. She said they will hold their first ever golf outing at Bonnie Briar on September 19. First prize is a Lexus and a power boat— admission is $200. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Odierna, the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. Authorization — Sale of Surplus Equipment On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby declare the below list as surplus and authorize the sale of the following equipment: 3 September 7,2005 4 September 7,2005 The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye 2. Authorization — Renewal of Agreements with Volunteer Ambulance Corps. This Item was held over to September 21, 2005 5 September 7,2005 3. Report of Bids — Contract TA-05-09 Dillon Road Improvement Project On motion of Councilwoman Wittner, seconded by Councilman Winick, it was RESOLVED, that the Town Board does hereby award bid TA-05-09, Dillon Road Improvement Project to Peter Landi Inc. For the amount of $475,105.00; and BE IT FURTHER, RESOLVED, that the Town Administrator is authorized to execute said contract on behalf of the Town. Report of Bids — Contract TA-05-08 Road Resurfacing On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby award bid TA-05-08 Road Resurfacing to ELQ for the amount of$ 77,025; and BE IT FURTHER, RESOLVED, that the Town Administrator is authorized to execute said contract on behalf of the Town. Salary Authorizations — Recreation On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was RESOLVED, that as provided for in the 2005 Town Budget the Town Board does hereby authorize the payment of salary to the following: Erica Block, Lifeguard, Hommocks Pool, $9/hour, retroactive to 8/5/05 Jeffrey Bolivar, Key Attendant, Hommocks Pool, $7.50/hour, retroactive to 8/8/05 Christine Corsetti, Lifeguard, Hommocks Pool, $7.75/hour, retroactive to 8/8/05 Kathleen Corsetti, Lifeguard, Hommocks Pool, $7.75/hour, retroactive to 8/8/05 Sara Gartman, Lifeguard, Hommocks Pool, $8/hour, retroactive to 8/9/05 Rebecca Sobel, Lifeguard, Hommocks Pool, $8/hour, retroactive to 8/9/05 Caroline Spader, Lifeguard, Early Morning Swim Program, $25/session, retroactive to 8/15/05. Set Public Hearing — Moratorium to Neon Signs On motion of Councilwoman Wittner, seconded by Councilman Winick, it was RESOLVED, that the Town Board does hereby set the date for public hearing on a Local Law entitled Moratorium on Neon Signs for Wednesday, September 21, 2005; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. Change Meeting Date in October On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby approve the Change of Meeting Dates in the 8 September 7,2005 month of October from Wednesday, October 5, 2005, to Thursday, October 6, 2005. Appointment— Replacement to Larchmont Library Board On motion of Supervisor O'Keeffe, seconded by Councilwoman Wittner, it was RESOLVED, Maureen LeBlanc be appointed as a member of the Larchmont Library Board of Trustees; and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire in May 2008. RESOLVED, that the Town Board does hereby approve the Board minutes from the meetings of, June, 1, 2005 as amended. PROCLAMATION — Constitution Week The following proclamation was read by Councilwoman Seligson WHEREAS, September 17, 2005 marks the 218th anniversary of the signing of the Constitution of the United States of America by delegates to the Constitutional Convention; and WHEREAS, By an Act of Congress on February 29, 1952, the date of September 17 has been annually declared Citizenship Day, and WHEREAS, Constitution Week was designated by a Joint Act of Congress August 2, 1956[36 U.S.C. 159], and WHEREAS, The Constitution of the United States of America, the guardian of our liberties, is a product of reflection and choice, embodying the principles of limited government in a Republic dedicated to rule by law, not by men; and 9 September 7,2005 WHEREAS, It is fitting and proper to accord official recognition to this magnificent document and its memorable anniversary and to the patriotic celebrations which will commemorate it. NOW THEREFORE, BE IT RESOLVED, That 1, Valerie Moore O'Keeffe, Supervisor of the Town of Mamaroneck, and the Town Board do hereby proclaim September 17, 2005 and the week of September 17-23, 2005 Citizenship Day and Constitution Week IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 7th day of September 2005. ORAL COMMUNICATIONS George Roniger asked for an update on the Larchmont Railroad tunnel situation. Supervisor O'Keeffe said both Mayor Bialo and George Latimer are trying to get money from Albany to fix the tunnel. She said the pumps are not broken they just need some maintenance. Mr. Roniger then said we seem to be losing the battle of the leaf blowers. The Supervisor said there had been 45 calls about them of which 20 had received summonses, the rest were turned off. He then asked about the start time for the recycling trucks because one had woken him up at 6:30 AM this morning. Mr. Altieri said they usually start at 7:00 AM. SUPERVISOR REPORTS Supervisor O'Keeffe stated the hurricane has caused a terrible tragedy in New Orleans and surrounding areas, she encouraged everyone to donate to the Red Cross. She also thanked Mary Stanton on the very well written Annual Report. She congratulated Liz Paul for getting a grant of$35,000. REPORTS OF THE COUNCIL Councilwoman Wittner said Liz Paul had done a great job with the conservation crew adding she is too be commended. Councilwoman Seligson said welcome back to school. Councilman Odierna said there was construction begun on the school, there will be significant parking problems. ADJOURNMENT The Supervisor said she would like to adjourn in memory of Beverly Lauflin, who recently passed away; she lived in Elkin Park and worked in the unemployment office in New Rochelle. She was active in Larchmont Avenue Church, and always willing to help.
