Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM. She then pointed out the location of exits. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:35 PM and on motion of Councilman Odierna, seconded by Councilwoman Wittner, the Board of Fire Commissioners was unanimously declared open. Other Fire Department Business RESOLVED, that the Town Board does hereby authorize the appointment of Peter Aquilino to the position of Town Firefighter at an annual Salary of$27,000 effective August 22, 2005. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye 3. Service Award Report Commissioner Wittner presented the service award program for January 1, 2005 through June 30, 2005 as submitted by Frank Cioffi to Fire Council. The report reads as follows: 3 August 8, 2005 4 August 8, 2005 5 August 8, 2005 6 August 8, 2005 There being no further business to come before the Commission, on motion of Commissioner Odierna, seconded by Commissioner Winick, the Commission unanimously adjourned. The following was taken out of order of the agenda. ORAL COMMUNICATIONS Nancy Hardardt representing Larchmont Civic Association, said she had been told by George Roniger that the Board would be interested in a walking tour, maybe it could be set up for this Saturday. She said the straw bales are at the brook, and the border now needs plantings. The Supervisor said that September would be better. She said the board is not aware of hay bales being put there. Councilwoman Seligson said they were there for about a year. She and the Supervisor both proposed Saturday September 10, at 9:30 AM for the tour. Ms. Hardart said where the plants were put in around the banks it is very beautiful. Supervisor O'Keeffe said Councilwoman Wittner should be thanked as she got the grants and they may give us hope for some dredging to be done. She added that thanks should be sent to the Highway staff too for all their hard work. Supervisor O'Keeffe announced that on channel 58, Court TV at 10 PM this evening will be a special based on a book written by our Assistant to the Administrator, Mary Stanton. The name of the book is From Selma to Sorrow, about a white lady, fighting for civil rights, who was killed by the KKK, it was critically acclaimed. AFFAIRS OF THE TOWN 1. Authorization —Amendment IMA— Mamaroneck School District— Hommocks Pool On motion of Councilman Odierna, seconded by Councilman Winick, it was RESOLVED, that the Town Board does hereby agree to amend the current agreement between the Town and School District regarding the financing of the Hommocks Pool reconstruction project; and BE IT FURTHER, RESOLVED, that the Town agrees to provide its share of the cost of the project up to $900,000 to be paid to the district in March of 2006, and BE IT FURTHER, RESOLVED, that the Town Board authorizes the Town Administrator to execute above-said agreement on behalf of the Town. Authorization —Amendment— New York State Snow/Ice Agreement The Town Administrator explained this is an amendment to the original agreement which increases the amount the Town will receive. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby agree to amend the current agreement with New York State for the removal of snow and ice on State roads in the Town; and BE IT FURTHER, RESOLVED, that the Town will be reimbursed by an additional $12,162.49 based upon severity of the winter and also $739.07 for fuel adjustment; and BE IT FURTHER, RESOLVED, that the Town Board authorizes the Town Administrator to execute above-said agreement on behalf of the Town. Authorization —Westchester County Snow/Ice Agreement On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby agree to amend the current agreement with Westchester County for the removal of snow and ice on State roads in the Town; and BE IT FURTHER, RESOLVED, that the Town will be reimbursed by the consumer price index for the New York Metropolitan area to a maximum of an additional 3.5% per year; and BE IT FURTHER, RESOLVED, that the Town Board authorizes the Town Administrator to execute above-said agreement on behalf of the Town. Authorization – Drug Testing Agreement On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby agree to change the Town's random drug & alcohol provider to Clarity Testing Services; and BE IT FURTHER, RESOLVED, that the Town Board authorizes the Town Administrator to enter into an agreement on behalf of the Town with Clarity to provide drug and alcohol testing services. Set Public Hearing — Parking — Colonial Ave On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the parking amendment on Colonial Avenue for September 21, 2005; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. Authorization — Rider Urban County Cooperation Agreement In a memo from the County it was explained a rider to original agreement had to be approved. It is regarding the automatic renewal periods, which specifies the County will notify the municipality in writing about the next qualification period. RIDER to URBAN COUNTY COOPERATION AGREEMENT— FY 2006 - 2008 Between COUNTY OF WESTCHESTER (the "County") and (the "Cooperating Municipality") dated The Urban County Cooperation Agreement FY 2006 - 2008 is hereby revised on to include the following under paragraph 12 therein; With respect to automatic renewal periods, the County shall notify the Cooperating Municipality in writing by the date specified in HUD's urban county qualification notice for the next qualification period of the Cooperating Municipality's right not to participate in the new qualification period. The County shall send a copy of the notice to the Cooperating Municipality to the HUD Field Office by the date specified in the urban county qualification schedule. The County and the Cooperating Municipality shall adopt any amendment to the agreement incorporating changes necessary to meet the requirements for cooperation agreements set forth in an Urban County Qualification Notice applicable for a subsequent three—year urban county qualification period, and shall submit such amendment to HUD as provided in the urban county qualification notice, and that failure to comply shall void the automatic renewal for such qualification period. THE COUNTY OF WESTCHESTER By County Executive COOPERATING MUNICIPALITY By Chief Executive On motion of Councilwoman Seligson, seconded by Councilman Winick, it was RESOLVED, that the Town Board does hereby agree to amend the current agreement between the Town and County; and 13 August 8, 2005 BE IT FURTHER, RESOLVED, that the Town Board authorizes the Town Supervisor to execute above-said agreement on behalf of the Town. Salary Authorizations POLICE DEPARTMENT On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the promotion of Richard DiGraziano from the position of to the position of Police Sergeant at an annual Salary of$87.965 effective August 11, 2005. Moore Coordinator, Basic Life Support Services at an annual Salary of$37.180 effective August 9, 2005. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye Supervisor Reports Supervisor O'Keeffe said she wanted to commend the Highway Department, the Town has never looked so good. The summer concerts are going well also. 16 August 8, 2005 Council Reports Councilman Odierna attended a concert in the Village of Mamaroneck yesterday, there were mostly seniors there. He went to the Recreation Commission meeting where they discussed the progress at the camps. It all seems to be going well. Councilwoman Wittner said Coastal Zone Management had met on July 26 and The Fire Council met on August 1. The softball game with the Village of Mamaroneck was cancelled. Councilwoman Seligson said there was a conflict when Zoning and Board of Architectural Review met because she had a greenway meeting, where they discussed the signs and maps. The next meeting is in early September. Councilman Winick said everything has been in recess since the Board's last meeting. He added that signs on his street were put up within 10 days. Councilman Odierna said he was pleased to see Rye Playland now has moorings and four docks on shore, and has a boat launch.
