RE: 2022 REASSESSMENT UPDATE
The Town is currently preparing for our 2022 Tentative assessment roll update.
Adjusting assessments to appropriately reflect market value shifts and/or physical changes due to
changes in property inventory data is required by the New York State Office of Real Property
Services.
As in past years, all property owners will receive an "assessment notice," regardless of whether
there was an actual change in the assessment.
Property tax fairness remains the goal of the Town Assessor's office and, as always, the tentative
assessment roll and assessment data may be found on our Town website
(www.TownofMamaroneckNY or ) on June 1, 2022.
If you disagree with your full market value estimate, you are entitled to challenge your
assessment through the Board of Assessment Review from
.June ls` to .Tune 21s`. 2022.
Grievance applications (form RP-524), instructions and procedures are available on our
website under the Assessor's Department and can be mailed or submitted in the lobby of
the Town Center, Monday -Friday 8:30AM to 4PM beginning 6/1/22 until 6/21/22.

Attached please find a memo from Robert Wasp regarding Bid TA-22-05 — Town
Senior Center Parking Lot Improvements. As Rob mentioned in his memo, we have
requested a reallocation of CDBG funds in the amount of $125,000.00 to add to the
original funding of $100,000.00. If we are not approved for this reallocation, the
total shortfall will actually be $330,032.50 for which the Town would be
responsible. We are respectfully requesting the following action by the Board:
Resolved that the Town Board hereby approves the agreement with Peter J.
Landi, Inc. for work on the Town Senior Center Parking Lot and hereby
authorizes the Town Administrator to execute the agreement and any related
documents necessary to carry out its implementation.

SUBJECT: Recommendation of Contract Authorization
TA-22-05 — Town Senior Center Parking Lot Improvements
GENERAL:
Bid procurement was recently completed for the Senior Center Parking Lot Improvements. On
March 25th, 2022, six (6) bid proposals were received as summarized on the attached bid
tabulation table. Bid proposals were reviewed for completeness and contractor's project
qualifications by Town staff with support from the Westchester County Department of Planning.
As outlined in the enclosed memorandum prepared by Suzette Lopane, RLA, the proposal
received from "Peter J. Landi, Inc" is recommended as the lowest responsive bidder for Town
Board consideration of award.
Bid proposals were structured with "add -alternates" to coincide with specific components of the
project that are beyond the base bid scope of work. These alternates include construction of a
new ADA compliant ramp, new timber guide rail, site landscaping and pathway to the bocce
court on the property. Peter J. Landi's base bid amount of $500,212.00 increases to $604,032.50
if all four add -alternates are included in the project award.
The project was originally awarded $100,000 in CDBG funding allocated through the 2021 FY
program. Reallocation of an additional $125,000 in CDBG funding originally intended for the
2023 FY interior renovation of the Senior Center Activity Room, Foyer and Front Porch has
been requested from Westchester County. The request would increase the CDBG fund
contribution to the parking lot project to $225,000.00.
The Town's original budget contribution of $162,000.00 was planned through capital project CP-
2021-48. Contributions from the CDBG program and Larchmont Garden Club offer additional
funding in the amounts of $225,000.00 and $12,000, respectively. Contingency budget of
$50,000 for miscellaneous additional work (MAW) and construction phase testing is included in
the base bid amount. Overall projected costs of $604,032.50 create a budget shortfall balance of
$205,032.50 as necessary to fully fund the project.

Enclosed for your review is an analysis of the bids submitted on Friday, March 25, 2022, for the Town Senior
Center Parking Lot. All of the bid proposals received have been checked for mathematical accuracy and the
totals shown on the spreadsheet represent correct amounts. In addition, as per the latest `NYSDOL List of
Employers Ineligible to Bid on or be Awarded any Public Work Contract', this Contractor is eligible for award.
The low responsible bidder is Peter J. Landi, Inc. This contractor has worked on various other projects of
similar scope, including Ridge Road Park in the Town of Greenburgh where they rehabilitated an existing
parking lot. We recommend the Town award the bid to Peter J. Landi, Inc. at the next Town Board meeting.
Please notify us once the bid has been awarded so that we can schedule a pre -construction conference.

TA-22-06 — Reconstruction of Municipal Sidewalks & Curbing
GENERAL:
Bid procurement was recently completed for the Town's 2022 reconstruction of sidewalk and
curbing contract. The project scope consists of sidewalk and curbing along roadways listed in the
Town's multi -year sidewalk and curb replacement capital plan. Sidewalk and curbing along
Dante Street, Orsini Drive, Homer Avenue, Dimitri Avenue and Revere Road are part of the
2022 project.
On April 29th, 2022, six (6) bid proposals were received as summarized on the attached bid
tabulation table. The apparent low bidder is "Laura Li Industries" at the submitted total price of
$678,300.00 for the full project scope. Deduct alternate price for the removal of work along
Revere Road was included on the submitted bid form that reduces the project cost to
$625,800.00 if elected.
The Engineering Department contacted the references enclosed with the Laura Li Industries
proposal and received positive feedback on their completed projects. The Contractor has
extensive experience executing large contracts with the Westchester County Department of
Public Works. No errors or omissions that could potentially impact the viability of their bid
price have been identified at this time. The Engineering Department recommends authorization
of contract award to Laura Li Industries based upon their submitted base bid amount of
$678,300.00.
Budget for the reconstruction of sidewalk and curbing contract was planned as part of capital
project CP-2020-73. Incorporation of a contingency budget in the amount of 68,000.00 for
potential unforeseen additional work and field inspection support is recommended. Overall
considered costs of $745,300.00 are fully contained within the available balance allocated to the
capital project.

services.

Town and Robert Lunde for consulting services and hereby authorizes the Town
Administrator to execute the agreement and any related documents necessary to
carry out its implementation.

Whereas, Robert Lunde, who has served as General Manager of the
Hommocks Park Ice Rink for more than thirty-one (31) years, will be
retiring on May 28, 2022.
Whereas, the Town Board wishes to have Robert Lunde continue to train
and assist, as needed, the incumbent General Manager. In addition, in the
event staff coverage is needed at the Hommocks Park Ice Rink, he may be
called in to assist.
This agreement expires on December 31, 2022, however, it may be
extended at the Town Administrator's discretion and with Robert Lunde's
concurrence.
Whereas, this agreement is effective as of June 1, 2022.
Therefore, the Town and Robert Lunde agree to the following terms and
conditions:
1. Prior to performing any duties, for which Robert Lunde will receive
compensation from the Town, it is understood that approval must be
obtained from Jill Fisher, Superintendent of Recreation.
2. Robert Lunde will be compensated up to a maximum of two hundred
fifty (250) hours for work performed.
3. Robert Lunde's hourly rate for worked performed will be $52.63,
which is based on his current annual salary of $109,468.

SUBJECT: Authorization to Appoint a Court Clerk
Authorization is requested to promote Dominique Patterson, currently an Assistant Court
Clerk to Court Clerk, effective May 31, 2022, at an annual salary of $79,169. The position
will be vacant due to a pending retirement later this month. The 2022 budget for the
position is slightly higher than the stated salary, which would result in a savings.
The Court Clerk is classified as an exempt Civil Service position and, as such, the
incumbent is not required to take a test. However, she will have to serve a fifty-two week
probationary period.
Ms. Patterson was hired in August 2020 as the Assistant Court Clerk and has extensive
municipal court experience, having worked in the court offices in the Village of Port Chester
for two years and the Town of Greenburgh for more than six years.
As Court Clerk, she would be responsible for the daily activities and administration of the
Court and would supervise a full-time and part-time Assistant Court Clerk. The Town Court
handles a wide array of cases, including criminal, civil, small claims and landlord tenant
matters, as well as environmental and Town ordinance violations. All scheduling of trials,
hearings and other proceedings fall within court administration. In addition, she would be
responsible for the financial administration of the Court, which includes filing reports with
the State Comptroller's office and activities related to banking.
Judge Brescia and Judge Meister are in support of Ms. Patterson's promotion to Court Clerk.
According to the Justices, Ms. Patterson "has capably fulfilled all her responsibilities in her
position in our chambers and exceeded our expectations in the quality of her work. We have
found her to be conscientious, thorough, courteous and dedicated to her job."
ACTION REQUESTED: That the Town Board approve Dominique Patterson's promotion to
Court Clerk at an annual salary of $79,169, effective May 31, 2022,

Re: 2022 Bonding Resolutions
The 2022 Capital Budget included many projects that were needed throughout the Town. In
consideration of the financial impact of the economy and the anticipated allocation of American
Rescue Plan Funds, a prudent and careful review of all projects planned was completed with the
objective of keeping debt service as low as possible. The first step in securing the funding requires
the adoption of bonding resolutions.
Please note that the bond resolutions for the replacement of two fire engines have been approved
and voted upon by the residents earlier this year. The Water District bonds requires a public hearing
before a vote that will be scheduled in a separate resolution. The total amount listed in the 2022
Borrowing column of $5,183,080 will be the amount bonded this year.
According to the financial advisors, the bond market has been stable and rates for both Bonds and
BANS for municipalities with a Aaa bond rating are still low but climbing. Fifteen -year bonds are
currently selling at a rate of 3.42%. We intend to accept the financial advisor's advice on the most
cost effective borrowing method at the time the bonds are ready to be sold. We will provide an
update as the process progresses.
Debt service on bonds that are issued in 2022 will begin in 2023. The debt service for the projects
below will be funded by several different funds. The Water District debt service is funded with
fees based on usage and the annual cost will be incorporated into the 2023 fee structure. The debt
service in the other funds are paid with tax revenues. The total anticipated debt service will be
$449,000 of which $96,519 or 22% will be paid through fees.

Below is a brief summary of the projects and the amount of the required bonds for which approval is
necessary:
1. Computer Hardware/Software- Project #2019-19 ($126,400)
Fund a balance was used to fund the purchase of computer equipment in 2019 and as a result, the related
bond resolution will be rescinded, saving the Town debt service.
2. Town Center Flat Roofs- Project #2018-14
$610,000
This project includes the replacement of five flat roofs on Town Center that are beyond their useful life,
leaking and causing damage. Debt service will be paid by the General Fund. The bond resolution for this
project is attached and combined with the elevator modernization project.
3. Elevator Modernization -Town Center- Project #2020-14 $155,000
The elevator in Town Center is well beyond its useful life and has had operating issues. This project will
update the mechanics of the elevator and extend its useful life, Debt service will be paid by the General
Fund. The bond resolution for this project is attached and combined with the Town Center roof project.
4. Financial Enterprise System- Project #2021-89
$203,400
This project funds the second year of a multi -year project to implement the Tyler on-line financial
management software as reviewed with the Town Board. Debt service will be paid by the General Fund.
5. Traffic Signal Replacement- Three Locations — Project 2022-61 $415,000
Traffic signals at Myrtle/Murray; Palmer/Richbell and Forest/ Murray will be replaced and modernized.
Debt service will be paid by the Part Town Fund. The bond resolution is attached.
6. Road Reconstruction- Project #2020-04
$642,380
This project includes the reconstruction/resurfacing of roads that have been prioritized based on road
conditions. Debt service will be paid by the Highway Fund. The bond resolution is attached.
7. Highway Vehicles- Project #2020-06 and 2020-72 $343,000
In accordance with the vehicle replacement plan, six highway vehicles are beyond their useful life. The
six vehicles include a black top roller, 1 ton dump truck- Ford F450, salt spreader, Ford F250 Utility
Truck and two electric vehicle cars. Debt service will be paid by the Highway Fund. The bond resolution
for this project is attached.
8. Sidewalk Reconstruction- Project #2020-73 $618,500
This project includes the replacement of deteriorated concrete sidewalks on Memorial Park, Revere
Road, Dante St and Orsini Drive. Debt service will be paid by the Highway Fund. The bond resolution
is attached.
9. Overhead Lube System- Project #2021-84 $75,000
Purchasing an overhead lube system for the garage will provide efficiencies within the garage and be
cost effective by purchasing fluids in bulk. Debt service will be paid by the Highway Fund. The bond
resolution for this project is attached.
10. Rye Lake Filtration —Project #1364-12 $189,000
This funding is for the Town's share of the (16.7%) the engineering, legal and design services costs of
the construction of the Rye Lake Filtration Facility to be completed by the Westchester Joint Water

Works. This project requires a public hearing. The bond resolution is attached and combined with all
of the water infrastructure projects.
11. Purchase Water Storage Tank #1- Project 1382-12 $306,900
Multiple failures of the coating system on this 1.0 million gallon water storage ground tank were found.
In order to avoid structural steel failures and to extend the useful life of the water storage tank, a full
rehabilitation is required. The rehab will involve a complete blasting of the tank's interior and exterior
surfaces and application of a new coating to properly protect the structural steel. Improvements will be
made to the tank to meet current regulatory requirements. This project requires a public hearing. The
bond resolution is attached and combined with all of the water infrastructure projects.

A RESOLUTION REPEALING A BOND RESOLUTION ADOPTED BY THE
TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK ON
FEBRUARY 20, 2019.
WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County, New York
(the "Town") has heretofore duly adopted a purchase and installation of computer software for
various departments bond resolution of said Town on February 20, 2019, including incidental
improvements and expenses in connection therewith subject to permissive referendum; and
WHEREAS, it has now been determined that said financing authorization will not be
required for said capital project and it is now desired to repeal said serial bond authorization thereof;
NOW, THEREFORE, BE IT
RESOLVED, by the affirmative vote of not less than a majority of the total voting strength
of the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows:
Section 1. The serial bond authorization of the bond resolution dated February 20, 2019
for the purchase and installation of computer software for various departments is hereby repealed;
provided, however, such repeal shall only be effective to the extent any such authorization to be
repealed has not heretofore been utilized for the issuance of obligation of the Town therefor:

WHEREAS, it is now desired to authorize the financing of such capital project; NOW,
THEREFORE,
BE IT RESOLVED, by the affirmative vote of not less than two-thirds of the total
voting strength of the Town Board of the Town of Mamaroneck, Westchester County,

Section 1. Town Center building reconstruction, in and for the Town of
Mamaroneck, Westchester County, New York, being roof replacement and elevator
modernization, including original furnishings, equipment, machinery, apparatus, appurtenances,
and incidental improvements and expenses in connection therewith, is hereby authorized at a
maximum estimated cost of $765,000.
Section 2. The plan for the financing of the aforesaid maximum estimated cost is by
the issuance of $765,000 bonds of said Town, hereby authorized to be issued therefor pursuant to
the provisions of the Local Finance Law.

Section 4. The faith and credit of said Town of Mamaroneck, Westchester County,
New York, are hereby irrevocably pledged for the payment of the principal of and interest on
such bonds as the same respectively become due and payable. An annual appropriation shall be
made in each year sufficient to pay the principal of and interest on such bonds becoming due and
payable in such year. There shall annually be levied on all the taxable real property of said
Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due
and payable.
Section 5. Subject to the provisions of the Local Finance Law, the power to authorize
the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the
bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor,
the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in
such manner, as may be prescribed by said Supervisor, consistent with the provisions of the
Local Finance Law.
Section 6. All other matters, except as provided herein relating to such bonds,
including determining whether to issue such bonds having substantially level or declining annual
debt service and all matters related thereto, prescribing whether manual or facsimile signatures
shall appear on said bonds, prescribing the method for the recording of ownership of said bonds,
appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of
said bonds (and if said bonds are to be executed in the name of the Town by the facsimile

signature of the Supervisor, providing for the manual countersignature of a fiscal agent or of a
designated official of the Town), the date, denominations, maturities and interest payment dates,
place or places of payment, and also including the consolidation with other issues, shall be

clause provided for in section 52.00 of the Local Finance Law and shall otherwise be in such
form and contain such recitals in addition to those required by section 52.00 of the Local Finance
Law, as the Supervisor shall determine.
Section 7. This resolution shall constitute a statement of official intent for purposes
of Treasury Regulations Section 1.150 - 2. Other than as specified in this resolution, no monies
are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set
aside with respect to the permanent funding of the object or purpose described herein.

The Water District capital projects to be bonded were discussed in the bond resolution memo. The
Water District is a special district and requires a public hearing of the proposed bond resolution
for three water projects. Debt service for these projects will be funded with fees based on usage
and the annual cost will be incorporated into the 2023 fee structure. The total anticipated debt
service will be $96,519.

WHEREAS, the Town Board of the Town of Mamaroneck, Westchester County,
New York, has caused to be prepared an estimate of cost, pursuant to Section 202-b of the Town
Law, relating to the increase and improvement of the facilities of the Water District No. 1, in the
Town of Mamaroneck, Westchester County, New York (the "Water District"), consisting of the
Town's share of certain preliminary engineering and other planning expenses in connection with
the cost of the following Westchester Joint Water Works projects: a) improvements to the Rye
Lake Filtration Facility ($189,000), and b) reconstruction of water storage tanks ($613,800), in

each case including incidental expenses in connection therewith, at an aggregate maximum
estimated cost of $802,800; and
WHEREAS, said capital project has been determined to be a Type II Action pursuant to
the regulations of the New York State Department of Environmental Conservation promulgated
pursuant to the State Environmental Quality Review Act ("SEQRA"), the implementation of
which as proposed, it has been determined will not result in a significant environmental adverse
effect; and
WHEREAS, it is now desired to call a public hearing on the question of the increase and
improvement of the facilities of said Water District, in the matter described above, and to hear all
persons interested in the subject thereof, concerning the same, in accordance with the provisions
of Section 202-b of the Town Law; NOW, THEREFORE, IT IS HEREBY
ORDERED, by the Town Board of the Town of Mamaroneck, Westchester County,
New York, as follows:
Section 1. A public hearing will be held in the Town Center, in Mamaroneck ,
New York, in said Town, on June , 2022, at o'clock P.M., Prevailing Time, on
the question of the increase and improvement of the facilities of the Water District No. 1, in the
Town of Mamaroneck, Westchester County, New York, in the manner described in the
preambles hereof, and to hear all persons interested in the subject thereof, concerning the same,
and to take such action thereon as is required or authorized by law.

Notice of Public Hearing hereinafter provided to be published once in the official newspaper,

This local law shall be known as the "Implementation of Videoconferencing by Public Bodies in
the Town of Mamaroneck" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 - Purpose:
On April 9, 2022, Governor Hochul signed into law a bill that adds section 103-a to the
Public Officers Law. That amendment allows local communities when extraordinary
circumstances exist, to expand the use of videoconferencing when conducting open meetings even
when no emergency is declared. This local law adds a chapter to the Town Code that implements
this amendment to the Public Officers Law.
Section 2 - Addition of a chanter to the Mamaroneck Code:
The Code of the Town of Mamaroneck hereby is amended to add the following new
chapter:
Chapter 228 Videoconferencing of Public Meetings
§ 228-1 Definitions.
§ 228-2 Discretion to use videoconferencing.
§ 228-3 Requirement to attend; excuse for not being physically present.
§ 228-4 Public notice of videoconferencing.
§ 228-5 Videoconferencing.
§ 228-6 Requirements for the videoconferencing media.
§ 228-7 Minutes.
§ 228-8 Recordings of a meeting where videoconferencing is used.
§ 228-9 Compliance with the written procedure requirement.
§ 228-10 Exemption.

§ 228-1 Definitions.
Unless otherwise expressly stated, wherever used in this chapter, the following terms shall have
these meanings:
EXECUTIVE SESSION
The same meaning as that term has in New York Public Officers Law § 105.
EXTRAORDINARY CIRCUMSTANCES
A disability, a hospitalization, an illness, caregiving responsibilities, exposure to a serious
communicable disease, the hospitalization, death or illness of a relative or a significant or
unexpected factor or event that prevents a member of a public body from being physically present
at the location of such public body's meeting.
PUBLIC BODY
The Town Board, the Board of Appeals, the Board of Architectural Review, the Board of
Assessment Review, the Planning Board, the Recreation Commission and the Town of
Mamaroneck Housing Authority.
§ 228-2 Discretion to use videoconferencing.
At its discretion, a public body may employ videoconferencing during any meeting that is
required to be open to the general public pursuant to article 7 of the New York Public Officers
Law even in the absence of a declaration of emergency, provided that a quorum of the members of
a public body are present in the same physical location where members of the public can attend
such meeting and such body complies with this chapter.
§ 228-3 Requirement to attend; excuse for not being physically present.
Members of the public body shall be physically present at the location of such meeting unless a
member is unable to be physically present due to extraordinary circumstances. If the public body
exercises its discretion under § 228-2 of the Code, a member of the public body who is not
physically present at the location of such meeting due to extraordinary circumstances may
participate at such meeting and vote on any matters on which the public body votes by means of
videoconferencing. The extraordinary circumstance preventing that member's physical attendance
shall be announced during the meeting.
§ 228-4 Public notice of videoconferencing.
If it is contemplated that videoconferencing will be used at a meeting, the public notice for that
meeting shall inform the public that videoconferencing will be used, where the public can view
and/or participate in such meeting, where required documents and records will be posted or be
available and identify the physical location where the public can attend the meeting.
§ 228-5 Videoconferencing.
A. 'Except in the case of executive sessions, the videoconferencing shall enable members of
the public body to be heard, seen and identified while the meeting is being conducted,

including those portions of the meeting where any motions, proposals, resolutions and any
other matter are discussed and voted upon.
B. Members of the public shall have the opportunity to view such meeting through video and
to participate by way of videoconferencing in real time at times when public comment or
participation is authorized by law or by the procedural rules of the public body in a way
similar to the way members of the public who are physically present at the meeting are
allowed to comment or participate at such meeting.
§ 228-6 Requirements for the videoconferencing media.
The videoconferencing media shall utilize technology that permits access by members of the
public with disabilities in a manner that is consistent with the 1990 Americans with Disabilities
Act, as amended, and its corresponding guidelines and regulations.
§ 228-7 Minutes.
The minutes of any meeting where videoconferencing is used shall include which members
participated remotely and shall be made available to the members of the public pursuant to New
York Public Officers Law § 106.
§ 228-8 Recordings of a meeting where videoconferencing is used.
The public body shall provide that each meeting where videoconferencing is used be recorded and
that such recording be posted or linked on the public website of the Town of Mamaroneck within
five business days following the meeting. The recording shall not contain discussions during an
executive session or during recesses to obtain advice of counsel. The recording shall remain
available on the website for a minimum of five years after the meeting was adjourned. Such
recordings shall be transcribed upon request at a cost equivalent to the rate charged by a court
reporter for transcribing the minutes of a trial or hearing.
§ 228-9 Compliance with the written procedure requirement.
This local law is deemed to be the written procedures governing member and public attendance
required by New York Public Officers Law § 103-a (2) (b). It shall be posted conspicuously on the
Town of Mamaroneck's web site.
§ 228-10 Exemption.
The requirement for physical presence by members of a public body contained in § 228-3 of the
Code shall not apply during a state disaster emergency declared by the Governor pursuant to
section twenty-eight of the New York Executive Law, or a local state of emergency proclaimed by
the County Executive of Westchester County or the Supervisor of the Town of Mamaroneck
pursuant to section twenty-four of the New York Executive Law, if the public body determines

that the circumstances that led to the declaration of a state disaster emergency or a local state of
emergency would affect or impair the ability of the public body to conduct an in -person meeting.
§ 228-11 Sunset provision.
This local law shall expire and be deemed repealed on July 1, 2024.
Section 3 - Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4 - Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.
