BOARD OF THE TOWN OF MAMARONECK HELD ON JUNE
1, 2005 AT 8:15 PM IN THE COURT ROOM OF THE TOWN,
740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK

WORK SESSION
The work session was called to order by the Supervisor at 5:00 PM.
AUDITED FINANCIAL STATEMENTS
Dominick Consolo explained the change for the statements was caused by the
GASBY legislation. It requires fixed assets be included and now non-major
funds are put together, and purchases are considered expenses. There then
was a discussion on the modified statement.
COMMERCIAL ASSESSMENT
Mr. Altieri explained that revaluation is not happening at this time and another
band aid is being proposed for commercial properties. There is a proposal to
create an assessment rate for commercial properties.
Supervisor O'Keeffe asked if this would take away steam to revaluate all
properties. He said not really. They then discussed the proposal.
ROCK OUTCROPPING
Supervisor O'Keeffe said there is a law which allows rock chipping to only go on
for a certain amount of time. There has been a suggestion that we look again at
the law and consider an end time frame for chipping. On one property the
owners received a cease and desist order but they are now starting up again on
a different project on the same property. It was decided to consult with a
geologist to help decide this.
CODE ENFORCEMENT
This will add the Fire Inspector to the list of people authorized to enforce the
code.
REMOVAL OF STREET TREES

The Administrator explained four trees were removed from Town property on
Dillon Road which will be replaced when the Community Development Block
Grant (CDBG) commences.
Councilwoman Wittner suggested the owners of houses and neighbors
surrounding the trees be contacted to tell them what is happening with the trees.

Supervisor O'Keeffe said she received calls regarding the funds being spent on
playground equipment at Larchmont Acres —they said we shouldn't do it, because kids
will make noise and there were questions on clean up and where the children would be
coming from to play there.
HOMMOCKS POOL
The bids were opened and everything was as expected except steel which came in
$600,000 over what they expected, and the plumbing came in at $500,000 but they
expected $100,000 so they will rebid that.
CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at
8:20 PM. She then pointed out the location of exits.
PUBLIC HEARINGs — Amendment to the Section of the Code Dealing with the Board of
Assessment Review
-- Addition of a Title to the List of Enforcement Officers
The following notice of public hearing was entered into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of
the Town of Mamaroneck on June 1, 2005 at 8:15 PM or as soon thereafter as is
possible in the Court Room of the Town Center, 740 W. Boston Post Road,
Mamaroneck, New York to consider the adoption of a local law to Amend the
section of the Code dealing with Board of Assessment Review.
Purpose
The purpose is to increase the number of members from three members to five
members, with an additional provision to appoint an alternate member.
The full text of this Local law may be examined and copies obtained at the Town
Clerk's office during regular hours (Monday through Friday, 8:30 AM to 4:30 PM,
or until 4:00 PM during June, July and August) at 740 W. Boston Post Road
Mamaroneck, New York
PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons
interested will be given an opportunity to be heard and that all persons are
invited to submit written comments at or prior thereto.
The Town Attorney explained the law.
On motion of Councilman Winick, seconded by Councilman Odierna, the hearing was
unanimously opened.
Supervisor O'Keeffe asked if anyone wished to speak against or in favor of the
law. There was no response.

Councilman Odiena said with only three members a potential conflict could arise
this law would help.
Supervisor O'Keeffe said the proposal makes sense and is recormmended by.

On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board finds that the adoption of
the proposed local law regarding Amendment the section of
the Code dealing with Board of Assessment Review is hereby
declared to be a Type II action with no impact under the New
York State Environmental Quality Review Act (SEQRA)

On motion of Councilman Odierna, seconded by Councilwoman Seligson, the following
law was adopted:
Local Law No. 11 -2005
This local law shall be known as the "Supersession of Portions of Section 523
1. (b) of the New York Real Property Tax Law in the Town of Mamaroneck"
Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows:
Section 1 — Purpose.
The Town Board concludes that creating the position of alternate member of
the Board of Assessment Review will minimize the possibility of there not being
a quorum at meetings of the Board of Assessment Review.
Section 2 -Amendment to an Existing Section of the Code of the Town of
Mamaroneck
§ 5-7. Board of Assessment Review.
A. Portions of section 523 1. (b) of the New York Real Property Tax Law
hereby are superseded. Words enclosed in brackets are eliminated therefrom.
Italicized words are new matter added thereto. Section 523 1. (b) of the New
York Real Property Tax Law, as superseded below, shall apply in the Town of
Mamaroneck.
"Section 523
1. (b) The board of assessment review shall consist of[not less than] three [nor
more than five] members and one alternate member appointed by the
legislative body of the local government or village. The alternate member shall
substitute for a regular member in the event such member is absent or is
unable to participate because of a conflict of interest. When the alternate
member sits in the place of a regular member, the alternate member shall
possess all the powers and responsibilities of such regular member of the
board. Members shall have a knowledge of property values in the local
government or village. Neither the assessor nor any member of his or her staff
may be appointed to the board of assessment review. A majority of such board

shall consist of members who are not officers or employees of the local
government or village."
B. The Board of Assessment Review, previously established by the Town
Board, shall continue to exist. It shall consist of three members and one
alternate member. The members shall be known as Member A, Member B,
Member C and the Alternate Member. All of the members shall be appointed by
the Town Board. In accordance with § 523(1)(e) of the New York Real Property
Tax Law, annually the members of the Board of Assessment Review shall
designate which of them shall serve as the Chairperson for that year.
C. Except for persons appointed on or before September 1, 2003, and except
as provided in § 5-713 of the Code, the term of office of each member shall be
five years and shall expire on the 30th day of September of the year in which
the term expires.
D. The term of office of a member appointed on or before September 1, 2003,
shall commence on the date selected by the Town Board in its resolution
making the appointment, but the term of office of:
(1) Member A shall expire on September 30, 2003;
(2) Member B shall expire on September 30, 2004; and
(3) Member C shall expire on September 30, 2005.
E. The term of office of the Alternate Member appointed prior to July 1, 2005
shall commence on the date selected by the Town Board in its resolution
making the appointment, but shall expire on September 30, 2006.
F. If a person is appointed or qualifies as a member after October 1 of the
year in which the term of that person's office was scheduled to begin, that
person's term shall expire on the September 30th on which that person's term
is scheduled to expire even though the person shall have served less than five
years.
Section 3 — Severability:
Should any provision of this Local Law be declared invalid or unconstitutional
by any court of competent jurisdiction, such declaration of unconstitutionality
or invalidity shall not affect any other provisions of this Local Law, which may
be implemented without the invalid or unconstitutional provisions.
Section 4— Effective Date:
This Local Law shall become effective upon filing with the Secretary of State

Mamaroneck, New York to consider the adoption of a local law entitled, "Addition
of a Title to the List of Enforcement Officers and the Addition of Laws to Chapter
34 of the Code of the Town of Mamaroneck. "Law

Purpose
On September 22, 2004, the Town Board added a chapter to the Code of
Mamaroneck (Chapter 34) which gave certain Town officials the power to enforce
the "Quality of Life Laws" identified in that chapter. Since then, the Town has
enacted two new laws that fit within the definition of Quality of Life laws. This law
adds these two new statutes to the list of laws which such enforcement officers
may enforce.
This law also adds Chapter 173 (Sewers) to the list of Quality of Life laws and
adds "Fire Inspector" to the list of Town officials authorized to enforce Quality of
Life laws. Chapter 173 and the position of fire inspector were omitted
inadvertently when Chapter 34 was added to the Code of the Town of
Mamaroneck.
On motion of Councilwoman Wittner, seconded by Councilman Winick, the
hearing was unanimously opened.
Mr. Maker explained this amendment would add the Fire Inspector as a code
enforcement officer.
Councilman Winick said this was a valuable law which gives us more bang for the buck
by putting in proper enforcement ability.
Councilwoman Wittner said this law makes sense when you have a small staff.
Councilman Odierna said he wants to discuss issuing ID cards to enforcement officers.
Councilwoman Seligson said it's hard for the police to enforce all the laws and this
would help.
The Supervisor asked if anyone wished to speak in favor or against the law.
Pete Perciaseppe said he was confused about this law. Under the International law a
fire inspector enforces code for commercial office buildings, sports clubs, banks,
schools, what you are appointing does not fit the description for fire inspector.
Supervisor O'Keeffe explained this was to add a fire inspector to enforce the code.
Councilman Winick said this expands what they can issue summonses for. What the
law does is list the people who have added authority to that which they do already, but
they can't enforce compliance with codes regulated by the fire inspector.
Following a lengthy discussion, on motion of Councilwoman Wittner, seconded by
Councilwoman Seligson, the hearing was closed.
Resolved, that the Town Board finds that the
adoption of the proposed local law regarding
Addition of a Title to the List of Enforcement
Officers and the Addition of Laws to Chapter 34
of the Code of the Town of Mamaroneck is
hereby declared to be a Type II action, with No
Impact under the New York State Environmental
Quality Review Act (SEQRA).

On motion of Councilman Winick, seconded by Councilwoman Wittner, the following
local law was adopted:
Local Law No. 10 -2005
This local law shall be known as the "Addition of a Title to the List of
Enforcement Officers and the Addition of Laws to Chapter 34 of the Code of
the Town of Mamaroneck" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows:
Section 1 — Purpose.
On September 22, 2004, the Town Board added a chapter to the Code of
Mamaroneck (Chapter 34) which gave certain Town officials the power to

Section 2 -Amendment to an Existing Section of the Code of the Town of
Mamaroneck
Section 34-2 of the Code of the Town of Mamaroneck hereby is amended
by deleting the definition of ENFORCEMENT OFFICERS in its entirety and
substituting the following in its place:
"ENFORCEMENT OFFICERS — The persons serving in any of the following
positions in the Town of Mamaroneck: Assistant Building Inspector, Code
Enforcement Officer, Director of Building Code Enforcement and Land Use
Administration, Environmental Coordinator, Fire Inspector, police officer,
Senior Engineer(Civil), Superintendent of Highways and Deputy
Superintendent of Highways (if such a position is created)."
Section 3 —Amendment to an Existing Section of the Code of the Town of
Mamaroneck
Section 34-2 of the Code of the Town of Mamaroneck hereby is amended by
deleting the definition of QUALITY OF LIFE LAWS in its entirety and
substituting the following in its place:
"QUALITY OF LIFE LAWS — The following chapters and sections of the
Code constitute the quality of life laws:
A. Chapters.
(1) Chapter 58, Animals.
(2) Chapter 77, Conservation Areas.
(3) Chapter 95, Erosion and Sediment Control.
(4) Chapter 117, Garage Sales.
(5) Chapter 141, Noise.
(6) Chapter 148, Parks and Fields.
(7) Chapter 161, Property Maintenance.

(8) Chapter 173, Sewers.
(9) Chapter 175, Signs.
(10) Chapter 183, Solid Waste.
(11) Chapter 207, Trees.
(12) Chapter 231, Water.
(13) Chapter 233, Waterfowl.
B. Sections.
(1) Section 106-49. Requirement for a Discharge Compliance Certificate.
(2) Section 106-56. Duration and hours for mechanical rock removal.

Section 4— Severability
Should any court of competent jurisdiction declare any provision of this
Local Law invalid or unconstitutional, such declaration of unconstitutionality
or invalidity shall not affect any other provisions of this Local Law, which
may be implemented without the invalid or unconstitutional provisions.
Section 5— Effective Date
This Local Law shall become effective on the date that it is filed in the office
of the Secretary of State.

2. Other Fire Department Business
Commission Wittner announced there would be a special golf outing on
Septemember 19 sponsored by the Fire Council.
Councilwoman O'Keeffe said at the Memorial Day parade on Thursday our Fire
Department was well turned out. She thanked them for a good job.
There being no further business to come before the Commission, on motion of
Commissioner Odierna, seconded by Commissioner Myers, the Commission
unanimously adjourned.

2. Resolution — Commercial Assessment Ratio
On motion of Councilman Odierna, seconded by Councilman Winick, the following
resolution was adopted:
WHEREAS, the Town of Mamaroneck has experienced an
unprecedented appreciation in residential property values
over the last several years while at the same time commercial
property values have remained constant or have appreciated
slightly; and
WHEREAS, the unprecedented appreciation in residential
property value has caused the state equalization rate for the
assessing unit to drop dramatically; and continue to decrease
unabated; and
WHEREAS, this tremendous downward spiral in the final state
equalization rate does not accurately reflect the value of
commercial property and artificially creates an over-
assessment of commercial property; and
WHEREAS, these factors, when combined, have resulted in
the assessing unit having to defend numerous and
unnecessary legal challenges through certiorari proceedings
resulting in windfall tax certiorari refunds to commercial
property owners; and
WHEREAS, Assembly Bill No A-5793, sponsored by Honorable
Adam Bradley and Senate Bill No. S-3368, sponsored by
Honorable Nicholas Spano, would establish a commercial
assessment ratio to deal with this ever burgeoning problem;
and for use in Article 7 proceedings reviewing assessments
of major commercial properties;

WHEREAS, if adopted, the establishment of a commercial
assessment ratio for use in Article 7 tax review proceedings
would save the Town of Mamaroneck from additional tax base
erosion.
NOW THEREFORE, BE IT
RESOLVED, that the Town of Mamaroneck hereby endorses
Assembly Bill No A- 5793 and Senate Bill No. S-3368 and
beseeches that the New York State Legislature act with all
due speed and adopt this legislative initiative; and
BE IT FURTHER,
RESOLVED, that clerk of the Town of Mamaroneck be and is
hereby directed to forward this resolution to all members of
the New York State Legislature who represent the County of
Westchester.

3. Authorization — Employee Assistance Program
On motion of Councilwoman Wittner, seconded by Councilman Winick, it was
RESOLVED, that the Town Board does hereby approve the
agreement between the Town of Mamaroneck and the
Westchester County Employee Assistance Program to
provide consultation and counseling of employees; and
BE IT FURTHER,
RESOLVED, that the cost for the program is $30 per
employee at a total cost to the Town of$3,710; and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized
to execute said agreement on behalf of the Town.

On motion of Supervisor O'Keeffe, seconded by Councilman Odierna, it was
RESOLVED, Maureen Naughton is hereby appointed to
the position of Member D (alternate) of the Board of
Assessment Review, and
BE IT FURTHER
RESOLVED, that the foregoing appointment shall be
effective immediately upon the appointee taking and
subscribing the oath mandated by section 25 of the New
York Town Law and shall expire September 30, 2006.

Councilman Odierna read the Violet Sundin Proclamation:
WHEREAS, Violet Sundin is retiring as the professional of the United Way after
25 years of service to our community, and
WHEREAS, During her 25 years of service with the United Way
Westchester/Putnam and United Way of Larchmont/Mamaroneck
organizations, "Vi"has accomplished much including:
➢ Starting as a part-time Community Director in Larchmont in
1981, Vi became full time in 1985 assuming duties for United Way of
Mamaroneck
➢ In 1994 her duties expanded to include staffing of United
Way of Harrison and United Way of Larchmont
➢ In 1998 Vi was promoted to Vice President- Community
Giving
➢ Throughout Violet's career with United Way, she has staffed
a volunteer committee involved with the Fund Distribution process on a two-
county basis, given overall direction to two-county small business
development, supervised and trained new community directors and recruited
new donors; and
WHEREAS, Under Violet's "watch"more than $6.5 million has been raised in
Larchmont/Mamaroneck, $1.5 million in Mamaroneck only and$2.1 million in
Harrison/Purchase with a combined total of more than $10.1 million; and
WHEREAS, In 1999 United Way of Larchmont received the prestigious Spirit of
Westchester and Putnam Community Award, followed by United Way of
Harrison/Purchase in 2001; and United Way of Larchmont/Mamaroneck
received a Spirit of Caring Community Award, and
WHEREAS, Working together with the Hunger Task Force Violet has led
United Way's involvement in the annual Thanksgiving Food Drive in
conjunction with the Larchmont and Mamaroneck Post Offices.
NOW THEREFORE, BE IT
RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of
Mamaroneck, and the Town Board members salute VIOLET SUNDIN on the
occasion of her retirement.

PROCLAMTION - Bishop Sullins
Councilman Winick read the Bishop Sullins Proclamation
WHEREAS, Richard Sullins is being consecrated as a Bishop of the Victory
Temple Pentecostal Churches International, and
WHEREAS, Bishop-Elect Sullins has served in our community as both
Head Deacon and Pastor of the Second Baptist Church with great distinction
and zeal, and
WHEREAS, His ministry has built up our community.
NOW THEREFORE, BE IT
RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of
Mamaroneck, and the Town Board members thank Bishop Sullins for his past
work and offer our congratulations and best wishes in undertaking his new

community.

Supervisor O'Keeffe said she went to the ceremony for Bishop Sullins at Strait Gate
Church, there were lots of people, it was well attended.
APPROVAL OF MINUTES —April 13, 2005
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the
following resolution was unanimously adopted:
RESOLVED, that the Town Board does hereby
approve the Board minutes from the meeting of
April 13, 2005 as amended.
REPORTS OF THE COUNCIL
Councilwoman Seligson said she marched in the Memorial Day parade on Thursday
night which was fabulous, and then reviewed the parade. There were lots of
Brownies and firemen. There was a service at the Kemper Memorial and a breakfast
at the Firehouse.
Councilman Winick was at the Town Memorial Park ceremony, the grunds and the
memorial were renewed by the Highway Department— it was a fabulous job.
Attending were two marines, one was Steve Rubio Jr. He said it was gratifying
attending all the events for Memorial Day.
Councilman Odierna said the Supervisor was eloquent at the Memorial Day event, she
did a good job. He would be attending the Audubon Society meeting honoring
Councilwoman Wittner and Sandra Marrafino tomorrow night and reminded everyone
that Harbor Fest would be held on June 12.
Councilwoman Wittner said LISWIC will be holding two demos at the Harbor Fest and
that she had attended all the Memorial Day events also.
Supervisor O'Keeffe said she also was at all of the events, including the American
Legion Breakfast, the Village of Mamaroneck Parade, the Kemper Memorial and the
American Legion in Mamaroneck.
ADJOURNMENT
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the
meeting was adjourned at 9:40 PM.
