MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE
TOWN OF MAMARONECK HELD ON MAY 18, 2005 AT 8:15 PM IN THE
COURT ROOM OF THE TOWN, 740 W. BOSTON POST ROAD,
MAMARONECK, NEW YORK

WORK SESSION
Mold Abatement
There was discussion on the status of the work being done on the first floor in the Town
Clerk's Office and the Recreation Department.
Recreation Department
Ms. Stanton reported that Maria Gallagher, Recreation Supervisor would be leaving. The
Board discussed the County List of names and how the position would be advertised. A
suggestion was made to put the opening on the website
Clarification of Fire Inspector Appointment
The Town Attorney explained the difference between a fire inspector and a code
enforcement officer.
Housing Authority
There was a suggestion that Robert Cammer be appointed to the Housing Authority and
the Town Board liaison assignment was changed frm Phyllis Wittner to Paul Winick.
CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30
PM. She then pointed out the location of exits.
The Supervisor said Mr. Altieri was absent because he was attending the Manager's
convention.
Presentation — Second Annual Report— Stormwater Compliance
Elizabeth Paul, Environmental Coordinator explained the Town is required by New York
State Department of Environmental Conservation and by the Federal Environmental
Protection Agency to implement a program that decreases pollution that is present in
stormwater runoff and also to prepare an annual report that lists progress in achieving the
goals set.

She then presented the following:
Some of the pollutants targeted by our efforts included pet waste, fertilizers,
pesticides, oil, automotive fluids and litter which degrade water quality in our
waterways and Long Island Sound every time it rains.
The stormwater management plan is broken down into six sections:
1. Public education and outreach
2. Public involvement and participation
3. Illicit discharge detection and elimination
4. Construction site stormwater runoff control
5. Post-construction stormwater management
6. Pollution prevention and good housekeeping
In order to eliminate duplication of efforts, the Town of Mamaroneck worked with II
other municipalities in an intermunicipal council known as LISWIC the Long Island
Sound Watershed Intermunicipal Council. With LISWIC, we developed educational
outreach materials, created a stormwater web site (www.liswic.org), participated in
the Mamaroneck Village Historic Harbor Festival, shared ideas for local
environmental laws, purchased storm drain markers and applied for grant funds.
In addition, the Town:
1. Participated in the Sheldrake Environmental Center's festival where we set up a
runoff demonstration table and distributed educational information to the residents.
2. Adopted the Elimination of Illegal Sewer Connections Law
3. Completed improvements to the Town Yard and the Volunteer Ambulance Corp
(VAC) properties. The Town Yard now has a covered salt dome and vehicle maintenance
areas and an oil/water separator. The VAC property has an oil water separator and
drywells for stormwater detention.
4. The Town worked with the Westchester County Planning Department and the
County Soil and Water Conservation District to install a sediment basin at the entrance to
Garden's Lake.
5. Began work on the restoration of Pryer Manor Marsh.
Upcoming plans for the program include:
1. On Sunday, June 12th from 1lam — 5pm, the Town as a member of LISWIC will be
participating in the Mamaroneck Village Historic Harbor Festival. Look for us in the Water
Quality Pavilion in Harbor Island Park where we have sponsored exhibits from the
Norwalk Aquarium.
2. The Conservation Department is seeking volunteer groups from local schools,
clubs and organizations to install storm drain makers on Town catch basins. Liz Paul has
already worked with 4th grade classes from Mamaroneck Ave and Chatsworth Ave
Schools. Anyone interested can contact Liz Paul 381-7845.
3. Continue improvements to Gardens Lake that will include dredging and habitat
restoration.
4. Continue working on the implementation of a GIS system - begin the
implementation process. Useful for environmental studies, planning, zoning and
maintenance of infrastructure.
5. Creation of a contractor bulletin board in the building department with information
on erosion control, environmental protection and upcoming training events/seminars.
6. Continued participation in LISWIC grants and projects pertaining to the creation of
a regional stormwater utility district.

PUBLIC HEARING – Community Development Block Grant Projects for 2006-2008 Funding
Cycle
The following notice of public hearing was entered into the record:
PLEASE TAKE NOTICE, that Public Hearing will be held by the Town Board of the Town
of Mamaroneck on Wednesday May 18, 2005 at 8:15 PM or as soon thereafter as is
possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck,
New York to consider a Community Development Block Grant Projects
On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the hearing was
opened.

Ms. Stanton explained this public hearing was required to discuss proposed projects the
Town was applying for under the CDBG. The grants are aimed at benefiting low to
moderate income areas for projects such as lighting, etc. In 2005 we did curbs and
sidewalks and lighting in the Dillon Park Avenue and also in the Madison Avenue areas. .
Proposed for 2006 is the reconstruction of the playground at Larchmont Acres and
sidewalks. Ms. Stanton showed the maps and said the playground is owned by Sampson
Management so an easement would have be granted for at least 10 years to enable us to
do this. The cost is $70,000 to $115,000 of which 50% would be applied for in the grant.
The sidewalks would cost $290,000, half to applied for in the grant.
Supervisor O'Keeffe said the playground at Larchmont Acres fits into the low to moderate
guidelines, aesthetically it would be an improvement.
Councilwoman Wittner said improving the playground would be beneficial to children in
the neighborhood. The sidewalk project could be considered as they are used by a
significant number of people.
Councilman Winick asked what is the number of people who would be served by these
sidewalks. The Supervisor said about 100.
Councilwoman Seligson added these both seem like worthwhile projects.
Councilman Odierna asked if the residents were notified of this hearing, and if we upgrade
the playground does the Town then become responsible for it.
Mr. Maker replied the Town would indeed have some responsibility.
Councilman Winick said there is newly designed playground equipment that is much
safer.
Supervisor O'Keeffe asked if anyone had comments or objections, there being no response,
on motion of Councilman Winick, seconded by Councilwoman Wittner, the hearing was
unanimously closed.
On the motion of Councilwoman Wittner, seconded by Councilman Winick, it was
RESOLVED, that the Town Board of the Town of Mamaroneck
hereby directs Stephen V. Altieri, Town Administrator to
submit an application for funds in the amount of$75,000 from
the Westchester County Planning Department in accordance
with the provisions of Title 1 of the United States Housing and
Community Development Act of 1974 for the Richbell Road
Playground Improvement Project; and
BE IT FURTHER
RESOLVED, that the Town of Mamaroneck hereby agrees to
contribute $83,000 towards the total cost of the project.
BE IT FURTHER
RESOLVED, that upon approval of said request the Town
Administrator is hereby authorized to enter into and execute a
project agreement with the County of Westchester for
financial assistance to the Town for the Richbell Road
Playground Project.

ADJOURNED PUBLIC HEARING
Elimination of the Citizen Member Positions on the Tree Preservation Commission
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the
Town of Mamaroneck on Wednesday, May 18, 2005 at 8:15 PM or as soon thereafter as
is possible in the Court Room of the Town Center, 740 W. Boston Post Road,
Mamaroneck, New York to consider the adoption of a local law entitled "Elimination of
the Citizen Member positions of the Tree Preservation Commission" Law.
Purpose
Currently the Tree Preservation Commission consists of five members, three who are
employees of the Town and two volunteers, known as Citizen Members. History has
shown that it is not necessary to have Citizen Members in order for the Tree
Preservation Commission to function properly. This local law eliminates the positions
of Citizen Members of the Tree Preservation Commission.
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board finds that the adoption of
the proposed local law regarding the elimination of the
position of Citizen Members of the Tree Preservation
Commission hereby declared to be a Type II action under the
New York State Environmental Quality Review Act (SEQRA)
and does not require further review.
On motion of Councilwoman Wittner, seconded by Councilman Winick, the following Local
Law was adopted
Local Law No. 8 -2005
This local law shall be known as the "Elimination of the Citizen Member positions of
the Tree Preservation Commission and the Addition of Educational Requirements"
Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 - Purpose:
Currently the Tree Preservation Commission consists of five members, three who
are employees of the Town and two volunteers, known as Citizen Members. History
has shown that it is not necessary to have Citizen Members in order for the Tree
Preservation Commission to function properly. This local law eliminates the
positions of Citizen Members of the Tree Preservation Commission.
This local law also adds an educational requirement for the members of the Tree
Preservation Commission.
Section 2 -Amendment of a current section of the Mamaroneck Code:
Section 5-14 of the Code of the Town of Mamaroneck hereby is repealed and the
following substituted in its place:
§ 5-14. Tree Preservation Commission.
The Tree Preservation Commission, previously established by the Town Board,
shall continue to exist. It shall consist of three members who shall be the
Environmental Coordinator, the Director of Building Code Enforcement and Land
Use Administration and the Superintendent of Highways (or the Superintendent's
designee). Annually, the Town Board shall designate which of the members shall
serve as the Chairperson for that year.

Section 3 -Amendment to correct sections of the Mamaroneck Code:
Sections 207-4 and 207-5 of the Code of the Town of Mamaroneck hereby are
repealed in their entirety and the following substituted in their place:
"§ 207-4. Criteria for removal of trees.
A. Permits for the removal of trees may be granted under the following
circumstances:
(1) If the presence of trees would cause hardship or endanger the public or
the person or property of the owner.
(2) On property to be occupied by buildings or structures, within a distance of
ten (10) feet around the perimeter of such building or structure,
depending upon tree species and conditions to be determined by the Tree
Preservation Commission.

This was handled earlier in the meeting.
2. Set Public Hearings — Traffic Committee Recommendations
The Board decided to send the recommendation for Dundee Road back to the Traffic
Committee for further review.
On motion of Councilman Winick, seconded by Councilwoman Wittner, it was
RESOLVED, that the Town Board does hereby set the
date for public hearing on the proposed legislation for
stop signs on West Garden and Clover Road for June
15, 2005; and
BE IT FURTHER,
RESOLVED, that the Town Board does hereby set the
date for public hearing on the proposed legislation for
stop signs on West Garden and Mardon Road for June
15, 2005; and
BE IT FURTHER,
RESOLVED, that the Town Board does hereby set the
date for public hearing on the proposed legislation for
stop signs on Locust Ridge and Glen Eagles Road for
June 15, 2005; and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized

immediately upon the appointee taking and subscribing the
oath mandated by section 25 of the New York Town Law and
shall expire December 31, 2007.

hour from $8.50 to Helen Romanek Assistant to the
Ambulance District Administrator.

Summer Intern
On motion of Councilman Wittner, seconded by Councilwoman Seligson, it was

appointment of Jonathan Bingman to the temporary position
of Summer Intern in the Town Clerk's Office & Recreation
Department at the rate of$10.00 an hour effective June 1,
2005 through September 1, 2005.

On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board does hereby set the
date for public hearing on the proposed legislation for
the Quality of Life Law for June 1, 2005; and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby authorized
to publish the notice of said hearing in a newspaper
appointed as an official newspaper, and that said
notice be posted.

ORAL COMMUNICATIONS
Abby Katz thanked the Supervisor and Board members for attending the annual meeting
of the Larchmont Gardens Civic Association. She reminded everyone the Spring Fling
would be held on Saturday from 1:00 to 4:00 PM, with games by Ernie. She asked if the
Board has walked around the lake and seen the erosion. She thanked Councilwoman
Wittner for procuring a grant to put in plantings around the pond. She added there is a
lack of communication on the internet.
REPORTS OF THE COUNCIL
Councilman Odierna said the Village of Mamaroneck would be having a Base opening of
Auxiliary 73 on May 22. He attended the Recreation meeting on May 10, saying that ice
skating is still open and that the summer concerts are coming up. And he reminded all
that the Board would be having a special meeting on May 25, 2005 to discuss the Forest
City Daly application. He added the rest rooms would be open at Memorial Park when the
attendant it present.
Councilwoman Wittner attended the Senior Lucheon, and the Larchmont Garden Civics
Association meeting, as well as the event at the Community Counseling Center, and the
Washingtonville Housing Alliance meeting.
Councilman Winick attended the Traffic Committee meeting, and will be going to the
Housing Authority meeting on June 7. Mr. Cherry has taken over as Chair. He will be
participating in the Memorial Day parade on May 26, and on May 30 at 9:30 AM the
Memorial Ceremony at Memorial Park then at 10:00 AM at Kemper Memorial.
Councilwoman Seligson said the Planning Board was cancelled and Zoning was coming
up. She went to the Community Counseling Center event and thanked Mark Levy. She
congratulated Andy Spano and Delores Battalia for being honored by the Washingtonville

Housing Alliance.
Supevisor O'Keeffe said the Larchmont parade would be held on May 26, and would be
attending the Sunday breakfast at the VFW, and the Kemper Memorial service.
ADJOURNMENT
Councilwoman Seligson suggested the Board adjourn in memory of Allen Shapiro, who
died in a terrible accident— he lived in Larchmont and sent her condolences.
On motion of Councilman Winick, seconded by Councilman Odierna, the meeting was
unanimously adjourned in memory of Mr. Shapiro at 11:05 PM.
