HomeMy WebLinkAbout2005_03_16 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON MARCH 16, 2005 AT 8:15 PM IN THE COURT ROOM OF THE TOWN, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilman Ernest C. Odierna Councilwoman Nancy Seligson Councilman Paul A. Winick ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney WORK SESSION Forest City Daly The Board spoke about referring the application for a zoning amendment and petition to the Planning Board. The Administrator said he would go over the process with George Kruse and see how they wish to proceed. Boards and Commissions The Board members discussed filling slots for vacancies on various boards and talked about changing the structure of the Tree Commission. Notification Law Forms were reviewed and the signs for notification were discussed. Property Assessments The Supervisor said a meeting was held by the City of New Rochelle along with other communities regarding revaluations —there was a discussion about doing a feasibility study together. The contractors would be asked to come in to determine how much it would cost. Coastal Zone Management The Board members decided to send the proposed changes to the Village of Larchmont for their input. Resolution —Association of Towns Supervisor O'Keeffe said she received a communication regarding a resolution of support regarding lowering school taxes —the smaller communities upstate are going bankrupt. Sewer Connection Law There was a discussion regarding making the effective date of the law be in September so it would not cause havoc during the busiest house selling season. March 16, 2005 Councilwoman Wittner said we would then be putting the onus of compliance on the new buyers if the requirement was not tied to the sale. Councilwoman Seligson said informing people of the law is important, maybe there should be signs in the Building Department, also announce it on Cable TV and do a show on it. The Attorney suggested the law go into effect late autumn. Councilwoman Wittner disagreed. Councilman Odierna said there should be a fact sheet about this and show who this law affects. Summit Supervisor O'Keeffe said she received a call from Mary Lee Beringer who said she had spoken to Mayor Triffiletti requesting him to send a representative to the Summit. He said he would do it himself. The Supervisor then called to speak to him and he said they don't need anyone from the Town to go. RECONVENE REGULAR MEETING CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20 PM. She then pointed out the location of exits. APPOINTMENT OF COUNCILMAN The Supervisor said there was a vacancy on the Town Board caused by the resignation of Judy Myers who had been elected to the office of County Legislator. Councilwoman Wittner then submitted the name of Paul Winick for the vacancy. She said he is a long term resident who practices property law. He has served as chair of the Housing Authority since its inception in 1992. He is a member of the Zoning Board of Appeals, appointed in 1999, is a life long democrat and has served as Deputy Supervisor under Supervisor O'Keeffe. Councilman Odierna said there were numerous candidates, six were interviewed but Paul stood out. He was always active in the community including serving as chair of the Parking Task Force. Councilwoman Seligson added that Mr. Winick has a long history of working with the Town on many projects as a volunteer. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby appoint Paul A. Winick as Councilman of the Town of Mamaroneck effective immediately replacing the vacancy caused by election of Judith Myers to County Legislator; and BE IT FURTHER, RESOLVED, that the appointment is contingent upon Mr. Winick resigning any and all volunteer positions he presently holds in the Town. PROCLAMATION —American Red Cross Supervisor O'Keeffe read the following: PROCLAMATION AMERICAN RED CROSS WHEREAS: The Town of Mamaroneck is pleased to salute organizations that have throughout the years tirelessly dedicated their efforts to meeting the critical needs of people within our community and across the nation and toward improving the quality of human life, and WHEREAS: Foremost among these distinguished organizations is the AMERICAN RED CRSS, founded by Clara Barton, which remains the recognized leader in the field of humanitarian relief, assisting tens of thousands annually, and WHEREAS: The AMERICAN RED CROSS IN WESTCHESTER COUNTY has helped to improve the quality of life in our County for more than 100 years by creating a safer place to live and by enhancing individual self-reliance through emergency disaster relief, health education and training in life-saving skills, and WHEREAS: The AMERICAN RED CROSS IN WESTCHESTER COUNTY, which assists more than 70,000 individuals annually, translates our community's concern into immediate action, because when Red Cross services are needed, "Help Can't Wait", and WHEREAS: The Town of Mamaroneck is pleased to commemorate National AMERICAN RED CROSS MONTH by raising the prominent red and white flag, symbolic of the organization's efforts and achievements on behalf of those in need. NOW THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of Mamaroneck, and the Town Board members hereby proclaim the month of March 2005 to be: AMERICAN RED CROSS MONTH In the Town of Mamaroneck and call upon our residents to join with us in acknowledging the manifold contributions to our community, the County of Westchester, and our nation, while expressing heartfelt gratitude for their unparalleled humanitarian efforts. The Following Agenda Item Was Taken OUT OF ORDER ORAL COMMUNICATIONS Judy Myers, County Legislator then asked to speak. She said she wanted to be here to congratulate Paul Winick on his new position and that she knows he will have a fantastic experience with it. She presently is working on trying to keep the CDBG monies in the budget. The Town received $210,000 in 2005, the Village of Larchmont got $120,000 and Mamaroneck Village received $3,958,00. The funds are being put to good use and they should be continued. The Board members all thanked her for coming. 3 March 16, 2005 Robin Ginsberg, representing Larchmont Gardens Civic Association said the streets are not in good condition, there are pot holes and cracks everywhere. She invited the board to come to the area and see the damage caused by snow removal trucks along the curbs which she was not sure was public or private property. Mr. Altieri replied the Town prepares a list of damaged property which the Town will fix in the spring. He asked her to contact him and he will make sure the damage is included on the list. Ms. Ginsberg invited everyone to plan to come to the Spring Fling being held on Little Falls Road — it's lots of fun. PRESENTATION —Wind Power Keith Christensen representing Community Energy spoke on the growth of wind energy over the past few years and its history—showing slides of the turbines and locations. He explained the cost structure and how when communities use more it costs less. Should the Town opt to sign up all the energy they use would be produced in New York and assured the Board that for 20 years the price to produce the energy would the same or go lower. He said Governor Pataki had signed an Executive Order mandating 10% of all New York State government buildings use renewable energy sources within a year. There was then a discussion on which buildings the Town could designate to use the wind power, the costs, whether to have a one, two or five year contract and cancellation procedures. Mr. Altieri suggested Mr. Christensen prepare a contract and the board will consider it. PUBLIC HEARING — Notification Law The following notice of Public Hearing was entered into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, March 16, 2005 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to amend the Local Law known as the "Notification Procedures" Law to extend it's effective date to April 30, 2005. Mr. Maker explained as part of this law there are signs which must be put up by applicants and the form of notifications that the Town Board is still seeking to formulate, he therefore thought it necessary to extend the effective date of implementation of the law to April 30, 2005. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the meeting was unanimously opened. The Supervisor asked if anyone wished to speak either for or against this amendment. There was no response, therefore on motion of Councilwoman Seligson, seconded by Councilman Odierna the public hearing was closed unanimously. On motion of Councilwoman Seligson, seconded by Councilman Winick, the following was unanimously adopted: Resolved, that the Town Board finds that the adoption of the proposed amended local law regarding Notification is hereby declared to be a Type II action, with No Impact on the environment under the New York State Environmental Quality Review Act (SEQRA). On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the following local law was adopted: 4 March 16, 2005 Local Law No 3-2005 This local law shall be known as the "First Amendment to the Notification Procedures Law" Law BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 -Purpose: On February 16, 2005, the Town Board enacted Local Law No.2-2005 entitled the Notification Procedures Law. This law is scheduled to go into effect on March 31, 2005. Among other things, the law requires the Town Board to establish specifications for the sign that applicants will need to post as part of the notification procedure. In order to discuss and establish those specifications, the Town Board will need to obtain and review samples of signs used in other communities. That process will require a certain amount of time and therefore to afford the Town Board the proper time to study the issue properly, this law extends the effective date of Local Law No. 2-2005. Section 2—Amendment of a section of Local LawNo.2-2005: Section 11 of the Local Law No. 2-2005 is repealed and the following substituted in its place: "Section 11 -Effective Date: Local Law No.2-2005 shall become effective on April 30, 2005 if it is filed with the Secretary of State prior to that date." Section 3-Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4-Effective Date: This Local Law shall become effective upon filing with the Secretary of State. AUTHORIZATION — TRANSFER OF FUNDS — CAPITAL PROJECTS A memo was received from the Town Comptroller requesting funds be transferred to close out the reconstruction of the fire house roof. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Board of Fire Commissioners does hereby authorize a transfer of funds to appropriate $1,598.66 from the fire district surplus and transfer to the capital fund to close out project no. 23-02, reconstruction of fire headquarters roof, account no.h3497.4.3410.5006. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye Commissioner Odierna questioned one of the bills for vehicle repairs and asked if he could see a periodic review of costs for each vehicle. Mr. Altieri said he would prepare a report. Councilwoman Wittner said she attended the Fire Council meeting on March 7. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Odierna, the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. Referral to Town Planning Board —Zoning Petition — Forest City Daly The board decided to defer this item. 2. Appointments — Board and Commissions Board of Appeals On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby appoint Irene O'Neill to the position of Member C of the Board of Appeals; and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law, said term shall expire on December 31, 2009. Board of Architectural Review On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby appoint Anthony Spagnola to the position of Member C of the Board 7 March 16, 2005 of Architectural Review; and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law, said term shall expire on December 31, 2007. The above adoption of a local law was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye 3. Authorization —Property Appraisals Service Mr. Maker explained this authorization would provide payment for appraisals on two properties at $2000 each, the appraisals would be performed and reports issued for HSBC Bank and Kenneth and Linda Wiltsek which will help to settle these cases out of court. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the following resolution was adopted: RESOLVED, that the Town Board does hereby hire Brian Kenney Appraisals to perform two (2) appraisals on properties at a cost of$2000.00 each; and BE IT FURTHER, RESOLVED, that the Town Administrator be and is hereby authorized to execute an agreement with Property Appraisal Service on behalf of the Town of Mamaroneck. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye 4. Westchester Joint Water Works Mr. Altieri explained under a court order Westchester Joint Water Works must contract for designing the filtration plant and purchasing filtration equipment, the latter is phase 2. The cost of this is $7.1 million, with a first installment payment of$1,007,610, of which the town's share is $211,600 payable by March 18, 2005. The Town will have to start evaluating how they wish to finance our share of the rest in the near future and of course if the courts decide the plant must be built. Following discussion, on motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the board adopted: WHEREAS, The Town Board is aware that the Westchester Joint Water Works (WJWW) is currently under a court order to construct a water filtration plant that must be up and running by September 2007; and WHEREAS WJWW must, under the court order, proceed with certain 8 March 16, 2005 phases of the project; specifically, the WJWW must contract for the design of the plant and must also proceed with certain phases of the project. WHEREAS, Phase 2, as it is called in the report, requires the WJWW to contract for the purchase of the filtration equipment at a total cost of $7.1 million; and WHEREAS, The Town of Mamaroneck's share of this cost is $1.49 million; and WHEREAS, The WJWW expectations for payment from the member municipalities for the filter equipment will impact our finances in the Water District; and WHEREAS, The report from the WJWW indicates that of the total equipment cost of$7.1 million, an initial installment payment of $1,007,610 must be made by March 18, 2005; and WHEREAS, The Town of Mamaroneck's share of this first installment is $211,600; and WHEREAS, The WJWW will make the payment using its own funds but would expect payment from the municipalities some time in the latter part of the year; NOW, THEREFORE BE IT RESOLVED, that the Town Board does hereby approve the payment of the first installation in the amount of$211,600 under Phase 2 of the project to design and purchase the filtration equipment. Authorization — Town and County Tax Warrant The Administrator explained this is the warrant which the Board must authorize before collection of Town and County Taxes. He noted there was an error in the 2005 Town budget and it will result in a reduction in the tax rate from $12.45 to $12.19 in the county rate. On motion of Councilwoman Wittner, seconded by Councilman Winick, the authorization of the warrant was approved: THE PEOPLE OF THE STATE OF NEW YORK To Raymond Bingman, Receiver of Taxes of the Town of Mamaroneck in said County: You are hereby commanded pursuant to the provision of the Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, and also pursuant to resolution of the Town Board of the Town of Mamaroneck adopted March 16, 2005, by authority of Chapter 313 of Laws of 1934, to receive and collect from the several persons named in the Assessment Roll hereunto annexed by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended, for the neglect to pay the Judicial, County, Town and Town District Taxes, charges for services, exemptions removed, and water arrears after the levy thereof as follows: 9 March 16, 2005 Judicial and County Taxes - $31,321,547.00 Town and Town District Taxes 16,331,550.00 Charges for Services - - 0 - Exemptions removed - - 0 - Water arrears - 3026.30 47,656.123.30 And you are hereby directed to deposit to the credit of the Town of Mamaroneck in the Bank of New York, County Trust Region, all of such monies so collected by you by virtue of this warrant. And you are further commanded to make and file with the undersigned, the Supervisor of the Town of Mamaroneck, as required by the Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended, the reports provided for therein. And you are further directed and commanded to proceed as directed and authorized by said Westchester County Tax Law, Article 16, Chapter 852, Laws of 1948, as amended. And in case any person named in said Assessment Roll shall neglect or refuse to pay his taxes or penalties (after giving the notices and waiting the time as specified in said Act) you are hereby authorized to collect the said taxes and penalties with the costs and charges of such collections in the manner provided by the Westchester County Tax Law, Article 16, Chapter 852 of the Laws of 1948, as amended, and for so doing this shall be your sufficient warrant. Set Public Hearing — Illegal Sewer Connection Law On motion of Councilwoman Wittner, seconded by Councilman Winick, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the proposed legislation illegal sewer connections for May 4, 2005; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said 10 March 16, 2005 notice be posted. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye 7 Authorization — Use of Voting Machines — Mamaroneck School District The Town Clerk said this was the annual request for use of the Town's voting machines being made by the Mamaroneck School District Clerk. They are asking for the use of 13 machines and will pay all costs associated with the election. RESOLVED, that the Town Board does authorize the use of 13 voting machines by the Mamaroneck School District for their May 17, 2005 budget and trustee election. Salary Authorizations — Town Comptroller's Office - Recreation Comptrollers Office On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby appoint Peggy Nero the position of Deputy Comptroller at an annual salary of$61,935 and an additional stipend of$8,065 for coordination of telephone systems and computer systems, effective March 31, 2005 The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye Councilman Odierna asked if people know when jobs become available, if they are posted or advertised in any way. The Administrator said they were. Recreation On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that as provided for in the 2005 Town 11 March 16, 2005 Budget the Town Board does hereby authorize the payment of salary to the following: Alexander Oppenheimer, Swim Instructor, Hommocks Pool, $16/Hr. retroactive to 3/12/05 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Added Item 9. Resolution Re: Notification Forms The Town Attorney explained as part of the new Notification Law there are forms for residents for notification and signs which the Town Board may authorize and change from time to time by resolution. He had submitted some proposed forms and saying if the Board agrees to them a resolution is recommended On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby approve the notification forms as follows: NOTICE OF AN APPLICATION FOR THE APPROVAL OF A SUBDIVISION 200_ (date) Re: (name of applicant) (address) Block: Lot: Greetings: THIS IS THE ONLY WRITTEN NOTICE YOU WILL RECEIVE. IF THE APPLICATION DESCRIBED BELOW IS NOT DECIDED ON THE DATE SHOWN BELOW, IT WILL BE YOUR RESPONSIBILITY TO CONTACT THE BUILDING DEPARTMENT ABOUT FUTURE MEETINGS INVOLVING THIS APPLICATION. The applicant has applied to the Planning Board ("Board") for approval of a subdivision pursuant to Chapter 190 of the Code of the Town of Mamaroneck ("Code"). The Code is posted on www.townofmamaroneck.org. and also is available for purchase or review in the Town Clerk's office at 740 West Boston Post Road, Mamaroneck, New York 10543. The application is on file in the Building Department also located at 740 West Boston Post Road, Mamaroneck, New York 10543 and is available for review on weekdays (other than holidays) between the hours of 9:00 AM and 3:30 PM. You may ask the 12 March 16, 2005 Building Department to make copies of the application and the papers filed to support it. If you ask to have plans, renderings or surveys reproduced, you will be required to sign a statement that you will use such copies for the sole purpose of reviewing the application and participating in the proceedings before the Board and not for any commercial purpose whatsoever. You will be charged for the copying costs. At the meeting, but only to the extent permitted by the rules of the Board, you will be allowed to speak either in favor of or against the application and submit letters, photographs, drawings or other tangible evidence. The above resolution was put to a roll call vote: Winick - Aye Seligson - Aye Odierna - Aye Wittner - Aye O'Keeffe - Aye ORAL COMMUNICATIONS Larry Miralia, 210 Hommocks Road congratulated Paul Winick on his appointment as councilman. He then said he has lived here 54 years and keeps noticing so many 16 March 16, 2005 overlapping services in our municipalities. He remembers when Mr. Ralph Berger gave land to the Town in perpetuity with a proviso it be maintained —five trees have been lost on this nature preserve this year. The transfer station in the Village of Larchmont is in terrible condition this year. He encourage the board members to walk with village elected officials and school officials to see what is happening. He also complained about a no parking zone at the Hommocks that has now been taken over by the teachers. The numbers of lights there have increased, the hockey rink is used every night beginning at 3 to 5 AM. The board thanked him for his comments. REPORTS OF THE COUNCIL Councilman Odierna attended a Recreation meeting early this week, they are beginning to seed the fields, and he will be attending Human Rights on the 28th of March. Councilwoman Wittner said there had been no meetings. Councilwoman Seligson attended the Town Planning Board meeting last week where they discussed some interesting issues. She would be attending the Zoning Board of Appeals meeting next week and she thanked Mr. Miralia for bringing up the issue of municipal cooperation. Councilman Winick said he had been appointed by Supervisor O'Keeffe as her Deputy Supervisor five or six years ago and over all that time he had chaired only two meeting when she was absent, he has now sent in his letter of resignation from that post. ADJOURNMENT Supervisor O'Keeffe said she wished to adjourn tonight's meeting in memory of James Staropoli, former Police Chief and in memory of Helen Stuart, a Village of Larchmont Poll Watcher. Her wake is tomorrow at Fox. She was very active in the Women's Club and a lot of fun.
