HomeMy WebLinkAbout2004_10_20 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON OCTOBER 20, 2004 AT 8:15 PM IN THE COURT ROOM OF THE TOWN, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney The Work Session was called to order at 5:10 PM. The Supervisor invited in the following list of residents to discuss their request to put in a sidewalk on Colonial Avenue: Barry Hart Abbe Kirsch Laura Lavan Erik Graber Keate Beebe One of them said she has two boys who walk to school and this situation needs to be studied. We need a sidewalk or maybe a widening of the street. The parents picking up and dropping off their children on Colonial are making this dangerous. Councilwoman Wittner and the Supervisor both asked if this could be fixed by not allowing parking on one side of the street during pick-up and drop-off times. They then discussed some of the ramifications of different ways to handle this problem. The Board members pointed out the costs of putting in a sidewalk were immense and they did not necessarily agree one should be put in. It would involve moving catch basins and putting in curbing. They explained they were thinking of instituting a co-pay plan for residents to contribute to help pay the costs of new sidewalks and sidewalk repair. A resident said this is not just for them but for a whole community whose kids go to the school. The Supervisor said the point is if the Town can do something to make it safer they will. However, we can't change behavior of those people who are being unsafe, and it was never the intent of the Town to put a sidewalk there. A resident replied that this sidewalk has so much more of an impact for the Town than the one put in on Edgewood. The Supervisor explained why the sidewalk was put in on Edgewood — part of the street already had a sidewalk, part did not. A long discussion ensued. The Supervisor said the Board will give this to the Traffic Committee for input and talk to the police department. She suggested the residents talk to the people on the side of the street where they were proposing to create a sidewalk to inform them that the matter has been brought to the Town Board's attention. It was also pointed out that residents would be required to shovel snow from sidewalks. Public Notification Law There was a discussion on who would pay for the notification letter. It was decided it should be borne by the applicant. The Attorney suggested there be signs required for Site Plan review, zoning variances, subdivisions, and special permits. They also talked about the notification area requirement and who should be noticed. Mr. Maker said he would come up with a template for the Board to see. October 20, 2004 Fence Finishing Supervisor O'Keeffe explained the problem of the Colello family, whose house is perfectly maintained. They have a new neighbor with a retaining wall who has built a fence with steel pipes securing the wall and facing the Colello's property. The Supervisor visited them and asked them to make it look better, to put in ivy or something similar to make it more attractive, which was not done. Under discussion was a law to have the finished side of the fence facing neighbors and/or the public. The Town Attorney was asked to draft it. Motor Vehicle Idling There was a discussion regarding how to enforce a law regarding no automobile idling for more than five (5) minutes. Councilwoman Seligson said passing a law would show the Town is willing to take a stand on this. Councilwoman Myers thought it could be better handled through public service rather than by law and suggested Councilwoman Seligson write an article for the newsletter. It was decided to refer this to the Traffic Committee for comment. Traffic Fine Legislation The Administrator explained this was to adopt a resolution to be sent to the Governor and New York State legislators to allow the Town to keep more funds collected for traffic fines. Lafayette Road Drainage It was decided to hold this over to allow the Administrator more time to gather information and to have the staff look at it. Councilwoman Seligson asked if the November 15, 2004 budget session could be changed. It was agreed to change it to November 16, 2004 from 9:00 am to 12 noon. CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:25 PM. She then pointed out the location of exits. Public Hearing — Installation of Stop Signs — Rochelle Road / Huguenot Drive The following Notice of Public Hearing was entered into the record: PLEASE TAKE NOTICE that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, October 20, 2004, at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider Installation of Stop Signs on Rochelle Road / Huguenot Road. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the public hearing was unanimously opened. Supervisor O'Keeffe asked if anyone wished to speak for or against the proposed amendment. Janet Segal, Huguenot Drive resident, said she was grateful to have this law enacted. The cars don't stop for our children, which is dangerous so she is very much in favor in seeing it passed. Bob Kirby, 1 France Place, said he was in full support of this law. He witnesses cars constantly speeding and then having to stop short. Malcolm Plett stated he has two boys who like to play outside and there are no lines or dividers on Rochelle Road. The original proposal was for stop sign on the corner of Huguenot and Mountain, which would complete the equation. 2 October 20, 2004 Councilwoman Myers said it almost looks like one stop sign is missing. Councilwoman Seligson agreed and from a driver's perspective it seems there should be one there. Kate Jarrett, 10 Rochelle Road, fears to let her daughter play outside. It helps having stop signs for the children walking to Murray Avenue School — so she is in favor of this law. On motion of Councilwoman Myers, seconded by Councilwoman Seligson, the public hearing was closed. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was Resolved, that the Town Board finds that the adoption of the proposed local law regarding the installation of a stop sign on Rochelle Road is hereby declared to be a Type II action, which will constitute an Unlisted Action with No Impact under the New York State Environmental Quality Review Act (SEQRA). The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye On motion of Councilwoman Myers, seconded by Councilwoman Seligson, the following local law was duly adopted: Local Law No. -14-2004 This local law shall be known as the "Stop Signs on Huguenot Drive and Rochelle Road" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 - Purpose: The purpose of this local law is to regulate traffic at the intersection of Huguenot Drive and Rochelle Road and at the intersection of Huguenot Drive and Mountain Avenue. Section 2 - Regulation of traffic on Huguenot Drive: A. Vehicles traveling in either direction on Huguenot Drive shall come to a full stop on Huguenot Drive at the point where Huguenot Drive intersects with Rochelle Road. B. Vehicles traveling north on Huguenot Drive shall come to a full stop on Huguenot Drive at the point where Huguenot Drive intersects Mountain Avenue. Section 3 - Regulation of traffic on Rochelle Road: Vehicles traveling west on Rochelle Road shall come to a full stop on Rochelle Road at the point where Rochelle Road intersects with Huguenot Drive. Section 4 - Signs to be Erected: A. An appropriate sign or signs shall be erected on Huguenot Drive facing the northbound traffic thereon and another appropriate sign or signs shall be erected on Huguenot Drive facing the southbound traffic thereon. Such sign or signs shall be erected at the corners formed by the intersection of Huguenot Drive and Rochelle Road. B. An appropriate sign or signs shall be erected on Huguenot Drive facing the northbound traffic thereon. Such sign or signs shall be erected at the corners formed by the intersection of Huguenot Drive and Mountain Avenue. 3 October 20, 2004 C. An appropriate sign or signs shall be erected on Rochelle Road facing the westbound traffic thereon. Such sign or signs shall be erected at the corners formed by the intersection of Rochelle Road and Huguenot Drive. Section 5 - Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 6 - Effective Date: This Local Law shall become effective upon filing with the Secretary of State. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe and on motion of Councilwoman Myers, seconded by Councilman Wittner, the Board of Fire Commissioners was unanimously declared open. Other Fire Department Business Supervisor O'Keefe said she was sorry to hear about the recent death of former Fire Chief Harold LaRocca, and she sent her sympathy to his wife Terry and to his children. There being no further business to come before the Commission, on motion of Commissioner Odierna, seconded by Commissioner Myers, the Commission unanimously adjourned at 8:50 PM. AFFAIRS OF THE TOWN 1. Submission 2005 Tentative Budget - Mr. Altieri outlined the tentative budget for next year stating appropriations are $25.4 million, an increase of $1.3 million, and the Tax levy $16.5 million, an increase of $1 million. The tax rates for the villages would increase $14.50 to $15.95 per one thousand dollars of assessed valuation which results in an average tax of $319. In the Unincorporated area of the Town the tax rate will increase from $204.04 to $218.95, which amounts to approximately $4,380 in taxes for the year. He said there will be public work session on the budget and a Public Hearing on December 1, 2004. 2. Authorization —Westchester Joint Water Works — Rye Lake Project Mr. Altieri explained this project would increase capacity which is in response to an increasing demand for water. It would be a joint project totaling $1.7 million, the Town's share is $351,000. The Town would have to consider borrowing to fund this. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby call for a public hearing to authorize the Rye Lake Pump Station expansion project to be undertaken by Westchester Joint Water Works; the total cost of the project is $1,713,100, of which the Town's share is 20.5%, or$351,200 after bonding papers are received. Report of Bids Contract TA-04-10— Hydraulic Leaf Claw The Administrator explained bids were opened for the leaf claw which will be attached to the payloader truck. The lowest bid was submitted by Nortrax Equipment, but they left out the accessory part of the bid which the specifications required. Therefore, if we were 5 October 20, 2004 to accept, they would not be furnishing the hydraulic hoses. He recommended the Board approve the next lowest correct bid, which is Trius at $14,936.00. Penn 699 Brush Ave, Bronx, NY Neither $15,315.00 Following discussion, on motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby award the bid TA-04-10, to purchase the Hydraulic Leaf Claw at a total cost of$14,936.00 to Trius Equipment of Bohemia, New York and BE IT FURTHER, RESOLVED, that the Town Administrator is authorized to execute said contract on behalf of the Town. Resolution — Hospitalization Insurance The Supervisor read the resolution regarding health insurance for elected officials. On motion of Councilwoman Wittner, seconded by Councilman Odierna, the following resolution was adopted: Whereas, the Town of Mamaroneck subscribes to a group health insurance plan whereby employees of the Town can enroll for health insurance policies for themselves and their eligible dependents; and Whereas, the collective bargaining agreements between the Town and all of its bargaining units provide that under specific circumstances, the Town is required to pay all or some of the premiums on such policies for certain Town employees and their eligible dependents during their employment with the Town and once those employees reach retirement age and retire; and Whereas, the Town Board considers it appropriate for the Town to pay the premiums for health insurance policies covering the elected officials of the Town if those officials have served a significant amount of time in office under circumstances similar to those promulgated in these collective bargaining agreements. NOW THEREFORE, BE IT RESOLVED, that for the purpose of this resolution: "Eligible Dependent" means a Qualified Individual's (a) surviving spouse, (b) child under twenty-one (21) years of age 6 October 20, 2004 or(c) child who has attained twenty-one (21) years of age but has not reached twenty-three (23) years of age and is a full- time student, unless the definition of Eligible Dependent (or like term) in the Town's Plan is different from this definition, in which case the definition of Eligible Dependent contained in the Town's Plan shall be substituted for this definition of Eligible Dependent; "Eligible Elective Office" means the Supervisor of the Town of Mamaroneck, each Councilmember of the Town of Mamaroneck, each Town Justice of the Town of Mamaroneck and the Town Clerk of the Town of Mamaroneck; and "Qualified Individual" means any person who (i) holds an Eligible Elective Office or(ii) who no longer holds an Eligible Elective Office but who since December 31, 1993, held an Eligible Elective Office (including any combination of those offices) for ten (10) or more consecutive years; and "Policy" means a health insurance policy issued by the insurance company which issues health insurance policies pursuant to the Town's Plan; and "Town's Plan" means the plan under which certain employees of the Town can enroll for Policies for themselves and their Eligible Dependents. The Town's Plan and the Policies may change from time to time so that any reference in this resolution to either the Town's Plan or a Policy is a reference to the Plan and a Policy as either or both may be exist from time to time; and BE IT FURTHER, RESOLVED, that subject to the conditions set forth below, the Town of Mamaroneck shall pay the entire premium for a single or family Policy covering a Qualified Individual holding Eligible Elective Office while that Qualified Individual holds Eligible Elective Office; and BE IT FURTHER, RESOLVED, that subject to the conditions set forth below, the Town of Mamaroneck shall pay the entire premium for a single or family policy covering a Qualified Individual who no longer holds an Eligible Elective Office for as long as that Qualified Individual is eligible under the Town's Plan to be covered by a Policy if(a) coverage is requested by the Qualified Individual and (b) that Qualified Individual leaves an Eligible Elective Office after attaining fifty-five years (55) of age; and BE IT FURTHER, RESOLVED, that subject to the conditions set forth below, if a Qualified Individual (a) dies after attaining fifty-five (55) years of age and (b) on the date of death, was covered by a Policy, the Town of Mamaroneck shall pay the entire premium for a single or family Policy covering an Eligible Dependent of the deceased Qualified Individual for as long as that Eligible Dependent is eligible under the Town's Plan to be covered by a Policy if coverage is requested by or on behalf of an Eligible Dependent of the deceased Qualified Individual; and BE IT FURTHER, RESOLVED, that subject to the conditions set forth below, if a Qualified Individual leaves Eligible Elective Office before attaining fifty-five (55) years of age, then upon the Qualified Individual attaining that age, the Town of Mamaroneck shall 7 October 20, 2004 pay the entire premium for a single or family Policy covering that Qualified Individual for as long as that Qualified Individual is eligible under the Town's Plan to be covered by a Policy if coverage is requested by the Qualified Individual; provided that (a) from the time the Qualified Individual left Eligible Elective Office, that Qualified Individual shall have continuously been insured under a Policy and (b) shall have paid all of the premiums therefor; and BE IT FURTHER, RESOLVED, that if a Qualified Individual (a) dies while holding Eligible Elective Office and (b) on the date of the Qualified Individual's death, the Qualified Individual's surviving spouse shall have attained fifty-five (55) years of age, the Town of Mamaroneck shall pay the entire premium for a single or family Policy covering such surviving spouse for as long as the surviving spouse is eligible under the Town's Plan to be covered by a Policy if coverage is requested by or on behalf of that spouse; and BE IT FURTHER, RESOLVED, that if a Qualified Individual (a) dies while holding Eligible Elective Office and (b) on the date of the Qualified Individual's death, the Qualified Individual's surviving spouse shall not have attained fifty-five (55) years of age, the surviving spouse shall be allowed to subscribe for a single or family Policy. If the surviving spouse does so, the Town of Mamaroneck shall pay the entire premium for the first three (3) months following the month in which the Qualified Individual shall have died. If the surviving spouse (i) subscribes for a Policy, (ii) pays all of the premiums therefor and (iii) is continuously insured under a Policy from the date of the Qualified Individual's death until attaining fifty-five (55) years of age, then upon the surviving spouse attaining that age, the Town of Mamaroneck shall pay the entire premium for a single or family Policy covering the surviving spouse for as long as the surviving spouse is eligible under the Town's Plan to be covered by a Policy if coverage is requested by or on behalf of the Qualified Individual until such time as the surviving spouse remarries; and BE IT FURTHER, RESOLVED, that if a Qualified Individual (a) dies while holding Eligible Elective Office and (b) on the date of the Qualified Individual's death, the Qualified Individual (i) was not married but had an Eligible Dependent, or(ii) was married and has an Eligible Dependent (in addition to a surviving spouse) and the surviving spouse chooses not to subscribe for a Policy, the Eligible Dependent shall be allowed to subscribe for a single or family Policy. If the Eligible Dependent does so, the Town of Mamaroneck shall pay the premiums for the first three (3) months following the month in which the Qualified Individual shall have died and the Eligible Dependent shall be responsible for paying all of the premiums thereafter; and BE IT FURTHER, RESOLVED, while a Qualified Individual is alive, that Qualified Individual's Eligible Dependents shall not have the right to subscribe to a Policy of their own; and BE IT FURTHER, RESOLVED, that if a Qualified Individual or an Eligible Dependent of a Qualified Individual fails to qualify for 8 October 20, 2004 coverage under a Policy or a Policy is terminated for a Qualified Individual or an Eligible Dependent of a Qualified Individual for any reason other than the failure of the Town of Mamaroneck to pay premiums when it is required to pay such premiums under the terms of this resolution, or under the terms of the Town's Plan, the insurance company which issues Policies has the right to decline coverage to a Qualified Individual or an Eligible Dependent, the Town of Mamaroneck will have no obligation under this resolution to acquire a health insurance policy for that Qualified Individual or that Eligible Dependent of a Qualified Individual; and BE IT FURTHER, RESOLVED, that if the Town's Plan is terminated and the Town does not subscribe to another group health insurance plan, the Town of Mamaroneck will have no obligation under this resolution to acquire a health insurance policy for any Qualified Individual or any Eligible Dependent of a Qualified Individual; and BE IT FURTHER, RESOLVED, a Qualified Individual (or an Eligible Dependent of a Qualified Individual) for whom the Town is not paying premiums on a Policy or a Qualified Individual (or an Eligible Dependent of a Qualified Individual) who subscribes for a Policy with single coverage shall not be entitled to receive in cash or in kind the difference between the highest premium then being charged for a Policy and the amount which the Town is paying for a Policy for that Qualified Individual (or an Eligible Dependent of that Qualified Individual); and BE IT FURTHER, RESOLVED, that time served as Deputy Supervisor shall not be counted toward the time of service required to become a Qualified Individual unless during a person's term as Deputy Supervisor that person also is a Councilmember, a Justice or the Town Clerk of the Town of Mamaroneck. Salary Authorization a. - Community Services b. - Recreation Community Services On motion of Councilwoman Myers, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby approve the hiring and salary of Charlotte Copland as a part time temporary Community Outreach worker in Community services at an hourly rate of $15.00 for 25 hours per week for the remainder of the year. 9 October 20, 2004 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Recreation On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that as provided for in the 2004 Town Budget the Town Board does hereby authorize the payment of salary to the following: Hommocks Pool Effective Stephanie Allen Alt Lifeguard $11.25/hr 10/16/04 Stephanie Allen Swim Instructor $19/hour 10/16/04 Beatrice Ghitelman Lifeguard $7.25/hour 10/4/04 Liz Linsalato Lifeguard $8/hour 10/4/04 Bette Pollak Key Attendant $8/hour 10/20/04 Wayne Pollack Alt Manager $15.50/hour 10/4/04 Max Sanchez Lifeguard $7.50/hour 10/4/04 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ADDED ITEMS 7. Traffic Fines On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the following resolution was adopted: WHEREAS, Vehicle and Traffic Law, § 1803 governs the disposition of fines and penalties collected in connection with convictions pursuant to the Vehicle and Traffic Law; and WHEREAS, Chapter 56 of the Laws of 2004, effective August 20, 2004. changed the distribution of the lines taking them away from municipalities and placing them in the State Treasury; and WHEREAS, this change in the fine and penalties distribution formula will result in a loss to local taxpayers of more than $20 million in fine monies -- monies which have historically been used to fund justice court operations; and WHEREAS, the Town of Mamaroneck will likely lose $50,000.00 in anticipated fine revenues; and WHEREAS, this State Budget provision with its immediate effective date will result in significant 2004 deficits and will negatively impact town property tax rates for 2005; and 10 October 20, 2004 NOW THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck calls for the restoration of the original fine distribution formula in order to provide towns with necessary revenues to fund justice court operations; and BE IT FURTHER RESOLVED, that the Town of Mamaroneck urges the passage of legislation introduced by Senator Bonacic (S.7757) and Assemblyman Cahill which amends the Vehicle and Traffic Law to restore this source of revenue to local governments; and BE IT FURTHER RESOLVED, that a copy of this resolution be sent to the Governor George E. Pataki; Joseph L. Bruno, Majority Leader of the Senate; Sheldon Silver, Speaker of the Assembly; Senator Elizabeth Little, Chair of the Local Government Committee; Assemblyman Robert Sweeney. Chair of the Local Government Committee; Senator Owen Johnson, Chair of the Finance Committee; Assemblyman Herman D. Farrell, Jr., Chair of the Ways and Means Committee; Senator John A. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Proclamations — Vincent Graziano Giovanni Vozza Leonard Verrastro The following proclamations were read into the record: PROCLAMATION VINCENT GRAZIANO WHEREAS, Vinny was born in Little Italy and followed in the footsteps of his grandfather, father and brother in undertaking the important role of Funeral Director,and WHEREAS, he purchased his Mamaroneck funeral home in 1981, when he moved to Westchester and made impressive improvements by undergoing four expansions and various renovations to provide the community with excellent personal service and facilities; and WHEREAS, Vinny provides supportive and kind help in to many families in times of need. His commitment, compassion and professionalism have remained constant and his devotion to our community is exemplary, and WHEREAS, he is a graduate of Pace University and the American Academy McAllister Institute of Funeral Service. He has been married for 26 years to, Annmarie. They have two children, Jennifer and Vincent Jr., both attaining college degrees. VERRASTRO WHEREAS, throughout its history the Town of Mamaroneck has been fortunate to have men and women who give their talent for the betterment of the community, and WHEREAS„ Leonard M. Verrastro is one of these exceptional citizens. He has served with distinction as Clerk Treasurer in the Village of Mamaroneck from 1981 to 2003, was appointed to Village Manager in 2004, and continues to perform his outstanding services; and WHEREAS, Lenny is well known throughout Westchester and New York State as a government leader and has been an officer in organizations representing over 400 villages and cities in the state; and WHEREAS„ Lenny is a second generation Italian American who is proud of the sacrifices of his grandparents who immigrated to this country. APPROVAL OF MINUTES—September 8,2004, September 22, 2004 and October 13, 2004 (Special Meeting) On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby approve the minutes of September 8, 2004 as amended. WRITTEN COMMUNICATIONS Supervisor O'Keeffe said she received a communication regarding voting and she read a communication she received from Jeff Marston into the minutes. REPORTS OF COUNCIL Councilwoman Seligson said she and the other Board members met with the Town's land use boards last week to discuss design guidelines and to see how they were working and on how we may make it easier. She also attended the wine tasting sponsored by the Hispanic Coalition. Councilwoman Wittner said she attended the Municipal Officials Dinner in Elmsford at the Knollwood Country Club, which was beautiful. Councilman Odierna reminded everyone about the VAC building opening next Saturday. He attended on Monday night a meeting held by the County on the long-range plan for Playland. He made suggestions on boating activities. Councilwoman Myers said — GO YANKEES!
