THE TOWN OF MAMARONECK HELD ON OCTOBER 6, 2004 AT
8:15 PM IN THE COURT ROOM OF THE TOWN, 740 W. BOSTON

WORK SESSION
There was a discussion about the Long Island Sound Restoration Act. The Board then
discussed the preliminary results of the survey sent out to Town residents. There were 4000
surveys sent out and 1177 were answered and returned. There was a discussion about a
letter to be sent to residents who are encroaching onto the conservation area along the
Leatherstocking Trails. The Board decided to send two letters and then to follow up with a
phone call. Councilwoman Wittner suggested they also be issued a summons if they failed to
comply.
Health Insurance
The Board discussed the implementation of Health Insurance for elected officials who serve a
minimum of 10 years and reach the age of 55.
Vehicle Idling Law
There was a discussion regarding vehicles which are left to idle for lengthy periods. The
attorney was asked to research the matter to see if there is an existing law and/or to create
one.
Budget
There was a discussion on the dates and times of the Budget Work Sessions. It was decided
to have the Administrator revise the Budget calendar to change the November 3 meeting to
November 4 and then hold one on both November 17 and 18.
Pool
The Supervisor described the new roof for the Hommocks Pool and the possibility of bringing
in the architect to meet with the Town Board. The suggested date is November 8. She said the
lockers would cost $1 million and the total is $5.6 million estimated for the pool repair. Also
discussed was the possibility of the Town doing the bids for themselves. The Supervisor also
reported she received a letter from Eleanor Sherman complaining about bushes, a letter from
Detective McCarthy regarding the speed monitor, and a report showing the police are giving
out leaf blower summonses.
Code of Ethics
It was decided to hold the public hearing on the revision to the Code of Ethics on October 20,
2004.
Patriot Act
Councilwoman Wittner had a copy of a resolution to request amending the Patriot Act and
asked the Board to adopt it. Supervisor O'Keeffe disagreed, preferring to wait until after the
election.
CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:35 PM.
She then pointed out the location of exits.

The Supervisor invited Lee Bloom up to the podium and she then read the proclamation. Mr.
Bloom thanked her and the Board members.
Public Hearing — Section 8 Public Housing Agency Administrative Plan
The following notice of public hearing was entered into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of
Mamaroneck on Wednesday, October 6, 2004, at 8:15 PM or as soon thereafter as is possible,
in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to
consider a Local Law to be known as "Administrative Plan for the Section 8 Public Housing
Agency" Law
On motion of Councilwoman Myers, seconded by Councilwoman Seligson, the hearing was
unanimously declared open.
Anna Danoy, Section 8 Housing Administrator, presented the Five Year HUD Plan, declaring
there were no major changes. She said there are 260 vouchers, with 248 families, 80 elderly
recipients and 75 families which are headed by disabled people. There are also working
families on the waiting list and 19 disabled people waiting. HUD required the recipients be low
income ($20,000 for singles and $45,000 for a family of four). If HUD makes a criteria change,
she then would be required to have another public meeting to identify the changes. HUD has
not allowed any new vouchers over the last few years.
Councilwoman Myers asked if the Town had more vouchers would there be more available
apartments. Ms. Danoy replied yes, probably because the landlords know they will get paid
and the apartments are required to be maintained.
There being no further comment on motion of Councilwoman Wittner, seconded by
Councilwoman Myers, the hearing was declared closed.
On motion of Councilwoman Myers, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board finds that the adoption of
the proposed local law regarding the Section 8 Public
Housing Plan is hereby declared to be a unlisted action with
no impact under the New York State Environmental Quality
Review Act (SEQRA)

Public Hearing — No Left Turn — Bryson Street
The following notice of public hearing was entered into the record:

PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of
Mamaroneck on Wednesday, September 22, 2004, at 8:15 PM or as soon thereafter as is
possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New
York to consider a Local Law to be known as "No Left Turn from Bryson Street" Law.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the public hearing
was unanimously opened.
The Administrator explained that the Traffic Committee worked with the Murray Avenue PTA
design a plan to make traffic flow safer and more efficient. The Traffic Committee is
recommending no left turn during school hours on Bryson.
Councilwoman Myers said the school has been working on this. They are concerned about
kids crossing. The police have been observing and have agreed this no left turn will make it
safer.
Brad Garfield, a resident on Bryson, said this is long overdue. There isn't a sidewalk and it's
very congested, and this should also stop people who circle.
A resident from 4 Bryson Street said he agreed with this proposal but thinks it should say
"except holidays" instead of saying "school days".
Councilwoman Wittner said to leave it this way and see what happens.
There being no further comment, on motion of Councilwoman Wittner, seconded by
Councilwoman Myers, the hearing was unanimously closed.
On motion of Councilwoman Myers, seconded by Councilman Odierna, it was
Resolved, that the Town Board finds that the adoption of the
proposed local law regarding No Left Turn — Bryson Street is
hereby declared to be a Type II action with No Impact under
the New York State Environmental Quality Review Act
(SEQRA).

On motion of Councilwoman Myers, seconded by Councilwoman Wittner, the following
law was adopted:
Local Law No. 13 -2004
This local law shall be known as the "No Left Turn from Bryson Street" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 - Purpose:
The section of Murray Avenue between Bryson Street and Forest Avenue becomes
particularly congested during school hours. The purpose of this local law is to prevent
traffic from turning onto Murray Avenue from Bryson Street thereby relieving some of
the congestion.
Section 2 - Regulation of Traffic on Bryson Street:
From September 1st of each year to and including June 30 of the immediately following
year, vehicles traveling east on Bryson Street between the hours of 8:00 AM and 4:00 PM
on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays shall not be allowed to
make a left turn onto Murray Avenue.
Section 3 - Sign to be Erected:
An appropriate sign or signs shall be erected on Bryson Street facing the east bound
traffic thereon. Such sign or signs shall be erected at the corners formed by Murray
Avenue and the termination of Bryson Street.

Section 4 - Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any
court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall
not affect any other provisions of this Local Law, which may be implemented without the
invalid or unconstitutional provisions.
Section 5 - Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

There being no further business to come before the Commission, on motion of Commissioner
Wittner, seconded by Commissioner Odierna, the Commission unanimously adjourned.
AFFAIRS OF THE TOWN
1. Authorization — Transfer of Funds — Hommocks Ice Rink Trust Fund
A memo from the Town Administrator explained that in 2003 the Town went out to bid for a
project to build an elevated dining terrace adjacent to the Hommocks Ice Rink Concession,
all of which were too high and the project was rejected. We have continued to look at ways
of recreating the project but without the elevated terrace. What is now proposed is
establishing an eating area similar in size to that of the terrace but at ground level. Rather
than the construction of a railing, the eating area would be bounded by an attractive interior
fence. Finally to make the eating area more comfortable it would include radiant heating.
The proposal to the Town Board is to request authorization to transfer $11,000 from the Ice
Rink Trust Fund for the installation of the radiant heat. Three estimates were received for
the installation of the radiant heat:

Ward Associates $12,000
Asaia and Sons Contracting $13,100
The fencing is being arranged by Brewer's Hardware, who will receive a dasher board ad in
exchange. The Administrator recommended authorization of the transfer and awarding of the
bid to Eagle Air.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the above resolution
was put to a roll call vote:
RESOLVED, that the Town Board hereby awards the bid for the
installation of radiant heat at the Hommocks Ice Rink to Eagle Air
Systems, the lowest bidder at $11,000.00; and
BE IT FURTHER,

RESOLVED, that the Town Board does hereby approve the transfer
of funds in the amount of$11,000.00 from the Hommocks Park Ice
Rink Trust Fund (T-109) into the Hommocks Ice Rink Operating
Budget Account A7265.2102 Miscellaneous Equipment; and
BE IT FURTHER,
RESOLVED, that the Town Administrator, Stephen V. Altieri, is
hereby authorized to execute said agreement on behalf of the
Town.

2. Authorization — Renewal of Snow Removal Agreement—County of Westchester
Mr. Altieri said the agreement for snow removal with Westchester County will expire in
September of 2005. There is a renewal proposal for an additional five years with the same
terms, but with a 2.75% increase, which means they will reimburse the Town $5,750. He
recommended approval.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board does hereby agree to
extend the current agreement with New York State
Department of Transportation for the removal of snow and
ice on State roads in the Town; and
BE IT FURTHER,
RESOLVED, that the Town will be reimbursed in a lump sum
of$5,750.00 for removal of snow and ice on Weaver Street
and the Boston Post Road. This agreement is for the 2005-
2010 season; and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes the Town
Administrator to execute above-said agreement on behalf of
the Town.

3. Authorization —Appraisal Service - 875 Associates Certiorari
The Board now took up the matter of Appraisal Services.
On motion of Councilman Odierna, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby authorize Brian
Kenney Appraisals to prepare an appraisal for 875 Associates
and representation should a trial be necessary. The fee for a
preliminary appraisal is $4,000. In the event a full trial
appraisal is needed, the fee will be an additional $3,000; and

BE IT FURTHER,
RESOLVED, that the Town Administrator is authorized to
execute said contract on behalf of the Town.

Road/Huguenot Road for October 20, 2004; and

the notice of said hearing in a newspaper appointed as an official
newspaper, and that said notice is posted.

PROCLAMATION
CARMINE A. DELUCA RETIREMENT
WHEREAS, Carmine DeLuca is retiring after 34 years of distinguished public service as
Treasurer of the Village of Larchmont, Comptroller of the Town of Mamaroneck, Secretary-
Treasurer of the Larch mont-Mamaroneck Joint Sanitation Commission and Controller of the
Tri-Municipal Cable Television Board of Control; and
WHEREAS, Carmine has consistently demonstrated attention to detail and innovative
approaches to the yearly Town budget process; and
WHEREAS, His dedication and devotion to Town residents has been repeatedly
demonstrated by his untiring performance of duties and earned him praise from his peers,
current and previous Supervisors, Town Boards and the Town Administrator; and
WHEREAS, Because of Carmine's old school care and concern for others, especially Senior
Citizens, he has served as an example of compassion and professionalism in providing
service to all Town citizens; and
NOW THEREFORE, BE IT RESOLVED,
That I, Valerie Moore O'Keeffe, Supervisor, and the members of the Town Council of the
Town of Mamaroneck hereby present this Proclamation to
CARMINE A. DELUCA
In deep appreciation, gratitude, and thanks for his many years of extraordinary service. We
ask all residents of the Town to join us in saying "Well Done" to a gentleman and great friend
and wish him many happy and healthy years in retirement with his wife of 41 years, 2
children and five grandchildren,

Supervisor O'Keeffe received the following letter from Detective Sergeant Jerry McCarthy:

Re: Trader Joe's Armed Robbery
On 06/12/04 at approximately 0040 hrs Patrol Officers responded to the scene of
an armed robbery that occurred at Trader Joe's located at 1260 Boston Post Road.
The incident involved the display and threatened use of firearms in the
commission of the crime. One victim was struck repeatedly on the head with the
butt of one of the handguns. The scene was processed by Detective John Infelice
and it was determined that the scene was negative for trace evidence
(fingerprints, blood, hair, etc.). Witness/victim accounts were sketchy due to the
fact that they were ordered, by gunpoint, to lay on their stomachs.
The investigation was multi-faceted and several approaches were initiated.
Numerous hours of intelligence gathering resulted in the identification of a
possible suspect. Surveillances were conducted and a second suspect was
developed. As is the case with many of our investigations we were required to
travel outside the confines of the Town, in this case the South Bronx area.
As a result of a team effort that involved the talents of the entire Detective Bureau
we successfully arrested two individuals for Robbery 1St Degree.
I would like to commend Det. John Infelice, bet Thomas Gisin and Det. T.J.
McDermott (arresting Officer) on their professionalism and performance during
this three month investigation. P.O Donn Edmonds was also invaluable to us
during the apprehension/arrest phase of this operation. As always, Chief Rivera's
support and direction during the investigation allowed our Detective Division to
be successful in helping to bring this unfortunate, and potentially deadly, incident
to a successful conclusion.

SUPERVISOR REPORTS
The Supervisor said she, the Town Board, and members of the Town staff attended the
retirement dinner held in honor of Carmine Deluca which was well attended and everyone had
a lot of fun. It was held at the Larchmont Shore Club with 238 people in attendance.
REPORTS OF COUNCIL
Councilman Odierna said he attended the Recreation Meeting. He reminded everyone about
the ice rink skating on Sundays from 1 to 4 where famous animal characters are skating, too.
There will be a magical workshop, medieval castles and on Sunday, October 31, free
beverages and door prizes. Pizza Bingo is back on Friday nights and Bubble Babies is
available for toddlers between 6 to 18 months. He commended the hardworking and
inspirational staff in the Recreation Department.
Councilwoman Wittner attended the Coastal Zone Management Meeting on September 28. She
said it was an interesting meeting. There were applications forwarded from the Planning
Board. She was at the Senior Citizen Luncheon and the retirement party for Carmine DeLuca,
both held the same day. The entire Board attended the Firemen's Inspection Dinner held at
Bonnie Briar after inspection of firemen and women and machines.
Councilwoman Myers also was at both events for Carmine DeLuca and she thanked the
Seniors for a wonderful luncheon. She attended a Cable TV meeting regarding the franchise.
BAR met the same night as the Town Board so she was unable to attend their meeting.

Councilwoman Seligson attended the Zoning Board meeting. She added thanks to all the
members for their hard work. She also attended the Fire Inspection Dinner, which was good.
TOWN CLERK REPORTS
The Town Clerk reminded everyone that the last day to register to vote would be held on
October 9 from 12:00 to 7:00 PM here at the Town Center.
ADJOURNMENT
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson the meeting was
unanimously adjourned into at 10:45 PM.
