MINUTES OF THE REGULAR MEETING OF THE
TOWN BOARD OF THE TOWN OF MAMARONECK
HELD ON SEPTEMBER 22, 2004 AT 8:15 PM IN THE
COURT ROOM OF THE TOWN, 740 W. BOSTON
POST ROAD, MAMARONECK, NEW YORK

CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor
O'Keeffe at 8:15 PM. She then pointed out the location of exits.
The Board started in Work Session at 5:00 PM. Police Chief Rivera and Ron
Carpaneto, Building Inspector, were both in attendance to give input on Code
Enforcement. The Board questioned them both on the best way to compel
compliance especially with the Town's leaf blower law and residents leaving
garbage out too soon. The Board then discussed the Ethics Law and
provisions within it which make it difficult to recruit and keep volunteers. One
provision which might need revising is the requirement that specifies
someone on our committees is restricted from practicing in the Town while on
the board or committee and for two years thereafter. It was decided to have
the attorney revise that section and present it to the Board at a later meeting.
The Supervisor said she had received a communication regarding purchasing
wind power in a token amount to support a state-wide program. The Town
would have to sign on before October 4t" and the Town would receive an
award for doing so. There was also a discussion on the state budget always
being late. Supervisor O'Keeffe said she had attended a meeting about it
where it was proposed to change things to help make it less crazy. One
change proposed was to redefine the fiscal year. They decided to hold over
the discussion on conservation area encroachment. The Board then
discussed putting up signs regarding pooper scooper laws. Councilwoman
Seligson said there are mesh cans which can be used for disposal, which are
helpful, along with a sign and they tend to dissuade people putting in other
types of trash. They said one would be put along the brook, one by
Landsdown, and one by Ferndale.
PUBLIC HEARING - No Left Turn — Bryson Street
The following notice of public hearing was entered into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of
the Town of Mamaroneck on Wednesday, September 22, 2004, at 8:15 PM or as
soon thereafter as is possible in the Court Room of the Town Center, 740 W.
Boston Post Road, Mamaroneck, New York, to consider a Local Law to be known
as "No Left Turn from Bryson Street" Law

The full text of this Local Law may be examined and copies obtained at the Town
Clerk's Office during regular business hours (Monday through Friday, 8:30 AM to
4:30 PM or until 4:00 PM during June, July and August) at 740 W. Boston Post
Road, Mamaroneck, New York.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the
hearing was opened.
Mr. Altieri said he attended the Traffic Meeting and found out no one on Bryson
was notified of the public hearing being held tonight.
On motion of Councilwoman Myers, seconded by Councilwoman Wittner,
the hearing was unanimously adjourned to the next meeting to enable
notification to residents of Bryson Street.
PUBLIC HEARING - Quality of Life Law
The following notice of public hearing was entered into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of
the Town of Mamaroneck on Wednesday, September 22, 2004, at 8:15 PM or as
soon thereafter as is possible in the Court Room of the Town Center, 740 W.
Boston Post Road, Mamaroneck, New York to consider a Local Law to be known
as "Enforcement of the `Quality of Life' Laws of the Town of Mamaroneck" Law.
The full text of this Local Law may be examined and copies obtained at the Town
Clerk's Office during regular business hours (Monday through Friday, 8:30 AM to
4:30 PM or until 4:00 PM during June, July and August) at 740 W. Boston Post
Road, Mamaroneck, New York.
PLEASE TAKE FURTHER NOTICE, that at said Public Hearing all persons
interested will be given an opportunity to be heard and that all persons are invited
to submit written comments prior thereto.
Supervisor O'Keeffe explained this proposed law authorizes and expands the
power of certain staff members to issue summonses. She then asked if anyone
wished to speak in favor of or against the proposed law. There were no public
comments.
Councilman Odierna said he constantly receives complaints about the lack of
enforcement. It appears the same people are doing the offenses and maybe with
added personnel it may help to enforce laws. He apologized for offending some of
the police personnel at the last meeting; it was not his intent and not what he
meant to do.
Councilwoman Wittner said she did not think the staff has been adequately trained
to deal with irate residents nor did she agree with the time which will have to be
spent in court by the staff and was, therefore, not in favor of this proposal.
Councilwoman Seligson said she was in favor of it. Quality of life is important to
our residents. There has been a lot of discussion on leaf blowers and organic
waste and we are asking our staff in the course of their duties to issue
summonses when they encounter infractions — as an adjunct to what they do.
Councilwoman Myers said she was not in favor as there were people in place
already to issue these summons. Adding this job to current staff takes time away
from what they do presently. The problem will improve just by adding another
Part Time Code Enforcement Officer and rely also on Police.
Supervisor O'Keeffe said she was in favor of the concept of having extra eyes out
issuing summons, which will alleviate problems with keeping our community

attractive. Giving out one or two summonses will help people catch on to the
problem, help with the quality of life issue, and adding an additional Code
Enforcement Officer should also help.
Then on motion of Councilman Odierna, seconded by Councilwoman Wittner, the
public hearing was unanimously closed.
On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, it was
Resolved, that the Town Board finds that the
adoption of the proposed local law regarding
Design Requirements in the Site Plan Law is
hereby declared to be a Type II action, which will
constitute an Unlisted Action with No Impact under
the New York State Environmental Quality Review
Act (SEQRA).

On motion of Councilman Odierna, seconded by Councilwoman Seligson, the
following local law was adopted:
Local Law No. 12-2004
This local law shall be known as the "Enforcement of the 'Quality
of Life' laws of the Town of Mamaroneck Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 - Purpose:
The Town of Mamaroneck has adopted numerous statutes
designed to maintain the high quality of life that the citizens of the
Town have always enjoyed. To maintain such standards requires
vigilance and the vigorous enforcement of these laws. The
purpose of this local law is to grant certain employees of the
Town the power to issue notices of violations and summonses for
violations of the "Quality of Life" laws of the Town of
Mamaroneck.
Section 2 -Adoption of a new chapter of the Mamaroneck Code:
The Code of the Town of Mamaroneck hereby is amended by
adding thereto a new chapter to be known as "Chapter 34 -
Quality of Life Laws - Enforcement" which reads as follows:

§ 34-4. Form and Content.
§ 34-1 Purpose
The Town of Mamaroneck has adopted numerous statutes
designed to maintain the high quality of life that the citizens of the
Town have always enjoyed. To maintain such standards requires
vigilance and vigorous enforcement of these laws. The purpose
of this local law is to grant certain employees of the Town the
power to issue notices of violations and summonses for violations
of the "Quality of Life" laws of the Town of Mamaroneck.
§ 34-2. Definitions
As used in this chapter, the following terms have the meanings
indicated:
ENFORCEMENT OFFICERS --- The persons serving in any of the
following positions in the Town of Mamaroneck: an Assistant
Building Inspector, a Code Enforcement Officer, the Director of
Buildings and Land Use Administration, the Environmental
Coordinator, a police officer, Senior Engineer(Civil), the
Superintendent of Highways and the Deputy Superintendent of
Highways (if such a position is created).
"QUALITY OF LIFE" LAWS - The following chapters and sections
of the Code:

§ 34-3. Enforcement
A. An Enforcement Officer is empowered to issue
summonses to be adjudicated by the Justice Court of the Town of
Mamaroneck for a violation of any of the "Quality of Life" laws.
B. The Enforcement Officer shall be required to give
written notice of the existence of a violation of a "Quality of Life"
law prior to issuing a summons in situations where such notice is
required.
C. Notwithstanding the provisions of§34-313 or any other
notice requirement of any law, ordinance, rule or regulation of the
Code, if, in the opinion of the Enforcement Officer, a violation
exists which creates an imminent threat to the life or health of any
individual or where construction, renovation, repairs or other
work is being performed without a license or permit and, under
the laws or ordinances of the Town of Mamaroneck, a license or

permit is required prior to the commencement of such work, a
summons may be issued immediately.
§ 34-4. Form and Content
The form of summons issued pursuant to this chapter shall be
governed by the New York Criminal Procedure Law and the New
York Uniform Justice Court Act and shall be subject to approval
by the Town Board. The content of such summons and the
method of prosecution thereunder shall be subject to the
aforementioned Criminal Procedure Law and Uniform Justice
Court Act as well as any other applicable law, rule or ordinance.
Section 3 -Amendment to existing sections of the Mamaroneck
Code:
A. Section 148-1 of the Code of the Town of Mamaroneck hereby
is amended by deleting the following words therefrom:
"ENFORCEMENT OFFICERS ---- The persons serving in any of the
following positions in the Town of Mamaroneck: an Assistant
Building Inspector, a Code Enforcement Officer, the Director of
Buildings and Land Use Administration, the Environmental
Coordinator, a police officer, the Superintendent of Highways, the
Superintendent of Recreation or the Town Administrator"
and substituting the following words in their place:
"ENFORCEMENT OFFICERS --- The persons described in section
34-2 of the Code plus the Superintendent of Recreation and the
Town Administrator.
B. Section 231-2 of the Code of the Town of Mamaroneck hereby
is amended by deleting the following words therefrom.
"ENFORCEMENT OFFICERS - The persons serving in the
following positions in the Town of Mamaroneck: any police
officer, the Director of Building Code Enforcement and Land Use,
the Assistant Building Inspector, the Superintendent of Highways,
the Deputy to the Superintendent of Highways (if such a position
created), the Code Enforcement Officer and the Environmental
Coordinator"
and substituting the following words in their place:
"ENFORCEMENT OFFICERS --- The persons described in section
34-2 of the Code.
Section 4 - Severability:
Should any provision of this Local Law be declared invalid or
unconstitutional by any court of competent jurisdiction, such
declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented
without the invalid or unconstitutional provisions.
Section 5 - Effective Date:
This Local Law shall become effective upon filing with the
Secretary of State.

Councilwoman Wittner added that 12 volunteers have qualified for the service
award.
Commissioner Odierna asked the Administrator if public meetings at the fire
house were available yet. Mr. Altieri said no, probably by the end of October.
There being no further business to come before the Commission, on motion of
Commissioner Odierna, seconded by Commissioner Myers, the Commission
unanimously adjourned at 8:45 PM.

AFFAIRS OF THE TOWN
1. Authorization — Transfer of Funds — Certiorari
The Administrator explained that temporary loans are necessary for the
payment of a settlement of Certiorari for Bonnie Briar Country Club.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board hereby
authorizes the loan of$69,494.62 through a
transfer of funds by the Comptroller to make
certiorari settlements for Bonnie Briar Country
Club from each department as follows:
Highway Fund $29,068.93
Fire District $24,715.62
Garbage District $15,713.07
Total $69,497.62

1A. Resolution regarding Wind Power
The Supervisor explained several communities have decided to buy power
from wind generated sources at a greater cost but should offset use of Con
Edison power. If we do this, it will enable the Town to win an award. She
suggested authorizing up to $2,000 and for Mr. Altieri to sign the agreement
subject to advice of counsel.
On motion of Supervisor O'Keeffe, seconded by Councilwoman Seligson, it
was
RESOLVED, that the Town Board does hereby
authorize the expenditure of up to $2,000 toward
the purchase of wind powered generated energy;
and
BE IT FURTHER,
RESOLVED, that the Town Administrator is
authorized to execute said agreement on behalf of
the Town subject to advice of counsel.

2. Set Public Hearing — Section 8 — Public Housing Administrative Plan
On motion of Councilwoman Myers, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board does
hereby set the date for public hearing on
the Section 8 Public Housing Plan for
October 6, 2004; and
BE IT FURTHER,
RESOLVED, that the Town Clerk is hereby
authorized to publish the notice of said
hearing in a newspaper appointed as an
official newspaper, and that said notice be
posted.

2. Authorization — Memorandum of Understanding —Westchester County
— Garden's Lakes
The Administrator outlined in a memo that this proposed agreement is for
improvements in the Sheldrake River and the Garden's Lake. The project will
include bank stabilization, pond restoration, installation of sediment control
structures and dredging to increase pond and lake storage volume. The
County will be responsible for the design of the project, bid preparation and
construction. The funding will be from a $1,000,000 grant from New York
State, a $600,000 subsidy from the County and the rest $488,000 to be funded
by the Town and the City of New Rochelle based upon allocation of work in
the project, with our portion amounting to $200,000. The Board discussed
changes in the paperwork.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board hereby
authorizes the Town Administrator, Stephen V.
Altieri, to enter into an agreement between the
County of Westchester and the Town of
Mamaroneck for improvements in the Sheldrake
River and the Garden's Lake.

4. Authorization - Extension of Maintenance Contract

This contract would provide for grass maintenance at the Hommocks Pool
and field. The contract requires the contractor to conduct spring and fall
cleanup, with a provision that the grass be mowed a minimum of three times
per month. Tony Corvino Landscaping was the low bidder in 2003 at $8,730
with a clause to extend the contract to 2005.
On motion of Councilman Odierna, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby
extend the contract with Tony Corvino
Landscaping for Grass Maintenance at the
Hommocks Pool & Fields for the year 2005 at a
rate of$8,730; and
BE IT FURTHER,
RESOLVED, that the Town Administrator is
authorized to execute said contract on behalf of
the Town.

5. Authorization — Installation of New Fire Hydrant— Boston Post Road
Mr. Altieri said that Westchester Joint Water Works is recommending that as
part of the new construction of the Webster Bank and Duane Reade a new fire
hydrant be installed in front of the new buildings. The cost for putting it in will
be handled by the construction company, but thereafter the yearly hydrant
rental fee of$425 will be the responsibility of the Town.
On motion of Councilwoman Wittner, seconded by Councilwoman
Seligson, it was
RESOLVED, that the Town Board does hereby
approve the installation of a new fire hydrant on
the Boston Post Road in front of the new Webster
Bank and Duane Reade, all costs of installation
shall be paid by them; and
BE IT FURTHER,
RESOLVED, that the Town will pay the cost of
$425 per year to Westchester Joint Water Works
for the annual rental of said hydrant.

6. Report of Bids — Highway Department Roof— TA-04-09
Mr. Altieri recommended rejecting all bids for this project as they all came in
substantially over what was budgeted. He suggested the Board re-bid the

project with revised specifications for only a section of the garage roof which
must be replaced.
Following discussion, on motion of Councilwoman Myers, seconded by
Councilwoman Seligson, it was
RESOLVED, that the Town Board does hereby
reject all bids for TA-04-09, Highway Department
Roof, as they were all over budget; and
BE IT FURTHER,
RESOLVED, that the specifications for the
Highway Department Roof be revised down to only
a portion of the roof then re-bid.
7. Authorization - Housing Inspection Contract— Public Housing Agency
In a memo the Administrator explained authorization to enter into a contract
with Quality Inspection Services to conduct housing inspections outside of
the Town of Mamaroneck as required for the Section 8 Housing Program. The
Housing office is short staffed and rather than hire a part time employee, Anna
Danoy discovered a company with experience in certifications. The fee for
the basic inspection is $40 and will be funded by Section 8 administrative
funds.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby
authorize the Town to enter into an agreement
with Quality Inspection Services for them to certify
Section 8 housing units at a cost of$40 per unit,
said costs to be paid from Section 8 administrative
funds; and
BE IT FURTHER,
RESOLVED, that the Town Administrator is
authorized to execute said agreement on behalf of
the Town.
8. Amended Appointment Resolution — Town Comptroller
Supervisor O'Keeffe said the resolution passed at the last meeting appointing
the Town Comptroller needs to be amended to coincide his term with that of
the Town Supervisor.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that Denis J. Brucciani is
hereby appointed Comptroller of the Town
of Mamaroneck for a term of commencing
September 13, 2004, terminating on
December 31, 2005.

RESOLVED, that the Town Board does authorize
the appointment of Joseph Russo to serve as a
Part Time Code Enforcement Officer for the
Building Department at a salary of$15 per hour.

the rate of$16 per hour.

10. Resolution — Family Day
Councilwoman Myers read the following resolution into the minutes:
PROCLAMATION
FAMILY DAY
WHEREAS, the use of illegal drugs and the abuse of alcohol and nicotine
constitute the greatest threats to the well-being of America's children;
WHEREAS, surveys conducted by The National Center on Addiction and
Substance Abuse (CASA) at Columbia University have consistently found that
the more often children and teenagers eat dinner with their families the less
likely they are to smoke, drink and use illegal drugs;
WHEREAS, teenagers who virtually never eat dinner with their families are 72
percent more likely than the average teenager to use illegal drugs, alcohol and
cigarettes;
WHEREAS, teenagers who almost always eat dinner with their families are 31
percent less likely than the average teenager to use illegal drugs, alcohol and
cigarettes;
WHEREAS, the correlation between family dinners and reduced risk for teen
substance abuse are well documented;
WHEREAS, parental influence is known to be one of the most crucial factors in
determining the likelihood of substance abuse by teenagers;
WHEREAS, family dinners have long constituted a substantial pillar of family life
in America:
NOW THEREFORE, BE IT
RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of
Mamaroneck and the Town Board members, hereby proclaim the fourth week of
September as

On motion of Councilwoman Wittner, seconded by Councilwoman
Seligson, it was
RESOLVED, that the Town Board does approve the
minutes of July 7, 2004 Work Session as amended.

August 2, 2004
On motion of Councilwoman Myers, seconded by Councilman Odierna, it was
RESOLVED, that the Town Board does approve the
minutes of August 2, 2004 Work Session as amended.

Councilwomen Wittner and Seligson were both on vacation when this meeting
was held.
ORAL COMMUNICATIONS
George Latimer, County Legislator, said he had been contacted by residents
from Hommocks Road and Oak Lane again regarding removing them from the
sewer district. They pay taxes for it, yet are not hooked up. To make this
change it must first be approved by the Town Board. He asked if the matter
could be put on the agenda for a future meeting. He added the Department of
Health is not anxious to do this.
Mr. Altieri said there is a concern that the Town be made to put in sewers. Mr.
Latimer said if the County mandates it, then the County sewer district should
have to pay for it.
Mr. Altieri replied this would force the evaluation by the County whether to put
in sewers — rather than just taking them out of the sewer district.
Mr. Latimer stated if the Town Board chooses not to act then it ends there.
These groups are rallying to be removed because they do not have sewer
hookups.
Supervisor O'Keeffe asked Mr. Latimer if he could see about the issue with
Saxon Woods regarding making the part in the Town a recreation area for
soccer and/or baseball.
Mr. Latimer said he would lobby for it but that he does not have the ultimate
power to give it. He would look for it in the budget.
Betty Miller, Larchmont Civics Association, stated that she is delighted to see
some things happening with Garden Lake. She had a few other concerns.
Cooper Lane is a heavily trafficked road with parking problems. People are
parking on the curve forcing others to go into the adjoining lane. People
seem to be ignoring the no parking signs. They need to be enforced. There
also is a pot hole at the bottom of Cooper which seems to be growing, and
there is a no parking between sign there with no other sign. We are also
worried about the huge Verizon boxes being put in.
Supervisor O'Keeffe said the Board is on that and is having staff meet with
Verizon tomorrow. Ken Bialo has written to them; the boxes are being put up

all over the place. We are trying to determine if we have the authority to have
them removed.
Ms. Miller then said the bathrooms at Memorial Park are not being cleaned
and the attendant is scary to the kids and rude. There also is a swimming
pool attendant who is very unfriendly.
Ms. Miller said there will be a Halloween Party sponsored by them on October
30 and there will be a costume parade.
SUPERVISOR REPORTS
The Supervisor said she had met with Senator Leibell and Assemblywoman
Galef regarding improving the state budget and increasing bi-partisan efforts.
REPORTS OF THE COUNCIL
Councilwoman Wittner announced there will be Clean Up Household Chemical
Day at Rye Playland on Friday, November 5, and Saturday, November 6. The
newspaper gave a list of items allowed.
Councilman Odierna said that when he was trying to get down a street he was
forced to turn around because of sidewalk construction. He suggested a sign
be put up warning people that the road was blocked before traveling all the
way down.
Councilwoman Myers had a traffic meeting last night where there were
complaints about speeding and stop signs not being observed. The blinking
lights on Murray Avenue are up and we will be having a hearing on Bryson at
the next Town Board meeting. Councilwoman Myers was missing Board of
Architectural Review tonight. Tomorrow morning there is a meeting for Cable
TV Board of Control.
Councilwoman Seligson attended the Planning Board Meeting where they
discussed the floor area ratio law and many people think it might allow
houses to be built that are too large.
Councilman Odierna added that a Recreation Meeting will be held on August
14, and the Pool is open.
The Supervisor asked to adjourn in memory of Michael Pinto Sr., father of our
lead mechanic.
