BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Judith A. Myers Councilman Ernest C. Odierna ABSENT: Councilwoman Phyllis Wittner Councilwoman Nancy Seligson The Supervisor said both of the Councilwomen were away on vacation. ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 10:30 AM. She then pointed out the location of exits. She said the Board convened a work session at 9:30 AM to discuss water rate increases, conservation encroachments, and code enforcement. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe and on motion of Councilwoman Myers, seconded by Councilman Odierna, the Board of Fire Commissioners was unanimously declared open. Present were the following members of the Commission: Commissioner: Valerie M. O'Keeffe Commissioner: Judith A. Myers Commissioner: Ernest C. Odierna 1. Salary Authorization — Firefighters The Administrator explained there are two vacancies in the Fire Department caused by retirements. There is an agility test we thought could be taken by anyone, but we have since learned from the County that we can only send people who have been authorized. He requested authorization for two firefighters at a salary of$36,965. The Fire Department will ultimately decide on who the appointees will be. On motion of Councilwoman Myers, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does authorize the salary of two fire fighters at a rate of$36,965 per year. There being no further business to come before the Commission, on motion of Commissioner Myers, seconded by Commissioner Odierna, the Commission unanimously adjourned. 2 August 2, 2004 AFFAIRS OF THE TOWN 1. Update Volunteer Ambulance Corps Construction Project Mr. Altieri reported the building construction is ahead of schedule, and noted because the original plan had to be resited the landscaping has become more imperative. There was then a discussion on the construction. 2. Approval of Certiorari On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby approve the following Settlement of Certiorari as recommended by the Town Attorney: 306 Fayette Avenue Realty, Inc 306 Fayette Avenue, Mamaroneck Block 831, Lot 48 Town/Village of Mamaroneck Reduced Year Assessment Amount of Reduction Assessment 1993 $120,600 $71,300 $49,300 1994 $120,000 $71,100 $49,500 The above resolution was put to a roll call vote: Odierna - Aye Myers - Aye O'Keeffe - Aye 3. Authorization —Agreement Winged Foot Golf Club —Amateur Golf Open Mr. Altieri said Winged Foot would be hosting the USGA Amateur Golf Open from August 13 to August 22, 2004. The Town has an agreement for providing police and ambulance services at the event. They will pay $7,500 to have the ambulance on site during the Open and pay for both on-duty and off-duty police, including paying full reimbursement for any overtime incurred. Mr. Altieri recommended approval. There was discussion on notification to residents of the area, especially if there was to be a no parking zone during the event. On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby approve the agreement with the Winged Foot Gold Club to provide Police and Ambulance services at a cost to be fully reimbursed by them; and BE IT FURTHER, RESOLVED, that the Town Administrator is authorized to execute said agreement on behalf of the Town. 3 August 2, 2004 The above resolution was put to a roll call vote: Odierna - Aye Myers - Aye O'Keeffe - Aye 2. Authorization — Temporary Parking Ban —Amateur Golf Open On motion of Councilman Odierna, seconded by Councilwoman Myers, the following resolution was unanimously adopted: Whereas the Winged Foot Golf Club will be hosting the 2004 United States Golf Association Amateur Golf Championship from August 18 through 22, 2004; and Whereas, to minimize traffic congestion on the streets in the vicinity of Winged Foot, it is necessary to ban on-street parking during part of each day on which the Championship will take place. NOW THEREFORE, BE IT RESOLVED, that between the hours of 6:30 AM and 3:00 PM on August 16, 17, 18, 19, 20, 21 and 22, 2004, no parking will be allowed on the streets listed below: Rockland Avenue, Fenimore Road, Old White Plains Road, Winged Foot Drive, Durham Road, Avon Road, Griffen Avenue, Carriage House Lane, Stonewall Lane, Gatehouse Lane, Wagon Wheel Road, Fairway Drive, Magnetti Circle, Poccia Circle, Country Road, Dudley Lane and Boulder Brae Lane; and BE IT FURTHER RESOLVED, that the Police Department of the Town of Mamaroneck shall have the authority to cause any motor vehicle violating this temporary ban on parking to be towed away at the owner's expense. Authorization — Transfer of Funds — Bonnie Briar Certiorari This matter was held over. 4 August 2, 2004 6. Approval of 2005 Budget Calendar The Administrator outlined the calendar for the upcoming meetings on the budget; he noted that meetings may be added or changed as needed. On motion of Councilwoman Myers, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby set the dates for meetings on the 2005 Budget as follows: Monday, July 26, 2004 Issue work papers to Department Heads. Monday, September 13, 2004 Submission of Budget Requests by Department Heads. September 15-September 29, Departmental Budget Review by Budget Officer. 2004 Wednesday, October 20, Submission of 2004 Tentative Budget to Town 2004 Board by Town Clerk. Wednesday, October 27, Public Work Session - Overview of Tentative 2003 Budget. Friday, November 5, 2004 Public Work Session - Operating Departments. Wednesday, November 10, Public Work Session - Capital Budget. 2004 Thursday, November 18, Public Work Session - Finalize preliminary 2004 budget Wednesday, December 1, Preliminary Budget Public Hearing. 2004 Wednesday, December 15, 2005 Budget Adoption. 2004 The above resolution was put to a roll call vote: Odierna - Aye Myers - Aye O'Keeffe - Aye 7. School Tax Warrant The Administrator's approval was needed for the taxes to be collected for both the school taxes for Mamaroneck and part of the Scarsdale district. On motion of Councilman Odierna, seconded by Councilwoman Myers, the following tax warrants were approved for collection: TOWN OF MAMARONECK SCHOOL TAX WARRANT FOR THE YEAR 2004 STATE OF NEW YORK COUNTY OF WESTCHESTER TO: Receiver of Taxes of the Town of Mamaroneck in said County YOU ARE HEREBY COMMANDED, to receive and collect from several persons named in the assessment roll of the Union Free School District in the Town of Mamaroneck, hereunto annexed and herewith delivered to you, the sum of the School Taxes of said School District set opposite their respective names in accordance with provision of Chapter 852 of the Laws of 1948 (Title 16) and the 5 August 2, 2004 acts amendatory thereof and supplemental thereto including the amendment made by Chapter 386 of the Laws of 1962 and the resolution adopted by the Town Board of the Town of Mamaroneck on August 2, 2004. Recreation 7 August 2, 2004 Highway Department On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does authorize the promotion of Anthony Buonnano to Automotive Mechanic effective August 2, 2004 at a salary of $53,035 per year. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Engineering Department On motion of Councilwoman Myers, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does authorize the promotion of David Goessl to the position of Senior Engineer effective July 30, 2003 at a salary of$66,055 per year. Recreation On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that as provided for in the 2004 Town Budget the Town Board does hereby authorize the payment of salary to the following: Donato J. Callara, Diving Coach, Hommocks Pool, $1,200/season July 1 to August 13. Sam Selonick, Key Attendant, Hommocks Pool, $7.50/hour, retroactive to July 12, 2004. Chris Byron, Games Specialist/Health Director, Monroe Pre School, $270/week, retroactive to June 28, 2004. Christopher Avery, Counselor, Monroe Pre School, $165/week, retroactive to July 12, 2004. Tananshe Campbell, Counselor, Monroe Pre School, $180/week, retroactive to July 12, 2004 Christine Visa, Counselor, Hommocks Playground Program, $200/week, retroactive to July 19, 2004. Larry Oberman, Substitute E.M.T., Central Pre School, $10/hour, retroactive to July 19, 2004 Scott Schwartz, Tennis Instructor, $10/hour, retroactive to July 12, 2004. Councilwoman Myers noted that Scott Schartz, Tennis Instructor, is her son. The above resolution was put to a roll call vote: Odierna - Aye Myers - Aye O'Keeffe - Aye APPROVAL OF MINUTES — March 31, 2004 On motion of Councilwoman Myers, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby approve the minutes of March 31, 2004 as amended. The above resolution was put to a roll call vote: Odierna - Aye Myers - Aye O'Keeffe - Aye ORAL COMMUNICATIONS Frank DeCabia, Cabot Road, said he was here in the past and again today to ask for help with the flooding at his house. He has done everything possible including building a wall in front which prevents the water from coming in the front, but it now is coming through the back. When it floods they are forced to relocate his daughter and granddaughter who both live in the lower part of the house. His granddaughter gets hysterical now whenever it rains. He said he doesn't know what else he can do and needs help. Supervisor O'Keeffe said they talked with officials in Larchmont about keeping the pipe clean and have some ideas about a retention basin but have to obtain permission from the owner of the property. There was a discussion about the owner where the retention basin would go being ten years behind on taxes. Councilwoman Myers reassured Mr. DeCabia of the Town's concern and that they are working on possible solutions. 9 August 2, 2004 The Supervisor said because the property is not located in a flood zone, the DeCabia's are not able to obtain flood insurance and the Town has contacted FEMA to help rectify this. Mr. Cabia questioned how the house was allowed to be built three feet below grade. He also said if there was anything he could do to help the Town alleviate his flooding to let him know. SUPERVISOR REPORT Supervisor O'Keeffe said the concert was not able to be held in the park, but was moved to the Hommocks. It was excellent. They had an Elvis Impersonator. The second concert was also moved. REPORTS OF THE COUNCIL Councilwoman Myers attended the movie in the park and had a good time. The Recreation Department did a good job. The Supervisor said the Town had again received a triple A bond rating by Moody's. Councilwoman Myers said Moody's said the Town was a stable affluent suburb of the city, a sound investment. Councilwoman Myers said someone had a heart attack at the Sports Club. Police Officer Anthony Hoffman arrived and because he had a defibrillator in the car was able to save this person's life. There is presently a bill pending requiring defibrillators be available in all health clubs with more than 500 members. Councilman Odierna said his son had entered a Four-Mile Swim Across America event with 500 participants. They raised over$800,000. There were 100 kayakers and many swimmers. ADJOURNMENT The Supervisor announced the next meetings of the Town Board are on September 8, 2004 and September 22, 2004 Then on motion and second the meeting was adjourned unanimously at 12:30 PM.
