BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM. She then pointed out the location of exits. The Supervisor said the Board had convened into a Work Session at 5:30 PM to discuss zoning on the Boston Post Road and review the resident survey. PUBLIC HEARINGS -Amendment to Income Limits: Property Tax Exemptions for Disabled Persons -Amendment to the Zoning along the Boston Post Road Environs On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the public hearing was declared open. The following notice of Public Hearing was entered into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday June 2, 2004 at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider adoption of an "Amendment to the Zoning along the Boston Post Road and Environs" Law. The full text of this Local Law may be examined and copies obtained at the Town Clerk's Office during regular business hours (Monday through Friday, 8:30 AM to 4:30 PM or until 4:00 PM during June, July and August) at 740 W. Boston Post Road, Mamaroneck, New York. PLEASE TAKE FURTHER NOTICE, that at said Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments prior thereto. The Supervisor asked if anyone wished to speak for or against this amendment. No replies. 1 June 2, 2004 Councilman Odierna asked if this exemption applies to all taxes: County, School and Town. The Administrator said that each of those government units had also adopted this. There being no further comment on motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was unanimously closed. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was Resolved, that the Town Board finds that the adoption of the proposed local law regarding raising the income guidelines for the Disabled tax exemptions is hereby declared to be a Type II action, which will constitute an Unlisted Action with No Impact under the New York State Environmental Quality Review Act (SEQRA). The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye On motion of Councilwoman Myers, seconded by Councilwoman Wittner, the following was adopted: Local Law No. 11-2004 This local law shall be known as "The 2004 Amendment to the Persons with Disabilities and Limited Incomes Tax Exemption" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows: Section 1 - Purpose: The purpose of this local law is to amend Section 195-31 of the Code of the Town of Mamaroneck to conform that section of the Code, as it relates to real property tax exemptions for persons with disabilities and limited incomes to the recent amendments to Section 472.11 of the Laws of Westchester County made by Westchester County's Local Law No. 15 of 2003. Section 2 -Amendment: 1. Section 195-31 of the Code of the Town of Mamaroneck hereby is repealed in its entirety and the following substituted in its place: Except as provided in § 195-31 of this article, where the owner of real property is a person with disability, or are one or more persons, both of whom have disabilities, or is a husband, wife, or both, and one of them is a person with a disability, or are siblings, at least one of whom has a disability and the income of the person with the disability is limited by reason of such disability, that real property shall be exempt from taxation by the Town of Mamaroneck to the extent set forth in the following table, provided an application for such exemption is made in accordance with the provisions of this article: 2 June 2, 2004 Annual Income Percentage of Assessed Valuation Exempt From Taxation $0 to $24,000.00 50% $24,000.01 to $24,999.99 45% $25,000.00 to $25,999.99 40% $26,000.00 to $26,999.99 35% $27,000.00 to $27,899.99 30% $27,900.00 to $28,799.99 25% $28,800.00 to $29,699.99 20% $29,700.00 to $30,599.99 15% $30,600.00 to $31,499.99 10% $31,500.00 to $32,399.99 5% $32,400.00 and above 0% Section 3- Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law which may be implemented without the invalid or unconstitutional provision. Section 4 - Effective Date: This Local Law shall become effective immediately upon its filing in the office of the secretary of state of the State of New York. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Public Hearing -Amendment to the Zoning along the Boston Post Road Environs The Town Attorney explained the Board had requested major revisions which resulted in substantial changes; therefore, the revised law may have to go back to the Planning Board for comment. It was decided to take no further action on the amendment at this time. The Public Hearing was closed. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe and on motion of Councilman Odierna, seconded by Councilman Wittner, the Board of Fire Commissioners was unanimously declared open. Present were the following members of the Commission: Commissioner: Valerie M. O'Keeffe Commissioner: Phyllis Wittner Commissioner: Judith A. Myers 3 June 2, 2004 Commissioner: Ernest C. Odierna Commissioner: Nancy Seligson 1. Fire Claims Commissioner Odierna presented fire claims for authorization of payment, thereafter on Commissioner Odierna's motion, seconded by Commissioner Wittner, it was RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office as amended: American Gun & Uniform Supply $1,127.39 AT&T 222.20 Avaya 51.89 IOS Capital 170.93 Joseph Mirabella 58.56 Motorola 78.00 Nextel 280.07 R&L Consulting 41 .35 Verizon 325.83 TOTAL $2.356.22 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 2. Other Fire Department Business Commissioner O'Keeffe said the Department held a parade and ceremony at the firehouse honoring deceased firefighters. There was then a bad accident on 1-95, and they all responded. Commissioner O'Keeffe also thanked the Fire Department for providing sleeping quarters to the VAC personnel during construction of the Ambulance building. It was also noted by Commissioner Wittner that there was an excellent turnout for Memorial Day services and for the parade. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Myers, the Commission unanimously adjourned at 8:45 PM. AFFAIRS OF THE TOWN 1. Bond Resolution — Traffic Signal: Myrtle Boulevard/Chatsworth Avenue. The Town Clerk explained this Bond resolution had been adopted at a prior meeting, but the newspaper made a mistake in publication dates. It was necessary, consequently, to readopt and republish it. $125,000 Serial Bonds — Traffic Signals 4 June 2, 2004 At a regular meeting of the Town Board of the Town of Mamaroneck, Westchester County, New York, held at the Town Center, in Mamaroneck, New York, in said Town, on June 2, 2004 at 8:15 o'clock PM., Prevailing Time. The meeting was called to order by Supervisor O'Keeffe , and upon roll being called, the following were PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith Myers Councilman Ernest Odierna Councilwoman Nancy Seligson ABSENT: NONE The following resolution was offered by Councilperson Wittner who moved its adoption, seconded by Councilperson Myers , to-wit: BOND RESOLUTION DATED JUNE 2, 2004. A RESOLUTION AUTHORIZING THE ISSUANCE OF $125,000 SERIAL BONDS OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, TO PAY THE COST OF THE PURCHASE AND INSTALLATION OF TRAFFIC SIGNALS AT VARIOUS LOCATIONS THROUGHOUT AND IN AND FOR SAID TOWN. WHEREAS, all conditions precedent to the financing of the capital project hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; and WHEREAS, it is now desired to authorize the financing of such capital project; NOW THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. For the class of objects or purposes of paying the cost of the purchase and installation of traffic signals at various locations throughout and in and for the Town of Mamaroneck, Westchester County, New York, including incidental expenses in connection therewith, there are 5 June 2, 2004 hereby authorized to be issued $125,000 serial bonds of the Town of Mamaroneck, Westchester County, New York, pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the maximum estimated cost of such class of objects or purposes is $125,000, and that the plan for the financing thereof is by the issuance of the $125,000 serial bonds of the Town of Mamaroneck, Westchester County, New York, authorized to be issued pursuant to this bond resolution. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid class of objects or purposes is twenty years, pursuant to subdivision 72(a) of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 5. The faith and credit of said Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such obligations as 6 June 2, 2004 the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year. There shall annually be levied on all the taxable real property of said Town a tax sufficient to pay the principal of and interest on such obligations as the same become due and payable. Section 6. Such bonds shall be in fully registered form and shall be signed in the name of the Town of Mamaroneck, Westchester County, New York, by the manual or facsimile signature of the Supervisor and a facsimile of its corporate seal shall be imprinted or impressed thereon and may be attested by the manual or facsimile signature of the Town Clerk. Section 7. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as he or she shall deem best for the interests of the Town; provided, however, that in the exercise of these delegated powers, he or she shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 8. All other matters, except as provided herein relating to such bonds, including determining whether to issue such bonds having substantially level or declining annual debt service and all 7 June 2, 2004 matters related thereto, prescribing whether manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds, appointing the fiscal agent or agents for said bonds, providing for the printing and delivery of said bonds (and if said bonds are to be executed in the name of the Town by the facsimile signature of its Supervisor, providing for the manual countersignature of a fiscal agent or of a designated official of the Town), the date, denominations, maturities and interest payment dates, place or places of payment, and also including the consolidation with other issues, shall be determined by the Supervisor. It is hereby determined that it is to the financial advantage of the Town not to impose and collect from registered owners of such serial bonds any charges for mailing, shipping and insuring bonds transferred or exchanged by the fiscal agent, and, accordingly, pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent. Such bonds shall contain substantially the recital of validity clause provided for in section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by section 52.00 of the Local Finance Law, as the Supervisor shall determine. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150 - 2, Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 10. The validity of such bonds and bond anticipation notes 8 June 2, 2004 may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, any action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 11. Upon this resolution taking effect, the same shall be published in full in The Journal News, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. Section 12. This resolution is adopted subject to permissive referendum in accordance with Section 35.00 of the Local Finance Law. The question of the adoption of the foregoing resolution was duly put to a vote on roll call which resulted as follows: Councilwoman Seligson VOTING AYE Councilman Odierna VOTING AYE Councilwoman Myers VOTING AYE Councilwoman Wittner VOTING AYE Supervisor O'Keeffe VOTING AYE The resolution was thereupon declared duly adopted. 2. Resolution RE: Ratification of Town Board Meeting Dates. On motion of Councilwoman Seligson, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby set the dates of their meeting during the summer months as follows: 9 June 2, 2004 Thursday, June 17, 2004 at 8:15 PM Wednesday, July 7, 2004 at 8:15 PM Monday, August 2, 2004 at 8:15 PM The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 3. Salary Authorizations: Conservation Corp. A communication was received from Elizabeth Paul, Environmental Coordinator, requesting authorization to hire eight (8) people as conservation workers during the summer. They would help to clean and woodchip the trails, repair and build catwalks, cut back brush and perform various other duties. She noted they would be all paid at the rate of$8.50 per hour, except the Crew Leader, who would receive $9 an hour. Councilwoman Seligson said she is pleased with the work these crews perform; the Town is in good condition, it's a coveted job and we all benefit from it. Councilwoman Wittner added that many of these workers come back year after year. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does authorize the appointments of Crew Workers for the Conservation Department as follows: Andrew Sanders, Crew Leader, $9 per hour, effective July 7 to August 20, 2004 Michael Ladner, Crew Worker, $8.50 per hour, effective July 7 to August 20, 2004 Brian Padgett, Crew Worker, $8.50 per hour, effective July 7 to August 20, 2004 Evan Palmer-Young, Crew Worker, $8.50 per hour, effective July 7 to August 20, 2004 Adam Kriesberg, Crew Worker, $8.50 per hour, effective July 7 to August 20, 2004 Edward Forsyth, Crew Worker, $8.50 per hour, effective July 7 to August 20, 2004 Yonatan Rabino, Crew Worker, $8.50 per hour, effective July 7 to August 20, 2004 Amine EI-Amraoui, Crew Worker, $8.50 per hour, effective July 7 to August 20, 2004 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Administrative Intern On motion of Councilwoman Seligson, seconded by Councilwoman Myers, it was 10 June 2, 2004 RESOLVED, that the Town Board does authorize the appointment of Jonathan Bingman, as a temporary summer intern effective June 2, 2004 at the rate of$10 per hour. Donald O'Connell, United States Air Force The Supervisor read the proclamations: PROCLAMATION FIRST BAPTIST CHURCH - 80TH ANNIVERSARY WHEREAS; May 2004 marks the 80th Anniversary of the First Baptist Church in Mamaroneck; and WHEREAS; the First Baptist Church is the second oldest African American Church in Mamaroneck. In the year of 1929 seven individuals organized "The Lovely Hill Mission" under the leadership of the Reverend Samuel Canty of New Rochelle. Through the faith and hard work of a few the church began to grow. In 1938, the property at 817 Howard Avenue, Mamaroneck was purchased and a church building was erected; and WHEREAS; Under the present pastorate of the Reverend James E. Taylor the church participates in health fairs, food and clothing drives and is active in supporting better and affordable housing for all of Mamaroneck citizens; and WHEREAS; Members of our community, irrespective of faith, color or socio- economic status have a great regard for the Reverend James E. Taylor, present Pastor of the First Baptist Church. Reverend Taylor has become a unifying force and an exceptional leader in his tireless efforts to bring people together through love and understanding. NOW, THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor, and the members of the Town Council of the Town of Mamaroneck do hereby proclaim Sunday, May 23, 2004, the First Baptist Church Day in the Town of Mamaroneck. DiCioccio, Town Clerk PROCLAMATION LIEUTENANT DONALD O'CONNELL WHEREAS; Lieutenant Donald O'Connell died in a fighter training accident in 1968; and WHEREAS; On June 10, 1954 Lieutenant O'Connell with great presence of mind and exceptional dexterity and courage piloted his plane into Larchmont Harbor, where he was forced to abandon it, but not until he had avoided all possible damage; and WHEREAS; The United States Air Force awarded Lieutenant O'Connell the Distinguished Flying Cross for his outstanding fortitude and selfless concern for his fellow man. NOW THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor, and the members of the Town Council of the Town of Mamaroneck do hereby proclaim that June 10, 2004 be hereby declared as Lieutenant Donald O'Connell Day in the Town of Mamaroneck. Sincerely, Bob Martin Debra Lazarus Executive Director Program Coordinator Dear Valerie, On behalf of the Board and Staff of Sheldrake Environmental Center, we would like to extend a special thanks to the Highway Department for the clean up of our grounds just before our Annual Spring Festival held on May 2"d - Foreman Tony Fiera and his crew - Donato Colantonio and Giovanni Bianco - all did a wonderfiul job with our property and should he commended for making the grounds look so perfect. Foreman Alan Casterella also helped us address some last minute emergencies that left the area unsafe and we needed immediate attention. He quickly sent Al Cirillo, John Phillipson, Jim Guinee and Roger Guterrez to make our property safe and clean up all of the debris. There was also last minute rain damage to a stone wall that John Barreto took care of personally. You really have a wonderful staff. Please extend a thank you to them all! Sincerely, Bob Martin Debra Lazarus Executive Director Program Coordinator ORAL COMMUNICATIONS A resident of Rockland Avenue was here on behalf of the Larchmont Gardens Civic Association. She said there were complaints about people putting up signs looking for work, which look terrible. And there are six lights out on Fernwood and Little Farms Road. REPORTS OF THE COUNCIL Councilwoman Seligson said she had attended many Memorial Day events, starting with the parade held on Thursday night. There was a ceremony at the Kemper Memorial on Sunday; then a service was held in Memorial Park which was very moving. There was the parade in the Village of Mamaroneck and attended a breakfast at the VFW. She attended a Zoning meeting last week and realized how difficult a job it is for the members to balance everyone's rights. They deserve credit for a fine job, very impressed with them, and she thanked all the members. Councilwoman Myers said the LMC/TV video awards were held last week. They were a delight to attend. She also attended all the Memorial Day events. She went to the Board of Architectural Review meeting where they reviewed the North Fork Bank application. The Traffic Committee meeting was postponed and will be held at the end of the month. 15 June 2, 2004 Councilwoman Wittner attended the Memorial Day events on May 30th and 31St and the Coastal Zone Management Meeting held on May 25th where they discussed the referral of North Fork Bank. She read a Long Island Sound Watershed Intermunicipal Council communication regarding a joint grant application from the Mayor of Scarsdale stating they will be receiving $100,000 on behalf of the eight communities that are part of this joint grant. She thanked Scarsdale for taking the lead and said it will take a great deal of cooperation to form this stormwater utility district. Councilman Odierna attended the graduation ceremony of the Cub Scouts who will now be Boy Scouts. It was a great evening watching them become good citizens. He said Human Rights will be hosting a program on how to mediate a human rights incident and will be holding its meeting at the end of this month. He asked if he could get a copy of a report of summonses issued on recycling. ADDED ITEM Set date of Special Executive Session. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for a special Executive Session of the Board for June 11, 2004 at 9:00 AM in Conference Room A of the Town Center.
