BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:25 PM. She then pointed out the location of exits. The Supervisor said the Town Board had convened at 5:00 PM into a Work Session to discuss Phase II Storm Water Annual Report, Property Revaluation, Boston Post Road Zoning DGEIS, Murray Avenue School Traffic, and the Parks and Fields Law. They then commenced into Executive Session to discuss Personnel and Certiorari. PUBLIC HEARINGS -Amendment to BMUB Zone - (To be adjourned to June 2, 2004). BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:30 PM and on motion of Councilwoman Wittner, seconded by Councilman Odierna, the Board of Fire Commissioner was unanimously declared open. There being no further business to come before the Commission, on motion of Commissioner Seligson, seconded by Commissioner Wittner, the Commission unanimously adjourned at 8:35 PM. 2 May 5, 2004 Supervisor O'Keeffe informed the Board members that Carmine DeLuca, Comptroller and Treasurer of the Village of Larchmont, has announced his retirement effective October 1, 2004 from both those positions. He also served as Treasurer of the Joint Garbage Commission. She wished him well and thanked him very much for his years of service. AFFAIRS OF THE TOWN 1. Authorization — Employees Assistance Agreement Westchester County The Administrator explained that the previous agreement approved by the Town Board had contained an incorrect amount for each employee. The fee was actually raised from $25 per employee to $30. The change will cost the Town an additional $625 for 2004, and he then recommended the approval. RESOLVED, that the Town Board does hereby approve the agreement between the Town of Mamaroneck and the Westchester County Employee Assistance Program to provide consultation and counseling of employees; and BE IT FURTHER, RESOLVED, that the cost for the program is $30 per employee at a total cost to the Town of$3,750; and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization — Land Records Access Agreement Westchester County Mr. Altieri explained there is presently a backlog in the land records of eight months. In order to make the records obtainable, the county is proposing a public viewer be made available in the Assessor's office to give them access to more current information. He said there would be no cost to the Town. Following discussion, on motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby authorize the agreement with Westchester County for access to the Land Records Public Viewer; and 3 May 5, 2004 BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the town. Authorization — Refrigeration Equipment Maintenance Contract— Hommocks Ice Rink A communication was received from Jill Fisher, Superintendent of Recreation, recommending the Town accept the proposal made by Eagle Air Systems to provide maintenance to the Hommocks Park Ice Rink equipment including the HVAC Equipment. The Administrator explained that when the proposals are broken down, Eagle Air is actually the cheapest. In addition to maintenance, both scheduled and unscheduled, they would perform the start-up and shutdown of the equipment. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby award the maintenance contract for Hommocks Park Ice Rink to Eagle Air Systems I, Goshen, New York; and BE IT FURTHER, RESOLVED, that the Town Administrator is authorized to execute said contract on behalf of the Town. Amendment to Income Limits — Property Tax Exemptions for Senior Citizens Parks & Fields Law On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on 4 May 5, 2004 the proposed legislation for regulations for use of Parks and Fields for May 18, 2004; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. b. Parking Prohibition — Murray Avenue/Forest Avenue On motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was: RESOLVED, that the Town Board does hereby set the date for public hearing on legislation to create a no parking zone on Forest and Murray Avenues for May 18, 2004; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. Amendment to Site Plan Law— Design Requirements On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the Site Plan Law— Design Requirements for May 18, 2004; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. Amendment to Income Limits — Property Tax Exemptions for Senior Citizens On motion of Councilwoman Myers, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the new guidelines for tax exemptions for Senior Citizens for May 18, 2004; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said 5 May 5, 2004 hearing in a newspaper appointed as an official newspaper, and that said notice be posted. ORAL COMMUNICATIONS George Roniger reported he had been told that a person living next to a neighbor who had applied for a zoning variance was never notified. He said the Spring Fling was a success; they had great weather and a large turnout. The Larch mont/Mamaroneck Civics Association would be holding their annual meeting on May 11, 2004 where there would be a presentation on what's happening with the duck pond. Councilwoman Myers said the procedure for notifications on variances is that the applicant is to notify people within a certain area and an affidavit is given to the Building Department. The Supervisor said she would look into this. SUPERVISOR REPORTS Supervisor O'Keeffe said she had attended two events. The Westchester Task Force on Child Abuse was sponsored by the Mental Health Association and other organizations. They presented awards, one of which went to our Detective Thomas Gisson. The second was a nice ceremony honoring Marty King, deceased former Town Justice. It was organized by the PBA, Denise Cookingham and Lillian Robustelli. There was a bag piper and representatives from all departments within the Town. Judges Battalia and Breschia from the Town spoke as did Judges Sirlin and Lanza from the Village of Mamaroneck. She also attended a meeting held by Andy Spano, who gave the State of the County address on April 29. He announced his accomplishments, citing seniors, children, terrorism, his attempts at getting the county removed from being mandated to provide Medicaid, which is one of only a few states where it's required. REPORTS OF THE COUNCIL Councilman Odierna reported he had attended on Sunday the Spring Festival held by the Sheldrake Environmental Center. There had been music from the High School Band and an ice cream social. He also attended on Saturday the house tour in Larchmont followed by the reception afterwards and said it was a wonderful experience. The Human Rights Commission did not meet. Councilwoman Wittner had attended the Coastal Zone Management Commission and the Fire Council Meeting. She announced that Friday, May 7, was Household Chemical Cleanup Day from 5 to 8 PM; items should be brought to FDR Park in Yorktown Heights, and there will be various other dates and places. There will be 8 May 5, 2004 a 3 I Annual `No Pesticides Day.' She said there was to be a new event called Spring Sting Clean-Up Day held June 11 and 12, 2004. Councilman Odierna interjected that the Mayor of Larchmont, Ken Bialo, had started a procedure whereby those people not doing the right thing with their garbage would have a sticker adhered to their houses. The Administrator said the Town sends out someone to enforce the regulations instead. Councilwoman Myers said she met with the Larch mont/Mamaroneck Board of Control, where there were representatives from Cablevision. They are still looking for comments in writing or by e-mail. The Traffic Committee met this past week and discussed the traffic at the Murray Avenue School. BAR had met and given final approval to Duane Reade and Webster Bank. They toned down the colors, and the signage is very similar. Now they must go back to Planning for final approval. Councilwoman Seligson attended a Greenway meeting and spoke with Jeff Main on mapping, which he will do for us. She explained Greenway is a 6.9 mile loop beginning at Playland. With grants they will provide the only long distance loop in the metro area. She announced she had gone to Washington, DC to speak before congress regarding the Long Island Sound stewardship system. There will be an introduction of a bill on this whereby LI Sound will receive funding for acquisitions of areas that need protection. The next regularly scheduled meetings will be held on May 18, 2004 and June 2, 2004. ADJOURNMENT On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the meeting was unanimously adjourned into Executive Session at 9':45 PM to discuss the history of personnel.
