OF FIRE COMMISSIONERS HELD ON APRIL 21, 2004 AT
8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740

CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:25
PM, who then pointed out the location of exits.
She said the Board had met in a Joint Work Session with the Recreation Commission and
representatives from the School to discuss the Hommocks Pool.
PROCLAMATIONS — Eyeglass Recycling Month
She invited the members of the Lions Club to come forward and introduce themselves. Paul
Abramson and the President of the Club said they were here to kick off a drive to collect used
eyeglasses which will be revitalized and distributed. There will be a box for depositing the
glasses located in the Town Clerk's Office.
The Supervisor then read the following Proclamation:
LARCHMONT LIONS CLUB
Eyeglass Recycling Month
WHEREAS; since its founding in 1926 the Larchmont Lions Club and
its members have been serving the communities of the Village of Larchmont and
the Town of Mamaroneck by volunteering their time for many community causes,
including the renovation of the Larchmont Library and replacement of emergency
equipment for the Larchmont Mamaroneck Volunteer Ambulance Corps; and
WHEREAS; the Larchmont Lions Club has, since its inception,
collected used eyeglasses for needy people; and
WHEREAS; the Larchmont Lions Club has collected and distributed
more than 50,000 pairs of eyeglasses during the club's lifetime; and
WHEREAS; The Town of Mamaroneck supports this collection effort
both because it helps the needy and because it removes these items from the
garbage waste stream; and
WHEREAS; The Larchmont Lions Club is engaged in a specific one
month campaign to gather at least 500 pairs of eyeglasses for distribution in the
Dominican Republic.

NOW THEREFORE , BE IT RESOLVED,
that I, Valerie Moore O'Keeffe, Supervisor, of the Town of Mamaroneck and the
Town Board do hereby proclaim that the month of May 2004 is hereby
proclaimed as Eyeglass Recycling Month in the Town of Mamaroneck and ask
all citizens to dig into their old suits, handbags, drawers and closets to find and
contribute their unused eyeglasses to the collection boxes established by the
Larchmont Lions. Furthermore, the Supervisor and the Town Board join with the
citizens of the community in extending our sincere appreciation for the work of
the Lions Club in the Town of Mamaroneck.
PROCLAMATION - Lee Bloom
Supervisor O'Keeffe said Mr. Bloom was retiring as Chair of the Sheldrake Environmental
Center after many years. He is a former Town Councilman and holds many other volunteer
positions.
Councilwoman Wittner then read the following proclamation:
PROCLAMATION
Lee H. Bloom
WHEREAS, Lee Bloom, Chairman, Sheldrake Environment Center, has over a
decade brought his wisdom, experience, and enthusiasm to countless endeavors and
projects which have helped all residents of the Village and Town of Mamaroneck; and
WHEREAS, In the fifties, Lee was appointed to the Cross-County Land Study
Commission by George Burchell, Town of Mamaroneck Supervisor. That land included
the Leatherstocking Trail. Lee's vision set a pattern of cooperation between the Town
of Mamaroneck, the Village of Larchmont and the Village of Mamaroneck which has
been a model for Conservation Advisory Committees and Councils throughout the
State; and
WHEREAS, Lee served with distinction as a member of the Town Board of the
Town of Mamaroneck for 16 years exhibiting exemplary patience, persuasiveness and
knowledge.
NOW THEREFORE, BE IT
RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of
Mamaroneck and the members of the Town Board hereby extend to Lee Bloom,
our appreciation and admiration and the hope that although he will be stepping
down as Chairman of the Sheldrake Environmental Center, his public spiritedness
will continue to influence the work of the Sheldrake Environmental Center.
PROCLAMATION -Arbor Day
Councilwoman Myers read the proclamation on Arbor Day:

Arbor Day Tree City U.S.A. Award
WHEREAS, April 30, 2004 marks the thirteenth year the Town of Mamaroneck has
been recognized as a Tree City U.S.A. by the National Arbor Day Foundation; and
WHEREAS, The Tree City U.S.A. award indicates that the Town of Mamaroneck
takes its tree-care responsibilities seriously with an effective community forestry
program; and
WHEREAS, Trees make a world of difference in our communities. Trees have long
been recognized for the beauty and value they lend to homes, neighborhoods, parks
and business areas. At the same time, those trees conserve energy, help clean the air,
protect rivers and streams, and provide a home for wildlife in our towns and cities.
NOW THEREFORE BE IT
RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor, and members of the Town

Council urge all citizens to participate in programs and activities designed to furthering
the establishment of trees in our community.
Supervisor O'Keeffe said the Town has an exceptional Environmental Coordinator, who runs
an active tree program.
Councilwoman Wittner agreed, saying the Environmental Coordinator and the Highway
Department has done an excellent job.
PUBLIC HEARINGS — Parking Ordinance — Boston Post Road
Moratorium Exemption North Fork Bank
Parking Ordinance — Boston Post Road
The following legal notice was entered into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of
Mamaroneck on Wednesday, April 21, 2004, at 8:15 PM or as soon thereafter as is possible,
in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to
consider adoption of a local law entitled "Parking Ordinance — On the south side of Boston
Post Road between Dillon Road and Larchmont Diner". The purpose of the law is to limit
parking for Three (3) hours between 9:00 AM and 6:00 PM.
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the public
hearing was unanimously opened.
The Supervisor asked if anyone wished to speak.
Richard Mari, Larchmont Acres resident and member of the Traffic Committee, explained that
the Traffic Committee had received a letter from the owner of property requesting this parking
law. They discussed it and decided to make the recommendation to the Town Board.
Councilwoman Wittner said the area is familiar to her, and there is two-hour parking all around
there. Even the owner of the Chinese Restaurant complained, so why we are making this side
be three hours? It seems excessive.
Mr. Mari responded there are workers from the auto body shop parking there all day. The
restaurant is having a hard time at lunch. The hope was this would free up space for
residents, the deli and the restaurant.
Councilwoman Myers said this was to keep people from parking there all day.
The Administrator added that enforcement is easier to enforce when it's for a longer period of
time.
Councilwoman Wittner said Dillon Road is between the two Post Road areas. One side will be
two hours and the other three, which doesn't make sense, and the parking has not been
enforced there for 18 years.
Mr. Mari said if the two hour side came up now it would probably be changed to three.
Councilman Odierna asked if anyone from the auto dealer had been contacted or if they were
at the Traffic Committee meeting. Councilwoman Myers replied they had not been.
On motion of Councilwoman Myers, seconded by Councilwoman Seligson, the public hearing
was unanimously closed.
On motion of Councilwoman Seligson, seconded by Councilwoman Myers, the following was
unanimously adopted:
RESOLVED, that the Town Board finds that the adoption of
the proposed local law will constitute a Type II action under
the New York State Environmental Quality Review Act
(SEQRA).

Then, on motion of Councilwoman Seligson, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby adopt the following
local law:
Local Law No. 6-2004
This local law shall be known as the "Restricted Parking on the portion of the South Side of
Boston Post Road between Dillon Road and the Boundary with the Village of Larchmont" Law.
Section 1 - Purpose:
The purpose of this local law is to control parking on the south side of the Boston Post
Road between its intersection with Dillon Road and the Town of Mamaroneck's border
with the Village of Larchmont as a means of preventing nearby businesses from
utilizing this section of the Boston Post Road as a staging area.
Section 2 - Hours of Parking:
Except on holidays, no vehicle shall be parked on the section of the south side of the
Boston Post Road that lies between Dillon Road and the boundary line between the
Town of Mamaroneck and the Village of Larchmont between the hours of 9:00 AM and
6:00 PM (prevailing time) on Monday, Tuesday, Wednesday, Thursday and Friday of
each week for more than three (3) consecutive hours.
Section 3 - Sign(s) to be Erected:
An appropriate sign or signs shall be erected on the Boston Post Road indicating the
area where parking is regulated by this local law.
Section 4 - Severability:
Should any provision of this local law be declared invalid or unconstitutional by any
court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall
not affect any other provisions of this local law, which may be implemented without the
invalid or unconstitutional provisions.
Section 5 - Effective Date:
This local law shall become effective upon filing with the Secretary of State.

PUBLIC HEARINGS - Moratorium Exemption North Fork Bank
The following notice of public hearing was entered into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of
Mamaroneck on Wednesday, April 21, 2004 at 8:15 PM or as soon thereafter as is possible, in
the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to
consider adoption of an "Application for an Exemption from the Moratorium Law for Seville
Realty LLC, 1370 Boston Post Road." (North Fork Bank).

On motion of Councilwoman Myers, seconded by Councilwoman Wittner, the public
hearing was unanimously declared open.
Supervisor O'Keeffe asked if anyone wished to speak on this matter.
Alex Hadjiyane, the representative from North Fork Bank, said they had sent the letter
requesting the exemption along with the proposal. They will rent the building and plan
to re-skin the outside completely. They would construct a new interior floor plan, minor
site work to enhance drainage, and install new landscaping. They will be meeting with
the Planning Board on the site plan.
The Supervisor asked if they would be putting in dry wells, to which Mr. Hadjiyane
answered yes.
Councilwoman Seligson asked if there was adequate space for a bank. Mr. Hadjiyane
said it was definitely adequate; the bank will have full service, with everything except
safe deposit.
Councilwoman Wittner asked if there were enough parking spaces. Mr. Hadjiyane replied that
it was tight but they are within the code in terms of what they must have. They will try to make
it more efficient. He said they are ready to file tomorrow on this application.
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the public
hearing was unanimously closed.
On motion of Councilwoman Seligson, seconded by Councilman Odierna, the following was
unanimously adopted:
RESOLVED, that the Town Board finds that the adoption of
the proposed local law will constitute a Type II action under
the New York State Environmental Quality Review Act
(SEQRA).
On motion of Councilwoman Myers, seconded by Councilman Odierna, it was
RESOLVED, that the Town Board does approve an exemption from
the Moratorium on Development along the Boston Post Road for
Seville Realty, LLC, 1370 Boston Post Road, (North Fork Bank).

The meeting was called to order by Commissioner O'Keeffe.

2. Authorization RE: Grant Contract— NYS Department of State
The Administrator said there was grantd money to obtain a thermal imaging camera. This
camera allows fire fighters to detect people in burning buildings. The grant was obtained
through Assemblyman Tocci's office and is for $8,500. The total cost of the camera is
$12,000. The additional funds will be sought through fund raising by the Fire Department.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was
RESOLVED, that the Board of Fire Commissioners does hereby
approve the New York State grant contract for the purchase of a
thermal imaging camera for use at fire scenes in the amount of
$12,000, of which grant funds in the amount of$8,500 will be
provided by New York State Department of State.
BE IT FURTHER,
RESOLVED, that the Town Administrator, Stephen V. Altieri, is
hereby authorized to execute said agreement on behalf of the
Town of Mamaroneck Fire Department.

AFFAIRS OF THE TOWN
1. Bond Resolution —Volunteer Ambulance Corps Building
Mr. Altieri reported that VAC has moved into the firehouse. The roofer has replaced part
of the trim; the contractor has set up a staging area and there is progress. He then
explained authorization for the bond was necessary to borrow the funds necessary for
the reconstruction of the VAC Building. (See Pages 7 through 12 for attachments)

2. Report of Bid TA-04-03 — Construct and Replace Concrete Sidewalks,
Curbs & Sidewalk Curb Ramps.
The Administrator requested authorization to award the contract to Vernon Hills contracting of
Mt. Vernon, who submitted the lowest bid at $235,237.50, and to authorize his executing the
contract.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby award the bid TA-04-
03, to construct and replace concrete sidewalks, curbs and curb ramps
to Vernon Hills Contracting, Mt Vernon, New York, who submitted the
lowest responsible bid of$235,237.50; and
BE IT FURTHER,
RESOLVED, that the Town Administrator is authorized to execute said
contract on behalf of the Town.

3. Waiver of Building Permit Fees —Volunteer Ambulance Corps Building.
The Administrator requested the Board authorize the Building Department to waive all fees in
the construction of the Volunteer Ambulance Corp Project.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby authorize waiving all
fees normally charged in regard to the Volunteer Ambulance Corps
Building

4. Authorization —2004 Stop DWI Agreement—Westchester County
Mr. Altieri explained this agreement would allow for the County of Westchester to reimburse us
for overtime incurred for enforcement of DWI only. The amount is the same as the Town
received last year: $8,400.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board does hereby authorize the
agreement with the County of Westchester for them to reimburse the
Town for overtime incurred for enforcement of DWI in the amount of
$8,400 and
BE IT FURTHER,
RESOLVED, that the Town Administrator is authorized to execute said
contract on behalf of the Town.

5. Authorization — Ice Rink Trust Fund Transfer of Funds re: Sound System
Mr. Altieri explained that Recreation has reviewed the possibility of the replacing their sound
system at the Ice Rink. They procured two proposals, one from Sound Construction for
$7,350.80, and the other from North Eastern Sound Productions for $8,210.04. He said the
funds for this purchase would come out of the Recreation Trust Fund.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was
RESOLVED, that the Town Board does hereby approve the transfer of
funds in the amount of$7,350.80 from the Hommocks Park Ice Rink
Trust Fund (T-109) into the Hommocks Ice Rink Operating Budget
Account A7265.2102 - Miscellaneous Equipment; and
BE IT FURTHER,
RESOLVED, that the Town Administrator is hereby authorized to
execute agreement with Sound Construction on behalf of the Town.
6. Amendment—Administrative Manual — Hiring Relatives
The Administrator requested approval of the new policy on hiring relatives which he had
distributed to the Town Board. The Board discussed changes and it was decided to change
certain words.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was

RESOLVED, that the Town Board does hereby approve as amended
the inclusion of the following into the Administrative Manual:
Purpose:
To prevent conflicts of interest, or the appearance of conflicts of
interest, in decision-making due to factors of kinship in reporting
relationships.
Policy:
The Town of Mamaroneck permits the appointment of relatives of
employees, except in cases where a family member would have
supervisory responsibility affecting the appointment, promotion,
development or evaluation of a relative.
The Town does not permit current employees to participate in or
affect any recruitment or selection procedure or other action
concerning the potential employment of any person to whom they
are related.
Procedure:
For the purpose of this policy, "relative" shall mean a parent, foster
parent, parent-in-law, child, spouse, brother, half-brother, foster
brother, sister, half sister, foster sister, grandparent, grandchild,
son-in-law, brother-in-law, daughter-in-law, aunt, uncle, niece or
nephew or another family member living in the same household.
The Town Administrator may determine that other inter-personal
relationships between individuals which create a relationship
similar to those described above may be included under the
provisions of this policy if one of the parties has influence over the
other.
Should marriage subsequent to employment result in an employee
directly supervising the job performance or work activities of a
relative, one of the employees must be transferred to another
department or some other appropriate action taken to change the
supervisory relationship.
This policy does not apply to temporary or part-time employment
of relatives under the age 21.
7. Grant for Computers —Town Court.
On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby approve the grant
application for the purchase of a computer that would be
operated in the Town Court. Said computer would be as a result
of funding from a New York State Division of Court Administration
Grant in the amount of$1,600.
BE IT FURTHER,
RESOLVED, that the Town Supervisor, Valerie M. O'Keeffe, is
hereby authorized to execute said agreement on behalf of the
Town.
8. Change of Meeting Date from Wednesday May 19th - Tuesday May 18th
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the
following resolution was unanimously adopted:

RESOLVED, that the Town Board does hereby change their
regular meeting date of Wednesday, May 18, 2004 to Tuesday
May 17, 2004.
APPROVAL OF MINUTES — Special Meeting April 14, 2004
RESOLVED, that the Town Board does hereby approve the
minutes of the special meeting held on April 14, 2004 as
amended.

WRITTEN COMMUNICATIONS
Supervisor O'Keeffe read the following communication from Elaine M. Price, Director,
Department of Consumer Protection:
"Dear Valerie:
Each year residents in Westchester County spend thousands of dollars on remodeling
their homes. When a problem arises, it is often the result of the homeowner not having
chosen a reputable contractor. One way of minimizing risk is for residents to employ
only County-licensed home improvement contractors. Unfortunately, many residents
are unaware of the licensing requirement and whom it regulates.
Under the law, it is a misdemeanor for home improvement contractors doing business
in the County (whether they live within or outside of Westchester) not to have a
Westchester County license issued by our department. We have the authority to
assess penalties up to $1,000 per violation. As importantly, the courts in New York
State have repeatedly held that an unlicensed contractor cannot sue a consumer in
court for monies owed on a contract even if the unlicensed contractor did an
outstanding job.
Pursuant to the Westchester County Consumer Code, the definition of home
improvement is expansive. It includes: WATERPROOFING, EXTERIOR SIDING,
AWNINGS, LEADERS AND GUTTERS, DECKS, PATIOS, GARAGE, CARPORTS
AND ADDITIONAL ROOMS, STORM AND/OR REPLACEMENT WINDOWS AND
DOORS, ROOFS, DRIVEWAYS AND WALKWAYS, KITCHENS AND BATHROOMS,
MASONRY, FENCE INSTALLATIONS, CHIMNEY MAINTENANCE, EXTERIOR
PAINTING, LANDSCAPING, (NOT SEASONAL AND ROUTINE MAINTENANCE)
ARBORICULTURE, TILE SETTERS, SWIMMING POLS, AND OTHER SIMILAR
IMPROVEMENTS.
We would appreciate your continued help in protecting Westchester residents as well
as contractors. Whenever you have the opportunity, please inform residents as to the
law. In addition, it is now possible to check on-line to see if a particular contractor holds
a current Westchester County Home Improvement License. This information can be
obtained by going to the Westchester County web site at
westchestergov.com/consumer.

ORAL COMMUNICATIONS
The Supervisor congratulated Councilwoman Wittner on being unanimously voted Chair of the
Soil & Water Conservation District Board.
George Roniger invited the public to the Spring Fling being sponsored by the Larchmont
Gardens Civic Association on May 1, from 1:00 PM to 4:00 PM. It will be held on East
Brookside. There will be items raffled and a book and record swap.
REPORTS OF THE COUNCIL
Councilwoman Myers said she attended a Cable TV Board meeting and they are beginning to
meet with Cablevision on the franchise renewal. She urges everyone to write or email
comments on the service, getting input on this is very important to the negotiations. She
attended the Board of Architectural Review meeting and they approved the signage and
lighting for both the Webster Bank and Duane Reade. She said the High School Seniors were
doing a musical.
Councilwoman Seligson said they had applied for a grant for the Greenway Project. The
Planning Board Meeting she attended was short; special permits were the only topic. She said
the entire Town Board had attended the Westchester Officials Meeting last week in North
Salem. Soil & Water held a conference and there was a storm water workshop run by the
Center for Watershed Protection Group.
Councilwoman Wittner added it was a rewarding event. There was such a big attendance they
had to turn people away.
Councilman Odierna attended a Recreation Commission Meeting, and earlier this evening the
Town Board met with representatives from the school regarding the Hommocks Pool. He
attended a Flagler Drive meeting about saving Harbor Island. He announced the upcoming
Harbor Festival to be held June 13, 2004 from 10 AM to 4 PM.
SUPERVISOR REPORTS
Supervisor O'Keeffe asked Town residents to please clean up after their dogs. She talked
about recyclables and the schedule, and announced the next regularly scheduled meetings-
May 5, 2004 and May 19, 2004
ADJOURNMENT
On motion of Councilwoman Seligson, seconded by Councilwoman Myers, the meeting was
unanimously adjourned at 10:00 PM into a Work Session in Conference Room A.
