HomeMy WebLinkAbout2004_03_03 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON March 3, 2004 AT 8:15 PM IN THE COURT ROOM OF THE TOWN, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:20 PM. She then pointed out the location of exits. She announced the Board had convened into a work session at 5:00 PM to discuss the Boston Post Road Zoning. There was an update on the new Website for the Town and an update on capital projects. The Board then convened an Executive Session to discuss personnel at 7:15 PM. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:25 PM and, on motion of Councilwoman Seligson, seconded by Councilwoman Myers, the Board of Fire Commissioner was unanimously declared open. Present were the following members of the Commission: Commissioner: Valerie M. O'Keeffe Commissioner: Phyllis Wittner Commissioner: Judith A. Myers Commissioner: Ernest C. Odierna Commissioner: Nancy Seligson 2. Fire Claims Commissioner Odierna presented fire claims for authorization of payment, thereafter on Commissioner Odierna's motion, seconded by Commissioner Wittner, it was RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office as amended: AAA Emergency $ 82.00 AAA Emergency 110.82 AT&T 221.81 Avaya 51.89 Cleaning Systems, Co. 33.40 J &J Barish 62.60 Motorola 78.00 Nextel 254.06 Poland Spring 44.93 R & L Consulting 57.00 Sound Shore Pest Control 130.00 March 3, 2004 Verizon 389.54 TOTAL 11516.05 2. Fire Reports — December 2003, and January & February 2004 Councilwoman Wittner presented the following reports which she received at the Fire Council meeting: December 2003 ALARM TYPE NUMBER Generals 34 Minors 17 Stills 1 Out of Town (Mutual Aid) 0 EMS 16 Drills 2 TOTAL 70 Total Number of personnel responding: 693 Total Time working: 22 hours & 29 minutes January 2004 ALARM TYPE NUMBER Generals 52 Minors 21 Stills 4 Out of Town (Mutual Aid) 6 EMS 21 Drills 3 TOTAL 107 Total Number of personnel responding: 1157 Total Time working: 36 hours & 46 minutes April 2004 ALARM TYPE NUMBER Generals 25 Minors 20 Stills 0 Out of Town (Mutual Aid) 1 EMS 12 Drills 3 TOTAL 61 Total Number of personnel responding: 582 Total Time working: 18 hours & 45 minutes There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Seligson, the Commission unanimously adjourned at 8:30 PM. 2 March 3, 2004 AFFAIRS OF THE TOWN 1. Appointments - Recreation Commission & Board Architectural Review Recreation On motion of Councilman Odierna, seconded by Councilwoman Myers, the following appointment was made: WHEREAS, the untimely passing of Richard Conlan has left a vacancy in the position of Member A on the Recreation Commission, BE IT, RESOLVED, Stanley Kaufman is appointed to the position of Member A of the Recreation Commission; and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on December 31, 2010. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Board of Architectural Review On motion of Councilwoman Myers, seconded by Councilwoman Wittner, the following appointment was made: RESOLVED, Andrew Fredman, is hereby appointed to the position of Member D of the Board of Architectural Review; and BE IT FURTHER, RESOLVED, that the foregoing appointment shall be effective immediately upon the appointee taking and subscribing the oath mandated by section 25 of the New York Town Law and shall expire on December 31, 2004. 2. Authorization - Fixed Asset Inventory - GASB 34 Compliance. This matter was deferred. 3. Set Public Hearing - Boston Post Road Moratorium Exemption. 3 March 3, 2004 Mr. Maker said a request for a exemption from the moratorium along the Boston Post Road was received from tenants of 1262 Boston Post Road. In order to grant the request a public hearing must be scheduled. RESOLVED, that the Town Board does hereby set the date for public hearing on request for hardship exemption for 1262 Boston Post Road for March 17, 2004; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. 4. Set Public Hearing -Amendment - Removal of Violations Law. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on amendment to the Removal of Violations Law for March 17, 2004; and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said notice be posted. ORAL COMMUNICATIONS Lynell Synarto, representing the Larchmont Civics Association, said the speed indicator is a good idea. She heard a lot of good comments about it but, if there is no patrolman stationed there to enforce it, then the next time the driver will ignore it. She added that parking on Cooper Lane has seen no enforcement. It's needed especially when it snows. WRITTEN COMMUNICATIONS The Supervisor said she received a letter from a resident on Lansdowne about dog litter not being picked up around the duck pond and the brook area. Councilwoman Wittner added that the letter also said when the litter is picked up they are throwing the plastic bags into the river. Councilwoman Seligson noted that once it rains the runoff goes directly into the Sound. Councilman Odierna said the residents are frustrated; maybe a few could be deputized to oversee this type of thing. 4 March 3, 2004 REPORTS OF THE COUNCIL Councilwoman Seligson said she attended a meeting on GreenwayTrail where they spoke about creating a 20-mile loop for walking and running by fixing some of the already existing trails and putting up signage. The County will help with mapping and the group wants to apply for funding. They took two NYS Greenway representatives for a walk. They were impressed and surprised with the trails in the Town. She said she was going to Washington, DC to the national estuary conference, hoping to learn more tricks of the trade. Some of the estuaries are: LI Sound, San Francisco Bay, Tampa Bay, and Pugeot Sound, all are part of the National Estuary program. Long Island Sound is the most stressed of them all. There is a stewardship system to designate areas around to protect and to create a public record for it. Councilwoman Myers said the Board of Architectural Review met last Thursday to discuss the designs for Duane Reade and Webster Bank. She attended LMC TV Board of Control Meeting where it was reiterated that we are still accepting comments on the franchise agreement. They are welcomed and may be sent either electronically or by snail mail. Tomorrow night she will be attending a Youth Council meeting . Councilman Odierna has attended no meetings since last week when the Town Board met last. He reminded everyone there are fun things to do at Memorial Park such as shuffle Board, tyke track, tennis, and many other activities. He commended the police for enforcing parking regulations next to Memorial Park. Councilwoman Wittner said the Luncheon held by the Larchmont Seniors last Friday was wonderful; she had a good time. SUPERVISOR REPORTS Supervisor O'Keeffe congratulated the Mamaroneck High School Hockey Team Section 1, who beat Scarsdale. And announced the next meetings of the Town Board would be held on March 17 & March 31, 2004. ADJOURNMENT On motion of Councilwoman Wittner, seconded by Councilwoman Seligson the meeting was unanimously adjourned into at 9:15 PM into an Executive Session. Submitted by Patricia A.
