BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. PUBLIC HEARINGS -Adjourned Public Hearing "Supersession of Portions of Section 267 (11) and 271 (15) of the New York Law" Law This Public Hearing was adjourned and the matter was referred to the Zoning Board of Appeals and to the Planning Board for their review PUBLIC HEARING First Amendment to Chapter 5 - Boards, Commissions, Authorities and Committees Law The following Public Hearing Notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, June 25, 2003, at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider adoption of a local law entitled "First Amendment of Chapter 5 - 'Boards, Commissions, Authorities and Committees' Law." The purpose of this local law is to amend Chapter 5 of the Code of the Town of Mamaroneck. The new chapter will standardize the terms of office of the members of various municipal bodies and repeal those sections of the Code where the organizational features of the municipal bodies listed in this new chapter currently appear. Neither the Board of Appeals, the Planning Board nor the Recreation Commission were included in the chapter when it was enacted. The purpose of this local law is to amend the new chapter of the Code to add the Board of Appeals, the Planning Board and the Recreation Commission to it. The Attorney explained when first preparing the original law he was under the impression that the Zoning Board of Appeals, Planning Board and Recreation Commission were not to be included. He has since learned otherwise and has included them into the law which would stagger the terms of the offices to expire . June 25, 2003 On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the hearing was declared open. The Supervisor asked if anyone wished to speak in favor or against this amendment. No one came forward. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, the hearing was declared closed. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, the Town Board declares itself to be lead agency in this matter; and BE IT FURTHER RESOLVED, that the Town Board of the Town of Mamaroneck does hereby find this action to be unlisted with no impact; and The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye On motion of Councilman Odierna, seconded by Councilwoman Wittner, the following Local Law was unanimously adopted: LOCAL LAW NO. 14 -2003 This local law shall be known as the "First Amendment of Chapter 5 Commissions, Authorities and Committees' Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1-Purpose: On April 22, 2003 the Town Board enacted Local Law No. 12 -2003 which created a new chapter for the Code of the Town of Mamaroneck where all of the standing Boards, Commissions, Authorities and Committees appointed solely by the Town Board are listed with their organizational features. The new chapter also standardized the terms of office of the members of those various municipal bodies and repealed those sections of the Code where the organizational features of the municipal bodies listed in this new chapter currently appear. Neither the Board of Appeals, the Planning Board nor the Recreation Commission were included in the chapter when it was enacted. The purpose of this local law is to amend the new chapter of the Code to add the Board of Appeals, the Planning Board and the Recreation Commission to it. Section 2 -Amendment to the Code of the Town of Mamaroneck (a) Section 5-5 of the Code of the Town of Mamaroneck hereby is amended to delete the word "(RESERVED") and substitute the following in its place: § 5-5 Board of Appeals A. The Board of Appeals, previously established by the Town Board, shall continue to exist. It shall consist of five (5) regular members and two (2) alternate members. The members shall be known as Member A, Member B, Member C, Member D, Member E, Alternate Member A and Alternate Member B. All of the members shall be 2 June 25, 2003 appointed by the Town Board. Annually the Town Board shall designate which of the members shall serve as the Chairperson for that year. B. Except for persons appointed on or before September 1, 2003 and except as provided in section 5-5 D. of the Code, the term of office of each member shall be five (5) years and shall expire on the 31st day of December of the year in which the term expires. C. The term of office of a member appointed on or before September 1, 2003 shall commence on the date selected by the Town Board in its resolution making the appointment but the term of office of: (1) Member A and Member B shall expire on December 31, 2003; (2) Member C and Member D shall expire on December 31, 2004; and (3) Member E, Alternate Member A and Alternate Member B shall expire on December 31, 2005. D. If a person is appointed or qualifies as a member after January 1 of the year in which the term of that person's office was scheduled to begin, that person's term shall expire on the December 31st on which that person's term was scheduled to expire even though that person shall have served less than five (5) years. (b) Section 5-10 of the Code of the Town of Mamaroneck is hereby amended to delete the word "(RESERVED)" and substitute the following in its place: § 5-10 Planning Board A. The Planning Board, previously established by the Town Board, shall continue to exist. It shall consist of seven (7) regular members and two (2) alternate members. The members shall be known as Member A, Member B, Member C, Member D, Member E, Member F, Member G, Alternate Member A and Alternate Member B. All of the members shall be appointed by the Town Board. Annually the Town Board shall designate which of the members shall serve as the Chairperson for that year. B. Except for persons appointed on or before September 1, 2003 and except as provided in section 5-10 D. of the Code, the term of office of each member shall be seven (7) years and shall expire on the 31st day of December of the year in which the term expires. The Recreation Commission, previously established by the Town Board, shall continue to exist. It shall consist of seven (7) members. The members shall be known as Member A, Member B, Member C, Member D, Member E, Member F, and Member G. All of the members shall be appointed by the Town Board. In accordance with section 244 of the New York General Municipal Law, annually the members of the Recreation 3 June 25, 2003 Commission shall designate which of the members shall serve as the Chairperson for that year. D. Except for persons appointed on or before September 1, 2003 and except as provided in section 5-11 D. of the Code, the term of office of each member shall be seven (7) years and shall expire on the 31st day of December of the year in which the term expires. E. The term of office of a member appointed on or before September 1, 2003 shall commence on the date selected by the Town Board in its resolution making the appointment but the term of office of: (1) Member A, Member B and Member C shall expire on December 31, 2003; (2) Member D, Member E and Member F shall expire on December 31, 2004; and (3) Member G shall expire on December 31, 2005. D. If a person is appointed or qualifies as a member after January 1 of the year in which the term of that person's office was scheduled to begin, that person's term shall expire on the December 31st on which that person's term was scheduled to expire even though that person shall have served less than seven (7) years. Section 3 - Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 - Effective Date: This Local Law shall become effective upon filing with the Secretary of State. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 9:00 PM on motion of Commissioner Wittner, seconded by Commissioner Myers. Authorization - Stipulation of Settlement - Professional Firefighters Association Mr. Altieri outlined the changes. He said there were numerous work sessions to negotiate this settlement and it seems a fair& equitable agreement. After eleven negotiation sessions, the Town and the paid fire fighters agreed to a 10 % percent increase over the next three years, which is an average of 3.53% per year. There will be an increased contribution towards the pension and benefits by the employees. He recommended its adoption. Commissioner O'Keeffe said the Administrator had done a good job. Councilwoman Wittner added her thanks to Mr. Altieri, as did Commissioner Myers. Commissioner Seligson said she was also pleased about being kept up to date on these negotiations. Commissioner Odierna asked if we had ever received the comparison numbers from other communities. The Administrator replied that we had not. On motion of Commissioner Myers, seconded by Commissioner Wittner, it was RESOLVED, that the Town Board does hereby authorize the agreement between the Town and Local 898 of the International Association of Firefighters; and BE IT FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Commissioner O'Keeffe said there had been a practice drill this past Saturday held in parking lot#1, participating were the police, ambulance, and firefighters. There was a good turnout with many volunteers and many young people. The drill involved a simulation of a chemical spill from a truck, showing what the expected response would be, she added specific thanks to those who acted the part of victims. Commissioner Odierna said it was a great learning experience, and Commissioner Myers said she had been impressed. She suggested next time though that signs be put up telling passersby it was just a test. 5 June 25, 2003 There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Myers, the Commission unanimously adjourned at 8:55 PM. AFFAIRS OF THE TOWN 1. Authorization - Hommocks Conservation Area Grant Mr. Altieri explained, at the end of May, the Town received word that the Federal Housing and Urban Development Agency awarded a grant to the Town of Mamaroneck for the renovation and improvement to facilities at the Hommocks Conservation Area. The amount of the grant is $67,061. This grant would allow building a small catwalk and an observation deck. He recommended approval for the submission with the condition that it be approved by the Coastal Zone Management Commission. Councilman Odierna asked if it would be possible to put in a kayak launch. Councilwomen Wittner and Seligson explained why it would not be feasible to do so with this grant. Councilwoman Wittner said this grant would also provide five more gravel parking spaces and a kiosk. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board of the Town of Mamaroneck does hereby authorize the submission of a Grant Application in the amount of$67,061 for funding through the Federal Housing and Urban Development Agency for facilities renovation and improvement for the Hommocks Conservation Area; and BE IT FURTHER RESOLVED, that the Town Administrator, Stephen V. Altieri, is hereby authorized to execute the grant application on behalf of the Town. Salary Authorizations - Summer Interns - Recreation Department, Town Clerk's Office and Highway Department Recreation Department Summer Interns - Recreation Department, Town Clerk's Office and Highway Department Summer Interns On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby authorize the payment of salary to summer interns as follows: 6 June 25, 2003 Jessica Lopez and Raquel Arce for clerical work assisting the Recreation Department for a total of 25 hours per week at a rate of$8.50 per hour; Kristy Lynn Libertella to assist with clerical operations in the Town Clerk's Office at a rate of$8.50 per hour and Chris Finnie to assist in the Highway Department at a rate of $8.50 per hour, effective June 30, 2003. Set Public Hearing - Town Parking Lot#1 On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing on the Town Parking Lot#1 for July 9, 2003 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. Authorization - Set Dates of Town Board Meetings for July and August On motion of Councilwoman Seligson, seconded by Councilman Odierna, it was RESOLVED, that the Town Board agrees to set Town Board Meeting dates for July and August as follows:: July 9, and 8 June 25, 2003 August 4, 2003 to be held in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck at 8:15 PM. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye The Supervisor read the following proclamation into the record: PROCLAMATION DR. ELIZABETH DREIER WHEREAS, Dr. Elizabeth Dreier is retiring after seventeen (17) years of service as Principal to the Murray Avenue School, and WHEREAS, Elizabeth has created a child-centered school in which children are in charge of their own learning and are allowed to grow and explore in developmentally appropriate ways; and WHEREAS, She has brought her wisdom, experience and enthusiasm to countless endeavors and projects which involved school boards, parents, elected officials and students of all ages; and WHEREAS, Dr. Dreier's tireless efforts as an ambassador of good will in the Town of Mamaroneck established a bond of friendship, cooperation and respect which will be Dr. Dreier's legacy to our Community for generations to come. NOW THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, and the members of the Town Council of the Town of Mamaroneck hereby present this Proclamation to DR. ELIZABETH DREIER and extend our very best wishes, our appreciation, praise and admiration and wish her well as she begins this new phase of her life "her retirement years". IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 19th June 2003. SUPERVISOR REPORTS Supervisor O'Keeffe said she attended the retirement party last week for Elizabeth Dreier, there was a musical program written by Eric Mason, who is studying at Yale, and there were many speeches and remembrances. They also held a testimonial dinner for her on Thursday She mentioned the Town's Junior Engineer, David Goessl, had recently received his certification as a Professional Engineer and sent him her congratulations. She read the names of the Mamaroneck High School Baseball team, saying they were undefeated in their conference, Section 1. Councilwoman Myers sent her congratulations to all the seniors who graduated tonight. 9 June 25, 2003 ORAL COMMUNICATIONS Shana Lula, 87 Edgewood Avenue, proposed putting the sidewalk slated to be put in on her street, be put on the other side. She said there would not have to be any trees removed, her design was budget friendly since it would not involve resetting of utilities. The Supervisor replied there had been many discussions about this, people had appeared before the board complaining it was difficult to push strollers, and it was dangerous for pedestrians. Mr. Altieri explained the cost would be more because excavation would be necessary based on her proposal. Plus there would be a problem with the width of the street. Councilman Odierna said it would work if parking was not allowed. Ms. Lula said most residents have large driveways so parking would not be a problem. There was a long discussion on the various issues involved with this sidewalk. Betty Miller, 60 Cooper Lane, representing Larchmont Gardens Civic Association thanked the Town Administrator for attending their meeting and for explaining the work at Garden's Lake. She added that George Roniger was the new president of the Organization. REPORTS OF COUNCIL Councilman Odierna reminded everyone about the concerts which will be held every Monday night in July beginning at 7:00 PM in Memorial Park, and there will also be a showing of Lilo and Stitch. Councilwoman Myers said she had attended the Board of Architectural Review where the drawings of the proposed changes to the VAC Building were reviewed. Councilwoman Wittner said the Long Island Sound Watershed Intermunicipal Council did a presentation concerning a proposed Stormwater Utility District at the Village of Larchmont Board meeting. ADJOURNMENT The Supervisor said the next scheduled meetings would be July 9 and August 4, 2003. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson the meeting was adjourned at 10:45 PM into a work session to receive the Draft Environmental Impact Statement (DEIS) from Forest City Daly.
