HomeMy WebLinkAbout2003_02_05 Town Board Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON FEBRUARY 5, 2003 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Odierna Councilwoman Nancy Seligson ALSO PRESENT: Patricia A. DiCioccio, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:30 PM, then was opened on motion of Councilwoman Wittner, seconded by Councilwoman Seligson. Present were the following members of the Commission: Commissioner: Valerie M. O'Keeffe Commissioner: Phyllis Wittner Commissioner: Judith A. Myers Commissioner: Ernest C. Odierna Commissioner: Nancy Seligson 1. Fire Claims: Commissioner Seligson presented fire claims for authorization of payment, thereafter on Commissioner Seligson motion, seconded by Commissioner Myers, it was RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office as amended: AAA Emergency Supply Co. $ 192.50 AAA Emergency Supply Co. 175.00 Avaya 27.40 Brewer Hardware 21.12 Cleaning Systems 192.40 Con Edison 2.06 Gary Galvao 650.00 Excelsior Garage & Machine 377.50 Gloves Inc. 281.40 IOS Capital 2.96 Nextel 196.84 NFPA 135.00 Poland Spring Water 65.73 February 5, 2003 Pronto Printer 224.63 T.C.D. 350.00 Town of Mam'k Professional Fire Fighters 375.00 Tri City Auto Parts 156.94 Verizon 411.98 TOTAL $3,838.46 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye There being no further business to come before the them, the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. Authorization -Amendment to Volunteer Ambulance Corps Agreements THIS ITEM WAS HELD OVER 2. Resolution - Greenway Trail Project Councilwoman Seligson explained that by passing a resolution of intent the Town will show a real commitment towards working with other communities, which was suggested by the Hudson River Geenway Conservancy. This would enhance grant proposals to the Greenway. The proposals could enable funding for the mapping of existing trails, signage, catwalks, and bridges. She added the Gannett paper had run an editorial in favor of this proposal, and both New Rochelle and Scarsdale have passed already this resolution already. Following discussion, on motion of Councilwoman Seligson, seconded by Councilwoman Wittner the following resolution was adopted: WHEREAS, This resolution dated February 5, 2003 is between the City of New Rochelle, the Towns of Mamaroneck, Eastchester, the Town-Village of Scarsdale, the Village of Mamaroneck, and the County of Westchester, which have areas of jurisdiction over the trail system known as the Leatherstocking Trail. WHEREAS, the cooperating municipalities share the goals of natural and cultural resource protection, public access to those resources, heritage and environmental education, regional planning and economic development; and WHEREAS, the cooperating municipalities currently have a connected trail system that provides natural resources and recreational opportunities; and WHEREAS, the connected trail system is in need of consistent signage, upgraded maintenance, removal of obstructions, bridging gaps, and coordinated trail standards to allow for improved enjoyment of the trail system; and WHEREAS, the improvements in the trail system would create the opportunity to expand the trail system from a current 6.1 mile loop to a possible 17 mile loop; and 2 February 5, 2003 WHEREAS, the cooperating municipalities are located in a heavily developed area of Southern Westchester with limited open space and natural resource opportunities. NOW THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck, along with the other cooperating municipalities wish to work together, apply for funding and provide in-kind volunteer and financial resources to accomplish improving and expanding the current trail system. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye PRESENTATION - TOWN OF MAMARONECK EMERGENCY MANAGEMENT PLAN Michael Liverzani, Ambulance District Administrator conducted a slide presentation, saying the goals of the plan were to create a response for all type of hazardous conditions, reduction of response time, and training. He said the primary responsibility belongs to the Supervisor and Town Board who would have to ratify the plan. EMERGENCY MANAGEMENT PLAN IS ON FILE IN THE TOWN ADMINISTRATOR'S OFFICE There was then a discussion on the procedure for ratification, and it was decided to have the Town Attorney research the procedure. 3. Set Public Hearings -Amendment -Wetlands and Watercourses Protection Law -Amendment - Senior Citizen Handicapped Tax Exemption WETLANDS AND WATERCOURSES PROTECTION LAW On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing to amend the Wetlands and Watercourses Protection Law for February 26, 2003 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 3 February 5, 2003 AMENDMENT - SENIOR CITIZEN HANDICAPPED TAX EXEMPTION The Administrator said the County of Westchester passed a law amending the income scale for senior citizen and handicapped tax exemptions. The Town has then adopted the amended income guidelines which would increase on the scale by $1000. This increase to the guidelines is for both the Senior Tax Exemption, and for the handicapped, which are two separate laws. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing to amend the Senior Citizen Handicapped Tax Exemption Law for February 26, 2003 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby set the date for public hearing to amend the Handicapped Tax Exemption Law for February 26, 2003 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ADDED ITEM SET PUBLIC HEARING - Establishing a Development Moratorium on the Boston Post Road On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that the Town Board does hereby set the date for public hearing Establishing a Development Moratorium on 4 February 5, 2003 the Boston Post Road for February 26, 2003 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 4. Salary Authorization - Police Matrons - Recreation POLICE MATRONS Mr. Altieri explained this increase for women who currently serve as crossing guards, who have now agreed to take on the job of police matron. They would be required to be on call for nights and weekends. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby authorize the adjustment of the hourly rate for Police Matrons, Vita Greco and Mary Portonova from $15 an hour to $20 an hour. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye RECREATION On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that as provided for in the 2003 Town Budget the Town Board does hereby authorize the payment of salary to the following: Danny Smith, Alt. Manager, Hommocks Park Ice Rink, $13/hour, retroactive to 1/13/03 Peter Genovese, Lifeguard, Hommocks Pool, $7.25/hour, retroactive to 1/30/03. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 5 February 5, 2003 APPROVAL OF MINUTES - December 18, 2002 On motion of Councilman Odierna, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby approve the Board minutes from the meeting of December 18 , 2002 as amended. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ORAL COMMUNICATIONS Ruth Campanelli, Representative from the Larchmont Gardens Civic Association asked the status of the curbs & sidewalks around the duck pond. Mr. Altieri answered they would not be redone this year. Ruth then said it was fun to see people ice skating at the pond again, hasn't happened for a long time. ADJOURNMENT The Supervisor said that the next scheduled meetings would be February 26, March 5, and March 19, 2003. On motion of Councilwoman Myers, seconded by Councilwoman Wittner the Town Board adjourned at 9:15 PM into an Executive Session to discuss employment history. Submitted by Patricia A.
