CALL TO ORDER
The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30
PM, who then pointed out the location of exits.
PUBLIC HEARINGS - Establish No Parking Zone -40 N. Chatsworth Avenue
-Add Position of Director of Building Code Enforcement and Land Use
Administration to the Town Code
ESTABLISH NO PARKING ZONE -40 N. CHATSWORTH AVENUE
The following public hearing notice was placed into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of
Mamaroneck on Thursday, November 7, 2002 at 8:15 PM or as soon thereafter as is possible
in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to
consider the adoption of a proposed Local Law entitled "No Parking Zone -40 N. Chatsworth
Avenue".
On motion of Councilwoman Seligson, seconded by Councilwoman Myers, the hearing was
declared open.
The Supervisor explained each of the Council members had visited the 40 N. Chatsworth
Avenue site. She then asked if there was anyone from the audience who would like to speak.
Mr. Maker explained the purpose of the local law was to change parking at 40 N. Chatsworth
Avenue to allow for a safer exit from the driveway for the homeowner.
The Supervisor read the contents of the amended law. She then questioned whether the six
feet north and south of the driveway as stated in the law was actually the driveway or the
apron, and from where the measurements were being taken.
The Supervisor said the site had been visited by all members of the Board and asked if
anyone wished to speak.
Councilwoman Seligson suggested putting up signs restricting the size of cars being able to
park in this area.
Mr. Maker said this is a public street and the Town could not make this type of regulation.

Mr. Rick Gear, owner of 40 N. Chatsworth Avenue, stated when he built the house and the
driveway the sub-contractor had checked with the Town to ensure the driveway was within
code as far as the width. He also stated the normal barrier for a driveway was three feet on
either side, so in actuality, there would only be a total of six feet being considered.
Councilwoman Myers stated the Traffic Committee had discussed this and said the driveway
in question would require more than three feet.
Councilman Odierna said he had pulled into the driveway, the visibility seemed to be no
problem when making a right turn out of the driveway.
Mr. Gear said it depended on the type and size of the vehicle parked near the driveway. It is
impossible to see uphill towards Rockingstone because people tend to crowd the apron of
the driveway, so much so he had to call the police on one occasion.
The Supervisor said if the Town put up signs within three feet this would push the cars back
a bit. She proposed six feet from the driveway line, mentioning it would be a disaster if lots
of residents started asking for this.
Mr. Richard Mari, member of the Traffic Committee, said the no parking sign should be put
from the perpendicular line on each side.
The Supervisor asked if he knew how wide the driveway was. The Board then discussed the
width and splay of the driveway and it was decided to hold this over to allow the Board to get
the precise measurements of the driveway, and to get the regulations from the building
department.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, the hearing was
declared closed.
On motion of Councilwoman Seligson, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board finds that the adoption of
the proposed local law will constitute a Type II action under
the New York State Environmental Quality Review Act
(SEQRA); and
BE IT FURTHER
RESOLVED, that the Town Board hereby declares itself to be
lead agency with respect to the proposed action.

It was suggested this public hearing be adjourned until November 20. More information is
needed, including the width of the driveway involved in the matter, before the hearing can
proceed.
On motion of Councilwoman Myers, seconded by Councilman Odierna, it was
RESOLVED, that the Town Board does hereby adjourn the
Public Hearing to "Establish a No Parking Zone at 40 N.
Chatsworth Avenue" until November 20, 2002.

ADD POSITION OF DIRECTOR OF BUILDING CODE ENFORCEMENT AND LAND USE
ADMINISTRATION TO THE TOWN CODE
The following notice was placed into the record:
PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of
Mamaroneck on Wednesday, November 17, 2002, at 8:15 PM or as soon thereafter as is
possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck,
New York to consider a Local Law to add the position of Director of Building Code
Enforcement and Land Use Administration to the Town's Code.
The purpose of the law is the Town of Mamaroneck has created the position of Director of
Building Code Enforcement and Land Use Administration. The Director performs the same
functions as the Building Inspector. Throughout the Code of the Town of Mamaroneck there
are references to "Building Inspector" which now also should include "Director of Building
Code Enforcement and Land Use Administration:". This local law makes that change.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, the hearing was
declared open.
The Town Attorney explained the amended local law substitutes the title of"Director of
Building Code Enforcement and Land Use Administrator" for the title "Building Inspector"
throughout the code. Some of the changes required more drafting than just the substitution
of the one title for the other. The new section 106.37B allows the Town Board to hire building
inspectors, assistant building inspectors and other deputies. To ensure a proper chain of
command, under the revised statute all of these appointees report to the Director.
The Supervisor asked if anyone had any comments or questions. There were none.
Councilwoman Wittner noted this had been referred to the Planning Board for comment and
review.
On motion of Councilwoman Myers, seconded by Councilwoman Seligson , the hearing was
declared closed.
On motion of Councilman Odierna, seconded by Councilwoman Myers, it was unanimously
RESOLVED, that the Town Board finds that the adoption of
the proposed local law will constitute a Type II action under
the New York State Environmental Quality Review Act
(SEQRA); and
BE IT FURTHER
RESOLVED, that the Town Board hereby declares itself to be
lead agency with respect to the proposed action.
On motion of Councilman Odierna, seconded by Councilwoman Seligson, the following Local
Law was adopted:
Local Law No. 10 -2002
This local law shall be known as the "The addition of the title of Director of Building Code
Enforcement and Land Use Administration to certain sections of the Code of the Town of
Mamaroneck" Local Law.
Be it enacted by the Town Board of the Town of Mamaroneck.

Section 1 - Purpose:
The Town of Mamaroneck has created the position of Director of Building Code Enforcement
and Land Use Administration. The Director performs the same functions as the Building
Inspector. Throughout the Code of the Town of Mamaroneck there are references to
"Building Inspector" which now should read "Director of Building Code Enforcement and
Land Use Administration". This local law makes that change.
Section 2 -Amendments to the Code of the Town of Mamaroneck:
The following sections of the Code of the Town of Mamaroneck hereby are amended by
deleting the words "Building Inspector" each time that the words "Building Inspector" appear
therein and in each instance, replacing those words with the words "Director of Building
Code Enforcement and Land Use Administration".

Section - 3 Amendments to the Code of the Town of Mamaroneck:
(a) Section 95-4 of the Code of the Town of Mamaroneck hereby is amended by
deleting the definition of BUILDING INSPECTOR in its entirety.

(b) Section 95-4 of the Code of the Town of Mamaroneck hereby is amended by adding the
following definition:
DIRECTOR OF BUILDING CODE ENFORCEMENT AND LAND USE ADMINISTRATION - The
Director of Building Code Enforcement and Land Use Administration or duly authorized
representatives of the Building Department or the Engineering Department.
(c) Section 106-37 of the Code of the Town of Mamaroneck hereby is deleted in its
entirety and the following is substituted in its place:
§ 106-37. Director of Building Code Enforcement and Land Use Administration.
A. The Town Board shall appoint a Director of Building Code Enforcement and Land Use
Administration, who shall be either an architect, engineer or person who has qualified
according to the rules and regulations for civil service in the County of Westchester for the
position of Director of Building Code Enforcement and Land Use Administration, and who
shall serve and hold office at the pleasure of the Town Board.
B. The Town Board shall appoint from time to time subordinates to the Director of
Building Code Enforcement and Land Use Administration such as building inspectors,
assistant building inspectors and such others as may be deemed appropriate. Such persons
(1) shall report to the Director of Building Code Enforcement and Land Use Administration,
(2) shall serve at the pleasure of the Town Board and (3) in the absence of the Director of
Building Code Enforcement and Land Use Administration, shall act in his or her place and
stead.
C. The Director of Building Code Enforcement and Land Use Administration shall have all
powers, duties and authority provided for in Town Law § 138 and the other provisions of
state law and any other laws, ordinances, codes or regulations of the Town of Mamaroneck.
(d) Section 108-6 of the Code of the Town of Mamaroneck hereby is deleted in its entirety and
the following is substituted in its place:
§ 108-6. Penalties for offenses.
Any violation of this chapter shall be a violation punishable by a fine of no less than fifty
dollars ($50.) nor more than two hundred fifty dollars ($250.). Summonses for violations of
this chapter may be issued by the Police Department or by the Director of Building Code
Enforcement and Land Use Administration or their designees.
(e) Section 106-45 of the Code of the Town of Mamaroneck hereby is deleted in its entirety
and the following is substituted in its place:
§ 106-45. Right of Entry
Upon showing the proper credentials and in the discharge of their duties, the Director of
Building Code Enforcement and Land Use Administration and the persons appointed by the
Town Board pursuant to §106-37B, shall be permitted to enter upon any building, structure or
premises without interference during reasonable working hours.
(f) Section 114-10 of the Code of the Town of Mamaroneck hereby is deleted in its entirety
and the following is substituted in its place:
§ 114-10. Inspections.
A. The Director of Building Code Enforcement and Land Use Administration, the persons
appointed by the Town Board pursuant to §106-37B and the Town Engineer shall be supplied
with copies of the permits issued under the law, and each of them is designated as an
inspection agent for the Planning Board for the purposes of determining, from time to time,
compliance with the terms of any permit issued under this chapter. For the purpose of such
inspection, the persons identified in the preceding sentence shall have the right to enter
upon and inspect any work.
B. Violations. The persons described in Section 114-10A shall have the power to issue
violations of permits issued under this chapter and demand remedial action and to initiate
such further proceedings as are necessary to enforce the provisions of this chapter.

(g) Section 175-4 of the Code of the Town of Mamaroneck hereby is amended by deleting the
definition of"BUILDING INSPECTOR or INSPECTOR OF BUILDINGS" in its entirety.
(h) Section 175-4 of the Code of the Town of Mamaroneck hereby is amended by adding the
following definition:
DIRECTOR OF BUILDING CODE ENFORCEMENT AND LAND USE ADMINISTRATION - The
Director of Building Code Enforcement and Land Use Administration or such other officer
duly authorized to perform the duties of that position.
(i) Section 183-14 of the Code of the Town of Mamaroneck hereby is deleted in its entirety
and the following is substituted in its place:
§ 183-14. Administration.
The Commission may promulgate such regulations as it deems necessary to effect the
provisions of this chapter. Any regulations promulgated by the Commission which will
directly impact the residents of the Town of Mamaroneck shall be subject to the approval of
the Mamaroneck Town Board. All provisions of this chapter shall be enforced by the Director
of Building Code Enforcement and Land Use Administration, or the persons appointed by the
Town Board pursuant to §106-37B.
(j) Section 192-7 of the Code of the Town of Mamaroneck hereby is deleted in its entirety and
the following is substituted in its place:
§ 192-7. Inspection.
After a permit has been issued under the provisions of this chapter, all work thereunder shall
be subject to inspection by the Director of Building Code Enforcement and Land Use
Administration or the persons appointed by the Town Board pursuant to §106-37B at all times
until completion to ascertain that there is compliance with all provisions of this chapter and
all provisions of the application for the permit. The Director of Building Code Enforcement
and Land Use Administration and the persons appointed by the Town Board pursuant to
§106-37B shall have the authority to stop any part of the work being done under any permit
which is not issued in conformity with the application for the permit or with the provisions of
this Chapter.
(k) The title of section 106-59 of the Code of the Town of Mamaroneck hereby is deleted in its
entirety and the following is substituted in its place:
§106-59. Notice to the Director of Building Code Enforcement and Land Use Administration.
Section 4 - Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court
of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect
any other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 5 - Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

Commissioner Seligson questioned the cost of the Inspection Dinner and asked if the amount
shown was normal. Mr. Altieri said it was.
2. Other Business

Commissioner Odierna said the open house which was held last Sunday was great and a
good time was had by all.
Commissioner O'Keeffe spoke about the demonstration using the jaws of life. It was very
interesting to see how very quickly a person could be extracted from a vehicle in an
emergency. It was an incredible show of skill and teamwork. Commissioner O'Keeffe
attended an all you can eat Explorer dinner.
Commissioner Wittner said it was very impressive how the demo of the smoke house showed
everyone how to get out safely.
There being no further business to come before the Commission, on motion of
Commissioner Seligson, seconded by Commissioner Odierna, the Commission unanimously
adjourned at 9:20 PM.
AFFAIRS OF THE TOWN
1. Appointment -Alternate Member Zoning and Planning Board
The Supervisor asked Mr. Maker to speak on this matter.
Mr. Maker explained the alternate member of the Zoning and Planning Boards would help
when other board members feel the need to abstain from voting on an issue because of any
perceived conflicts of interest.
Councilwoman Seligson stated Mr. Ortiz who is an attorney, holds a bachelors degree from
the University of Pennsylvania and a juris doctor from the University of San Francisco Law
School. He voluntarily attended a twelve-hour Land Use Training Institute course conducted
by the Westchester Municipal Planning Federation in March of 2002. He has two children and
is chairman of Larch mont/Mamaroneck Little League.
On motion of Councilwoman Seligson, seconded by Councilwoman Myers, it was
RESOLVED, that the Town Board does hereby appoint John
Anthony Ortiz as an alternate member to the Zoning and
Planning Boards effective November 7, 2002.

3. Request for Use of Voting Machines - Mamaroneck Public Library Election
The Town Clerk explained this was an annual request from the Village of Mamaroneck Library
to use two voting machines for the budget proposition and the election of trustees on
December 10, 2002. She added all costs involved with moving and setting up the machines
will be paid for by the library.
On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was
RESOLVED, that the Town Board does hereby authorize the
use of two voting machines to the Mamaroneck Library for
the budget proposition and the election of trustees on
December 10, 2002.

The Supervisor thanked the Town Clerk, her staff and Mr. John Caridi for a job well done
during the November 5 election.
The Supervisor said she had attended a luncheon held by the Daughters of the American
Revolution honoring Grace Pugh and Gerhard Spies.
4. Salary Authorization - Recreation
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was
RESOLVED, that as provided for in the 2002 Town Budget
that the Town Board does hereby authorize the payment of
salary to the following:
Cindy Ausiello, Head Coach, Dolphin Pre Swim Team, $1,500 for season (10/16/02 to 3/5/03).
Josie Blanckmeister,Assistant Coach, Dolphin Pre Swim Team, $20/session, effective
retroactive to 10/16/02.
Dennis Flores,Assistant Coach, Mamaroneck Swim Club, $4,320/season (10/21/02 to
3/20/03).
Vi Le,Alternate Swim Instructor, Hommocks Pool, $1 9/hour, effective 11/2/02.
Sean Bave, Lifeguard, Hommocks Pool, $7/hour, effective retroactive to 10/3/02.

Councilwoman Wittner congratulated Matthew Mann on his new rank of Eagle Scout, and
read from the following proclamation.
MATTHEW JOSEPH MANN
WHEREAS, Matthew J. Mann, a resident of the Town of Mamaroneck, is a
member of Immaculate heart of Mary Church Troop 2; and
WHEREAS, he has served his troop in a variety of leadership roles,
including Junior Assistant Scout Master and Senior Patrol Leader, and
WHEREAS, Matthew has earned 21 merit badges, including Citizenship in
the community, nation and the world, and
WHEREAS, As part of achieving his Eagle rank, Matthew completed a
significant community service project which involved the collection of no
longer used cellular telephones for refurbishment, reprogramming and
distribution to victims of domestic violence through a nation program,
"Call To Protect". Matthew collected 840 cellular phones and in excess of
500 accessories.
NOW THEREFORE, BE IT
RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor, and the Town
Board members, congratulate and extend our best wishes to

SUPERVISOR REPORTS
The Supervisor made mention that the Senior Center in the Village of Larchmont will be
holding its annual senior bazaar on November 15 and 16 from 10 AM to 12 PM. Proceeds will
go to benefit the Senior Center.

REPORTS OF COUNCIL
Councilman Odierna, liaison to the Human Rights Commission, called for nominations for the
Town's annual Dr. Martin Luther King, Jr. award which will be presented on January 15, 2003
at the Emelin Theater in Mamaroneck. Nominations for appropriate persons or organizations
can be forwarded to Robin Nichinsky, Chair of the Human Rights Commission, care of the
Town Center, 740 West Boston Post Road. The deadline for nominations is Monday
December 6, 2002.
Councilwoman Wittner had a Coastal Zone Management Commission meeting. She also
attended the first annual Commanders breakfast at the VFW. It was very enjoyable
The Supervisor reminded everyone November 11, Veteran's Day, events would be held at the
war monument at Village Hall in Mamaroneck and also at Village Hall in Larchmont.
Councilwoman Myers attended a Traffic Committee meeting. Very interesting issues were
discussed especially areas of the Town that overlay with other communities. The BAR met
and was well attended, a number of issues were discussed.
Councilwoman Seligson attended, along with other Town Board members, a meeting with
Con Edison with regard to service to the Marbourne areas.
The Supervisor stated there would be another meeting with Con Edison in May.
The Town Clerk gave a synopsis of the election results and stated 80% of the unincorporated
area of the Town had voted.
Councilman Odierna extended congratulations to all those who ran in the election.
Councilwoman Myers said the Town residents deserved a pat on the back for their election
turnout.
The Town Clerk stated in 1992 during the presidential election, turnout was 105%, which
happened because more people turned out to vote then were registered -thus there were an
abundance of affidavit ballots.
The Supervisor extended condolences to Police Officer Adam Libertella on the death of his
father.
ORAL COMMUNICATIONS
Mr. Richard Mari asked if the sidewalk on Dillon Road would be realigned to the driveway to
the shopping center.
Mr. Altieri said it would not.
ADJOURNMENT
The Supervisor said the next scheduled meetings would be November 20 and December 4,
2002.
On motion of Councilwoman Wittner, seconded by Councilwoman Seligson the meeting was
adjourned at 10:25 PM.
