Samela, Deputy Town Clerk CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. PUBLIC HEARINGS - Establish No Parking Zone - Madison/Fifth Avenues - Local Law - Special Meetings of Coastal Zone Management Commission - Establish Alternate Members to the Zoning Board of Appeals and Planning Board -Addition of Director of Building Code Enforcement and Land Use Administrator to Town Code ESTABLISH NO PARKING ZONE - MADISON/FIFTH AVENUES The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, October 16, 2002 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a proposed Local Law entitled "No Parking Zone - Madison Avenue and Fifth Avenue". On motion of Councilwoman Myers, seconded by Councilwoman Seligson, the hearing was declared open. The Administrator explained this proposed change was a recommendation from the Traffic Committee. Residents of Carlton House had appeared before the committee regarding safety concerns. The Supervisor asked if anyone from the audience had any comments. There were none. She then asked if the Town Board would like to comment. Councilman Odierna asked if the cars that were being parked in the area of Madison and Fifth Avenue were owned by residents or were they being parked by the gas station. October 16, 2002 The Administrator said there were only three spaces or 70 feet which would be taken away but there still would be parking spaces there. Councilwoman Myers added there were no objections by anyone attending the Traffic Committee meeting where this had been discussed. On motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was declared closed. On motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board finds that the adoption of the proposed local law will constitute a Type II action under the New York State Environmental Quality Review Act (SEQRA); and BE IT FURTHER RESOLVED, that the Town Board hereby declares itself to be lead agency with respect to the proposed action. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye On motion of Councilwoman Myers, seconded by Councilwoman Wittner, the following local law was adopted: LOCAL LAW NO. 8 -2002 This local law shall be known as the "No Parking Near Carlton House" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 - Purpose: The purpose of this local law is to create a no parking zone on Madison Avenue in the vicinity of the Carlton House as a means of improving sight lines at that location and thereby improving safety. Section 2 - No Parking: Parking on the eastern side of Madison Avenue for a distance of 70 feet southerly from the point where the southern side of the driveway for the property known as Block 134 on the tax assessment map of the Town of Mamaroneck ("Carlton House") meets the roadbed of Madison Avenue is prohibited. Section 3 - Signs to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on, and striping shall be painted on the surface of, Madison Avenue indicating the area where parking is prohibited Section 4 - Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 - Effective Date: This Local Law shall become effective upon filing with the Secretary of State. The above resolution was put to a roll call vote: 2 October 16, 2002 Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye PUBLIC HEARING - SPECIAL MEETINGS OF COASTAL ZONE MANAGEMENT COMMISSION The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, October 16, 2002, at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider a Local Law that would give the Chair of the Coastal Zone Management Commission the power to call special meetings of the Commission. On motion of Councilwoman Seligson, seconded by Councilwoman Wittner, the hearing was declared open. Mr. Maker explained it sometimes becomes necessary to call special meetings of various Boards and Commissions, most are called in line with either State and/or local laws. Presently the Town Code does not define a process which allows this to be done by the Coastal Zone Management Commission and this proposed law would set the guidelines. Councilwoman Wittner asked since this was a bi-municipal commission, does the Village of Larchmont also have to pass this local law? After Mr. Maker replied they would have to, Councilwoman Wittner said she would draft a letter to the Village of Larchmont. The Supervisor asked if anyone wished to speak either in favor of or against this law. There being no further comment, on motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby adjourn the public hearing to the December 4, 2002 Town Board meeting. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye PUBLIC HEARING - ESTABLISH ALTERNATE MEMBER TO THE ZONING BOARD OF APPEALS AND PLANNING BOARD The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday , October 16, 2002 at 8:15 PM or as soon thereafter as is possible in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the adoption of a proposed Local Law entitled "Creation of the Position of Alternate Member for the Board of Appeals and the Planning Board Law". On motion of Councilwoman Seligson, seconded by Councilman Odierna, the hearing was declared open. The Attorney explained the purpose of the law was to provide an alternate member to both 3 October 16, 2002 the Zoning and Planning Boards for those times when something comes before the boards and one of the members must step down because of a potential conflict. He said it would also be necessary to add the person appointed to this position to the Ethics Code list of sensitive positions. Following a brief discussion, on motion of Councilwoman Wittner, seconded by Councilwoman Myers, the hearing was declared closed. On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board finds that the adoption of the proposed local law will constitute a Type II action under the New York State Environmental Quality Review Act (SEQRA); and BE IT FURTHER RESOLVED, that the Town Board hereby declares itself to be lead agency with respect to the proposed action. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye On motion of Councilman Odierna, seconded by Councilwoman Myers, the following local law was adopted: LOCAL LAW NO. 9 -2002 This local law shall be known as the "Creation of the Position of Alternate Member for the Board of Appeals and the Planning Board" Local Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 - Purpose Paragraph 11 of section 267 of the Town Law and paragraph 15 of section 271 of the Town Law allow the Town Board to establish the position of alternate member or members of the Town's Board of Appeals and Planning Board. This local law creates those positions. Section 2 -Amendment to the Code of the Town of Mamaroneck (a) Section 240-89 A. of the Code of the Town of Mamaroneck hereby is amended by deleting paragraph (1) thereof and substituting a new paragraph (1) which reads as follows: (1) The Board of Appeals, as previously established by the Town Board, shall continue to exist. The Board of Appeals shall consist of five (5) members and two alternate members who shall substitute for any member of the Board of Appeals who is unable to participate in a matter before the Board of Appeals due to a conflict of interest. If the number of alternate members exceeds the number of members having a conflict of interest with respect to a particular matter, the Chairperson of the Board of Appeals shall select the alternate member(s) who will substitute for the member(s) with the conflict of interest. If the Chairperson is the member with the conflict of interest, the longest tenured member of the Board of Appeals shall make this selection." 4 October 16, 2002 (b) Chapter 240 of the Code of the Town of Mamaroneck hereby is amended by adding a new ARTICLE XV thereto which reads as follows: ARTICLE XV Planning Board § 240-95. Creation and Powers of the Planning Board. A. The Planning Board, as previously established by the Town Board, shall continue to exist. The Planning Board shall consist of seven (7) members and two alternate members who shall substitute for any member of the Planning Board who is unable to participate in a matter before the Planning Board due to a conflict of interest. If the number of alternate members exceeds the number of members having a conflict of interest with respect to a particular matter, the Chairperson of the Planning Board shall select the alternate member(s) who will substitute for the member(s) with the conflict of interest. If the Chairperson is the member with the conflict of interest, the longest tenured member of the Planning Board shall make this selection. B. The Planning Board shall continue to have all of the powers heretofore granted to it by the Town Board whether or not contained in the Code." (c) Section 17-4 of the Code of the Town of Mamaroneck hereby is amended by deleting the definition of SENSITIVE POSITION contained therein and substituting a new definition of SENSITIVE POSITION which reads as follows: SENSITIVE POSITION -- The following positions entail potential conflicts of interest and are deemed to be sensitive positions: Supervisor, Deputy Supervisor, member of the Town Board, Town Clerk, Deputy Town Clerk, Town Justice, Town Administrator, Assistant to the Town Administrator, Counsel to the Town, Town Prosecutor, Superintendent of Highways, Superintendent of Recreation, Director of Building Code Enforcement and Land Use Administration, Building Inspector, Assistant Building Inspector, Fire Chief, Deputy Fire Chief(s), Fire Inspector, Police Chief, Comptroller, Deputy Comptroller, Director of Public Housing, Public Housing Administrator, Town Engineer or Consulting Engineer, Senior Engineering Aide, Assessor, member of the Board of Assessment Review, Real Property Appraiser, General Foreman, member of the Planning Board, member of the Board of Appeals, alternate member of the Planning Board and alternate member of the Board of Appeals. In the event that a new position is created at a later date which the Town Administrator deems to be sensitive, then such position shall be added to this list upon the adoption of a resolution by the Town Board." Section 3 - Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 - Effective Date: This Local Law shall become effective upon filing with the Secretary of State. The above resolution was put to a roll call vote: 5 October 16, 2002 Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye ADDITION OF DIRECTOR OF BUILDING CODE ENFORCEMENT AND LAND USE ADMINISTRATOR TO TOWN CODE The following notice was placed into the record: PLEASE TAKE NOTICE, that a Public Hearing will be held by the Town Board of the Town of Mamaroneck on Wednesday, October 16, 2002, at 8:15 PM or as soon thereafter as is possible, in the Court Room of the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider a Local Law to add the position of Director of Building Code Enforcement and Land Use Administration to the Town's Code. On motion of Councilman Odierna, seconded by Councilman Seligson, the hearing was declared open. Mr. Maker explained that Ron Carpaneto's title was not added to the Town Code when the position was first created. The current head of the Building Department is titled the Director of Building Code Enforcement and Land Use Administration, not Building Inspector. The Town's Code has numerous references to the position of Building Inspector; but there is no references to the position of Director of Buildings. Since there is a possibility at some future time there may be both a Building Inspector and a Director, it is important one position yield to the other, so this law would give the power to the Building Inspector. The proposed law adds the phrase "or the Director of Building Code Enforcement and Land Use Administration if the office of Building Inspector is vacant" after the words: "Building Inspector" in the appropriate places in the Code. Mr. Maker thanked Carol Braiotta for her invaluable assistance in searching the Code. He added because certain sections are amendments to the Town's Zoning Code, a referral to the Planning Board is required before the Town Board can vote on this legislation. Supervisor O'Keeffe questioned the need to have both positions, if another person was hired under the Building Inspector title it would be taking Mr. Carpaneto's authority away. Mr. Altieri said it was highly unlikely the Building Director would be subordinate to the Building Inspector and the section needs to be reworded. Councilwoman Seligson said all that would be necessary was to take that phrase out of the law. On motion of Councilman Odierna, seconded by Councilwoman Myers, the hearing was declared adjourned to the November 7, 2002. On motion of Councilman Odierna, seconded by Councilwoman Myers, it was unanimously RESOLVED, that the Town Board does hereby adjourn the Public Hearing on "Addition of Director of Building Code Enforcement and Land Use Administrator to the Town Code" to the Town Board meeting of November 7 to allow for review and comment of the proposed law by the Planning Board. There will be free hot dogs and soda. The Supervisor noted that there would be an open house ("Big Truck Day") on October 19 from 10 AM to noon at the Larchmont Public Library. This is a program made possible by the Town of Mamaroneck and the Village of Larchmont. "Truck Day" will take place in the parking lot behind St. Agustine's Church next to the Library. She also made mention of the Inspection Dinner held on October 11. It was a very nice dinner and it was very encouraging to see all the new Explorers who attended. The Explorers will be hosting an all you can eat dinner on November 1 at 7 PM at the Weaver Street Fire House. There is a $10 per person fee. 7 October 16, 2002 There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Myers, the Commission unanimously adjourned at 9:15 PM. AFFAIRS OF THE TOWN 1. Submission of 2003 Tentative Town Budget Mr. Altieri explained this budget was for the fiscal year commencing January 1, 2003. The tentative budget was prepared by the budget officer and staff, who submitted their proposed budget sheets. Mr. Altieri gave a summary of the tentative budget, outlining a proposed increase to tax rates in the two villages averaging $30 per year, and an increase of approximately $221 in the unincorporated area of the Town. He said it would be necessary for the Town Board to set a public hearing and the budget must be adopted no later than December 20, 2002. He said during the next few weeks there would be many changes made by the Board, and anyone wanting copies of the tentative budget can obtain them from the Town Clerk's office. The Supervisor asked the Administrator to outline what is happening in the County and State which is affecting this budget. Mr. Altieri said there would be a substantial increase to the pension fund, liability insurance and in health insurance premiums. The actual quotes for these have not been received but we are anticipating a cost increase of about 30% for liability insurance which amounts to about $140,000, health insurance is expected to increase by about $300,000, and the state pension premium by about $312,000. This budget maintains our existing infrastructure, the increase is approximately 6.2%. Councilwoman Myers reminded residents the Town tax is only 25% of the total tax bill. Half of all resident taxes go to the school and the rest is collected for the county. 2. Authorization - Billing Services Agreement -Ambulance District Mr. Altieri explained a recommendation has been made to authorize the Town to enter into an agreement with Multimed Billing Service . When the Ambulance District was created in 1994 the decision at that time was to levy charges for ambulance calls and to issue bills for service. It was decided to hire a private billing service, Holdsworth Associates, because of the complexities involved in the billing. At that time Holdsworth Associates was retained for this purpose, but they have now decided to cancel their contracts with clients based in New York. Holdsworth currently has five clients in New York State, because of differences in Medicaid and Medicare billing regulations between New York and Connecticut, it is no longer profitable for Holdsworth to keep their New York based clients. They have recommended to the Town another company, Multimed Billing Services located in Baldwinsville, New York. Multimed bills for several ambulance services in New York State. They provide billing service for the Chappaqua and Yorktown Ambulance services in Westchester County. The terms for this are comparable to the one with Holdsworth. Multimed has also agreed to continue the same service fees as charged by Holdsworth. Billing fees will be 10.5% of monies collected on all non Medicaid Claims. Where Medicaid is the primary payer, the fee is $12.50 per bill and $6.50 per bill when Medicaid is the secondary payer. Generally, our billing service fees are between $35,000 and $40,000 per year depending upon actual revenue. The term of the agreement is three years but does provide for cancellation if the parties do not wish to continue with the agreement. He then recommended approval of the agreement with Multimed and authorization to execute the agreement. Councilwoman Wittner asked if the Town would receive reports from Multimed, how are fees set for the districts or how it is handled if the fees change. Mr. Altieri replied the Town Board is the final authority for any change in the fees and yes we do get summary reports. He added that the Ambulance District Board, which has 8 October 16, 2002 representatives from the Town and the two Villages, reviews all billing and any complaints or policies. It was decided to make a change on page five (5) paragraph I -to include `mediation' rather than just termination or cancellation. On motion of Councilman Odierna, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby approve the agreement between the Town and Multimed Billing Service as amended; and BE IT FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Set Public Hearing - Establish No Parking Zone -40 North Chatsworth Avenue The Administrator said the Traffic Commission has recommended a change to parking on a stretch of North Chatsworth Avenue which has a high volume of traffic and also is on the slope of a hill. Since there is such a change in grade, the speed of traffic along this stretch of North Chatsworth Avenue heading toward the Village of Larchmont tends to increase, making it more difficult for that traffic to slow down as vehicles leaving 40 North Chatsworth Avenue enter into the lanes of traffic on North Chatsworth Avenue. A solution to this problem is to create a no parking zone along each side of the driveway serving 40 North Chatsworth Avenue. This wider expanse will create better visibility for drivers of vehicles leaving 40 North Chatsworth Avenue, thereby reducing the risk of collisions. Councilwoman Seligson asked if it was possible to restrict the size of cars that could park in this area. Mr. Maker said he would check on this. On motion of Councilwoman Myers, seconded by Councilwoman Wittner, it was RESOLVED, that the Town Board does hereby set the date for public hearing to Establish a No Parking Zone at 40 North Chatsworth Avenue for November 7, 2002 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. Amendment - Town Administrative Manual - Driver Safety Policy Mr. Altieri explained that Mary Stanton has drafted an amendment to the Town Administrative Manual regarding driver safety policy. In August 1999 the New York State Department of Motor Vehicles offered a License Event Notification Service (LENS) to employers which was set up to promptly notify organizations of changes in an employees driver license status. This service, which is free to municipalities, operates in full compliance with the federal Driver Privacy Protection Act. The reportable activities include: accidents, convictions, license suspension and revocations, license expirations, license restorations and Point Insurance Reduction Program course compliance. Information is updated every two weeks by the DMV. The Town's Safety Committee has recommended this program and the Police, Fire and Highway Departments and the Ambulance District are currently submitting rosters of their employees for inclusion in the database. Councilwoman Seligson asked if this would help to reduce the Town's insurance premiums. Mr. Altieri said he would try to see if it would. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby authorize the amendment to the Town Administrative Manual regarding driver safety policy, effective November 1, 2002. Driver Safety Policy is as follows: Policy: It is the policy of the Town of Mamaroneck to take all reasonable measures to ensure the safe operation of its motor vehicles. All staff authorized to use Town vehicles will be registered with the Department of Motor Vehicles' License Event Notification Service (LENS). The service operates in full compliance with the federal Driver Privacy Protection Act. Procedures: Section 5.2 (pages 14-15) of the Town of Mamaroneck Administrative Manual treats the subject of"Use of Town Vehicles." This procedure reads (in part), "The Town maintains vehicles for use by authorized Town employees while on Town business. The Town Administrator shall maintain a list of all employees authorized to operate Town vehicles. All authorized employees shall maintain a valid New York State drivers license. An employee shall immediately notify the Town Administrator of any revocation, suspension or any change in license status that would prohibit the employee from operating a motor vehicle. Effective November 1, 2002, employees who are authorized to drive Town vehicles will automatically be registered with the LENS reporting service. The Department of Motor Vehicles defines reportable incidents as accidents, convictions, driver license suspension and revocations, license expirations, license restorations and Point Insurance Reduction Program Course compliance. Keeping DMV information secure is the responsibility of the Town Administrator's Office. All data will be kept on disks and locked in a secure file cabinet. Employees who commit two moving violations in any twelve- month period will be required to meet with their supervisor, the Town Administrator and the Assistant to the Town 10 October 16, 2002 Administrator to discuss corrective action, which may include enrolling in a driver education refresher course. Employees who commit three moving violations in any twelve-month period will be placed on probationary driver status for the following six months and may lose the privilege of driving Town vehicles. Resolution -Amend Meeting Date for November 6, 2002 Town Board Meeting On motion of Councilwoman Wittner, seconded by Councilwoman Myers, it was RESOLVED, that the regular meeting of the Town Board which was scheduled for Wednesday, November 6, 2002 will be held on Thursday, November 7, 2002 in the Court Room of the Town Center, 740 West Boston Post Road, Mamaroneck at 8:15 PM. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 6. Resolution - Refinancing Housing Authority Bond This item was deferred. 7. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye PROCLAMATION S - School Board Recognition Week - Clean Water Act The Supervisor asked Councilwoman Myers to read the following proclamation into the record: SCHOOL BOARD RECOGNITION WEEK WHEREAS, the members of New York's local School Boards are community leaders who prove an invaluable resource as local decision makers; they respond to the respective educational needs of their communities, serving the interests of schoolchildren and help prepare them for the future; and 12 October 16, 2002 WHEREAS, during the week of October 28 November 1, 2002, it is fitting to join in recognition of the commitment and contributions of members of local School Boards. NOW THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of Mamaroneck and the Town Board members hereby proclaim the week of October 28 through November 1, 2002 to be SCHOOL BOARD RECOGNITION WEEK. IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 16th day of October 2002. Councilwoman Seligson read the following proclamation into the record: CLEAN WATER ACT WHEREAS, October 2002 marks the 30th Anniversary of the Clean Water Act. Three decades ago, our government promised us clean and safe rivers, lakes, and coastal waters for our children and our communities. Despite some important successes, we are far from achieving the Clean Water Act's goals of clean and safe water for everyone; and WHEREAS, it is time to keep the promise of the Clean Water Act. As part of the Clean Water Network's 30th Anniversary campaign, citizens around the country are educating the public, the press, and elected officials about the need to defend and strengthen our clean water protections; and WHEREAS, maintaining and improving water quality is essential to protect public health, fisheries, wildlife, and watersheds, and to ensure abundant opportunities for public recreation and economic development in the Town of Mamaroneck, and WHEREAS, it is the responsibility of the government and of all American citizens to provide and protect clean water for future generations. NOW THEREFORE, BE IT RESOLVED, that I, Valerie Moore O'Keeffe, Supervisor of the Town of Mamaroneck and the Town Board members do hereby recognize the accomplishments and value of the Clean Water Act in helping to make the Town, of Mamaroneck a healthy, thriving and vibrant community. BE IT FURTHER RESOLVED, that October 18, 2002 be and is hereby proclaimed to be 'CLEAN WATER ACT DAY'in the Town of Mamaroneck. Councilwoman Seligson said she is proud the Town is joining with other communities on this. Before the Clean Water Act we had large water pollution problems, many of which have been corrected. 13 October 16, 2002 The Supervisor stated she and the Town Board earlier attended a dinner at Sara Neuman Nursing Home honoring Kathy Kopa, Liz Covington and others. Unfortunately, the Board had to leave early to attend this meeting. ORAL COMMUNICATIONS The Supervisor introduced George Roniger, of the Larchmont Garden Civic Association. Mr. Roniger spoke regarding signs at the brook. He asked if there was a law to prevent dumping leaves into the brook. The Supervisor said there was. Mr. Roniger asked who enforces it. The Supervisor stated that it was enforced by the Police Department and Building Department. There has been a noticeable increase in summonses issued. Mr. Roniger then asked about the "McMansion Law". Mr. Maker answered that the Board is still considering this law. The matter was referred back to the Planning Board last week due to the number of changes that had been made. The only hotly contested issue is whether attics should be included in the floor area ratio. Mr. Roniger than asked about the rock chipping law. The Supervisor said there was nothing in the Town Code that restricts the length of time that chipping and blasting is allowed. Mr. Roniger asked the Supervisor about revaluation. The Supervisor said The Westchester Municipal Officials Association can't seem to get a large enough percentage to go forward with revaluation and it would be too expensive for the Town to go it alone. She then read a portion of a letter from Andy Spano regarding the County Budget. She said she had attended a local summit where County Legislator George Latimer was asked a lot of questions regarding the budget. There is a $122 million gap to be filled, either through a 1% sales tax increase, which would raise $110 million, or a property tax increase of 28%. REPORTS OF COUNCIL Councilman Odierna stated that there will be a "Skate with Characters" at the ice rink on October 27. Councilwoman Wittner said Diane Courtney our Larchmont Library Director, was elected president of the New York Library Association. Resident Ellen Lobel kindly gave us a definition of specimen tree when the question came up at our last meeting. She referred to a definition in the Tree Preservation Law which was very limited. Councilwoman Wittner then read a broader definition from the internet. Councilwoman Seligson attended a Planning Board meeting with Mr. Maker and Mr. Altieri. She thanked Mr. Maker for his presentation of the proposed FAR Law and she was looking forward to the Planning Board's decision. On October 11 Sether Woods was dedicated as a conservation area. This was given to the Town by Nancy Masterson and her sister Joanne Bow, daughters of Hallie Sether. Mr. Odierna made mention of his Mediterranean cruise last week. In Geneva they decorate their pedestrian underpasses. It would be great for our Town to decorate the railroad underpasses. 14 October 16, 2002 Councilwoman Myers said the Youth Council, Board of Architectural Review and Traffic Committee had upcoming meetings. Councilwoman Wittner reminded the audience to obtain absentee ballot applications for the election in November if they would not be available to vote. Mr. Odierna said the Recreation Department was offering a 10% rebate next year for pool permits. In order to obtain this discount you must get your request in by November 29. ADJOURNMENT The Supervisor said the next scheduled meetings would be Thursday, November 7 and November 20, 2002.
