BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Valerie M. O'Keeffe Councilwoman Phyllis Wittner Councilwoman Judith A. Myers Councilman Ernest C. Samela, Deputy Town Clerk CALL TO ORDER The regular meeting of the Town Board was called to order by Supervisor O'Keeffe at 8:30 PM, who then pointed out the location of exits. PUBLIC HEARING - Floor Area Ration Law -THIS ITEM WAS DEFERRED BOARD OF FIRE COMMISSIONERS The meeting was called to order by Commissioner O'Keeffe at 8:35 PM on motion of Councilwoman Wittner, seconded by Councilwoman Seligson. Present were the following members of the Commission: Commissioner: Valerie M. O'Keeffe Commissioner: Phyllis Wittner Commissioner: Judith A. Myers Commissioner: Ernest C. Odierna Commissioner: Nancy Seligson 1. Tri-City 52.89 Verizon 515.30 Verizon Wireless 14.08 Westchester Joint Water Works 103.58 TOTAL $18,797.37 The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Commissioner Wittner noted that there would be an open house ("Big Truck Day") on October 19 from 10 AM to noon at the Larchmont Public Library. This is a program made possible by the Town of Mamaroneck and the Village of Larchmont. "Truck Day" will take place in the parking lot behind St. Agustine's Church next to the Library. Commissioner Odierna stated that there was going to be a fall festival at the reservoir on October 12. There being no further business to come before the Commission, on motion of Commissioner Wittner, seconded by Commissioner Odierna, the Commission unanimously adjourned. AFFAIRS OF THE TOWN 1. Review of New York State Audit Mr. Altieri explained this was the official filing of the New York State Audit by the Town Clerk. The Town Board reviewed the audit of the Town by the State Comptroller at the September 18, 2002 worksession. The final draft of the report is identical to the draft. There are new requirements in the State Law which require the audit be publicly filed with the Town Board. Supervisor O'Keeffe noted the Town was fiscally sound having received a Triple A rating. 2. Set Public Hearings - Establish No Parking Zone - Madison and Fifth Avenues - Set Special Meetings Coastal Zone Management Commission - Creation -Alternate Members to Planning & Zoning Boards Establish No Parking Zone - Madison and Fifth Avenues Mr. Altieri explained that the Board at its meeting held on September 17, 2002, had considered a request by the Carlton House Condominium Association to establish a no parking zone at the rear exit of their property which is located on Madison Ave. There is a short section of roadway between the end of the Carlton House Driveway and the intersection of Madison Ave. and Fifth Ave. This is the area where cars often park which causes narrowing the road and obstructs the view when exiting from the Carlton House. The 2 October 2, 2002 recommendation is to create a no parking zone between the existing "Do Not Enter" sign and the end of the Carlton House Driveway. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby set the date for a public hearing to Establish a No Parking Zone at Madison Avenue and Fifth Avenue for October 16, 2001 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Set Special Meetings - Coastal Zone Management Commission The Attorney said a question had arisen as to whether the Chair of the Coastal Zone Management Commission has the power to call a special meeting, and he was asked to research the matter. He learned it would be necessary to change a provision in the law to grant the power to the chair. It was therefore his recommendation to set a public hearing where the law could be discussed and amended. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was RESOLVED, that the Town Board does hereby set the date for public hearing to "Set Special Meetings" for Coastal Zone Management Commission for October 16, 2001 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye Creation of Alternate Members to Planning and Zoning Boards The Supervisor explained this matter was to allow for the appointment of alternate members to sit on the respective board when certain matters pertaining to existing members are in conflict. On motion of Councilwoman Wittner, seconded by Councilwoman Seligson, it was 3 October 2, 2002 RESOLVED, that the Town Board does hereby set the date for public hearing for the Creation of Alternate Members to the Planning and Zoning Boards for October 16, 2001 at 8:15 PM in the Court Room of the Town Center; and BE IT FURTHER, RESOLVED, that the Town Clerk be authorized to publish the notice of said hearing in a newspaper appointed as an official source, and that notice be so posted. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye 3. Sale of Surplus Equipment Mr. Altieri explained previously the Town Board had authorized the sale of surplus equipment. Sealed bids were subsequently requested via public notice and from interested buyers. The bids received did not meet the minimum prices set and are therefore not eligible for completion. He said there would be a joint auction of equipment held by the City of Rye and Village of Scarsdale on October 5, 2002; we have been invited to participate. The auction is to be conducted by an outside contractor who charges the buyer 10% of the premium, with absolutely no cost to the Town. To insure the sale of the equipment, the auctioneer has asked we reconsider the original minimum bid prices set back in June. Salary Authorization - Recreation On motion of Councilman Odierna, seconded by Councilwoman Myers, it was RESOLVED, that as provided for in the 2002 Town Budget that the Town Board does hereby authorize the payment of salary to the following: Emily Danforth, Head Coach, Mamaroneck Swim Club, $6,100, eff. 10/20/02 to 3/16/03. Elizabeth Linsalato, Lifeguard, Hommocks Pool, $6.75 per hour, Eff. 9/28/02. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye APPROVAL OF MINUTES -June 20, 2002 - This item was withdrawn by the Town Clerk. PROCLAMATION - UNITED NATIONS WEEK The Supervisor read the following proclamation into the record. UNITED NATIONS WEEK WHEREAS, the United Nations was founded in 1945, and the anniversary of its founding is observed each year on October 24; and WHEREAS, the United Nations was shocked and saddened by the tragic events of September 11, 2001; and WHEREAS, the United Nations Secretary-General, the United Nations General Assembly, and the United Nations Security Council immediately responded in solidarity with the United States of America by issuing statements of support and resolutions condemning the acts; and WHEREAS, the United Nations is a key partner in the global response to terrorism; and NOW THEREFORE, BE IT RESOLVED, that 1, Valerie Moore O'Keeffe, Supervisor of the Town of Mamaroneck and the Town Board members hereby proclaim the week of October 17 through October 24, 2002 as UNITED NATIONS WEEK. IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of Mamaroneck to be affixed this 2nd day of October 2002. The Supervisor then introduced Lee Bloom to explain the purpose of United Nations Week. Mr. Bloom stated he has been a part of this organization for 30 years. He said this year was more important than just a regular event. It is imperative this year to remind everyone how very important the United Nations is. It is not only involved in war and peace. Last year after September 11th all parts of the UN took strong actions in support of our country's positions. The UN plays an important role in world health, telecommunications, air traffic etc. He then invited the Board to attend the Westchester Chapter Week Observance in the Town 5 October 2, 2002 Courtroom on October 20 at 2:00 PM. There will be a speaker from the UN talking about bio terrorism, followed by a reception at the Senior Center, admission is free. Mr. Bloom also invited all to come to the Larchmont Reservoir Fall Festival on October 6 from 1 to 4 PM to have a good time. The Supervisor and the members of the Board thanked Mr. Bloom. ADDED ITEM 5. Approval of Certiorari Mr. Maker explained the details of the settlement and recommended approval. On motion of Councilwoman Wittner, seconded by Councilman Odierna, it was RESOLVED, that the Town Board does hereby authorize the settlement of the following certiorari as recommended by the Town Attorney, William Maker, Jr.: Nichols Yacht Yard, Inc. Block: 929, Lots: 1 and 41 Block: 922, Lot: 235 Town of Mama roneck/ViIlage of Mamaroneck Block 929, Lot 1 Assessment Reduced To Reduced Assessment 2001 $218,150 $113,025 $105,125 Block 929, Lot 41 Assessment Reduced To Reduced Assessment 2001 $14,500 $3,250 $11,250 Block 922, Lot 235 Assessment Reduced To Reduced Assessment 2001 $27,950 $11,800 $16,150 The Town will refund approximately $2,000.00. The School district will refund (or not collect) approximately $57,900.00. The above resolution was put to a roll call vote: Seligson - Aye Odierna - Aye Myers - Aye Wittner - Aye O'Keeffe - Aye REPORTS OF COUNCIL Councilman Odierna attended a Human Rights Commission meeting last Monday. They are getting ready to make plans for the Martin Luther King, Jr. celebration in January. There may be an opening on the Commission as Cora Rust may be stepping down. Councilwoman Wittner spoke about the United Way kickoff on September 22. Coastal Zone Management Commission met on September 24. She thanked Madeline Berg for chairing the Commission for the past three years. The new chair is Marc Godick from the Village of Larchmont. She attended the Emelin Theater Immigrant Day Celebration, which was great and a fund raiser for the Hispanic Resource Center. There was a celebration at the Village of Mamaroneck Senior Center honoring Lenny Verrastro for his service to the community. On September 28 the Sheldrake Environmental Center had its annual meeting. Alison Lowy remains president. Councilwoman Wittner commended Jill Fisher for the new signs. The Supervisor stated she attended the same events with Councilwoman Wittner. 6 October 2, 2002 Councilman Odierna noted last Saturday was National Beach Clean-Up Day. Councilwoman Myers also spoke about the United Way. She said that the program at the Emelin Theater was a phenomenal event. They reached their goal of$50,000. The Larchmont Mamaroneck Youth Council starts up on October 3. They are looking for new members. Members must be sophomores,juniors or seniors. Applications are available in the Recreation Department. She also mentioned that Toni Ann Guagliano, who works in the Recreation Department,just had a baby girl. Councilwoman Seligson dittoed the above. She said that the Immigrant Day Celebration was wonderful. She spoke about speaking at a conference on Friday "Putting the park back in the Hutchinson River Parkway". She will be speaking about the trails program here in the Town. The conference will be held at Manhattanville College at noon in the Castle. Mr. Altieri reminded everyone leaf collection will begin on October 15. Leaves need to be piled on the curb, not in the street. Do not pile leaves on the brook side of Brookside Drive. The leaves will not be picked up if there are branches mixed in with them and there will be summonses issued. Leaf blowers can be used from October 1 through May 31. No more brown bags will be picked up with leaves or garden debris after October 15. ADJOURNMENT The Supervisor said that the next scheduled meeting would be held October 16, 2002.
